If you both agreed to get married later and filed K1 with the required visit in 2 years you are good to go. Better check the particulars about the Philippines and immigration etc. and the P forum. I don't think a ring is mandatory but don't know about the embassy particulars. K-1 Fiance(e) Visa Process & Procedures	Pre AOS question about leaving country	Nobody is going to stop her leaving the country but if she does so before AOS is filed, she won't be able to come back (as she had a K1, which is one time entry, and won't be able to use the Visa Waiver Program anymore). So then next time she'd nee to apply for either a tourist visa to visit or a spousal visit to live in the USA. You are right that AP allows her to travel out of the USA, but AOS needs to be filed for AP to be given, and it is for travel abroad, not for living abroad. How long does she want to stay at her job? Keep in mind that the K1 visa is usually valid for 6 months, so she could always stay in Australia for another half a year before coming to get married to you in the USA. Another option, since your fiance stopped his education, would be for him to get a job, and find a room-mate situation for a few months. I would recommend this, because remember there is ni way of knowing exactly how long processing takes, there is the interval between medical and interview to consider, and he won;t get the visa at interview- they will keep his passport to put the visa in, and he will get it back in the post a couple of weeks later. :thumbs:A common sense approach is always best.	bigdog	Male	China	2013-02-18 09:54:00
K-1 Fiance(e) Visa Process & Procedures	K-1 Questions	Yes. If he has enough income for his household size plus the foreign fiance(e), then his income will count. It does not matter if it is income from retirement. He just needs to provide proof of how much income he receives. A 1099 for his retirement and some recent bank statements showing how much he is actually having deposited in income each month should do it. She does not need 3 years of tax returns. As a matter of fact, someone here that went through Australia said the consulate there does not even require a tax transcript for the I-134. When it comes time to adjust status and fill out the I-864, then she can simply include a statement as to why she was not legally required to file a return for any of the last 3 years she did not. Also something else was incorrect from the post above. She CAN file the I-129F while still living in Australia. I would have her use her family's US address to have the notifications sent there. The NOA1 is the first notice. It is simply a notice of receipt that have received the petition. Months later when finally approved, the NOA2 would be sent. That one is important and will be needed later after you are married and filing to adjust your status in the US. So, make sure it does not get lost. If you happen to get an RFE, that would be sent to that address as well, and her family could send it to her in case you need to send additional evidence to be approved. After the I-129F petition approval, things are all on your end at the consulate in Australia. Only the financial forms need to be provided by the USC. While yes, it does mean that your petition is in the adjudication process; it is now currently on hold, and likely in another pile, waiting for your response to the RFE. You should wait until you get the actual RFE letter, and then be prepared to fully, timely and accurately respond to the request. It may be something simple, or not, there is no way to fully determine with the actual letter. You can post the actual RFE letter contents (redacting personal information) on the forum, if you want to elicit discussion and comments from other forum members. The quicker you respond, the quicker your petition gets on down the line. BTW, my then-fiancee and son had to travel over 1,900 km for their successful K-1/K-2 visa interview. Heck, I even made the over 10,000 km trek to join them and support them at the same Guangzhou consulate interview. The time apart and the distance apart only make the end results of this entire immigration journey all the more sweeter. Other responses have voiced similar sentiment. Do all the pre planning, don't do any deposits or hard cash. The system is to iffy now and before. Just a suggestion, don't try and shop for the easy way, just the fastest way for you as a couple to meet your goals, and the legal avenue. If you are not marrying till next year Finance'e Visa seems fine. We did but would have gotten married first then came to US with a green card after our review. Furthermore, there is an uneasy coexistence between USCIS (Dept. of Homeland Security) and the Bureau of Consular Affairs (Dept. of State). Please support your contention with source material.Please name them.The purpose of the K-1 visa is to marry in the United States. It is incumbent upon you to be prepared to make a good impression, look professional and know your material and be able to present it if requested. You should also file for EAD and more importantly AP-advance parole. If the check was not cashed, then either he did not send it or they did not receive it, it should not take more than 2 months for the check to be cashed and to get NOA1. What address did he send it to? (btw, it's very early morning in the USA, and few people are online, so please be patient- only get worried about no replies if you hear nothing for a day or so). :thumbs:Agree this is unusual, the check showing cashed was the first clue and receipt followed soon after.
