Removing Conditions on Residency General DiscussionArrest record and I-751

The circumstances and details of the arrest and subsequent events are largely irrelevant in terms of whether or not to reveal the info to the USCIS on any applications you send them. I know that wasn't your question, but I wanted to point it out. One of the questions on the I-751 is:

"Since becoming a conditional resident, have you ever been arrested, cited, charged, indicted, convicted,fined or imprisoned for breaking or violating any law or ordinance (excluding traffic regulations), or committed any crime for which you were not arrested?"

Your answer to that question must be "yes", regardless of whether or not the charges have been dismissed after proceedings. They want you to answer "yes" even if you got away with the shoplifting without getting caught.

Note that by answering yes, you will need to comply with their request, "If you answered "Yes" to any of the above, provide a detailed explanation on a separate sheet(s) of paper. Place your name and Alien Registration Number (A#) at the top of each sheet and give the number of the item that refers to your response."

Strongly advise not trying to hide ANYTHING. Getting busted for shoplifting is not likely to be seen as a big deal. Lying about it and submitting fraudulent paperwork is likely to be seen as a VERY big deal. Don't play games with them.

Also note that on the application for citizenship, which I assume you will apply for eventually, are questions in section D pertaining to Good Moral Character as they say. "For the purposes of this application, you must answer ''Yes'' to the following questions, if applicable, even if your records were sealed or otherwise cleared or if anyone, including a judge, law enforcement officer or attorney, told you that you no longer have a record."

  • Have you ever committed a crime or offense for which you were not arrested?
  • Have you ever been arrested, cited or detained by any law enforcement officer
    (including USCIS or former INS and military officers) for any reason?
  • Have you ever been charged with committing any crime or offense?
  • Have you ever been convicted of a crime or offense?
  • Have you ever been placed in an alternative sentencing or a rehabilitative program
    (for example: diversion, deferred prosecution, withheld adjudication, deferred adjudication)?
  • Have you ever received a suspended sentence, been placed on probation or been paroled?
  • Have you ever been in jail or prison?
Based on your post, I think your answers are: YES, YES, YES, NO, YES, NO, YES

Last but not least, the citizenship application also has these questions:
  • Have you ever given false or misleading information to any U.S. government official
    while applying for any immigration benefit or to prevent deportation, exclusion or removal?
  • Have you ever lied to any U.S. government official to gain entry or admission into the
    United States?
You really do not want to have to answer "yes" to those questions, or answer "no" and get caught. Would be bad mojo in the worst way.

Given that the purpose of I-751 is more about verifying your marriage is "real" than concerning itself with your lack of respect for other people's property rights, it is unlikely your application will be denied because of this incident. However, if you hide anything or are not completely forthcoming, then it will likely be a different story.

In any event, I dunno it you will get an "automatic interview", but even if you do, I don't think it is anything to worry about as long as you can prove the validity of your marriage, which is what the interview is all about. Best advise for you is to get several copies (at least 3), certified and/or notarized from the court, indicating the actual charges and disposition of the case. You will likely need these for your applications and so forth. If i were you, I would include a certified copy of these things with the I-751 and the 400 when you apply. By giving them as much info up front as you can, I think you will reduce the odds of them deciding to interview you. In other words, give them as little reason to ask questions as possible. I would highly recommend providing certified/notarized copies rather than just regular ones. Also I would get this stuff ASAP while the paperwork is still fresh, before it gets lost or otherwise unattainable for some reason.

Something like, " I certify that i've known this couple for x years and it is obvious to me that they entered marriage in good faith"? Or something more official? less official?
Is there anybody out there who has done this type of affidavit has some good text suggestions?
My husband and I have 4 people who will be happy to affirm these affidavits, but we want to provide them with some stadard text, so they are not burdened by having to create it and that the statement is short and to the point enough. :help:


The email we sent to people who were writing ours said (we had my mom and our roommate do them for our AOS interview just in case, since we hadn't done K-1 and had never had to present any evidence the relationship was real before then):


This is the basic gist of what they want—the main points are:

1. that you're a US citizen (w/ enough info to verify that): name,
birth name if different, current address, place of birth. If born
outside the US, how you got citizenship (your parents were US
citizens, or the date and place you were naturalized, or whatever).
2. How and when you met each of us.
3. How often you see us and when the last time you saw us together
was. (This is why it should be done as late as possible.)
4. Statement to the effect that we give every appearance of really
being married, with examples if you can think of any.
5. Your contact info (address and phone).
6. "I certify under penalty of perjury that the above is true and correct."
7. The letter must be signed in front of a notary.

Both letters ran to about half a page, single-spaced.

It is legal to enter the US to get married if you intend to return to your home country afterwards. What would be illegal is if you came here on the VWP, stated your intention was to be a tourist (which is what VWP is for) when your intention was actually to get married and stay.

It is 100% legal to come here (under any visa or the VWP), get married, go back to Japan, and file for the CR-1 (the CR-1 is given to people married less than two years; IR-1 is for people married more than two years). You would also have the option of the K-3 if you wanted.

That said, I've heard (even here on VJ) of people getting denied entry when they tried to do so (come in for the wedding with the intent to leave afterwards). And if you're denied entry, you can't use the VWP again.

But yes, what you are suggesting is completely legal.

No. You can register, but then in order to track your case, you have to add the case number to your profile. So you can register but can't track your case until you have the number. It will be on your NOA-1.

Not true. The child is a US citizen and can simply enter on an American passport the same way any other American living abroad would do.

What ellis-island says is correct, but I did want to add that I've never heard of someone getting the HRR waived, there have been lots of couples here who have had to wait them out. Waivers are really hard to get.

We married and filed the I-485 (AOS) while my husband was here on a J-1 visa (no HRR though).

Is the processing time through NVC only long for petitions from CSC, or is it long for VSC also?


From what I've seen, there's only a delay with CSC, VSC (although approvals are slow) seems to be mailing cases off right away after approval.

I just called NVC and our case arrived on 10/15 and left today 10/17. Thank God! I hope this sheds a little light on the wait time. We were approved on 9/10.

One week to get the RFE in the mail, and about 17 days from the day u mail it in for them to update on the web that they receive your reply. You should call them and ask what info they're requesting in the RFE. kicking.gif

Right now, we are averaging about 81 days from NOA1 to NOA2 from CSC. But averages can be meaningless. Just ask people that have been waiting 160 days or more.

If you like details, fwaguy has done a really nice histogram, etc. For me, I will just hope we are all close to that average timeframe.

I would assume if two people put identical data in their timeline, they would get the same projected dates. I will count to 81 from the day my NOA1 issued and I will hold breath while counting! :blink:

I have been pondering this a while, but never really found an answer...

On the USCIS website, it says:

"On March 1, 2007, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case...."

My paper NOA has a date of March 5, so this is what I've been using.

I've read people saying to use the actual receipt date on the USCIS site. Is this true? Should I be using March 1 instead of March 5 in my timeline?

Yeah, there is definitely something wrong with the system. I was approved on May 22nd, and just found out today when I called CSC, but it showed just two touches on the 22nd and 23rd. A bunch of people have had similar situations lately...

I called NVC today, and they have received my petition. That sucks that they are being such slackers on yours though!

I don't know the prompt sequence to get the CSC office, I just know I was connected to CSC when I called the USCIS 1-800 number and did the RFE trick around 10 to 11 AM Mountain Time.

Sounds like a plan! I have tried the automated system (though I have read K1s arent registered here). Spoke to someone on Friday, but nothing. I will probably wait til Wed or Thurs of this week to "try" to speak to someone again. Will still check the auto system daily.


March Filers recently received NOA2 - how long does it take to go from CSC to NVC? I received my NOA2 on 5/24 but was lasted touched on 5/29. I am assuming my case did not get mailed until 5/29 - how long can I expect it to take before it reaches the NVC? I called on Friday, and nothing yet...

Hey Congrats! I am in the exact same boat as you! Approved on 5/24, received hard copy 5/29 and touched on 5/29. I have been calling NVC but nada. Please let me know when yours gets there and I will do the same!


I was also last touched on 5/29, and I called NVC today to speak to someone and they told me it arrived today. So I would try calling tomorrow! I had to call about 30 times to get through to a live person though.

Yeah, it's really hard. In the 2.5 years Neal and I have been seeing each other, we've been lucky enough to never go more than 2 months apart. Since we've filed our K1, we haven't seen each other at all. Last time I saw Neal was March 5 and I've really suffered since then...depression, anxiety, the whole works. Plus it doesn't help that I am trying to plan our wedding at the same time, bit by bit. Just hang in there. I know it's easier said than done, but just try to communicate as much as possible (Neal and I talk on the phone every single day...it's the highlight of my day!) and keep yourself occupied.
