K-3 Spouse Visa Process & Proceduresmarriage and tourist visa
ok people, it has been three years now since Jane and I were married in Taiwan, we are all set, she has immigrated and we had her Conditional status lifted. But I'm trying to help out someone else, and for the life of me trying to remember an important point. Correct me if I'm wrong, but I thought that once you got married in a foreign country, the foreign spouse cannot travel back to the US, with the US spouse on a tourist visa. But, maybe it's only if once you apply for the immigrant visa you cannot travel on the tourist visa. In other words, the person in question is a USC, and she wants to marry her fiancee in Guyana and bring him back with her to the USA, I'm assuming on a tourist visa.

thanks, that's what I thought when I read it on USCIS website, but was not sure.

Think about it another way... When you arrive at a POE there is a line for visitors and a line for US Citizens and permanent residents... No where do they make a distinction between conditional and not conditional residents... permanent residencey is just that....

that is true, but in researching the USCIS website, things are not always clear.

thanks Caro, but I had already read that section in USCIS, and nowhere in there does it mention "Conditional" Status, so it is confusing.

thanks simple male, hope you and others are right, it would mean my wife is eligible this September, even though she received her 10 year green card yesterday.

US Citizenship General DiscussionGeneral Info on Naturalization
what I mean is, it is said that a foriegn spouse of a USC is eligible to apply for Naturalization after three years of continuous Permanent Residency, but nowhere can I find out, if this includes the two years of Conditional.

my wife just received her 10 year green card yesterday, so I'm wondering, are we eligible to apply for USC on her three year immigration anniversary this Sept., or do we have to wait until three years from yesterday?

Here is the USCIS Guide and FAQ on becoming a Citizen of the US.

as far as a Conditional Permanent Resident spouse of a USC, when does the timeline start? It's very confusing, can't find the answer anywhere, on here or on USCIS.

Removing Conditions on Residency General DiscussionClarification on filing I-751 90 days before entry
Hi,

we have a letter from my wife's Immigrant Visa package she received from AIT in Taipei, the top half is in English, the bottom half in Chinese. The English part clearly states what has been said already here on this forum. Not sure what the Chinese part says, I'll have to ask my wife.

By the way, my wife's POE was Detroit also!

I'm wondering what mine is. It's a blue form, I-797E Notice of Action, and in the little box near the top on the right, it says "request for evidence". It was accompanied by a two page document on white paper, that was titled, "request for evidence".

So, I guess I got an RFE, correct? crying.gif

the point is, we made it with a relatively limited amount of evidence. I've heard a lot of people send in a lot more, and still have to go in to an interview. I thought for sure we would, but we made it.

Congratulations! What was the RFE about? Were you interviewed by USCIS before they issued the permanent green card or the interview was not needed?

I don't know, the RFE was not specific, it gave a general list of things "but not limited to", just like when you first send in the form for lifting conditions. So I wasn't sure what to send in. I researched it here on Visa Journey, and it looked like everyone who got an RFE, theirs was very specific in what it asked for.

Nevertheless, we were approved without interview.

I'm trying to find the copy of the cover letter I mailed to USCIS along with the RFE to show you all a list of what evidence we submitted, both originally and with the RFE, as I think we didn't submit nearly as much as most people do.

Thanks a lot. It will be very helpful info, if you can find out what you sent out initially before RFE and what you sent out after RFE. We will start our process in July, but it is good to know in advance.

ok here is the cover letter I sent with our application for lifting of conditonal status, you can see that we supplied a relatively smaller amount of evidence than most people have. With the original app, it was mainly just financial stuff. We didn't send any affidavits, only on photo:

Dear USCIS examiner(s):

In response to the Request For Evidence Form I-797E we recently received:

I (Donald E. Wright, United States Citizen) and my wife (Mei Chuan Ho, Conditional Permanent Resident) would like to submit additional information in support of our initial application.

We trust that you have received our initial application package, which included:

· Form I-751 (with an attached check for the amount of $275 USD)
· Copies of identification cards (Permanent Resident Card, joint health insurance cards)
· joint bank account (my life savings in both of our names)
· a joint credit card statement from xx bank
· our joint 2006 US tax return statement (including copies of W-2 forms)
· a statement from my wife’s direct deposit account from her work, showing our shared address
· a pay stub envelope from my wife’s workplace showing our shared address

In this package, we are including:
· Form I-797E (as received from USCIS)
· Copies of holiday and wedding greeting cards from friends and relatives
· recent employer statement addressed to Mei Chuan Ho (regarding joint health insurance with spouse)
· recent statement from dentist regarding Mei Chuan Ho at current address
· copy of passport pages regarding our trips to see each other
· photo of the shipping carton we made for our wedding photo

.

In addition, we would like to provide the following personal references, who are familiar with our relationship and marriage:

Gerald and Cassie Wright, (address and phone number) (parents)

Edward Bishop, (address and phone number) (neighbor and friend)

Brenda McDermott, (address and phone number) (friend)

we hope this is sufficient supporting evidence, however if you need any additional information, please do not hesitate to contact the above mentioned personal references, and/or us.

(our address and phone number)

Sincerely yours,

Donald E. Wright

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 interview last week in Taiwan and POE via Detroit

My wife and I went to her interview last week in Taiwan. They have a 3-step process there. The 1st window checks you in and and looks at your interview letter to make sure you are supposed to interview that day, the second window checked her CR-1 application papers and approved them and asked us to wait for the State Dept agent to interview her. He looked over her papers, swore her in and only asked one question..."Do you plan to immigrate to the US", she said yes and he stamped the papers and we were finished. I don't know if the reason for this short process was that she had already received her K-3 and has been living in the US since last September.

In Taiwan they take your passport and send it to you via courier. We got it in 3 days, they had stamped TERMINATED without PREJUDICE on her B-2 and K-3 visas and added the CR-1 visa stamp.

The POE in Detroit only took a few minutes. There are 2 windows for Special Processing, numbers 37 and 38 which have the fingerprinting device. The USCIS agent asked us our wedding date, took her fingerprints and stemped her passport.

Basically it sounds like the same thing my wife went through at AIT in Taipei. Three steps, first step is as you say, check in show your passport and interview letter, and DS part 1 and 2. second step (after waiting two hours) check out the CR-1 application papers but asked a lot of questions. third step, interview and only a few questions.

My wife may have had a few more questions, but as you say since you already had a K3 it may have been more streamlined for your wife.

By the way, as far as the "big brown envelope" yes they told her it would arrive in two to three days by courier, but to her surprise, later that day after she got home from AIT, they called and asked her if she would like to receive it that night!

Not sure where you were at, you said Taiwan but you didn't specify your location, or to whether you were dealing with Taipei or Kaoushing AIT, but congrats!
