ChinaConsulate Interview: Ex-spouses??
unsure.gif I have heard stories about the consulate officers asking detailed ex-spouse information such as name, age, addresses, work status and etc. Does anyone know if that question is more directed to the beneficiary or Me, the Petitioner?

My situation is that my ex has run away and flew back to China before I filed for divorce. I have not contacted her since 2003/2004.

You should be close to getting your P-2 any day now. After that it will start to move along.

Expect P-3 3 to 8 weeks after leaving NVC
Expect P-4 3 to 8 weeks after returning P-3 and received by GUZ

This may be a stupid question but I gotta ask...

We all know that the CSC takes its sweet time to issue NOA2s. But it also appears that cases involving Chinese beneficiaries are even slower (than Europeans, Japan, Philippines and etc.). Is this just my imagination?

I am also having troubles locating my I-129F after approval. I have been calling the NVC without any results and different USCIS agent had different answers. Today, a very nice USCIS agent told me that sometime a case would be forwarded directly to the consulate or the embassy. I don't think she is correct on that info because cases can't by-pass the NVC altogether (by process and law). But if the K-1 don't get put on the system then it may "appear" as by-passing the NVC. I think that's an acceptable explaination.

Finally, my questions: 1) Would a live NVC agent be able to tell me if my case has been processed? 2) I have heard that the NVC may or may not issue a notice to the applicant about case being forwarded to the consulate/embassy. If that happens then how can I find out my GUZ #?

First, the K1 process is a journey for both parties involved. Therefore, both parties should take time to understand what's involved and what it takes. I want to warn you that the interview can be very cruel and grilling. The US petitioner is not allowed to attend and she will be there all by herself. If she doesn't know what the VO is looking for then she will more than likely to fail. Information is her only friend during that 2 min interview.

My question is that if NVC has processed our cases (fingers crossed) then the NVC should have a record of my case. So far, all I heard from the NVC was "We have no record of your case. Either you have entered a wrong case number or we have not received your case yet."

So my conculsion is that the NVC has not received my case. I hope I am wrong ( headbonk.gif whistling.gif), of course.

"You should receive a letter..." "Should" is the key word. First, K1 applications don't get updated on the automated system so you must have to speak with a live rep. to find out if your case has been received. Tomorrow will be the last work day of this week. My case still has not been processed. I suddenly had a theory: Our cases have been forwarded to the NVC but the NVC hasn't entered them into the system. Only this hypothesis can explain why some June cases have already been forwarded to consulate/embassy.

That's good to hear milkyway. Maybe they have your case already at NVC just that they're not giving out exact detail since they're still going to assign a case number for that.

This morning we called up NVC since the representative called us that the USCIS sent our case to NVC before 4th of July. The operator said that they haven't got our case yet but she didn't mention about 2-4weeks or 60-90 days but instead she said "KEEP ON CALLING".

UPDATE: Last July 2 we called up the director's number. We got a representative who will be the one to look at our case. She said that she would call us back the following day which is July 3. Unfortunately, we didn't get any call on that day. The next day it's 4th of July - Holiday followed by weekends, so really have to wait for Monday. Finally, Monday arrived and WE GOT A CALL FROM THE REPRESENTATIVE. She said that she received an email on the same day,Monday, from the supervisor at USCIS that they sent our case to NVC before 4ht of July. I presume that if they sent out case it's not one-by-one,so I hope your cases are also there too. Goodluck to all of us. Hope we get our case numbers very very very soon.

Update: I called USCIS this morning and of course, the rep gave me the cookie-cutter answer, which is also the political correct way of saying that she had absolutely no idea what is been going on. The rep. first said the processing could take 120 days. I then promptly told her that the approval notice basically said "if the NVC has not received the case after four weeks of receiving the NOA, please contact the USCIS." She replied that could also take up to five weeks. I asked her if she could check and find out where is my case and she replied no and asked me to call back after July 20th. I was not happy with the answer and asked her what she could do for me differently after July 20th and she refused to answer to that.

Guess I will keep bugging them daily until something or someone moves! *sigh*

I have been calling the NVC almost daily but they do not have any records of our case. However, a friend of mine whose I-129F was approved on the same date by the same center already got the NOA2.5, which is a letter indicating the case has been forwarded to GUZ consulate! ARGH!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

The speaking ability becomes a major issue if the petitioner does not speak or only speaks a little Chinese and the beneficiary does not speak or only speaks a little English. This will be seen as fraud attempt. However, if you both were Chinese and able to communicate fluent in Chinese then the speaking ability may not become an issue at all. For example, showing letters and instant messenger logs that were completely in Chinese is a "hint" that you two were communicating in Chinese. Just my two cents.

I used a two-hole puncher and a Prong fastener to assemble the package (see the picture of our I-129 package (copy)). As of the original I sent to the USCIS, I put the G-325A pictures and other personal photos ( as a proof of an ongoing relationship) in a sandwich bag and attached it to the front of this package.
