No this isn't your situation. Some people have medicals valid for 3-4 months because of certain medical conditions and/or vaccines as well as how long the visa was issued after the medical. The medical itself is typically valid for a year. Therefore, as long as you enter the US before your visa expires, you will be fine. If your visa was issued for 6 months, it's because your medical will not expire before that. It does have to be valid when you enter the US, which again your visa would expire before that anyway. I understand you want to be prepared, but do not be concerned. Good luck.

I would like to add that I'm not sure if the medical has to be valid when you do AOS.


Yup, the medical has to be valid when you are going to file for adjustment of status otherwise you have to get a new medical done by USCIS designated doctors here in the US.

In the K1 process, if the medical is expiring before the applicant is able to travel, but the visa is still valid, What are the options? Can one get a new medical? And if so, what is the process?

Some countries like the Philippines, the visa expiration ties to the medical date. There is no implication if your medical expires before you are set a date to travel. If you are worried about your adjustment of status, you can have your a new medical done in the US. But you can't have a new medical done in your country unless the embassy asked for it. And if you are going to get a new medical in the US, it should be done with the USCIS designated doctors.

If anyone  help me regarding about filling K-1Visa. I've gathered just about every requirement that is needed for filling K-1 visa except the Fiance Letter of Intent. I am doing/filling it on my own. Is it ok to send the K-1 form now even without the "Fiance Letter of Inetent?" I still need to make one for my fiance, have it sent to her so she could signed it and doing this will take about at least a month. Is it ok to send the K-1 form now so that it can be processed and will I send the "Fiance Letter of Intent" when it's completed? 

 

If I were you, I would not take a risk not send Letter Intent of Marry that could delayed the process. Better be late rather than sorry. Indonesian post office is well known for being not reliable and my then-fiance (my now husband) received my package including Letter Intent of Marry less than a week. Use the best courier company in her country. I believe in the Philippines they also have FedEex, UPS, or DHL.

hi! I am the beneficiary and I will have my interview in 2 weeks.
My fiancee and I are young and she started her job 2 years ago. She sent me her last 2 years tax returns.
In 2013 her income was 26,000 and I should be fine with that.
In 2012 since it was her first job her income was around 8,000.
Should I give the officer both tax returns or just the the one from 2013? ( along with form 1040, I have w-2 and 1099, bank letter and employer letter that she is employed).

You just needed a recent one which means tax return 2013. Just follow what the packet 3 was asked from you. Based on my experience, the lady who handled all docs asked W-2, tax return,and original I-134 (signed and dated).

Does the letter of intent need to be signed by both? Each signing their own version of the letter of course.

 

For the Beneficiary, do I need to write my address, or my petitioners?

 

Does the letter of intent by the beneficiary need to be sent with original signed ink or can I scan and send(with my signature) it to my petitioner?

 

  • You need a separate letter intent of marry. Both from a petitioner and a beneficiary
  • You should put your address (beneficiary) on your own letter intent of marry.
  • You supposed to send the original one to the petitioner. Some people got RFE for sending scanned ones.

I am getting ready to file our I-129 and I have read people talking about different service centers, and that you are supposed to file either in TX, CA, or VT, depending on where you live.
But when I look at the USCIS website, it says there is only one filing location and it is in Texas. See the link. Is this true? I live in NY, and I want to make sure I mail the petition to the correct location.

You are right, it makes sense. But people are sometimes confused about what type of visa K1 is, because for example when you check visa status (CEAC status) this visa is under the immigrant visa.


That's why when an applicant receives email or mail usually from IV Unit at embassy or known as Immigrant Visa Unit. For information purpose for others, when a beneficiary gets assigned a number from NVC then started check the status on CEAC under immigrant visa box.

Hello, we are applying for a k-1 fiance visa. My fiance lives in Vietnam and we recently had our I-129f approved and forwarded to HCMC consulate
We were asked to fill out form DS-160. We submitted the form online. Now I realize this is a form for a non immigrant visa. Was this the proper form to use? She is coming to the US to marry me and stay, why would they request us to fill out the non immigrant visa form?.


Yes. All K-1 visa applicants are required to fill out DS-160 form online. Technically K-1 visa is a non-immigrant visa but also they threated as an immigrant visa at embassy. Most of times K-1 visa applicant got married within 90 days (non-immigrant visa) and adjust the status afterwards.

But a few people don't stay after got married on K-1 visa and go back to their home country. The reason why because many people wanted to get married in the US but they don't get approval for B-2 visa. Since many people abused of B-2 visa purposes, that's why they have created K-1 visa that serves two purposes, get married in the US and adjust of status afterwards ( if they wanted to).

  • As far as my knowledge, only US embassy in London accepts self-sponsorship for beneficiaries. So, your financial backgrounds won't count.
  • I have no idea about work remotely during AOS. I had several job offers from my home country but refused since I did not have EAD at that time. 
  • Background education is not really matters. Many people have master degrees and graduated from reputable universities and still struggled to find job in the US.

You can get the name changed on the SSN with the EAD in your married name. The new card will not come without the 'VALID FOR WORK ONLY WITH DHS AUTHORIZATION' though. That can only be removed when you are a permanent resident, or USC of course. You can always wait until you get your green card and change the name then, if you don't want to make another trip just to remove that stipulation.

K-1 is allowed to work, but a K-1 is allowed to work with DHS authorization, which is the EAD. You can get your SSN right after arrival, but you cannot use it for employment without first applying for AOS and receiving an EAD. Once the green card is approved, you can get the stipulation removed from the social security card and the EAD is no longer needed.

Having the EAD does not remove the stipulation from the SSN that you must have the SSN and authorization to work. You can get that removed from your SS card once you have a green card and are a permanent resident.

Hi again y'all..
 
What does the term Eligible to work mean...I ask this because if a K1 can apply for an SSN prior to marriage based on the immigrant status which implies Alien allowed to work, why then would we need to apply for an EAD if we are already allowed to work.
 
Would this not then imply that K! can work without an EAD.
 
I would like clarification on the matter as my fiancee wants us to got to the SSN office and apply prior to getting married.  However, having been told I need an EAD on the phone from an SSN employee i don;t want to go there and look stupid.

You can apply for SSN before get married because K-1 visa holder is allowed to do so. On SSN card says " valid for work with DHS authorization". When you have your EAD the restriction on SSN is lifted. If you waited until got married and your green card is finally come or EAD at least, I am afraid you can't get W-9 if your future employer asked it from you. Because when I apply W-9 from IRS, they asked my SSN number. Since I did not change yet my maiden name on it even though my EAD with married name, my W-9 came with maiden name instead. The bottom line is, apply SSN as soon as you can before your I-94 is going to expire.

Based on my experience, it took 69 days before I got my EAD had approved. I filed June 13th and am still waiting approval of my I-485. Yours is long way to go. Be patient.

As per our relationship is concerned I have alot of proof phone calls, emails, chats, skype anr facetime calls, presents by him also we share a diary that we exchanged everytime whoever visited from his family.

 

You already have NOA-1, as you said. You and your fiance just wait USCIS adjudicating your I-129F. If they think you are not meet the requirement, they will send you letter intent of deny. If you can passed it and got approved, the next big thing you have to get through is the US embassy in Pakistan. They are well known on VJ is one of toughest US embassies. You HAVE to well prepared. 

 

Of course you can still have a chance apply for B-2 visa while you are waiting for I-129F approval. Someone here got approved for B-2 visa while her K-1 visa was still pending. You are just need to show your NOA-1 during the interview, the reason why your fiance can't travel to your country, and a proof that you will coming back after visiting your fiance in the US. There is always a possibility for everything. You'll never knew how it worked until you tried even though you have to spend a lot money to get the experience. Good luck!

I believe the question was about how we met at first time, not how we met in person. Of course we met in person to fulfilled I-129F requirement. If you read through all the I-129F , I am sure - my husband has very good understanding English language- they asked how you met regarding of IMBRA. We did not met through dating site nor any paid dating site.

They would've had to met in person to be approved. It's just not necessary to put that in your answer to get approved as long as you send evidence of meeting in person. If you read the entire question it refers to marriage brokers etc. I think they just want a quick statement as to HOW u met.

Hello all, I'm new here and I've been reading a lot of forums just to prepare myself for this whole process. I just had a doubt on the 34A. question on the I-129F form asking "describe the circumstances under you have met." What I wrote in those small three lines was
" I met xxxx at the bar he was working at during my internship in Porto Alegre, Brazil." I mean that really was all that I could fit anyways. I know I could have attached another paper but I thought that was sufficient enough to answer how we met... but I think I interpreted the question wrong. 
 
So I was thinking that I was suppose to just describe how we met. I've been researching more and I see many users saying that we have to describe how we met in the past two years. Since it didn't specifically say describe all the circumstances that you have met in the past two years I didn't put this down. I was living over there when I met him and then went back two more times. I'm just freaking out now because I feel like I didn't answer that question well after reading what many other users wrote and now I'm scared they are going to make me do it again. Can someone direct me to the right track to eliminate this doubt? Thank you advanced!



My husband only wrote " met through internet" and for evidence we had attached printout of our first conversations on YouTube and how he contacted me. We did not get RFE and got approved in 38 days.

If you are referring to a timeline on VJ, I am afraid to tell you that do not count on it. The timelines on VJ based on what people are putting on their timelines and most of the times they are not accurate. My petition was approved in 38 days (October 2013) even though the timeline was said between November - December 2013.

My question to you and anyone else with common sense, how many people would MARRY a Nanny for the sake of having a Nanny. Seems crazy, I hope the Embassy would see it that was as well. NO matter how desperate anyone is, Marrying so you could have a full time Nanny to a child who no longer needs one seems insane. Use your brains people. This is love, Ive never been married before but I will walk to the edges of earth to make sure we are together. 

I know you are feeling down about the denial, but people are here trying to help you. People don't questioned your relationship but based on all facts you have presented here, they were trying to see a big picture why your fiancé's K1 visa was denied. I would think you are being nicer replied back to them.

If you think people have questioned your genuinely relationship then it is not for the first time happened ever. Many people had the experience including mine. But I wouldn't set a fire just because people don't believe my relationship to my husband is a real one. Swallow good advises and take a lesson from the tough ones.

Spousal visas get reaffirmed but not K1's.
 
CSC never reaffirms K1's anymore and Vermont used to to it very sparingly but that was years ago.

Lots of peole get a B1/B2 denied and that does not create a pattern.









I am sure it was hot topic before here. Their petition was sent back to USCIS and the couple decided to get married. But, they were confused after they received notification that their petition was reaffirmed and sent back to the embassy. You can use search tools on VJ. It was happened not long time ago. And my memory was clearly remember the post.

Of course the denial of B1/B2 visa is not affected of K-1 visa application. I was denied B2 visa before just because I had a relationship with an American man ( my now husband). I stated that I wanted to visit my boyfriend and the CO suggested to filed I-129F. You have only seen the denial but what a caused of denial. And if I were a CO I would think that why suddenly the relationship changed before and after DOMA was stuck down and a beneficiary applied to work as a nanny in the US.

Relationship could be changed any time. But this is a simple thing. She applied for B1/B2 visa as a nanny before DOMA was struck down. She got denied. She applied for K-1 visa AFTER DOMA was struck down and denied. Have you seen the pattern? The CO probably thinking that you were just trying to help her come to the US to get a job.

The best thing is waited until the petition sent back to USCIS and see what happens. Some people here had experience their petition got send back again to the embassy after USCIS had reviewed it. And, contacting your senator or congressman might give you some help as well.

My then-fiancé ( my now husband) and I have only met once during our courtship over 5 years online and talked over Skype most of times. I got approved for K-1 visa without the CO grilled on me after I told him than my fiancé was waiting outside the room. He came to Jakarta for my interview and it was made easy for me. We are at the beginning of the process. We sent our form at the beginning of June, and we got the NOA1 in June too.
I am going to have an appointment for surgery, and I should go to the Court, in my country (France), in March 30th, 2015, to fix a situation with a former employer. I could not be represented for this case.

I hope to be able to go to the Court, then if everything is good for the visa, to join my fiancé in the US to get married.

I think it is doable. You can also postpone your interview by delaying submit all papers. Many people do like I did. I postponed submitting all papers to delay the process due my husband and I had hectic work schedules and needed to be done.

I don't see your timeline is set up. It depends on which country the beneficiary comes from. Some countries like the Phillippines, the expiration date of visa tied up to the medical and some others like my country the visa is valid started from issued date up to 6 months. Better to check your visa to see the valid date.

The OP choose the K-1 visa path. That's different from IR-1/CR-1. They don't need to send or submit anything to NVC. For K-1 visa applicants, after approval of I-129F, USCIS send the petition to NVC, assigned a case number, and forward to the U.S. Embassy. Some beneficiaries have to scheduled the interview through NVC but some others don't.

Based on what I have read so far on VJ, there are some benefits if choose a K-1 visa or a spousal visa. So far, K-1 visa has a shorten length of process and you will be able to get her as soon as possible. But the downside is that K-1 visa is more expensive since after married the spouse of US citizen has to file adjust of status and can't work before at least an EAD in hand. A spousal visa is more cheaper and usually takes a while for whole process but the spouse of US citizen can work as soon as she/he enters the US. No waiting time like K-1 visa.

The US embassy is pretty easy toward Canadian applicants unless the petitioner or beneficiary have caught in trouble with immigration problem prior the petition. Choose the best path you think will give benefits for both of you. Good luck!

Pictures are only secondary evidence as a proof of meeting in person within 2 years. Boarding passes, hotel bills with your name on it visiting your fiancé in Ireland, and also all receipts should be sufficient. But again, it depends on how an adjudicator see your I-129F application.

God, I am speechless, whether you are a troll or an attention seeker, I have no idea. When my husband put me as his beneficiary for all his insurance policies I felt so bad because it seems like wishing his bad fortune. I did not even look at these papers. It took a while before I agreed to put my name on the papers.

To answer your question, I would say if he puts you as a principal beneficiary on his will then you would definitely get all the money you want. No doubt about that unless someone came up and dispute the will.
