When I was reading JULIUS CEASAR's post I was at work and can't wait to get home to answer his stupid and unmanly story!. I was shaking and ready to attack him!!!!. The way he wrote his post I can tell his uneducated person but I can't ignore his hurtful words against US.(FILIPINA)


Anyway, my husband and I disccused everything when it comes to financial matter. (especially sending money to PI) Both of us is working hard for the family to be happy. :thumbs:

We'll prolly end up with the stamp too since her passport doesn't expire until 2009, but I still think it's important to make the effort. That's who my wife is now, mrs. mich ;) Other than sentimental reasons for this, we also thought it might be prudent for two reasons: first, all our paperwork is filed in her married name and second, to absolve any doubts the CO might have in the interview. PS - jazzy - my wife had to go to the CFO for her passport name change and they told her that she'll not have to go through it again later for her visa. iirc, they just told her she'll go back and get a sticker. A nice way to get one thing out of the way early :)

Yes your right...nice to get the cfo out of the way, we actually had applied for the K-1 last year and already went through cfo...and so have the certificate and dont need to go again except for stamp. We are getting the name change stamp at place where she got the passport. Take care

I'm a us citizen and i applied I-130 for my spouse in India. It has been approved by CIS and forwarded to NVC.

My question is, does my spouse have to change her name in the Indian Passport to reflect her married name? If it has to be changed, would it make any difference if it is done today or right before the interview at the chennai consulate?

You don't have to change the name. In fact some countries won't let you get a new passport with the name change until its time for renewal. We inquired about it (Philippines) because we wanted the passport to reflect the name change, however we were told that we couldn't have that done, but that they would put in a special "stamp" to show the married name.

I am from the philippines also and i expereinced my k-1 interview last december and it seems that i felt so nervous while my interview is fast approaching but my god, when i was inside manila embassy office already the consul, staff and security guards are very kind to me and to my pretty little girl. don't you worry, as long as your papers are complete nothing to be worried about. just relax and tell your wife to be more confident coz no one was denied in spousal visa as long as documents and relationship is genuine.

M I-130 application has been sitting, untouched, at the Vermont Service Center for over 130 days. Today I got an e-mail from them saying that my application was being transferred to California! Why? And if they were going to do that, why didn't they do that sooner, and not wait over four months to do it?! Now will I be in line behind everyone whose applications reached California before mine does, or will the received date on my original application place me ahead of those who filed their applications in the last four months? What a nightmare!

We just got the same email today on our I-130 cases (wife and stepdaughter)...I was wondering the same thing....why transfer to california? I suppose you have to look at it as that they are doing something....find the silver lining as frustrating as it is. I still wonder though...the email says we will recieve a notice informing us that our case has been transferred to a local office....lol....can't get much more NON-local than california....i'm in New York...lol

I was hoping someone can shed some light on my situation. I just got married in Colombia and I want to bring over my wife's 2 children. I opted to use the i-130. I have called the uscis center and rec'vd mix responses. My question is will I have to file and i-130 for each of her daughters? They are both under the age of 18. I understand if I chose the i-129f I would be able to do so under one petition. Please help

Hi Chill...

If you go the route of the I-130 then yes you must file a separate petition for your wife and EACH of her daughters...3 petitions in all. After you receive the Noa#1 from the I-130 filed for your wife you may file the I-129f and her daughters can be included on that petition and be eligable for k-4 visas...this can be done without first filing a I-130 on the daughters; however at some point you will have to file I-130s on them in order to adjust their status here in the states. My wife has one daughter and I opted to file both I-130s now...it will just save time and aggravation down the line. Hope this helps...:)

I think, yes, you will need to submit G-325A for her daughters as well. But wait for other replies as well.

The answer is NO!! You do not file G325a's with any step childs petition. I just filed for my stepdaughter also, you must include the childs BC, mothers BC, marraige certificate, divorce/annulement decrees (if applicable).

You should get an email soon saying that CSC received your petition. Ours was transfer about a week before yours and i got emails a few days back saying they received the petitions. Hopefully just a few more days and you will receive an email..:)

I received 6 emails today....3 each for my wife and step daughters I-130's...had to laugh same email 3 times each. We still have not received an rfe for our I-129f though, i contacted my congressman and they are looking into the delay as well as having called the USCIS and put in an inquiry...we'll see what comes of that.

I do have a question in regards to the I-130. I understand that the I-130 for my step daughter is concidered a companion case although a separate petition. When the ds-3032 is generated how is that handled in regards to my step daughter?...Am i correct in thinking that my wife signs it for her (she is 5) naming me as the agent? Any thoughts?

I'm running about a week ahead of you with our processing. My asawa will be attending the G&C seminar sometime soon, not sure if Manila or Cebu yet. She is also overwhelmed with all of the tasks she needs to complete, so just yesterday I sent to her a list of milestone events for both the I-130 and the I-129F processes, and folders stuffed with information with checklists for the items she needs to get. She has so much to do there, has no passport yet, is waiting for the NBI check, needs more copies of the passport photo, more copies of her birth record and has been told that the NSO marriage certificate will finally be ready middle of this month. I've asked her to begin digging up her vaccination records and to get the Hep B vaccinations now. We were married Apr 24 in Tabango on Leyte. I am still have very much trouble getting NSO marriage certificates through the E-census website, but I used a certified copy of the local civil registrar office marriage certificate for the I-130 and also the I-129F I will mail to Chicago on Friday. Assembling these lists has helped me a great deal with the planning aspects from my own perspective. I have a 2-in thick binder filled with information here. I'm praying that I'll be able to go back to get her in early April next year. We'll see. Good luck.

My wife and i were married in cebu on april 26th...:)...we used the civil registry copy for our petitions with no problems....you should have the nso copy for the interview and for the ds-230 if you are going the route of the cr-1. The nso is months behind right now in processing marraige certificates....so be prepared for a little wait.

My wife took the seminar last year. Make sure you have copies of your marraige cert. and any divorce or annulment papers as well as at least 2 forms of id. The seminar isnt that bad, she should have an easy time with it...my wife took it in cebu and she said it was just easy.

We got approved on aug 3rd and still no case numbers yet...received the noa#2 stating the cases had been forwarded to NVC on aug. 3rd....to date (and i call everyday) they still haven't been recieved or rather entered into the nvc system. There are several people here in the same boat....just be a bit patient (hahahaha) call the automated system as often as you want to see if the petition has been received.

I had called NVC and found the ds-3032 had been generated. I used james short cuts for aos bill and wrote an email that my wife sent to nvc for the ds-3032. Her choice of agent was accepted with out a problem, however her daughters was not. Interestingly despite her daughter age being only 5 years old they would not accept an email from her mother appointing me choice of agent, stating that she was not the benificiary/petitioner in that case. In the email we stated she was the mother of the minor child, but they still would not accept it.
We sent out another email right away. This time my wifes name was not mentioned and sent as if just from my step-daughter.
This brings up an additional question. When it comes time to sign the ds-230, who signs it?..her daughter is only 5...the forms i had her sign ahead of time for me...i had her sign for her daughter and next to signature.."mother of minor child (daughters name)....i guess i'll have to call the nvc and ask about this...anyone else do the cr-2 with a young child?

This has just made me so much worried. I logged in to my account and saw that the I-130 was touched today!!!!!!!!!!!!!! the meassage still says "this case has been approved..............................".

I wanna know what this may be? has anyone else tried to login and saw a touch after so many days? The case was approved on July 31st, and is at NVC now where DS3032 has been issued as well.

So what is it???????? please tell me if any one else has had same experience. Especially those who were transfered from VSC to CSC for I-130.

If you are using the form to send in you must have an original signature....you can not fax or use an email version....however you can email them to as to your choice of agent preference.

Waiting certainly is the hardest part....our case was complete on Oct 17th and still not sent to the embassy. From what I understand they group petitions together and when they get a "batch" they send it out to the embassy...however...you should have been put in the "queue" for an interview date like we were...when your case is complete you are concidered documentarily qualified and placed in the embassies queue for an interview date, so try not to worry about it not being physically sent yet. Hope that helps a bit

Aside from previous divorce proof, there is nothing to prove that you are single aside from the "Fiance letter of intent".

Kitkat....Tax returns are also proof as well as an afidavit from the embassy. The "fiance letter of intent" doesnt prove anything as its not a legal paper.

Hello! I'm traveling to Tanzania in January to be with my fiance for a few months. We've been trying to figure out where it would be best to get married / what type of visa would be best for us. In the case that we decide to file for a IR-1/CR-1, we'd have to get married in Tanzania. How do I obtain proof that I am single and legally able to get married?

Also, was the IR-1/CR-1 process hellishly long for those who have gone through it? It's tempting because it's so much cheaper than the K-1 process, but I don't really want to be away from my fiance any longer than I have to.

1. In the first question, it states to fill in your name. Which format they want the name in? first name-last name or last-name, first name?

2. There are three checkboxes for question 8 which states "I am sponsoring the principal immigrant named in part 2 above" Should I check the box left to it and then also check YES?


3. Do I need to again put my wife's name on question 9?

Hi Janice,

If you are intending to bring the child you must submit a separate I-130 for the child (CR-2). If you choose to go the route of the k-3/k-4 then the child is listed on your petition and comes as a derivitive; however in that case you will still need to eventually submit an I-130 on the child so its probably best to do it now.

My I130 petition on behalf of my wife was approved on december 6. I was confused about the requirement of separate I130 for my wife's two daugthers. I had read on some postings that a separate I130 must be submitted for each dependent. However, on the USCIS website it states that dependents of beneficiaries obtain derivative status when their names are listed on the original I130 application. I called the help line at USCIS and they indicated that if the children were listed on the original I130 then separate I130's are not necessary for an immigrant visa to be issued. This was vonfirmed for US citizens only, it may be different for permanent residents. However, a separate I130 for each child will eventually be required when applying for change of status after the original two year probation.

This made sense to me when the USCIS representative stated it, she even went to talk to a supervisor to confirm the information. However, I am still a bit confused because I thought that with CR-1 visa you did not have to go through a change of status.

If you are applying for a K-3/k-4 visa then the child needs only be listed on I-130 to get derivitive status, but you will eventually need to file an I-130 on the child.
If you are going with the CR-1/CR-2 then you must file a I-130 for the child first. Spouse is the cr-1 and child is cr-2...in your case you must file 3 I-130's one for your wife...which you have done...and one each for her daughters. That is if you are trying to bring them here with your wife.
With the cr visa after the 2 years you are not changing status...you apply for "lifting of conditions" as the cr visa is a "conditional resident" visa.

Its hard to say exctly how fast things will happen...our cr-1 happened quick, and our k-3 is still waiting approval (see signature). If you are planning to bring your son with you then you should file another I-130 right away, this will have to be done at some point for him even if he comes over as derivitive on k-3 (k-4). Once complete the k-3 seems to be getting interview date much quicker than cr-1....but as you probably know cr-1 is more advantageous upon arrival, however you will have to wait for your sons I-130 to be processed for him to come as he doesnt come as a derivitive on that petition. As for us our I-130's for my wife and step-daughter were processed and pproved quickly...and the k-3 is still not approved....floating in limbo somewhere...we are in the queue at the embassy for interview for cr-1.

Sorry, I thought I had mentioned... there is a new USCIS policy that presumes that a K3 recipient will adjust status in the U.S. If a K3 recipient chooses to pursue a CR/IR1 they must now file an I824 and pay $200 to have the petition forwarded to the NVC.

Can you supply a link..I can find absolutely nothing about th 200 dollars anywhere on uscis or nvc sites. Since the petitioner has already filed a I-130, once that is approved the next step is that it is automatically forwarded to the nvc for processing....choice of agent, aos fee bill, aos(I-824), iv fee bill, ds-230...ect...its the petitioners choice whether or not to continue with cr-1 process....they didnt hold our cr-1 assuming our filing of k-3....they approved it and sent it to the nvc....i'ld really like to know about this 200 dollars.

I think that the extra $200 would now make the option more expensive to return to Canada. My understanding - although I never added it up myself - was that AOS cost the same as pursuing CR1, so I thought that now it would cost an extra $200 + the trip back.

I'll try to figure out it all out so I know for later :) I'm glad we're just getting the CR1 through Montreal though, it makes the most sense for us!

It is true that many Canadians choose to enter on the K3 and then go back to Canada just for the interview. They can stay in the U.S. until the CR/IR1 interview, and it is often faster than filing AOS. Choosing to enter on the K3 does not in any way abandon the CR/IR1 process.

But, I'm sure far less people will be doing this now that they will most likely have to file the I824 and pay $200 to have an I130 sent to the NVC if they already have an approved I129F.

You either have to pay the fees now with the cr-1.....or pay the fees later with k-3 and adjustment of status...6 of one half dozen of the other....at least with cr-1 you dont have to jump through anymore hoops once your in the US...nothing to do for 2 years when you go for lifting of conditions.

Can you clarify what 200 dollars your talking about?...the aos cost is 70 dollars and the IV bill is 380 dollars...you dont pay anything for the I-130 to be send nvc...thats just part of the processing. If i remember properly the adjustment of status is actually more expensive not including the trip back, plus you have more appointments and interviews to go to here in the states on the adjustment of status...which probably exceeds transportation costs of going back once.
