Thank you for yor question. The interview was very pleasant, and we were interviewed together. It took maybe 15-25 minutes, and was very informal. The Immigration had only a few questions, but for sure he wanted us to show that we were a couple. We had many photos of places we went after my wife arrived, documents with both names, he asked whether my wife had applied for any government aid since she was here (NO is the right answer), and that was about it. We were able to laugh and joke while doing all this as well. Once you arrive at this place in the immigration process, this is reallly a formality at this point to make sure that the couple is really a couple and acting the part.

So the long and winding road finally leads us to a successful and happy ending......or beginning! After a long journey together, or apart when we began, my love was approved today at the USCIS office in Phoenix, AZ. All I can say is WOW! It took so long and we were apart for such a long time, but with hope, prayer, and determination, we were triumphant. The immigration officer was nice and made the moment light, as he knew that Pat was nervous. After a few questions from him and some questions of our own, we were congratulated and sent on our way.

We've completed the first part of the "Visa Journey" and my lovely Svetlana is here in the USA with me. Now it seems comes the hard part. She has been here since 1 July and we've gotten married, had a beautiful wedding in Lake Tahoe and are settling in together.

The hard part has come as my bride is feeling down about not having work and worried about her "level" going down as a result. Unfortunately as luck would have it, the first two ladies she has encountered (1 from Odessa and 1 from St Petersburg) have relayed mostly negative stories about how they were successful in Russia/Ukraine, but that now they are like "guest workers" in the USA with little prospects for success. Of course this has only brought Svetlana's mood down only more. (Needless to say these very nice ladies have other issues in their relationships which are the true source of their unhappiness).

I'm working now to get some of the basics taken care of like immigration paperwork for AOS, driving lessons, English courses, although she speaks pretty well, etc. I work as an officer in the USMC and we have plenty of money. We live in a nice apartment with palm trees and a swimming pool in Oceanside, CA yet she still feels like she's gone backwards in life because of this job issue.

So the bottom line is that I'm looking for anyone out there who has had POSITIVE experiences getting adjusted and beginning their careers in the USA after coming from Russia. I know that if she can see some positive examples of ladies who have transistioned successfully that will really help her outlook and hopefully she can get some constructive advice on what steps she can take to attain the success here in this country that she seeks.

My wife has been here from France for 3-1/2 months, and is experiencing the same feelings. The trick is for them to stay busy, and also keep in touch with family back home. My wife speaks with and sees her son in France once a week on the pc using SKYPE. Of all the things that help her to feel well, this works wonders. We have also found that there are many French people in Phoenix, so I suggest that you try to find a support group of Russians in yor area for her to interact with.

I filed my I-130 and received a document from UCIS CSC called "I-797, Notice of Action". In the top header of this document under "Notice Type" it says "Receipt Notice". My question: Is this the document that I send with my I-129 or am I waiting for something that says "NOA1"?

So, what is the conclusion? I am about to start the K-3 process for my wife in Colombia.

I have none of the documents listed in the Guide for evidence of a bonafide marriage. Two things I could send as evidence (in addition to the marriage certificate) are:

1) Photos of the wedding/trip to Orlando.
2) A doctor's note of my wife's pregnancy.

Should I send these two extra piece of evidence with the I-130, or is it not necessary until the interview?


Both good ideas of evidence. I also had close friends, and my boss write letters where they stated who they were, how long they knew me, that I told them I had married, and other things that they suggest in the I-130 instructions. I also had my Human Resources department of my job write a letter on company stationary, stating that I sent them my marriage certificate and wanted to list my wife as a dependant to allow her to begin receiving benefits available to her.
I believe that the more pertinant the documents you send, the better. Hey, what will it hurt ti send more than a few?!

I sent my marriage and divorce certificates, no pictures, no emails, no telephone bills, no letters. Both my I-130 and I-129 were approved on same date, without any RFEs.

Now that is encouraging news! I looked at VJ for a long time until I was able to file my K-3, and even if I thought that I knew all that I had to do and felt good about everything, and I had all the documents filled out, I forgot pictures and other supporting documents and my confidence level disappeared when it came time to file. Now it takes to be cool, calm and collected and play the waiting game, and try not to stress :whistle:

I would note with an attachment the fact that you didn't send supporting documentation of your relationship with your spouse when you send in your I-129F packet. I would imagine in todays world of high speed information overload one USCIS office could communicate with the other, but we're talking about the government here. I worked very hard on my supporting evidence because I've only been married for 5 weeks. I sent USCIS -Chicago everything I had sent California plus copies of my stetdaughters I-130 paperwork. The only thing I worry about is that I sent the Chicago office copies of the G-325A's and not another set of originals that were sent to California. Have you received a I-797 (NOA#1) yet ?

2/23/07 Married !
3/10/07 I-130's sent to C.S.C.
3/20/07 Received NOA#1
3/27/07 I-129F sent to Chicago

5/08/07 Off to Zambales, Phil. for 2 weeks
to see my wife !!

I sent my !-130 in and in my haste, I did not add emails, photos, and other items that would show my three year relationship with my spouse. If I send these documents in with my I-129 packet, will this be of any value? Your coments are welcomed

I'm curious to know if anyone has entered the US while their case is pending and if that was difficult?

I have filed an I-130 and an I-129F. My son and I are going to Texas for Easter to visit my husband. We will be returning the weekend after ... we have return tickets. I work for the Canadian Federal Government, I own a home here, my son attends school here etc.

I plan to say I'm going to visit family. This isn't illegal is it? I'm getting nervous now as I will not lie.

The problem is, that they will be able to see that you are in the system, and have the right to refuse you admittance into the US. I think that the problem is, that they believe that someone with a case pending, could enter the USA, stay here, and file a change of status to stay as a spouse of an American citizen. I have heard of people doing that, and at the same time I have heard of people being refused admittance into the country. It could be easier if he were coming to visit you, as I don't think that this would be looked at in the same way!

We married in 01/2007 in China. I live in California so I sent the I-130 to the California service center in Lagune Niguel,
they received it 1/29/07. Received NOA 1 on 2/3/07.

Sent I-129F to Chicago as per the instructions on the I-129F form if filing for your spouse. If filing for finance mail to California, where I live.

Received NOA from Chicago on 2/26/07. Under case type it shows I-129F Petition for Finance(e)Spouse.

Received NOA from Chicago on 3/5/07. Under case type it shows I-129F Petition for Finance(E). Under notice type it states Trnasfer Notice. Below Notice Type is states the application was transferred to California for faster processing.

From what I have read Chicago should have processed the I-129F package and forward it to the National Benefits Center in Missouri.

Did they make a mistake and will this slow down the processing time. Has this happened to anyone before.

This seems to follow the same pattern as my I-129F application. I applied to the CSC for the I-130, then to Chicago for the I-129F. I also received a "Transfer Notice", stating that my I-129F was sent to the CSC for processing.
Can so many people be wrong?!

My wife and I were marrried in Las Vegas last December, but she has not declared it yet in France. She is recoognized as my wife here, but what about in her home country of France? Is there something special that I or she needs to do for our marriage to be recognized there?
I was able to claim her on my 2006 taxes that I filed through the IRS office in France. Regarding her French taxes, she is in the process of filling her 2006 taxes, and I am wondering what, if any, my tax burden will be, even if I did not earn any money in France, but we were married in 2006.

Married is married. As long as it is a man and a woman, marriages are recognized pretty much everywhere.

Think about it for a minute. If two US Citizens marry in Las Vegas and move to France, are they married? The same answer goes for couples of mixed citizenship. A little common sense goes a long way in this process.

I just received an RFE as well in the email, and then they sent me the paperwork in my mail. It is different for everyone, but for me they wanted a divorce document for my wife from France. All countries are different, and in France, your birth, marriage, and divorce, are all listed on one document. Apparently immigration wants a separate divorce document of my wife's divorce. I hope this helps.

I received an RFE on my I-130 submittal, and had a question regarding what is acceptable for evidence. In France, everything is posted on "Extrait D'acte de Naissance". or "Birth Certificate". That means that birth, marriage, divorce, and death information such as dates and places of all these events. Other than birth, the others acts are listed under the heading of "Additional Information".
Has anyone who filed for a French spouse had trouble submitting this to USCIS as evidence for a divorce? I am not sure if perhaps USCIS saw only "Birth Certificate" and overlooked the rest of the information, or not.
I would appreciate if those of you who may have had a similar problem, would share your experiences before I entist the services of a translator blink.gif

I filed through the CSC and am waiting for the information to arrive so that I can get this evidence together and send it out as soon as possible.

When I submitted my original K-1 and K-3 paperwork, I listed my wife using my last name. At some point before she received her packet, I realized that she was still using a passport with her maiden name. At the USA embassy in Paris, I don't think that they will issue her a passport in her married name, considering that her passport is in her maiden name. I understood that the visa would be isued in the same name that is on the passport.

My wife's visa to come to the USA was approved on 4/24/2008 at the American Embassy in Paris, France good.gif The questions were not very complicated, even if she was "sweating bullits" as they say. They asked her my name, how many times we saw each other since meeting, where she had visited in the USA, and some questions to be congeniel. I am a litle confused though, ebcause the immigration woman said that my wife wouldn't be able to leave the USA for awhile, and I thought that with the K-3 Visa, one could leave at any time. F.Y.I. I also filed and was approved for a K-1 Visa. I would appreciate any feedback with this.

After 5-1/2 years, we are finally together in the USA, arriving on 30 June and coming through Minneapolis. I went to France to accompany my wife to the USA, and immigration was great. She presented her packet and I-94 and was "Welcomed home" as we passed through. Now comes the filing of the I-485, and I will file the I-765 at the same time at no cost (true?). I understand that this is a temporary work permit until the greencard comes, but correct me if this is not the case. We are both still on cloud nine and I wish all of you who are still waiting success. What I can tell you is that "patience" is the key here, and it is definitely a test in that!

The same was true for my wife in Paris. She brought them with her to the interview and finished them there.Send them only what they ask for and hand carry the rest to the interview.

The time it takes to get approved for EAD is the same if you file for it on its own or if you file for it as a separate application- about 3 months. If you are planning on filing the AOS now rather than waiting until closer to your 2nd wedding anniversary then you would be best to file for AOS and EAD together and save some money as you will have to pay to remove the conditions on the greencard 18 months after it has been approved. If you want to wait to file for AOS so that you get a 10 year Greencard and dont have to file to remove the conditions then you would have to file for the EAD now and pay the fee.

Thank you for the info. Now another question: My two year marriage anniversary will be on 21 Dec. 2008. In this case, would my wife be elligible for the 10 year Greencard as our (2) years of marriage is nearly here? If this is true, I would file the I-765 and the I-485 together.


If the marriage is 2+ yrs. old at time of approval/ issuance of the greencard, then it will be the 10 yr one

It's true that we will be marriied for (2) years when I send in the forms for adjustment of status, but the thing is that my wife will not have been in the USA for (2) years. Is change to Permanent Resident contingent on being "in country" for two years? That being the case, will she then receive only a (2) year Permanent Resident Card(if that is possible)?

As it is only a few months until your anniversary I would wait and file for AOS and EAD together closer to your anniversary date, idealy you want it so that if you get an interview for the AOS it will be after your 2nd anniversary.

Thanks a million for your advice Jon. Waiting a little longer to insure that the time coinsides with the (2) anniversary makes sense.
