Hey everyone, I sent out our I-129f on April 10th and recieved the receipt number from CSC on April 15th. Today (April 17th), our case has been assigned an alien registration number. Is this a good thing?



It means that your application was received and put into the system for processing. It is a good thing but that is all it means.

Be safe and send copies of all pages, even if they are blank.

The reason it is advisable that you start AOS as soon as possible is because that is the entire purpose of the process. The K-1 is only 1/2 of the way, whereas AOS is the other 1/2 , at this point. The sooner you get it started the sooner your wife will have her greencard, SSN, DL and all other documents she will need to live in the US. There is no legal reason for you to rush, but do it as soon as you can and get it over with.

Sorry I don't know the bumping rules in this forum, but I would really appreciate a comment on our case. I know sometimes it comes down to a matter of personal opinion but I'm positive someone here can quickly assess it, moreover I'm sure a lot of people here have experience with (co)sponsoring and can answer the following question:

Are savings (retirement) considered assets and therefore need to be 5 times the poverty guidelines amount? The relevant line in the I-134 item 7 is "I have on deposit in savings banks in the United States".

In the meantime I'll be preparing the co-sponsorship just in case.

Hello VJ Fam. I have a question regarding #31 on the DS-156 Form

 

In 2008, My fiance applied for the Q-1 visa (International Cultural Exchange) through his University. However he was denied the visa, and he is not sure of the reason as to why he was denied. Also, he mentioned that it was a J-1 Visa (Exchage Visitor) but according to what he told about his reason to travel to the US matched more with a Q-1 Visa. Now I am concerned that on the day of the interview, he will be asked what type of Visa he applied for, and him not having any knowledge as to what type of visa it was. Now I asked him, to go to his University and ask about this visa program that they offered the student at that time. (I am also sure that is not a student visa) Unfortunately he has no record of the application submitted or anything of that nature.

 

What can I do? I am stuck with this question sad.png

I see that some people submit a DS-157 form, however I do not see in his packet anything that has to do with this form, should I submit one anyway since I have seen on this forum that some members have taken it to their interview? Will the IO ask for one?

Tell him to be as honest and truthful if he should be asked about the denial.  Even if he cannot recall the type of visa he will certainly be able to discuss the circumstances under which he applied.  The consulate has the denial on record, so all he has to do is answer any questions they  may have.  It is really not a big deal.

Hi everyone,

I'm look for people's opinion/experience with contacting their congressman for help.  We are currently 196 days or 6 mo and 14 days, which is clearly past the stated 5 months goal, however, USCIS does not think so.  I have already drafted the letter to send to my KY congressman (Rand Paul).  My fiancee is worried that asking for congressman help may actually make things worse.  Does contacting your congressman really helps?  Or are we better off to just patiently wait for NOA2?  I really feel helpless here, I want to do something to help our case, but there is just not much you can do.  BTW any one contacted Rand Paul office before?  are they helpful? outcome?

Asking for help from your congressperson will not hinder the application process.  Remember you pay his salary to represent you, therefore there is no reason not to contact him and ask for help.

I am not booking any flights this early in the stages, however i have been tracking flights for September-November just to keep sight on ticket prices. I am wondering if there is a "prefered" port of entry or possibly one is better then another? I have been looking into flights from my fiancees country into Chicago O'Hare. Anyone experience this port of entry? One can assume any where you first enter the US would be no different then the rest but you know what happens with assumptions.. lol... so any advice or experiences would be helpful when making our travel plans after we recieve the visa. Also, does it help at port of entry if the USC accompanies the visa holder, or is there no difference? Thank you for your insight and shared experiences in advance...

 

It does not matter which POE she comes through.  The processing will be the same.  Book whatever airfare is more convenient to both of you.

I'm the USC and i prepared the DS156 form for my fiancee from the Philippines.

 

She noticed an error in box 40,  i had dated it MM/DD/YYYY instead of DD/MM/YYYY.  Box 40 is not included in the barcode information,  it's handwritten after printing out,  and the date was 4/30/2013,  which is clearly an April date so there's no confusion as there would be if it was 4/11/2013

 

Should we redo the DS156?  It seems like such a small error, it's obvious what was meant and it's not part of the barcode.

I file my taxes electronically each year on TurboTax.  Can I print off a copy of my return from there to provide with my I-134?  Is that acceptable and do I need to have them notarized?

Yes, a printout of your 1040 and its supporting schedules and documentation is acceptable.  These documents do not need to be notarized.
 

If you have the time, go to www.irs.gov and get your tax transcripts.  They are free and preferred by the USCIS.

I called the NVC and they just recieved my case and gave me a new case number! She is in the Rio embassy in brazil. I guess we have to fill out all the forms and present them the day of the interview correct? At this point about how long does it take to the actuall interview? Do they email or mail us when to go to the medical and interview date. When do we figure that out? And all these forms we are filling out They take them at the interview? Thanks!

 

At this point, they may send you a RFE if they need more information or documentation from you.  If all is OK with the paperwork you submitted, the consulate in Rio will contact her with instructions as to which documents, exams, etc she needs to prepare. They will also set an interview date when she will have to appear before the CO.

 

All the forms you submitted will be retained by the USCIS.  The same is true for almost all of the documents they will ask of her, so tell her to take certified copies of birth certificates, etc and any other document she needs.

 

For the moment, just relax.

It says two hole punching at the top of the documents is "appreciated". Did you all do this? I feel weird putting holes in these very important documents?!


Two holes on top, three on the side or clip - or clasp - at the corner will not render the documents more or less valid, so long as they do not compromise the integrity of the information contained in the document. It is your call really.

General Tips on Assembling Applications for Mailing

I am filing the I-129F for my fiancees K1 Visa. I got to question 11, which is "Have you ever filed for this or any other alien fiancee or husband/wife before. If Yes give name of all aliens, place and date of filing. A# and result.  I have had a previous wife that I filed for 15 years ago on a K1 and was approved. I do not know the exact date of filing and do not have an A#. I called the help line as USCIS and they informed me that I could not get this through the hot line. The lady on the phone told me that I could give my best estimate but am worried this might complicate the process if not exact. Anyone had this issue before? Any advice?

Hey gang,  I am in the middle of helping my cousin in NY sponsor his fiancé since I can read and speak better English than he does.  I don't think shelling out $2,000 for K1 application is necessary (I hope).

 

He just returned from meeting his fiancé (they got engaged).  He has not filed taxes for 2011 and 2012.  Despite the legal ramifications, he could have hurt his sponsorship application if left ignored.

 

However, what concerns me is that he is a self employed painter and will not be able to provide check pay stubs.  In 2011 he made between $5K and $6K (took care of mother full time after being diagnosed with cancer).  In 2012 he made just over $30K. 

 

If he files his taxes now for 2011 and 2012 will it raise red flags since it's so close to the date he will initiate K1 visa application/sponsorship?

 

Will providing 2012 tax return and recent bank statements usually suffice?

 

 

 

On the contrary.  He should file his taxes all the more because he will be in a position he will have to sign an affidavit of support for his fiancee, so he better be current with his finances.

 

Since he does not get a pay stub he can - and should - present his tax returns as supporting evidence along with the I-134.

 

It may be obvious that he chose to do so because of the K-1 but that will not count against him, nor will it hinder his application.

I'm in my 5th month of waiting and I'm hoping that I get some sort of response soon regarding my K1- I129F Visa. I was wondering, how far ahead of time can I take the Medical? I don't want to leave it till last minute in case anything goes wrong, but at the same time I'm not sure if the medical expires so I don't want to take it too far ahead of time! 

 

Also, can any doctor do this exam or am I going to have to travel for that too? Are there specifics I have to take with me when I go see the doctor? If anyone can give me a rundown or direct me to a page or website that has all the listed requirements and doctors that would be awesome!

Your medical is valid for 6 months which is also the validity of your visa.  If you jump the gun on the medical you may need to go through it all over again or be issued a visa with a very short shelf life.  You would be wise to wait.

Hey guys, not sure what happned when I came at JFK but the officer who processed me did not give me an I-94 or finger print me a second time like I have read people did before.... does any one know why? Is this becasue of the automation of the I-94 form thing? He also spoke with other officers about it and seemed confused so I am not sure what is going on.... Can I still file the AOS using the passport stamp alone?

 

Paper I-94 are going the way of the Do Do bird, and being replaced by an electronic version.

If providing ?Proof of ongoing relationship? with the I-129F packet, does this need to focus on the time following when the 2 of us met within the past 2 years, or can it be focused more on the past? We have been in a committed relationship for the past 7 years and spent a great deal of time together during this. I have much more ducumentation available for the past 7 years than I do for the past 6 months (we were together in Thailand during the past 6-9 months). Would it be helpful to show proof of our long term relationship preceding the most recent visit within the past 2 years?

 

If you are in the filing stages, your more immediate need is to prove you have met in person at least once in the past two years, even if you have known each other longer than that.  If you have met more than once in the last two years, that would help too.

 

If you are speaking in terms of the upcoming interview or possible RFE then you should gather all the evidence you have - letters, cards, visas, phone records, the works.  Have it all ready in case you are asked to produce it.

You are not required to provide proof of employment in connection with the I-134, if that is what you are talking about.  All you need do is submit your tax returns (transcripts are preferred by the USCIS) along with the form.  If you have a statement supporting your claim to employment and condition it always helps.

I would file now.  It'll be a long time- 6+ months- before the file gets to Brazil and by that time hopefully they'll have whatever guidance they are looking for.

File now, do an address change once you move.

In addition the process needs to be initiated with the USCIS.  It might be a while until the consulates receive instructions on how to accept/handle DCF.  Even now, not all consulates do.

 

File with the USCIS stateside and take it from there.

She worked in the USA the past two years and I guess she never payed her 2012 taxes, do they cross reference the alien fiance with the IRS? I mean she didn't make very much money so I don't think she owes much but do you think it will still throw a red flag somewhere?

 

 

 

She can still file for 2012.  If she Googles 'filing taxes for previous years' she will find several websites where she can file her taxes and get the house in order for her K-1.

My suggestion is that you explicitly tell the priest at your church that you want a blessing ceremony.  Explain to him/her the legal implications and why you can't get married.  There is nothing wrong, immigration-wise,  with a blessing ceremony or something of the kind.  Keep it small and simple.  Remember you can go back at any time after your get your greencard in the US, and have a white wedding with all the bells and whistles.

IMHO the first thing you need do is find out if you need a waiver.  You must have been given a reason for the denial of your F-1 renewal and/or for the cancellation of your B-1.

You should keep both envelopes undisturbed and you will need to surrender them to the officer upon arrival at the border.   If you tamper with the sealed envelope you may have to go back to the consulate to have it resealed.

Yes, it is correct. We planned to get married in Ukraine in March (I wanted December originally, but it is kinda cold). I was in "busy season" in Florida where I work so I wanted to gain some more money before I returned. So, why not return in April on her birthday, which I did. I needed photos from her within 30 days of filing according to the I-129 petition and I do not trust Ukraine mail system. So, once I returned, I was debating about getting a lawyer or just doing the forms myself. If I had a lawyer, it would cost a lot and most people said just do it yourself because it is only paperwork. I did fine on the USCIS side. She said she will wait 6 months and let's try so we did. I filled out the petition on May12th, but it was the weekend, so it arrived in Dallas on May 15th - right on time from the day we took the photos in Nikolaev, Ukraine. 

 

If you have plans to return to the Ukraine anytime soon, you could still get married there and apply for a CR1 visa.   It will be more money into the USCIS pit but you may get a different result.

 

It is still an option.

 

After reading your additional posts, I am inclined to believe the denial was not related to your aesthetics, but I would not discard the possibility the interviewing office may have tried to rile up your fiancee with an off-the-cuff comment.

 

IMHO the most likely scenario here is that the consulate was not satisfied with the quantity or quality of the material you submitted as proof of your relationship.  along with other former SSRs, the Ukraine has a higher incidence of marriages for immigration purposes only; so they tend to be extra diligent in their scrutiny.

 

Get more facts, wait until she receives a letter from the consulate with the reasons for her denial and plot your next steps.

I was hoping someone would have an answer to my question. It is really important for me for my fiance to meet my family before we get married. We would like to get married here and then live in Rio. Does us getting married here tie him down to this country? Do we HAVE TO fill out the paper work for the green card soon after or can we worry about that when we decide to come back and live here? Can I process that paper work from abroad? Due to other personal reasons my fiance can not leave Rio for too long and I really want to go back and live out there as well.

My sister did just that.  They wanted to get married in Brazil but it was so complicated that her then-fiance flew up to the US.  They got married here, he left after a couple of days and applied for her Brazilian 'green card'.    Her visa took about 6 months to process.     They never returned to live here though.  In your case, if/when you're ready to move to the states you need to file a petition - I-130 - for an immigrant visa to be issued for your husband.   You can do the paperwork in Brazil, provided they still have DFC at the time.

K-1 Fiance(e) Visa Process & Procedures30-60-90 days rule - Good or bad idea?

Thanks for your inputs! I wouldn't do anything illegal as the risks are too high! I was just wondering what was this 30-60-90 days rule because I red a lot about it and was wondering if people really do it... 

 

So how about the Fiancé Visa? I was also reading about it ans was told it would take 6-9 months to receive it if everything is ok. IS that correct?

I have a few questions because everything is confusing at the beginning, so sorry if you read the same questions over and over again :

 

- How do you start the K1 visa process? By sending the I-129F form right? Which other documents need to be sent with this form? The documents have to be sent to Dallas, TX right?

 

- The I-134 Affidavit of support also needs to be sent with the I-129F Form?

 

- I have 2 different passport. One with a tourist visa for the USA (still valid 10 years I think) in it because last years I was travelling in the US and an other one without any visas. Which one do I need to use for the Fiancé Visa request? 

 

- During the visa process, I think I would still be able to go to the USA visit my fiancé right? What do you say at the immigration when you arrive at the airport? Do you mention the Fiancé Visa in process or you don't say anything? I assume they see that you have such a visa in process right? What is the right thing to tell them in order to enter the country without them thinking that you are going to stay there?

I commend you on your interest in doing things the right way.  There are many stories of success of many who managed to defraud the USCIS but there are also some horror stories of deportation, delays and endless interviews.  To each his own, but I can't figure why some choose to come in through the back door when they could just as well arrive here, come in through the front door in a respectful and dignified manner.  I have more respect for those who enter the country undocumented by want of better means than those who choose to commit fraud when possessing every valid reason to get in with a visa.

You start the K-1 by having the US citizen file a I-129F and send in the required documentation - take a look at the links for the updated info.

 

For the K-1 visa you can use either of your passports, so long as they are valid.  It makes no difference.  You can visit the US while your case is being processed. There will be a record of your case with the USCIS and the CBP officer may ask you about it.  The best strategy is honesty - declare the motive for your trip truthfully and if the questioning gets rough you can always remind the officer that you do have a fiance visa process underway, and it would be unnecessary and illegal for you to enter the US to circumvent that.  It will show the office that you understand how the law works.  I have a friend who was questioned upon entering the country to visit her fiancee while her K-1 was underway and she did just that.  She even offered to sign an affidavit right there and then stating she had no plans to stay.  She got her 90-days allowed by the VWP.  Remember it is always all about your attitude.

There is no such rule.  Anyone coming in with a tourist visa with the intention to get married and AOS is committing immigration fraud, no matter if they wait 30, 60, 90 or 900 days.

 

The K-1 visa exists to prevent that.

 

However, there is nothing wrong in getting married, so long as the foreigner returns to the home country and does the CR/IR process, at the end of which one can return to the US with a greencard on hand.

hi all! in what port of entry my fiance can fetch me if i have lay over flight would that be in the fist airport or in the second one?

You will clear customs and immigration on the first airport on American soil you will touch. That is the definition of POE.  If your fiance wants to accompany you on the remainder of the flight, he can meet you there, although he will not be allowed to accompany you to immigration.
