Aww.. That's great. I recall your post a few days ago. Glad everything is working out. Congrats with visa and upcoming marriage :) I had my POE in Chicago as well. Only thing I dislike is the Chicago loop. Hehehe!

Thanks! Chicago was a looooooong wait as there were lots of tourists and only one officer. We queued for nearly two hours, but all went well and we are here. :star:

Congratulations !

Spend that 4 hours enjoying a beer and those awesome chicago hot dogs. There are some decent vendors inside O'Hare.

My point of entry was Dublin. (Because I love Guinness). :)

The visa's are in hand and I am packing like a mad thing for our flight tomorrow - my fiance' loves real Guinness. I have been to OHare a good few times, as you might imagine, and I have not once frequented a bar. Perhaps I will tomorrow. After all the paperwork has been completed. Yay!

8 days from my K1 interview date and our visa's are on there way tomorrow - between 8 - 12.

YES!

It came in the nick of time as Larry and I were going cuckoo trying to arrange and re-arrange wedding plans and the honeymoon via twitter. NOT fun. Suddenly, I do not care about all that crazy stuff and just being with him in the knowledge we won't have to say goodbye in a few weeks time or pack suitcases for a long while.

YES!

We are booked to fly on Friday afternoon with a layover of four hours at Chicago for all the paperwork and stuff.

Thanks, for getting us to this point VJ. This place is a wonderful resource and there are so many good and helpful people. I will be back I am sure for the next stages, so until then adios.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJune 2011 Filers

Hello, all!

I didn't see a thread for us Juners, so I figured I'd start one and say hello! We applied for the K-1 on June 4, and got the text of receipt on June 15.

My fiance lives in Canada, and I'm hoping we can get everything in order and approved for our May 2012 wedding :) I cannot WAIT to marry my best friend! We've been together 2 years (3 by the time he gets here), and the long distance relationship thing is getting tiring :)

What's your story? :)

This is a great topic.

We are June filers too. Applied on the 10th of June and received our NOA1 on the 15th.

I am the beneficiary and I live in the U.K. My fiance lives in Missouri, which is where I will live with him. I am hoping we are getting closer to that oh so elusive NOA2. C'mon......:)

You do not need to have proof of a relationship that is 2 years long. You need to have seen eachother in person in the last two years. You could meet on the train today and file tomorrow.

I had all ready corrected myself :)

Hmmmmm, I don't wish to discourage you or alarm you, but I read that you have to have proof that you have had a relationship of at least two years, and with at least one face-to-face meeting. Me and my fiance' have just started the K-1 process and I can clearly remember reading that somewhere.

I will try to find the information for you.

I stand corrected; you have to have met 'within' 2 years. You can read it in the pdf I have attached for you.

K-1 Fiance(e) Visa Process & ProceduresK1 and dependent

Okay, I have been doing some research and so far I have found out that we would file the I-130 -- Petition for Alien Relative, and my son could join us out in America under the K4 visa while the I-130 is pending. My son is 16, so he is classed as a dependent.

I really could do with some other voices to help me feel like I am on the right track? :help:

Question, why didn't you already include him in the original K1 visa that you applied for? That is the easiest and yet fastest way for your dependent to come to the US as in together.

I totally hear you and I wish things could have panned out like that, but unfortunately, circumstances didn't permit that at the time we began the process. I know it would have made a lot more sense to do things that way, but life isn't always that simple. So, I am doing my best to find out how this will work this way around. There are a lot of unknowns and I would like to be able to fill in the blanks, not only for mine and my fiance's peace of mind, but so that I can assure my son and give him some idea of the time-line etc. Plus he will have to stay with family members when I initially go out there so it would be good to be able to inform them.

Thanks.

K-1 Fiance(e) Visa Process & ProceduresK1 and dependent
Hey there,

I have a question regarding my 16 year old son and applying for him to emigrate once me and my fiance' are married. Obviously, I am working on the assumption that we are approved and everything runs as smoothly as possible (fingers crossed).

We are currently awaiting for our NOA2. Once we are approved I will head out to America and we will get married, pretty much immediately. I was wondering if anyone knew how long it could take for my son to be able to come out there? I have read the section on dependents and I know what age and circumstances the USA consider a dependent to be. I have saved all the information regarding the type of visa we will have to apply for (can't think of what it is called off the top of my head?). And, I understand the process, well, in terms of what I have read.

What I would like to know is whether anyone has any direct experience of this kind of scenario, and how long did it take for the visa to be processed and approved, will I need to come back to the U.K for any part of the process, such as medical examinations etc, and is it correct that my son could be in the country while we apply?

Any advice or experience would be really, really appreciated.

Thank you in advance. :)

Does anyone know once the k1 is issued how much time does it take to have the k2 in hand if I start the k2 process let´s say 6 months after the k1 have been issued?
And
Will the k2 beneficiary have an interview too? even a kid 7 years old?
Thanks

"11.Do I have to attend an interview at the American Consulate to get K-2 visa? Generally an interview is required at the American Consulate. Some consulates do not require you to attend if you are below the age of 14. Some consulates require you to attend even if you are not going to move to the U.S. with your K-1 parent immediately, but will follow later.

Hey Sheep,

I proably won't be as informative as other VJ people as I am new in learning about the process, but I have read today that an interview dependent on age is up to the discretion of the consulate you go to. Some don't interview children under 16 and some do. I think you can check on-line with the consulate you will use to find that out. I can't answer the other questions, because I would not want to misinform you.

I hope that was at least a little bit helpful.

To get more information about the K-2 you can read this http://www.visajourn...-to-come-to-us/
It is in the Bringing Family Members to US forum!

I am not sure you can do the interview together, if your son is not coming with you now. After the visa is issued you have 6 months to immigrate. So you need to ask the embassy if your son is joining you later whether they can issue his visa later.

My husband got his visa issued 6 weeks after the interview because we were visiting US in between and if he had the visa in his passport that would have caused troubles. So we sent his passport after our return from US to the embassy and they issued the visa immediately.

A lot of times the embassies will work with you, it never hurts to ask.

Wishing you luck in your journey!
Sib

This immigration malarkey is one steep learning curve, but it is all well worth it. I can't wait for us all to be together and one happy united family.

Thanks for that, Sib.

We have all actually decided that it would be best for my son to travel at the same time as me, which makes things a little less awkward. I will read the information you have kindly posted.

Gosh, I have been reading all day...I am still in my P.pj's and it's nearly 6pm here in England. I found some excellent external links explaining the K2 process.

Thank you. I don't know what I would do without this place and the wonderful people to have as a resource?

When you file your visa application to the US consulate in London you can submit his as well at the same time... However, you CANNOT do this until YOUR petition has been approved by the USCIS.

I think you are confusing the petition process and the visa application process...

Ha, ha, ha, ha....you are dead right! I have been confusing the two. Wohoooooooooooooooooooooooooooooooooooooo!!! I finally understand. Blinkin' heck! You are one patient person and I am a dumb-####. Sorry, ha, ha.

Yay! Yay! (does a little dance)

I get it! I have been so worried about my sons part in all of this. So, we will have our interview and everything at the same time, and we will be able to leave at the same time, or he can follow within a year. OMG! So simple. Obviously, this is all dependent on USCIS approving our petition, as you stated.

I made the mistake of just letting my fiance' file at the beginning, filled out what I needed to fill out and I didn't investigate any further than what he told me. I have just re-read the I-129F form and what you said makes perfect sense in terms of the information that was required on that form.

THANK YOU!!!

as long as he was listed on the petition, their is no issue with him making application now or up to one year later.

applications are submitted concurrently with or after yours

Okay, I have been researching and researching, reading and re-reading and re-re-reading. Phew! My brain feels like it's going to explode :bonk:

Would I be correct in assuming that once the consulate receives the notice of Fiance Visa Petition from the NVC they will send instructions for packet 3? Okay, now this is where I am not so sure? At the time we filed for the I-129F we only entered my 16 year old son as my dependent, we did not apply for him to emigrate at that point. So, when I receive packet 3 would I be able to apply/add my son for the K2 visa? Or,because we did not initially put him down as emigrating will we have to wait until my K1 visa is issued before I can apply for his K2? I am trying to work out the time-line.

We had some issues initially with whether my son was going to emigrate at the same time as me, or follow due to his education, but we have all decided since that point that he will emigrate as soon as. Obviously, because we all ready started the process it has complicated things, which has complicated my understanding of the process too.

Thanks.

yes, applied for and issued within one year of the k-1 issuance..

as for the medical, unfortunately consulate specific answer... but i would doubt it..

You have really helped me so much. I can at least check the consulate now for their guidelines under medical examinations etc. I have to think about how we are going to do this now. Maybe once the K1 is granted (fingers crossed) we could apply for the K2 immediately and I could wait here with my son, so that I can gather all the information he will need etc? I would just like to be able to support him with the official stuff before I go out there.

Once again, thanks so much. You have pointed me in the right direction and I feel a lot more confident about my research findings now.

Here's a hug <virtual hug> in appreciation.

I need to correct myself.. the K-2 has a one year issuance window after the K-1... not application window.. slight but important difference.

So, we can basically apply for the K2 to be issued once the K1 is authorized up to one year>

Can I bother you again? (sorry). Do you know whether I will have to be with my son at his medical examination in the U.K as he is 16?

Really!!! Oh, wow. Okay, that changes everything. I thought because we had not applied for my son under the I-129F that we would not be entitled to file for the K2 once I was there.

That is soooo great!

Does not work that way... Your USC spose could file the I-130 but it would result in a IR visa not a K-4.

The fastest is K-2 if he is to travel within one year of you getting yours

I appreciate your help, but can I just make sure we are on the same page?

We are awaiting our NOA2, my child is listed as my dependent but we did not apply for him to come with me (for various reasons). So, once I am out there and we are married we want to apply for my son. Are you saying that even though we did not apply for a k2 visa for him that that is the route we would take?

THANKS!!

still need to do more research... your child would NOT be able to follow on a K-4, unless you arrived on a K-3 (same as a K-2 needs the parent to be on a K-1).

Your kids can follow u within a year. You do not have to pay for their visa first unless they will have their schedule for interview. You have options to bring them with u less cost and less time being spent or they follow u within a year on a k2 visa.

I am not recommending this but i would like to share my experience as well. I came here on a K1 visa and i did not bring my kids with me( 10 and 6 at that time).

I waited for the right time that me and hubby will be married for 2 years so we can petition the kids for I-130 for them to get the Immigrant or IR2 visa.
Once they are here on the IR2 visa the kids will no longer be adjusting their status or removing their conditions coz they will receive their 10 yrs. green card a few weeks later after entry to the US.

Aside from being away from my kids..i adjusted here well and got a good job first ,,being able to stand on my own feet(drive back and forth to work)

It is hard to be away from ur kids but everything was planned and it all worked out good in God's time and my kids are finally here with us.

Happyblessedme, I am so glad that you answered this post. I have a post elsewhere that has asked similar questions as I am too going out on the K-1 Visa and once married applying for my 16 year old son to come out too.

Me and my fiance' are currently awaiting our NOA2 (3months so far) , so hopefully we won't have too long to wait.

Please may I ask you some questions?

:help:

Do you have to wait until you have AOS before you can apply for children?

I read that the child can all ready be in the country (USA) while you apply for them this way?

Will my child need examination in his home country (U.K) etc and will I need to return home to be with him for this?

Do you know how long it may take to apply for kids separately?

Is applying for kids separately a similar process to K-1? Medicals, police report etc etc.

Me and my fiance' have briefly discussed this and we figured that we would fly my son out a few months after the process has begun. I am not sure if this is possible.

I am soooooo glad I have been watching this thread. I am worried about not knowing how things work. I really want to be able to discuss this all with my son.

Any information would be really great.

Thank you so much! :)

K-1 Fiance(e) Visa Process & ProceduresWe Finally have everything prepared I think!

Hey guys,

So we finally have prepared the last of our evidence to send to our lawyer to file our I-129f. I have pulled our skype records dating back to 2008, email records from both our accounts to and from, plenty of pictures of us together in the US different locations, in Toronto recently and in Ireland this year. We have proof we lived together at one point, i took screen shots of or viber log, the application we use to call each other, she made copies of cards i sent to her and cards she gave me and proof that her boss sponsored me for a J1 after we met.

I just want to make sure that everyone feels this should be sufficient evidence of our relationship and if anyone thinks anything else should be included?

Thanks guys im excited to get this filed and actually start one of those timeline thingys you all have in your signature :)

Thanks!!

Hey!

My guy included a table of contents, and also wrote down the historical dates (time line), events and involvement of our relationship, which also began in 2008. He included tickets stubs from our flights out to one another. He made 2 copies of packet one as well, and filed them at home.

Mega, mega good luck!

K-1 Fiance(e) Visa Process & ProceduresI-864, gifting money- is this going to work?!

Thank you everybody- a lot of this has been incredibly helpful and insightful, I appreciate your time and knowledge.

On the other hand...I don't think mildly patronising statements concerning the ridiculous correlation between adulthood and marriage should be applauded- I think we all know this is bureaucracy and theory and starting to chastise young people who are trying to build a life for themselves, and above all find legal employment, should be told off because they are naughty children who aren't 'ready' for marriage is sad.

I personally see marriage as paperwork, pure and simple, I am not proud to be married- I don't see it as an achievement. My wedding cost me $20. I just want to get a job, that is all- that really is all I want, to live with Kyle and get a job and come home to him every night and share a fridge.

Some people can tell me I'm naughty for not doing all my research properly, goodness knows I tried very very hard to cover every base, and I understand there will be monumental sacrifices- I just wanted some literal help concerning the issues raised.

I mean- dear lord, none of my other friends who are engaged or living together have ever had to justify themselves financially to the government, they are free to build their life however they see fit. These marriage visas are a ###### situation whichever way you look at it...

I think you seem like a very mature and grounded young woman. I also don't believe that age equates to wisdom. I see plenty of 'adults' who make mistakes and do not behave in an educated manner. Age can be helpful, because there are more chances for life experience, but that in itself still does not equate to wisdom. Aristotle believed that to have wisdom one must possess knowledge--theoretical and practical. He said nothing about age. And, he was a great and wise philosopher. I think it's highly unfair to assume that someone who is young cannot experience love in a way that older people might - not all older people experience love or healthy relationships. Age is a consideration, but it's not a precise and reliable predictor either.

You know in the field of psychology some believe that there is no such thing as an adult anyway.

I hope things work out for you I really do. Wishing you well with the rest of your journey.

K-1 Fiance(e) Visa Process & ProceduresWorried, please help

I've been waiting since April 26, 2011 for my NOA2. Still don't have it! Before I was stressed, now I'm just completely pissed off. One week from now it will be 5 months for me! I cannot believe this #######.

I just caught this thread as I was about to log off, it made me chuckle. I am not laughing at you or your situation, it was just that you managed to communicate your feelings very succinctly with just a few words. :) Hang in there!!! If they go beyond the 5 months mark you will be able to call and talk to a real person to find out what is going on?

I will send out good thoughts for you and lots of luck!!!!
