Does it go the US embassy/consulate in the fiance's country, or to that country of residence consulate???

It just gives applicants a choice on how to send in their petitions.

Personally, USPS with Delivery Confirmation is just as reliable as Express Mail or Courier services, and cheaper too. I think they are overloaded with petitions either way! The main thing is to get it there...they don't process your application faster or slower regardless of which mailing service you use. :)

on the uscis site it shows one address for usps normal mail, but if u use express mail it has another address. so what one do i use!? obv if i use express mail its quicker to get there but does that mean that office will be overloaded with petitions and it will in the end take longer? anyone have any suggestions or ideas about this.

From what I understand, others have more pages because of details on division of property, children/custody issues or a lot of back and forth before coming to a decision.

Agreed, I would put whatever is on your mom's birth certificate. If you want to include a separate sheet of paper explaining the name change of her birthplace, that would be good too. (or I would put a post-it on her birth certificate to explain it there, to save you a sheet of paper)

There are a bunch of posts on the Philippine regional discussion board (scroll down the Forums list and you will see the link) re: cheap hotels near St. Luke's and the Embassy. May want to do a search on that question.

You can only set the interview after you have received your NVC case number, and the approved petition is sent to the US Embassy Manila. (You may want to contact one of the VJ members named Tahoma to ask about what shortcuts they used to get a proactive jump in the process.) The petitioner or the beneficiary sets the appointment for the Embassy interview. Your medical exam has to be completed before the interview date, ideally 3 weeks before (just to avoid any potential snags in the process, especially if your SO has never been diagnosed with TB before). If s/he has a vaccination record from his/her pediatrician, s/he can present it to the doctors during the medical exam, otherwise the doctors there will tell your SO what vaccinations or booster shots s/he needs based on age and gender, and all of those shots and whatever tests and lab work is already part of the medical fee (which is in US dollars but paid in PHP equivalent).

Just starting our journey but when do you get your physical exam?? Do you wait until they set appointment and how long is that before your interview?? Also, innoculations when can we start those or do they give you a list of which are needed?? One, more qustions please can anyone who has gone through this process in Manila recomend a hotel very close to St Lukes and then one very close to the Embassy?? Thanks so much!!

You should be able to request for a copy at the county office, with a seal. Proof of both divorces should be in your fiancee's hand during her interview...especially if you mentioned both divorces on the I-129F.

In reading the documents requirements that was downloaded from the US Embassy in Manila I noted the following statement:

"PROOF OF TERMINATION OF A PRIOR MARRIAGE. If applicable, official documents (divorce decree, annulment decree or death certificate, etc.) that prove all prior marriages contracted by you and the petitioner have been legally terminated prior to the filing of the petition must be submitted."

My fiancée has never been married, and will provide a CENOMAR. I have been married twice before, and included my most recent divorce decree with my I-129F. I do not have a copy of my divorce decree from my first marriage over thirty years ago. Is this a reason for an RFE? Will copies of both divorce decrees need to be presented for the interview at the embassy or will the most recent one suffice?

Yes, Philippine passport photos are in different dimensions. US passport photos are 2" x 2" Philippine passport photos are defined as:

Colored photos of the applicant taken against a royal blue background & no shadow. Applicant should be in decent attire with collar & sleeves and in dark-colored shirt. Photo must be studio taken & of good quality, and must have been taken within the last six (6) months. Photo size: 4.5 cm x 3.5 cm. Facial image size: About 3cm-tip of head to chin; with 8-10mm head clearance from top edge. Ears and forehead should be visible. Wearing of accessories, colored contact lenses or eyeglasses, with name/name board are not allowed. DFA has the right to reject photos that do not comply with specifications and international standards.

Is the "passport size" photo for the Philippines different from that of the United States???

When I went to get my US photos, they are 2in. by 2in. and have a white background.

So I went and looked at the "passport size" photos of her that my fiance sent me from the Philippines. They are a little smaller, obviously rectangular, and have a blue background. You can see her face perfectly though, and I think her face is probably the right size - there is just less background.

Is this going to be a problem? Do I have to make her treck alllll the way back to the city to take photos that are 2in. by 2in. and on a white background??

First time posting in the forums, long time reader now...

I'm Canadian, my fiance is American. I'm currently visiting him in America.

We filed our I-129F March 15, 2010 and received our NOA2 September 23, 2010. This past week we received a letter from the NVC indicating that they had received the approved I-129F and that the petition would be forwarded to the Montreal Consulate within a week. We have our Montreal Consulate Case Number.

The letter concludes with a paragraph stating "Your spouse will soon receive a packet with instructions from the consular section on how to apply for your K3 visa at that post and what documentation will be required..."

This threw us for a loop. K3??? We're not married. We're applying for a K1 visa in order to get married. Is it normal for them to send us this letter mentioning a K3? Who do we contact to confirm there has been no mistake? The NVC or the Consulate?

I am looking for notary services in Mexico City. My fiancee is preparing to enter the U.S. on a K1 Visa with her minor child. She needs to have a document signed and notarized by her minor child’s estranged father stating that she is permanently relocating the child to the U.S.; Do you know what this type of document is called? Does anyone have experience with this, specifically in Mexico, even better in Mexico City?

My fiancee has called many notary services in Mexico and they are giving her the run-around, some are even saying this will cost upwards of $500!

Since we didn't know which Service Center the packet would go to, the address we put was USCIS, the address of the lockbox, and just put the salutation: Dear Sir/Madam:

Just put the Texas address, that should be fine.

Just like previously, we have problem with the address ... which address do we put on the cover letter? People suggested that we use the Vermont address on the Letters of Intent, so do we put the same address on the Cover letter as well, or do we use the new Texas address?

Ummm...work where? You can return to Canada anytime, but without an AP, you will not be able to re-enter the US...and you can't work in the US without an EAD.

Personally...I think it would be better for you to file AOS after you are married, so you can apply for both EAD and AP concurrently with your AOS. In the event you find a job in the US, you can request for your EAD application to be expedited. Otherwise, with the AP in hand, you know you can go to Canada and return to the US without a problem.

The petitioner's current income must meet $18,212 for a family of 2 (am assuming there are no children involved, just you and your fiancee).

I have been told different things about petitioning my Fiance in the Philippines. I was told in the US I have to make at least 25,000 a year or more to be sure she will be approved and allowed in the US so we can Marry this was told to me by a married couple I know who went through the process 2yrs ago. I wanted to be sure what is the financial amount you need to have to ensure they allow her in. Please give me the information I need so I know what to do. I have not seen any notices that explain the financial parts of the process.

I know someone who does the filing and processing for Petitioning Fiances from the Philippines and he told me I just need to pay all the fees and be currently working and all would be okay and if needed my family can bring their Tax Returns for the past few years to show that they can help support her if needed and that by doing so the Process will go through and I just have to wait 6mths after filing to bring her here and then marry. The married couple said he is wrong and if she is denied they still get paid and I would have to do the process over again. Please help me with these questions.

Please let me know what the answers are cause nothing on the website says anything about this particular part of the Processing

If her middle name appears on her official documents, like her birth certificate or passport, then yes, it must appear appear on her forms.

If it doesn't fit when you type, then skip it and handwrite the information clearly later after you print out the document.

Quick question. My fiance has a really long middle name (Father's name in Russia). In some of the forms, it just does not fit. It leaves out about 2 to 3 letters. What should I do for those? Once printed, add the missing letters nicely by hand, use a typewriter, something else? Also, does she even need to use her middle name? I know in Russia they all have it but do you think it would be a problem if she just leaves it blank?

After you guys get married, the non-USC spouse has to apply for adjustment of status. This is when your non-USC spouse applies for a conditional green card (using the I-485, G-325A, I-864, and I-1693), employment authorization (I-765) and advanced parole (I-131, which allows your spouse to re-enter the U.S. should you decide to go on a trip/vacation outside the U.S. while the green card is still being processed.)

You can work now that you have the EAD card, but your future employer needs your SSN for payroll purposes (mainly processing your tax information). You need your SSN for a number of situations, opening a bank account is one of them. Later when your USC spouse files taxes, he will need your SSN too.

Go on and apply for your SSN.

I'm a little confused. Someone told me that I can get a SSN with my Employment Authorization Card. In fact she told me I had to get an SSN with my Employment Authorization Card. Is this true? Or can I still work with my Employment Authorization Card. I haven't tried looking for work yet because I still go to my job across the border. If anyone knows when I need to get an SSN or if I can get one now, I'd really appreciate the response.

my paystubs of the job i had now for 7 months,.averaging $55000.00 a yr gross

my last years w2 and tax return form,showing i made like $2000.00(its so low because i spent mostly all year in the Philippines with my fiance

i have a letter from my employer stating my full time position and salary

and of course i filled out the I134

i am not using assets(therefore my father will cosponsor)

My father the cosponsor(his check list):

i have a copy of his certificate of naturalization

his w2 and last years tax return showing an income of $75000.00 for 2009

copies of last 6 weeks paystubs

land tax receipts showing land ownership and house assesment value


does anything need to be notarized or am i missing anything? i have the cosponsor because i cant show any
income for 2009 just to be safe.

My daughter was previously treated for primary complex, so we had to report to the local health department for her to be cleared to go to school. They gave me her medical records, but I was not given a copy of mine/

Wow...that's weird. You're applying for K1, so it's the first letter you should focus on. I would suggest you bring both letters to the interview and tell them it was sent to you in error. That should clear it up then and there.

I was wondering if anyone could help clarify something.

In my package for the K1 application (the packet with the checklist) it quoted a fee for the non-immigrant app of $350 or €287. In the next package there was a letter quoting a fee of $404 for an immigrant visa 'or equivalent in local currency'.

Now, as I understand it, I'm applying for a non-immigrant visa not an immigrant visa, so in theory it should be the first amount - but the other letter has thrown me sideways and I've no idea how to find out what I should be doing. My interview's in a week, so it's not as if I could send them a letter asking them to clarify.

Any help would be greatly appreciated.

The US citizen can file an AR-11 Change of Address form online, this must be done within 30 days of moving to the new address.

The non-USC fianc(e) also has to file an AR-11 Change of address form but can only do it by downloading the form, filling it up and mailing it out within 10 days of transferring to the new address.

Later, when the non-USC spouse applies for Adjustment of Status, and you guys move again to a new address:

The US citizen must file an I-865 Change of Address form online, this must be done within 30 days of moving to the new address.

The non-USC spouse must file an AR-11 Change of address form but can only do it by downloading the form, filling it up and mailing it out within 10 days of transferring to the new address.

You must report all changes of address until the non-USC spouse becomes a U.S. citizen, or has worked for 10 years in a US (and made 40 quarters of SS contributions).

Me and my fiancé is thinking of contacting his congressman with regards to our K-1 Visa problem. But he does not know how to do it, or which office to call or email. I know nothing how the congressman's office in Texas work or deal with its constituents. But I have read here that people with immigration problems are advised to contact their congressmen.
Anybody here who knows which office we should bark at? My fiancé resides in Dickinson area.

The expiration of your petition is within 4 months from the time the approval was issued. Within that 4 month period, you must have proceeded to the next step in the process, which is to schedule the Embassy interview and complete the requirements before the interview takes place.

You already did that. They just need that one document to complete the visa process so your visa could be issued. So your petition "expiring" has no impact on that.

If you had waited past the 4 months initially allotted to you to proceed with the interview scheduling, etc., the US Embassy would have automatically extended the life of the petition for another 4 months, and they would have contacted the petitioner to verify that both of you were still interested in pursuing the K1.

Our K1 visa is to be approved as soon as we provide one missing document (Israeli police clearance).
My petition may expire before the missing document will get to the embassy. The visa interview occurred before the petition expiration date.
The question is: Can the visa approval process continue after the petition expiration date?

Follow the instructions for registering a new account. Enter your NOA1 receipt number, set up e-mail or SMS alerts. SMS alerts will only be sent to US mobile numbers.

You will know if your file has been "touched" if the date under the column "Last Updated" has changed.

Please note you will ONLY receive alerts for major milestones in your application, such as: Acceptance (of application), Initial Review, Request for Evidence, Approvals, Card Production, etc. You will NOT receive alerts for touches.

Nothing wrong with sending it in, but you have to understand it will not be returned to you. On many of USCIS forms, they caution applicants from sending original documents when they are not required to...only photocopies are needed when petitions are being processed.

I think the disclaimer your read is telling YOU not to accept the certified copy of the birth certificate without a raised seal from GA, and if you do, it should be returned to GA and re-issued with a seal.

Hey, thanks for the replies. I wouldn't worry too much about writing in the number- if you included the copy of the certificate, whoever reviews the documents will see that it matches up, and it should be fine.

The only reason why I'm going to send in the certified copy (the state of GA still has the original, and just mailed me the certified copy with the raised stamp) is because at the bottom of the certificate are disclaimers like "do not accept copy without raised seal, etc. etc.". I have another certified copy that I'll keep with me. Is there something wrong with mailing in the official certified copy, or is it just unnecessary? Thanks!!

I am planning on doing everything my self (using all the forums, example forms, and other online outlets) but a friend suggested that I get a lawyer because the reviewers are looking for mistakes and such and a lawyer would be able to make sure there aren't any. I personally think that I would be able to take care of this my self but now I am a little scared. What do you think?

Your educational attainment would not be an issue, nor the choice of where you guys will reside when you arrive in the U.S.

Later on your DS-156 (visa application form), you will be asked for the address where you and your fiance will reside when you move to the U.S., just put down his dad's or aunt's address - no problem.

Just make sure that when you move to your new address, you and your fiance report it to USCIS.

You may want to do a search in the Philippine discussion board about specific requirements for CRBA at the US Embassy Manila.

Btw. Will they mind if I wasn't able to finish College here? They might be worried if I don't get a job? I don't know what I'm supposed to say. Honestly I don't care, whatever job I can get is fine (as long as it's legal) I just want to get my visa and be with Anton.

And would they be okay if we plan to live with my fiance(e)'s dad/aunt first until we can get our own place?
