Europe & Eurasia (except the UK and Russia)Police Cert. ??
My fiance lived in Germany ~4 years ago and got the police cert back in Dec when we first applied for the I129F, it is now going on 6 months (which is how long the cert's are good for) and we have still not recieved the NOA2 and it is looking like we wont get the approval/interview (where she will need the cert's) before the 6 months is up.... any input?
thanks

US Embassy and Consulate DiscussionI 134 questions, one for me, one for co-sponsor?
QUOTE (JimVaPhuong @ Jul 28 2009, 10:01 PM) <{POST_SNAPBACK}>
I'll take a shot at this... blush.gif

One of your parents will have to assume the co-sponsor role. It can't be both of them. The co-sponsor will have to fill their own I-134 according to their own circumstances, and provide their own evidence. In other words, their I-134 will state the number of dependents they have (including your fiancee), their income, their tax forms, and their assets. For relationship to sponsor, I would think "father/mother of fiance" would suffice.

If your parents have enough income to qualify without assets, then they don't need to list any assets. If they are short on income, then they'll need to list assets to qualify. Note that there are no rules for what is needed to qualify with the I-134. This means that the consulate has wide latitude in what they are willing to accept as assurance that the beneficiary won't become a public charge. Most consulates use all or part of the I-864 requirements, so that's usually a good place to start when trying to determine qualifications. The I-864 allows YOU, the primary sponsor, to make up any shortfall in income with assets that are 3X the value of the shortfall. However, your parents are not sponsoring a spouse or minor child, so the consulate may require their assets to be valued at 5X the value of their own shortfall, since this would be the case with the I-864 form. This is a consulate specific issue. Some consulates are also reluctant to accept a co-sponsor that requires assets to qualify, since this is essentially declaring that neither the primary sponsor nor the co-sponsor have enough cash income to support the beneficiary.

Any credible proof that they own an asset should be acceptable. For land, a copy of the deed should suffice. For stocks, a recent statement from their broker.

A recent professional appraisal is usually required to declare the value of a home, but I would think a tax assessment would be sufficient for declaring the value of land. It might also be helpful if they can obtain statement from a Title Company that the property is free of liens (i.e., they own it outright). I doubt a consular officer is going to want to look up the ticker symbol for each stock they own, so a statement from the broker stating the value of their portfolio on a given day should work. A bank statement will do for cash assets.

Check the regional forum or send an email to the consulate in Madrid and ask about their requirements for co-sponsors.

OK, its been a while now, we have the NOA2 and the new case # from the NVC. I have a couple more questions, I currently have 2 jobs, but on the 134 form there is only space for 1? do i fill out 2? my mom signed up on here and asked a question about their 134, and i think she is ok, but with my 2 jobs, it should show that i make more than enough to meet the poverty requirements, the problem comes that the past few years i have made nowhere near enough $$ to show support, thus i will continue to use the 134 support of my dad (he is the one that will fill out the 134)

another question, does she need to fill out a 134? i was reading
http://www.visajourn...e...&cty=Madrid
and it seems like the person that wrote it did.... as it talks about "copy of a letter I sent to the company who administer my income, directing them to send the money to my new bank in the US" does Maria need to submit a 134 as well?

US Embassy and Consulate DiscussionI 134 questions, one for me, one for co-sponsor?
We have been waiting a long time and still have not received our NOA2, but i want to be ready when we do get it. I have filled out the I 134 but i dont make quite enough money on the books right now, and do not have enough tax records to be able to do it with out a co-sponsor. My folks are willing to do it, they have money in the bank i think, a business, and a LOT of money in their land (~400acres) so it should not be a problem for them. They had just asked me if they get "added on" to my I134 or if they submit their own. If they do their own, how should they list their relationship to her? future daughter in law? family friend? what evidence will they need to submit in regards to their property assets? it is all paid for, so their is no mortgage documentation to submit. their financial assets? do stocks count? how do they show proof?
sorry for all the questions, i just want to be prepared for when these documents need to be sent off to the embassy in Madrid. We have been waiting so long, i would like to have everything ready so it can go as quickly as possible after we get the NOA2
thanks!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsJust got our RFE... the are requesting:
Well we were expecting them to request some signed 325's and letters of intent but they did not ask for these. Here is what they requested:

Apparently our 'passport style photos' were not correct so I am going to to to rite-aid or somewhere today to get some more passport photos and she is going to do the same.

I sent in some pages from the divorce papers i had from my past marriage, but apparently they were not what they are looking for. I am going to call the court and request 'a final (absolute) divorce degree' as all the papers from my divorce are back in NH and i am currently in FL so i will just request that these documents are faxed/mailed down here.

I sent in a copy of my birth certficate from the hospital where i was born, but that is not a civil document. I need one from a civil authority that shows birth in the US. It also lists i can use my passport, since i will not get it back can i just photocopy it? Do i need to photocopy all the pages in in, even if they are blank? Also they say i can submit a statement executed by a US consular officer certifying that i am a US citizen and the holder of a US passport, where do i find a consular officer?

Another curious observation i made today.... i was reading through some information on here and learned about when your file is 'touched' it could mean it has just been moved from one place to another, or it could mean that it has been processed, anyway, our case has not been 'touched' since Jan 14..... every time i log on to their website to check our case it always has looked the same. Ever since Jan 14, is this normal? shouldn't it have at least moved from one sort of bulk storage to a different closer to being processed location as it gets nearer to being processed? According to the time line on this site we should have heard something between April 24 and may 14....and here it is the 19th and we still have not heard anything and the case status still looks the same on the USCIS site...any info would be a great help!!

Did you contact a site admin or moderator? There's no guarantee they are reading these threads, and only someone with administrative access will be able to unblock her IP.

She could also try to use a proxy server, but there's a good chance most proxies are already being blocked since spammers use them a lot.

Maria is going to send me the forms she signed along with a copy of her birth cert. and a copy of her passport and a 'letter of intent'..... so if the USCIS requires them I will have them here with me and i can just send them along to the VSC.

Her birth cerificate and passport will not be required by USCIS. They will be required at the embassy or consulate in the foreign country. She doesn't need to send these to you.

The letters of intent are specifically requested in the I-129F instructions:

Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent;

You should have sent these with the original petition, usually one letter for each of you. Your signatures should be notarized, and you should send the originals of each document. In most cases you have to repeat this, and provide two new letters at the consulate stage to prove that you both still intend to wed.

do they have to be notarized? i can have her send a letter of intent tomorrow but does she need to find a way to have it notarized?

well we are starting to get worried, i did not know about that this type of forum existed so when i completed the forums (the I129F and the 325) I had her sign them, scan them, then email them to me so i could print them to submit with the application.... she found this video http://www.youtube.c...feature=related and it has us worried that we did not do this correctly. Sorry. I don't have time to watch the video right now.

A lot of documents submitted with the I-129F can be copies, though originals will be needed for many of them at the consulate stage. However, ANY document that either you or her have to sign MUST BE the original. Scans of the G-325A can't be submitted.

Is it too late to get the original from her and revise your petition?

no, i could have her send them over today...should she just send them directly to the USCIS office in VT? I think i may call them to find out

Check out the Immigration Timelines link at the top of the page. The stats are based on the info submitted by VJ members (which is why it's important for people to fill in their timelines). Looks like Vermont is averaging about 4.5 months between NOA1 and NOA2, but you can see on Igor's List that some are taking quite a bit longer.

USCIS is quoting 6 months on K1's right now:

https://egov.uscis.g...e=serviceCenter

When you hit the 6 month mark, if you still don't have any info then call them at 1-800-375-5283 and find out what's going on.

Thanks for the quick replys!! Also have a question, she is the one that actually found this site yet she cannot sign on!?!?! is there a reason for this? I am excited that this cover letter is not required! I was just going by the info i saw on the form and the USCIS site

I imagine there's a whole host of possibilities there. What O/S is she using? Which web browser? Does she have cookies enabled? Was she successfully able to create a user account? What precisely happens when she tries to logon?

She is running windows vista, and she can log on to lots of other forums so i doubt it is a cookie issue, she can view a lot of areas of the site, like the photos i just uploaded, but when she tries to log on or sign up, it just says "Sorry, you are not permitted to use this board"..... im not sure what the problem is.... thanks for all the help!

K-1 Fiance(e) Visa Process & ProceduresIntroduction + Questions
Excuse me if I should have searched but this is all pretty new to me. I met my wonderful fiance last summer, went to visit her last nov/dec over in Madrid. We got engaged, I returned to NH and filed the I 129f, I had forgot to sign some forms (DOH!!) despite going over the form sooo many times to make sure I had everything. They received it Dec 27 08, sent it back to me to sign the forms i forgot, i sent it back to them, then i got a letter from them where they had listed her last name twice (as her first name as well) so i called and had that squared away and that was on Jan 14th 09. I have signed up on the USCIS website and have been checking it very regularly but nothing has happened since that up dated date.....
I have been looking around on here (just found this site yesterday, wish i had found it a long time ago) and a few questions have come up, I did not submit any sort of cover letter, i did not see anything on the application about it, i also did not submit a photocopy of my passport with the stamp of my trip to Madrid, i did submit a photocopy of my ticket stub that they tear off when you get on the plane and a number of photos of us together in Madrid.
This processing time is starting to drive me crazy, i went and visited her a few weeks ago again in Madrid which was great but i was difficult to leave her and come back with out her. She does not have a job over there right now (she stopped because at the time we did not know how long all of this was going to take) and she cannot come over to visit me as she is from Bulgaria and they do not have a 'visa wavier program'.....
I'm sure i will think of things to update on this later but here is a short introduction to my current situation and a quick "hello" to everyone here, again sorry if there is a FYI here that I just have not found yet....
