The reason they did not submit the K3\I-129F is because I never did receive the first NOA. They had told me I could forward my postal mail to a family member while in Cebu. I did and the NOA was returned to the Nebraska Service Center as undeliverable. I never did receive the NOA, the website said the I-130 was approved on the 16th. I cancelled my mail forward on the 13th from out of state so we are praying it cancelled in time to receive the approval letter.

Now that the I-130 is approved, do they still need to send a copy of the receipt in with the I-129F?

We really appreciate the information :) Ken is the lawyer in Denver CO, Dennis is the owner in Thailand. I have written both of them and Ken says he is starting a trial this week, has to get back to me next week and my contact (who does the paperwork, Nena in Bangkok) doesnt answer my questions so I am looking for alternative methods to finding out what needs to be done. I asked all of them whats next and that we are concerned, Ken and Dennis never got back (over the course of a week) and Nena only wrote the following.

"will send your petition (I-129F) and all documents to the USCIS inChicago. This forms for running process for you."

Other than she needs us to sign new G-325A's, thats all the letter said and is why I assumed they are persistant on the K3. I regret using FastK3 for various reasons. This is just one. The name of the business (FastK3) would suggest they may refuse me to even pursue a CR1.

I am here because it confuses me why they would want to pursue a K3 now that the I-130 is approved, when I keep hearing either it's not possible or there are 2 choices, the K3 or the CR1. Personally all that matters to me is what will get her to the US the quickest.

Hi everyone. I submited my I-130 (NE Service Center) in late July and it was approved this week on October 16th. I don't know much about all of this, but from what I was told we were going to pursue the K3 Visa. Due to bad information I got from my immigration lawyer, I missed the first NOA because it was returned to USCIS undeliverable, hense I couldnt get the K3 paperwork in fast enough. The thing is, the I-130 was approved so fast, I was told we cant file for K3 now. Is that true? If so, what is next? My wife is in Cebu Philippines, I am excited the petition is approved, but will that set us back or get her home to the US quicker? THanks for any remarks :)

Heya, absolutely! I went back to Cebu just a short time ago after I filed the I-130 :):):) Just be sure you have someone to get your mail for you, not a forward. Thats where I ran into trouble and delay.

Hey everyone. Today I received a letter from CA DHS saying my I-130 is approved and that the official form was mailed on the 16th, the day of it's appoval. I believe the letter is in response to my call to USCIS to check it's status. Anyway, the letter was addressed in care of a family member and his address in AZ, I live in IA. (since I am in the Phils) USCIS took that address from me and said they would send NOA's etc to it but they never showed up. Later when I called USCIS to confirm, they said I need AR-11 to change my address, that they dont take in care of addresses if I am overseas. It's crazy. Now I am getting that letter at the in care of address, but I havent gotten the official form I need to submit with my K3.

Will USCIS automatically send all NOA's to my home address and not the in care of address? If so, why did I get this courtesy letter at the in care of address? I never did change my address with USCIS, I only gave them an in care of temporary and this courtesy letter is all I have ever received from them since submiting the I-130. Any insite would be greatly appreciated. Thank you :)

Here is another corny question I have. Why do people even pursue a K3 visa when at the interview it is for CR1 by default? You cant come into the US without the K3 and you cant get the K3 until after the interview. Am I really confused? Or what sense is there in this? hehehe

If your I-130 petition makes it thru NVC to the embassy in your home country before your I-129F gets approved and sent, then the I-129F for K3 becomes null and void, and you will have an interview for the immigrant (CR1) visa.

Sounds as though you're well on your way with the immigrant visa, so you can probably just forget about the K3 altogether.


Ok so the CR1 is default if the I-129F is not approved by the time an interview is generated..... It seems as thought it may be close, is there a cut off time for the I-129F approval? Or can it be approved anytime up to the interview?

Also, if she does go for CR1 because I-129F is not approved by then, when can I bring her to the US then?

I was seeing that the I-130 is approved and sent to NVC for forwarding to the appropriate embassy where an interview is scheduled. My confusion is where does the K3 fit into that? I mean if we had not filed I-129F, an interview date would still be generated. But since we did file I-129F, the embassy holds the K3 until after the interview (head is spinning). What happens then if the interview happens before the I-129F is approved?

Does the petition even get forwarded to the embassy before the I-129F is approved? *takes deep breath* I am just trying to see where these two things join or are dependand on eachother etc. We are so confused.

Cautious in the way of checking out whatever they tell you.

They were 100% wrong about the K-3/I-129f from what you have posted. Do you know what other errors they've made?


THanks for getting back! Here is a most recent excerpt from an amail reply I received last night. (FastK3)

"It would be highly unusual that the CR-1 should be approved before the K3.So my suggestion would be this: We follow through with both processes(K3and CR-1) and then simply go with the one that gets approved first. If youreally get an interview and approval for the CR-1 visa first, you can usethat for your wife’s immigration. But we should also continue with the K3process to avoid any risks of having to wait very long for the CR-1."

As far as errors go they have never gotten back to me when they said they would. Not once, not even the owner and other partners. The biggest error was telling me it was ok to leave the country and go back to my wife, that I can submit a temporary change of address with the postal service. I did that and came back to the Phils and never received my NOA for the I-130 which was needed to send the I-129F. NOA was returned to USCIS as undeliverable. That mistake cost us 2 months at least. The lawyer sent off the I-129F only after I sent them the I-797, which, as you can see from my timeline was just recently.

It's been super frustrating and they have been hard to deal with. I'm anxious to see what you have to say about the comment they left last night. Thanks again.

Hello again. Here is a recent email I got from my lawyer at FastK3. Everything they tell me contradicts what is said in this forum, which concerns me........... The first part is what I wrote a whole week after they said they would get back to me as a follow up. The 2nd is FastK3's reply.

FastK3 responds:

"I've been checking with fastK-1 and have concluded that if you focus on the I-129 and follow their instructions, everything will work out. Thanks, ****"

What a shallow answer, it looks like FastK3 will just move the process along however they want. I dont like them and I dont recommend anyone use them. I have had multiple stumbling blocks with them since I hired them. I know everything will work out, but I want to do whats best.

They are 2 separate petitions, but you can't do the I-129F for a K3 without first having the I-130 sent in. It is government paperwork reduction policies in action!

If the I-129F is approved, the beneficiary (foreign spouse) should be receiving a package in the mail in a few weeks from the consulate. Complete the checklist and medical exam, send it all back to the consulate and they'll schedule your interview. And yes, this part will include the affidavit of support form I-134, that your spouse/sponsor will need to complete and send to you.

That has to do with visitors, and other non-immigrant visas.

K-1, and K-3 visas are handled by the immigrant visa section and they set the interview dates.

I can schedule a visa interview for my wifes K3 here??? And from the times they list on that site the interview waiting periods are negligable for K3 applicants! I am really excited about this! I havent seen anyone mention this yet so I wanted to ask here first, maybe I read something wrong.

I just compiled everything (for K3 and CR1) I had to and sent it all in seeing which one would get Mai home sooner. Even as late as the I-129F was sent for us, looks like it will still get her home faster :) You will hear from NVC no worries :) It took a little time for us to hear after NVC received our case.

I think Mai has not had any of the vaccinations on the instruction packet. Well, none she can prove she had anyway hehe. Is there anything we can do with these prior to the interview? I know some shots like Hep have to be given in series and thus, cant be given all at once at the medical. Or is it even necessary that we do any of them in advance? How does that all work?

I've never heard anything like that. As a matter of fact I only spent 30 days in the US after our wedding before I returned back to my wife's country to wait out the visa process. I did file the I-130 from the US, but I don't see how that would have any baring on the case. The entire process nobody was ever concerned about where I was and I spent an entire year in the Philippines after submiting the I-130. The I-129f I filed from the Philippines and ran into no issues whatsoever. Nobody even questioned it, not even the interviewing consular officer. We also pursued both CR1 and K3 visas and ended up receiving both interview dates which happened to be within 2 weeks of eachother. I believe all they want is that your american spouse is domiciled in the US, it doesnt matter if he is with you or not. So make sure he has a residence in the US is all. Hope this helps :)

My husband (the US Citizen) and I are not separated he is living here with me in Mexico as a tourist and will remain here through the i-130 process we are about to begin. We are also considering filling for the k-3 in case it get's approved quicker. My husband went to the US embassy in Mexico this morning and he was told that you must be seperated for at least three months in order to file for the k-3 visa. Has anyone else heard this? Can you file while living together from abroad? I guess since he is considered a tourist here, we are not technically living together and he can use his parent's address to file.


Any suggestions?

Hi! Congrats on being so close! As you can see from our timeline below, we had kind of similar experience. We decided to fork out the money and move ahead with both to see which would come sooner. Of course if at all possible stick with the CR1. You will be super happy you did. The only reason we would have done the K3 is if the CR1 would have taken a few months longer. Otherwise, the CR1 is well worth the wait.

On another note, we received the K3 interview prior to the CR1 and the interview date was 2 weeks prior to that of the CR1. When we went to the embassy in Manila for the K3, I requested that they interview us for the CR1 instead and they had absolutely no problem doing that :) Yay! So it just depends on how you want to move and if it's worth the money or not. But you should stick with the CR1 if at all possible, (unless it's going to be a really long time) you will be so glad you did :) I hope this helps! Take care!
