hi vj's, i had my interview last september 1. when the window 73 in-charge told me that my visa is approved they didn't ask me an amount to pay for mailing via 2GO. and also when i ask him when can i expect to receive the package? he just said just wait in your house and everything will be delivered. so my question is. Do you have any idea when they can deliver or how many days i can receive my package from embassy? it will be 6 working days today since i had my interview. please if anyone knows your reply is highly appreciated. and if you know how to track 2GO site please include also. thank you and have a good day.


It really depends on whether you are picking up the visa from a 2go outlet in Manila or if it is being delivered in Manila
or your province. Our interview was August 16 and we picked up the visa August 19 from 2go outlet in MOA. On the
average, it takes 7-10 business days if delivered to your province.

I am under k1 status when came in US from the PHILIPPINES and eventually married my fiance last three weeks ago... We would like to know if i can get my SSN before filing AOD ( Adjustment Status ) ... what are the process of getting a SSN ?


You should've applied for your SSN before you got married. A K-1 visa holder is eligible to get an SSN, but as soon as you get married, you're no longer a K-1 visa holder. Hence, the Social Security Office tells you you have to wait until you get your green card. You do not need an SSN when filing your adjustment of status.

I think I am going to try to get her to call in sick or stick to her guns and say she has to have these days off. These people work so much, for so little,
with no benefits.. its just not right. I think it is near slave labor because the resort room rates are $ 200 a night there. It really changes the equation
when I am behind her and she knows that. I'll have her work right up till the interview if possible.

Her next job will be Domestic Goddess. (L)


It's a non issue. I had Patty quit her teaching job in college back in May because I did not want her quitting in the middle
of the semester and put undue strain on the University. It had no impact whatsoever on the visa approval.

This is misleading. Yes, you can work if you file your I-765 as soon as you land in the US and receive the EAD. However, it is not worth paying $380 for an EAD that is only good until your I-94 expiration date (90-days from your POE). You can file for AOS ASAP and send in the I-765 (EAD) and I-131 (Advance Parole) with the I-485 and the fee for the EAD & AP is waived.

It takes about a week for your approved petition to get to Manila through DHL. If not, not a big deal, but call them every other day until you get the information. You can also email them at NVCINQUIRY@state.gov. On the subject line of your email, put the USCIS # and on the body of the email, put petitioner's name & DOB and beneficiary's name & DOB on the body of the email.

When you obtain your manila case #, you can pay the visa fee through BPI. Be sure to have your passport when paying for the visa fee and keep the receipt. Wait til the next day and schedule your interview online. You do not have to wait for the eligibility letter from the USEM. Otherwise, you will be waiting for awhile. When you are scheduling online, you'll need manila case #, passport info, and the receipt # from BPI. Give enough time in between interview date and when she plans on getting her medical done when scheduling. There is no need to schedule an appointment for medical since it is walk in. You can register through the SLMEC and fill up the registration online and this will save you an hour and a half. if you don't fill it up, they will make you fill it up on the spot @ the clinic.

A CFO sticker is needed to be affixed to your fiance's passport. If you do not have this, they will not let her board the plane. This can be done in advance and once you have the visa in hand, you can go back to the CFO office in Quirino Avenue and obtain it. Or, you can wait until visa in hand and then attend the CFO seminar and get the certificate the same day.

Ok I am a little confused. I got my NOA 2 on the 23.

I know all the paperwork I need etc but here is what I am not real clear on.

Now it goes to the NVSC and they route it to Manila. Do I need to call the service center. I hear people keep saying to call, but not sure what the purpose in that is . Do I wait on the consulate in Manila to notify my fiancee. My Fiancee seems to think this (and she is smarter than me :) :thumbs: , that I can call and they can give me the Manila case number and she can go ahead and make her interview appointment..

I know the forms, evidence, affidavit of support etc that I need to send, just not sure on the sequence of events.

That is all I did and during the interview, they only took the 2010 tax information and letter from employer. They did not even bother with the
pay stubs, but it is always advisable to have too much information than not having it. They also asked Patty for money remittance receipts,
which we had. So, the moral is be prepared for anything and everything!

but yea, just want to clarify this question in my head... i have been reading some experiences from people over here saying they did their medical examination at St. Luke's in Manila even without the appointment letter or the packet 3 from NVC or Embassy (not sure where the packet 3 will come from.. either NVC or Embassy?) and the guard allowed them even if they only had their NOA2 from USCIS with them...

some were saying, that the guard allowed their walk-throughs with the NOA2 and Manila Case # Letter from NVC with them...

but on the website of SLEC, one of the Required Documents is Appointment letter from the Embassy or Instruction letter from the National Visa Center (NVC), so ...

which to go for? cos we are already thinking of getting my Medical Done while we are waiting for the Packet 3 from NVC or Embassy..

oh yea, one more thing, really, where would the Packet 3 come from as well anyway? NVC or Embassy...

You as the petitioner should prepare I-134, employee letter, pay stubs, and tax transcripts for 3 years (you can order tax transcripts from IRS website for free), evidence of ongoing bonafide relationship, money remittance, and anything else that proves a genuine relationship, and then send it all to your fiance as she will need these things for the interview @ USEM.

I know I have seen this discussed, but is the NVC like USICS, some may get a case number right away and some may take weeks.? I am very patient I was just wondering when to start getting conncerned. My Noa2 was 23 Sept. A firend had a 27 Sep NOA2 and got his case number today.

I wonder if I call every day does it log it and I get a big ol' PEST ! by my name LOL.

P.S. I called at 8:20 tonight EST and got right thru no wait.


Just be patient. We got NOA2 June 24 and did not get a case # until July 27. But, once you have the manila case #, provided
both you and your fiance have prepared all that is needed, everything will happen very fast. Just hang in there. I was the
same a couple of months ago...:)

Thanks for the reply and thank you for the link. I read the thread. This is an interesting issue. As far as I can tell, One of two things may have happened with your case, as well as scruffydog's case.

One possibility is that the U.S. Embassy Manila now is allowing K-1 interviews to be scheduled as soon as they receive an electronic file from the NVC, rather than waiting for the physical case file. This would be a real timesaver.

The other possibility is that your physical case file was already at the U.S. Embassy Manila and you were not aware of it.

I noticed that it was a bit over a month from the time you got your NOA2 until you got your MNL case number. Normally, this is more than enough time for a physical case file to arrive at the NVC, get assigned a case number, and be shipped to Manila. Could it be possible that your physical case file was already at the Embassy at the time you received your case number? I say this because it's my understanding that the NVC doesn't know which particular petition is in which particular shipment to the Embassy. Anyway, this is what the NVC told me.

In your case, the NVC told you that there was a shipment on 7/28, but did they verify that your petition was included in that shipment? The tier one people at the NVC may assume that if the NVC assigned a case number to a petition, and the case is no longer at the NVC, then it must have gone out on the previous shipment, when it's entirely possible that it went out earlier and already arrived at the Embassy.

On the other side of the same coin, did you verify with the Embassy exactly when they received your physical case file? If so, was it after you made the interview appointment?

I sure hope the answer lies in the first scenario where the Embassy is now allowing interview appointments to be set as soon as they receive the electronic file. I hope others chime in.


Around the time frame we were approved, it was well known that there was a delay, which occured with CSC getting the approved petitions to NVC.

I tend to lean on the first scenario. I called NVC and specifically asked if our approved petition was shipped yet and the answer I got was yes it was shipped
on 7/28/11. No, I did not call USEM to verify if the physical file was already there before scheduling the interview appointment online. Plenty of other K-1
couples have done the same thing we did and that is why I tend to lean on the first scenario. The trend continues today with scruffydog.

It can take a lot longer than four hours from the time you pay the visa fee until you are able to schedule an interview. Four hours would be a minimum amount of time.


In the past, the Embassy wouldn't schedule K-1 interviews unless the physical case file was at the Embassy and it was entered into their system.

As I posted in your thread, it's not clear to me that your physical case file was not already in Manila at the Embassy when you finally got your MNL number from the NVC. If your case was still at the NVC, and you were able to make an interview appointment, it would be the first time I've ever heard of it.

Once again...I'd be curious to know...

How exactly did you know that your physical case file was still at the NVC at the time you made the interview appointment? Did you talk to a tier one rep, or a tier two rep?

How exactly did you know that your physical case file was not at the Embassy at the time you made the interview appointment? Did you talk to someone at the Embassy call center, or did you call the IV Unit directly?


We went through this a little over 2 months ago. NOA2 6/24/11, received manila case # 7/27/11 by calling NVC. Called NVC the next day
and they were able to tell me that the package was shipped via DHL 7/28/11. Patty paid the visa fee 7/28/11 and was able to schedule
online 7/29/11 for the interview. I wen to DHL website to track and was able to because it was the only shipment going to the USEM.
It was signed for at the USEM 8/1/11. So, we were able to schedule for an interview prior to the physical file getting to the USEM.

HI everyone,

Does any of you guys thought about having a wedding ceremony with your fiance at your own country first before leaving, after getting your K1 visa? Is that possible? Me and my beloved Fiance thought about doing it...


A K-1/Fiance visa is just for that...a fiance visa...K-1/Fiance visa is a single entry visa...meaning...you must get married within 90 days upon entering the USA with a K-1/Fiance visa...if you get married in PI prior to you entering the USA...you are not a fiance anymore...you are married now...hence, you have to start over and file for a CR-1/Spousal visa. I don't think you want to do that!

My suggestion is go to the USA, get married via civil ceremony, save some $$$, go back to PI at a later date and have a wedding ceremony.

When you filled out the application for a marriage license, it should've asked you to specify how you would like your married name to appear.
For example, maiden name is Gabrielle De Silva Leynes, married name Gabrielle Leynes Bontigao. However you specified on the application
on how your married name would appear is what it will be on the marriage certificate. At least in California, that is what we did.

My wife, Chinook, was a K-1er. She applied for a SSN a week after her POE and received a restricted card about a week later. Shortly after we were married, she filed for a name change on her SS Card. About a week later, she received an unrestricted card. She received the card about four weeks before her I-94 expired. Of course, she wouldn't have had a conditional Green Card at that time.

Since she had an unrestricted SS Card, I'm thinking that she would have been legally allowed to work if she had wanted to. She never applied for another SS Card after she received her unrestricted one. About a year later she got a job with an employer who uses E-Verify and she had no problem with her SS Card. I took it to mean that the SS Card she received during her I-94 period was a work-authorized card.

It should be noted in the second paragraph of your response that you are talking only about employers who use E-Verify. It would not apply to other employers. I do see your point though...an E-Verify employer is going to notice your SS Card doesn't authorize you to work.

Finally, it's a mystery to me why there can't be a serious discussion here on VJ about a topic about in which there are so many questions. To say that the issue is long-ago and undeniably settled is ignoring the fact that there is disagreement about it even among immigration attorneys. Also, it should be readily apparent that your personal K-1 experience has been very different than mine in regards to the SS Card issue.

Finally, I'm not advocating anything illegal and I have no intention to do so.


Your experience is certainly different. Patty also applied for a name change after we were married and her SSN card still has the restriction.
Something tells me that an SSA employee may have inadvertantly pushed the wrong button or entered incorrect information to receive an
unrestricted SSN card.

Maybe some other K-1ers will see this thread and post their experience on getting employment without an EAD. Has anyone read or seen
any thread with which a K-1er was able to get employment without EAD?

We were fortunate enough to know someone who had gone through the process and also referred us to this wonderful site.
After doing our own reading and research, we were confident enough doing it ourselves. It also helped that we did not have
a complicated petition.

It is really up to the couple's capability and underlying circumstances that I think ultimately determines whether to use a
lawyer or not. For us, we just wanted to control the whole process (at least things we had control on) and not rely on anyone
else.

Ok... But i read somewhere that you can only withdraw what you have filed. But I didn't file my I-140 so I can't withdraw the application, only my employer in the states could.


Then request from the employer to withdraw/cancel the petition since you do not intend to honor it anymore.

My another problem is that, the agency that's been processing my i-140 application has stopped communicating with us for more than 3 years now since there was a great retrogression in terms of providing visas for this type and the current priority date is december 22,2005. I have been contacting them and still waiting for any replies till now.


You should have the pertinent information regarding the employment based application. Use that and write/contact the USEM yourself
and withdraw the application. If you're not able to, I don't think it will be a problem. Chances are, they will ask about it when it comes time
for your interview. Just tell them to cancel it since you will be going to the US via K-1 visa.

I have a pending 1-140 employment-base immigrant visa apication since 2006 with a priority date of August 2006.

I met my fiance only last June of 2009 and has petitioned me for a K1 visa June of this year.

The first question I have is are my fiance' and I able to file for a temporary work permit for him prior to his entering the US and us being married? This question somewhat times into the second question which is, if he cannot do the previous, is he able to file for the work permit once in the US and before the AOS is filed?

How will he go about getting a driver's license? I read somewhere he cannot get a driver's license until he has the AOS completed. Is this true?

He is able to file for EAD as soon as he gets in the US and it will cost $380.00 and takes about 60-90 days to process. It is a complete waste of money because it expires
the same time as the I-94 which is good for 90 days from date of port of entry. So, once he receives the EAD it will be only good for less than 30 days approximately.


Best thing to do is get married as soon as he arrives, then get SSN, then file for AOS & EAD at the same time because the fee for EAD is waived if submitted w/ AOS.

Hello VJ Community!

I'm a little confused on wether my fiancée whom came via k-1 (wife now) can get a SSN and ID in California.

I read the SSN web site it it states that unless my wife has a work permit, she can't get a social security number.
I read the DMV web site and it states that I need a SSN number for an ID card but if I eligible for SSN, the SSN requirement for ID.

I need the SSN to open bank account and for insurrance purposes. How have you handled this before? Any information would be greatly appreciated.

My now wife just did this a little over a month ago before we were married. She received her SSN card with maiden name a week later. After
we were married, we went back and applied for a name change and she recevied her SSN card with married name. It does help that the clerk

You've been given some incorrect information.

The household size is the US citizen, plus all minor children regardless of where they live, plus the intending immigrant(s). From what you are saying that is a household count of 5 (petitioner, 3 children, plus the immigrant.

Minor children are considered to be wholly dependent regardless of living/custody arrangements.


Your child is not included on line 3 as that is for persons who would need to be sponsored. US citizens do not need sponsorship.

Oh okay... As to determining the household size in the poverty guideline of my fiance, should I be already counted or just our daughter? Will he categorized my daughter as partially or completely dependent? Since I also have a job here in the Philippines and I support my daughter financially as well.

Do not count yourself. I don't know that it will matter what you do here because your husband to be makes more than enough.

He has 2 other kids in his previous marriage who are also dependent. Her ex-wife has a job too. And the custody states that they are 50-50 in terms of child support. Will he answer partially dependent in the form I-134 for his 2 kids?

In this case, partially dependent would be the correct answer.

So if my fiance has 2 kids from previous marriage and has 1 with me, what household size are we going to look at in the poverty guideline? -- 3 (2 kids and my fiance), 4 (2 kids from his ex plus our daughter and himself), or 5 (to which i already am included in the basis for the household size for the petition).

Based on the information you've provided, I would put 4.

His latest w2 and pay statements states that he earns around $44,00 net annually. Is this good enough for the petition?

My fiance and I are going over the affidavit of support (form I-134). We need help in properly filling out the form. We have a 15 month old daughter who's with me here in the Philippines right now and she just received her CRBA certificate and US Passport. My fiance is in the US navy and has already included our daughter as her dependent even before the CRBA has been approved. He declared there that our daighter recieves monthly remittance.

As for the form I-134, my daughter will surely be travelling with me to the US once i get my K1 visa (fingers crossing). So for question no. 3 in the form, we have to write our daughter's name there, right? Since she will be accompanying me and will be supported by my fiance as well, though she's already a US citizen and her father is the one filing the petition.

And then in page 2 of the form, do we still need to write our daughtet's name in the box indicating that she's also my fiance's dependent. Won't it be redundant to puy our daughter's name in those 2 different boxes/questions?

Yes, you will put your daughter's name on both. No it is not redundant. It is for 2 different purposes. The 1st question refers to who will be accompanying you when you travel to the US. The 2nd question refers to the size of the petitioner's household, which is used to determine the poverty guideline. In the petitioner's case who is a member of the US Armed Forces, 100% of the poverty guideline is used. For 2011, the poverty guideline for a military member and a household size of 2, it is $14,710.00. I am pretty sure the petitioner meets this assuming it is only the petitioner and the daughter.

You're correct. My mistake!

For those who are about to apply for SSN, just make sure you print out the information provided in the K-1
guide on how to obtain an SSN. From what I've read here before, some SSA offices are not even aware that K-1 visa holders are eligible to obtain an SSN. So, you may actually have to point it out to them.

It really depends on the state. In California, all they asked for was her passport and birth certificate. The lady that worked in the local office knew exactly what we were ther for. We actually went there after only one week and it was not an issue. My now wife received her SSN card a week later. Then after we were married, we went to the local office and applied for a name change SSN card and she received the updated SSN card a week later. We were reminded by the SSA clerk to come back when the green card is received to again update the SSN card and then again when the 10-year GC is received. It definitely helps when the local SSA office knows your situation.

Well, its been 18 days since our date of I129F approval and the NVC has just now received it into their system today. They informed me to allow an additional 2 to 4 weeks for processing and to receive our letter or case # .....Is this a normal time frame?? (I was expecting things to go quicker than this.)


That is a standard/scripted answer you get from NVC. Call them every day until you get your case #. The following is what we did a little over 2 months ago.

Call NVC after about a week or so and and make sure you talk to a live person. Be sure to have your USCIS # (it starts with either WAC or VAC), petitioner's name & DOB, beneficiary's name & DOB. Ask if they've received your approved petition from USCIS. If they have, ask them for the manila case # and when it was shipped to US Embassy in Manila. It takes about a week for your approved petition to get to Manila through DHL. If not, not a big deal, but call them every other day until you get the information. You can also email them at
]NVCINQUIRY@state.gov[. On the subject line of your email, put the USCIS # and on the body of the email, put petitioner's name & DOB and beneficiary's name & DOB on the body of the email.

While awaiting for your manila case #, your fiance should already be gathering her Birth Certificate, NBI Clearance, CENOMAR, Police Clearance if she worked overseas for more than 6 months from the country where she worked, Annulment (if applicable). You as the petitioner should prepare I-134, employee letter, pay stubs, and tax transcripts for 3 years (you can order tax transcripts from IRS website for free), evidence of ongoing bonafide relationship, money remittance, and anything else that proves a genuine relationship, and then send it all to your fiance as she will need these things for the interview @ USEM.

When you obtain your manila case #, you can pay the visa fee through BPI. Be sure to have your passport when paying for the visa fee and keep the receipt. Wait til the next day and schedule your interview online. You do not have to wait for the eligibility letter from the USEM. Otherwise, you will be waiting for awhile. When you are scheduling online, you'll need manila case #, passport info, and the receipt # from BPI. Give enough time in between interview date and when she plans on getting her medical done when scheduling. There is no need to schedule an appointment for medical since it is walk in. You can register through the SLMEC and fill up the registration online and this will save you an hour and a half. if you don't fill it up, they will make you fill it up on the spot @ the clinic.

A CFO sticker is needed to be affixed to your fiance's passport. If you do not have this, they will not let her board the plane. This can be done in advance and once you have the visa in hand, you can go back to the CFO office in Quirino Avenue and obtain it. Or, you can wait until visa in hand and then attend the CFO seminar and get the certificate the same day.

Once NOA2 is received, you have 4 months to obtain the visa. Say you get approved next month, it will expire in March 2012. As long
as your fiance works on getting all the required documents including getting the medical done, she can setup an interview just prior
