my NOA1 was April 3rd, NOA2 was April 14th. we were basically waiting for packet 4 and my fiance went down to london today for his medical. he also JUST received the letter today telling him that our case was recalled and sent back to the U.S. it took so long to get that letter that we almost thought we were in the clear. bollocks. hopefully it reaches the service center soon and we won't be out of the loop for too long.

we haven't been touched since we were approved on April 14th.

what happens with the RFE? do i just fill out a new I129-F form and send it in? i'm assuming i won't have to send out the whole package again and just the single form...?

has anyone here sent in their RFE and actually started the process again?

Are you saying they have only sent back your application today?



i'm saying that my fiance in the u.k. only got a paper notice today that our case had been recalled. no idea when they sent it back. i'll have to ask him what the letter says in more detail tomorrow.

I'm in the same boat as you. My fiance is well educated and has been in the US for a long time now. Yet because of poorly enacted legislature, she is stuck in Moldova waiting with no answers. I can't even see my fiance because of my obligations to my business in the US.

A thought I had on the class action idea. The class action would be seeking two different things.
First, they would probably need monetary compensation for lost deposits due to processing errors on behalf of "fill in your choice of government agency here." People have already had their petitions approved and a recall of an approved petition at the time of interview constitutes negligence of continuity on the governments part because all RFE's should have been handled earlier in the process.

Second, the suit would require a more clear definition of how late in the game an RFE can be issued. It seems like currently ones fiance could be at the airport and the sponsor would still be filling our RFE's based on the originally petition.

I will say that IMBRA would have been a great piece of legislature if it was implemented clearly and given the appropriate amount of time to have all the paperwork that goes along with it prepared. Unfortunately it was poorly implemented. The people we call for help at agencies across the country have no idea what IMBRA is or how it is affecting our lives. The people we are supposed to call for answers to our questions only leave us with more questions.

I'm sorry to say that our government rushed a good idea and now we are all paying the price.


i would have to agree wholeheartedly. luckily, my fiance has a place to live and a job to keep him fed and healthy until we can get this all straightened out. i can't imagine how much stress folks are under who have handed in thier resgination and sold their home/gotten out of their lease to find that their interview is postponed or that thier visa will not be issued.

i'm not even going to mention dates that were scheduled for weddings...

I am really, really, REALLY hoping that the "30 days until case adjucated" email that was sent to my senator (Evan Bayh) was correct. That would keep Sian and I on our planned schedule, mostly. We really want an autumn (October 15th was the tenative date) wedding. If we receive our NOA2 within 30 days, then it might still be possible.

Here's hoping that CSC approves a whole assload of I-129Fs very soon.


ha! Yes, me too! I heard that 30 day deal from my senator as well.

But October is still pushing it, it takes about 3 months to interview once NVC gets it for UK, if you check past interviews....


daaaamn, that's a long time. is that from the embassy receiving the initial file and sending out packet 3? our case was recalled after we sent back our checklist AND on the day my fiance was in london for his medical. do you think it might still be a 3-month wait once the petition is reapproved and returned? (not expecting you to know, of course - just wondering on an opinion ;) )

I think if you have the hard copy approval notice in your hand, it HAS to be an approval, right? The fact that they didn't update the website or send an email doesn't mean a whole lot since they don't always do that anyway. So CONGRATULATIONS!!!

Of all the approvals so far in VSC and CSC, did you guys use marriage brokers, have been arrested(expunged?), or filed a waiver for multiple petitions filed? I see a lot of people saying that the dating websites aren't considered marriage brokers, are these websites free or do you have to pay?


i just got (re)approved today - no marriage broker, no criminal history, and no multiple petitions. clean sheet, me.

Our re-approval was a week after yours. We are now waiting for Packet 4 from the London Embassy. Have you received your packet, and if not, how do you know of your Interview Date?

we've not physically received Packet 4 yet, but my fiance emailed the embassy with a change of address notification and they responded with the following:

"Thank you for the information you have furnished. An interview appointment has been scheduled on your behalf for September 8, 2006 at 10:00 am. Written notification of your appointment has been sent to your new address, as requested.
Thank you for your e-mail correspondence.
Consular Information Unit
U.S. Embassy London"

i'll take that as a big hint as to what information our Packet 4 contains. :)

my fiance phoned the london embassy today to change his address (he's moving in with his sister for the last month or so) and they told him that they have everything and are just waiting until his turn comes up to schedule an interview. it sounded great to me, but i phoned the NVC just to check and the woman told me that they sent the petition out on the 10th! excellent, and back on track! i'm just happy that this whole thing only added a few weeks to our process instead of the dreaded months and months. here's hoping we get an interview soon! :dance:

i called both the VSC and NVC today about how they are forwarding the petitions to the embassies. a woman at VSC told me that nothing in the process will change and that all the applications will be sent through the NVC (it could take up to 30 days, of course! big effin' surprise at that answer).

i then called the NVC and a woman there told me that they were just a sort of holding station for the petitions and had no idea what would happen and to call 'immigration'. i asked her if by 'immigration', she meant the VSC. she answered yes. she also had no record of my petition being there at the moment.

so i got nowhere with those uninformed toolbags. i guess i'll just have to wait and have my fiance ring the embassy (at something like £1.50/minute) to see if the petition arrives there anytime soon...

EDIT - i just read another thread that seems to confrim everything being sent through the NVC. i haven't been online much in the past week, so i totally missed it. disregard this comment! ;)

Woah! VSC is sending different messages! I'd have expected CSC to send different notices, but not VSC. Oh, well.

Hey, could you call NVC and VSC next week and see what answer they give you as to who will be sending the petition back to the consulate? So we'd add one more set of answers to the ones we've collected...

VSC officers are saying the opposite.

Here are my two cents on this issue because I am in the exact situation you all are.
I've had my mental breakdown and have come out of a very long haze with some clear thoughts for everyone.

1. If your applications were previously approved, then you have nothing to worry about.
2. Good things are coming to us for all of the hell we have been put through.
3. When all our applications are re-approved and sent out again things will be back on track.
4. When we are finally married and all of this is in the past, we will never have to deal with this again.

Of course let me also add that no matter how many times we call, it will not speed things up. I have resigned myself to going to the gym until I am a lifeless human body without a single ounce of energy to worry about anything.

Hope that helps. So lets all just get our frustration out now and relax. If we think this process is hard for us the petitioner remember how hard it is on the other end so far away.

I hope everyone hears lots of great news in the coming weeks. I am waiting to see who gets the first RFE out of Vermont that has already had their NOA2 previously approved.

here's a weird (and hopefully simple) question. i am filling-in my I-129F form and question #10 asks for my birth certficate #, date, and place it was issued. my b.c. doesn't have a #. how should i go about saying that on the form?

Side note: what visa status have you been living in the UK with? Have you investigated whether or not London would accept an I-130 from you? (DCF case) You may be eligible if you have been living there for 2 years, even if you do not have an ILR stamp.

As Yodrak suggest, look in the AOS forum for ideas of proof of living togetheer. You don't have to prove co-mingling of your finances or anything---mail addressed to you each individually at the same address shows that you are living in the same place.


yep, i am going to use a lot of the mail we have received, as well as photos of us together and letters from his sister, mum, and possibly his best mate stating we have been living together. i am here on a student visa, but will be leaving about 4 months short of 2 years.

this was a reply to another post, but since it has to do with the exact opposite of that post (possibly sending TOO much information), i have decided to ask it here. it is in regards to proof of having met/seen your fiance within the past 2 years of sending in the I-129F:

my problem is that i have been LIVING with my fiance for the better part of the last 2 years. we have loads of photographs of us together, but no emails, phone logs, texts, flight tickets, etc. because we just haven't done any of that! i am going to describe the situation in the letter, and include my pay stubs and bank statements and anything with my name and u.k. address on it (along with the same from him), just to show we have been residing at the same address. i *think* our original mobile phone plan has both of our names on it, even though it was hand-written and my name isn't on the electronic bills. the pay stubs, bank statements, and university invoices i have date from october/november 2004-january 2006. he pays all of the bills, so they're all in his name.

any other suggestions of proof that we've been living together?

interesting that in the guide, it shows 'NONE' in only the first box for certain questions (like 'list all children'), but it's been advised to put 'NONE' or "N/A' in every empty box.



The box for list all children can be counted as one question with lots of spaces for those it applies to, so one NONE is sufficient. If you had one child you would put their name in the first box and leave the rest blank, you wouldn't put NONE in the 2nd box, 3rd box, etc. I would say its common sense but that seems to be lost on some people......

(If you're being sarcastic then maybe this can just clear it up for other people, because you know someone else will ask)

To answer one of your questions, yes you both need a letter of intent to marry, and yes, they both have to be original signatures. He is going to have to mail you a few things with original signatures (G325A, letter of intent, and I can't remember what (or if) anything else) so be sure to read the guides!

i am in the process of gathering together everything for the I-129F, but am thinking ahead for what my u.k. fiance needs for his application and interview. i have read about sending away and getting police records or something of that sort, that would take about 40 days to arrive. what sort of required paperwork or forms should he start gathering now, to save us time in the future? if there is a list somewhere on the site, just re-direct me there

also, should i include a letter signed by us both in the I-129F stating our engagement and intent to marry? can it be a faxed copy from england, or should it be an original?

my problem is that i have been LIVING with my fiance for the better part of the last 2 years. we have loads of photographs of us together, but no emails, phone logs, texts, flight tickets, etc. because we just haven't done any of that! i am going to describe the situation in the letter, and include my pay stubs and bank statements and anything with my name and u.k. address on it (along with the same from him), just to show we have been residing at the same address. i *think* our original mobile phone plan has both of our names on it, even though it was hand-written and my name isn't on the electronic bills.

the pay stubs, bank statements, and university bills i have date from october/november 2004-january 2006. any other suggestions of proof that we've been living together? he pays all of the bills, so they're all in his name...

i just finished my write-up of this. it ended up being two paragraphs (8 extended lines) stating the date we met, why he was in the U.S. on that date, how we kept in touch, the dates we visited each other and the addresses where we stayed (family homes), the reason and dates i moved to the u.k. for a year and lived with him, how long we lived together/dated, and the date we got engaged.

i think i included enough info for them. i HOPE i did. i'm also going to have his sister (who lived down the street from us) write a short letter reiterating the details and possibly mentioning attending our engagement party.

it's weird compacting the relationship into such bite-sized pieces...

tell me about it. i had to use a little white-out for some things on my packet. nothing huge, but little details that annoyed me/didn't look pretty (numbers written over other numbers, small cross-outs, etc). hope it won't be a problem for them... :wacko:
