Hi everyone,

 

I received a notice that a request for initial evidence was mailed to me on August 2nd.

 

I'm almost certain it is regarding the 'Letter of Intent to Marry'.  I say this because even though me and my fiance wrote the specific date we want to marry, in September, how we met, future plans, ect..  We did not write the specific statement, "I intend to marry my fiance within 90 days of her arrival in the U.S."

 

With that being said we're already preparing new letters to send out as soon as I receive the NOA in the mail either on Monday or Tuesday of this coming week.

 

My question is this:  Do the letters have to be the original copies?  Or can my fiance sign and date her letter and fax it to me?

 

If she is able to fax the letter it will save lots of time as the delivery date on international mail can vary.

 

I think it may be ok for her to fax it, because if USCIS really wanted to ensure that the signature was real they would require the letter to be notarized.

 

Anyone have any thoughts on the matter?

I'm getting ready to respond to my RFE and I have a question regarding making highlights on copied documents, such as credit card statements and copies of passports.  Are we allowed to highlight with a highlighter specific areas or passport stamps so that the case officer will be able to easily locate the information?  Or should I just not make any marks and send it on its way?

You are best off contacting the local Consulate or USCIS.  Like most topics on here, no one has any concrete proof saying X can happen or Y can happen.  If you have a serious question that goes beyond a simple "what do I put on line 4 on the i-134 form" you should try and get your answers from immigration services or immigration law professional.

Correct, plus from everything I've read they do not test for drugs.  They will ask you about it on a questionnaire and perhaps verbally when going over the questionnaire that you fill out.  The only time they will test for drugs is if they suspect you are a user.

 

It's a catch 22 situation, you're screwed for at least a year if you answer yes and if you lie and they somehow find out about it then you're screwed.

 

To give you an example, a case I read on another site was someone in their 50s who admitted to smoking marijuana 30-40 years ago when he was a teenager and he was denied.

Admitting to any drug use will almost 100% of the time result in a denial of the visa.  You'll then be required to do some sort of rehab like program, proving that you are clean.  I've read that this program can add anywhere from 1 to 2 years onto the process.  After the program you could reapply.

 

This is just one of the many many things I've read doing my research.  Could be different in some degree depending on the country, like everything else.

I agree with others.  You don't really know why your case is undergoing AP.  If your evidence is strong then it probably has to do with something other than proving a bona fide relationship.  There may be a delay due to security clearance or background check of the beneficiary.  If you cancel the petition, get married and apply for a CR-1 visa, whatever the issue is may resurface.  I know it's difficult, but I think the best thing right now is to just be patient.

This was not a concern of mine at all, and I really don't think you need to worry that much about it. It's the US government- they already have your social security information and if you ever file your taxes and owe money (and submit a check) or get $ back via a direct deposit, they already have your bank information. I guess do whatever makes you feel comfortable.

 

That being said, I never submitted anything with personal account info. For the I-129f, you don't need to submit an affidavit of support, so you don't neeed to send in any financial documents at this time.  The call logs I submitted did not have my account information on them (I only sent in records of call histories, not the bill itself.)

 

For the interview, you will need to submit an affidavit of support.  However, again, none of my documents had my account information.  I requested a tax transcript from the IRS, a letter from the bank with the amounts in each of my accounts, pay stubs and also a letter from my employer.

My fiancé entered through JFK 2 weeks ago it took him about 30mins to get through customs and get his luggage which is excellent time. They won't care who is coming to pick you up but make sure you have a number for the person who is coming to get you. JFK is a very large airport not like sangster or Norman Manley. What I did was I told my fiancé after he gets his luggage do not go outside (it's very cold now in New York) and find a landmark in the terminal where we can meet (like an au Bon pain or dunkin donuts). Once he is at his location borrow someone's phone and call me and tell me where he is located.

I know this is longer than you asked but trust me I am jamaican and I live in New York and deh ah airport all the time and JFK no easy at all. You can get lost easily there so make sure u have the number of the person coming to get you. Good luck! Welcome to New York and dress warm cuz it cold bad!

The reason I am asking here after looking through tons of information already on the forums is, well, because I'm still unclear how this works. I'm sure you'll all appreciate how confusing this whole process can be, and how much conflicting information there is.

 

For instance, a lot of posts seem to suggest that proof of domicile is not required for the K-1 and is only an issue for IR-1/CR-1. An equal number of posts say that it is a requirement. I'm trying to get a definitive answer on what is required of us, and at what point we need to show it.

Hi, we are in a similar situation as we're both living and working in Oz - basically from what I've read on this site is that the Consulates in NZ and Australia are pretty understanding.

 

If your USC fiance has a US driver's license that is still valid, plus some sort of US address to use as an initial base (a relative or a good friend), that is helpful.

 

Ideally your USC fiance would have some sort of job offer, otherwise the self-employed typically show 3 last tax returns.  Alternately if he has enough assets, that also can work.

 

In our situation, I still have an AZ driver's license and am using my nephew's address in AZ (with his permission, haha), plus I still have bank accounts in the US that go to his address.  Anything like that helps as well.

He still has a US bank account which we plan to transfer money into ahead of the move back. His mail is redirected from his old apartment in New York to his parents' place in Washington (which is also what we used as the address on the I-129F). He doesn't drive, being a north Brooklyite, but has a valid New York State ID, as well as all his furniture in storage in Brooklyn (for which the bills are being sent to the Washington address).

 

Unfortunately he hasn't been able to work here yet so we are fast running out of money, which means he's unlikely to be able to travel back to the States to reestablish himself before my interview. Given that we likely won't be heading back until 3 or so months after the interview, I'm sure his chances at having a job lined up already are slim.

Hi all

 

First of all thanks for collectively being such a great resource. With great thanks to the people here, we've filed our I-129F and received NOA1.

 

I'm just looking for clarification on domicile requirements now. We'll be using a co-sponsor as my American fiance is living with me in New Zealand temporarily (he arrived a month ago) until we return to the US.

 

We made a decision ages ago that we couldn't wait in uncertainty any more for a ruling on DOMA, and that he would make arrangements to come to New Zealand - on a temporary basis if there was a ruling in our favour, or more permanently if there wasn't.

 

He has given up his apartment and full time job in the US (he is also a self employed writer), but has kept all of his furniture in a storage unit in New York. Our intention, should everything go to plan, is to travel to the States in late February to coincide with his best friend's wedding - they're going on honeymoon so their house will be empty for a month, giving us a place to stay while we get ourselves sorted again.

 

Any suggestions on what we can do to prove domicile would be really helpful.

I assume by "spontaneously" marrying you mean entering the USA on the VWP in order to marry and file for adjustment of status. This is also known as immigration fraud, and you won't find anyone here condoning or recommending this.

Services at the airport open, does that airport (city, state) have to be my address? Or can her destination be any US State??

Yes, you'll also need to file your own I-134. The USC petitioner remains the primary sponsor, regardless of whether or not they meet the requirements. For whichever boxes don't apply (i.e. if you have no US income, or assets) you can just put a zero.

If you file for her permanent residency along with advance parole in early July, the earliest she'd even be able to leave the US without abandoning the application would be when advance parole is granted 60-90 days later (September/October).

 

Beyond that, one of the requirements of permanent residency is right there in the very name. You need to be residing in the US on a permanent basis.

As an Australian citizen you can travel on the VWP to the US and get married (on tv atleast, don't sign any documents). You can then return to Australia and finish your K-1. After you arrive in the US, just go the county clerks office and have it officiated in a quick ceremony. Then file AOS.

 

According to the OP's timeline they already have the K-1 approved, so can't enter the US on the VWP unfortunately.

Once you enter the US to marry during the 90 days, you can not work, until you receive AOS, social security(I might be a little off on all that's needed).  You can not leave the US for 2 years, but you can file for early parole and after that is approved you may leave and return. 

 

Pretty much none of this is true. Here is the correct information:

 

Social Security

 

You can apply for a Social Security Number (SSN) with your I-94 after entering with a K-1 visa and before filing AOS. This is best done 2 weeks after your arrival, to ensure your arrival information is correct in the SAVE database. You can apply for an SSN up until 2 weeks before your I-94 expires. When issued before you have your green card, your Social Security Card will have the condition "valid for work only with DHS authorization" which means that the card itself is not proof of employment authorization.

 

EAD

 

The Employment Authorization Document (EAD) allows you to work after you have filed for AOS and before you have received your green card. It is usually applied for at the same time as AOS. The processing time is generally 60-90 days.

 

Advanced Parole

 

Advanced Parole (AP) is usually applied for at the same time as AOS and EAD, and comes as a condition noted on your EAD card and for this reason is also generally processed in 60-90 days. AP is used to reenter the United States into a further period of authorized stay if you leave the United States while your AOS is pending. Without first being granted AP, leaving the United States before your AOS is approved will result in your green card application being abandoned.

 

Travel

 

You can safely leave and reenter the United States if you possess a valid AP or a green card. There is nothing preventing you from traveling for 2 years. Nothing at all.

We have applied in april, 7 months in advance. The average is 5. We are not looking to jump ahead. Im just apprehensive on the timing. Its a little too close for comfort

I dont really think its grounds for an expidite but ive read of other people getting things expidited for less(loss of a weeks wages)so i feel entitled to ask the question about our situation(loss of $30,000) Im not expecting the answer i want but hey thats life and im fine with that. 5 months is the stated processing time for the I-129F petition only. There is a lot more to be done following that before you will have your visa in hand. Remember, you are always at the whim of whichever department currently has your file - one step moving faster than average doesn't do anything to prevent you being held up somewhere further down the line.

 

After your I-129F approval, your case goes to the NVC for processing where it can sit for a significant period of time (ours was at NVC for around a month), then it is shipped to your local embassy at which point the speed you are processed will depend mostly on how fast they move, but also on when you can gather and return the required information and forms, and when interview slots are available. I had my passport with visa in hand almost 2 months after the embassy received my files, and the NZ embassy is definitely among the faster ones.

 

You do not have grounds for an expedite. Your situation is unfortunate but also entirely within your control. You came here to ask a question of people that know, and hopefully you will have the grace to accept an answer you weren't hoping for.

Nothing to worry about.  All visa approval goes through NECESSARYAP stage after an interview. This type of AP is mostly like final administrative paperwork being done, and it includes the process of getting your visa ready and placed in your passport, your immigration envelop package ready for you.  If all goes well normally that status should changed to ISSUED in a short time.

 

I can understand the shock of seeing those two words, because it had me for a while too until my status, and the rest of my family status change in 24  hours after the administrative phase.
