I visited UK several times and David came here on VWP about every 2 months for any where from a long weekend to 10 days. He never overstayed, always had a return ticket and was always honest. He did get a few questions when he brought the ring over to propose but he was let in without issue. We even had to deal with being robbed which meant losing his passport. He got a replacement and left as planned. He has had a few extra questions from time to time but never not been allowed entry. Now we have the 10 yr GC so it should never be a problem again.

BTW to OP great idea pinning this topic. It comes up a lot! :thumbs:

Another tip: don't try to send in faxed copies of pages needing original signatures!

We thought we'd save time by doing that instead of waiting for the Bio form to come back snail mail and it actually slowed us down a couple weeks. Not an actual RFE, but they sent the whole thing back to be corrected. So no faxes or photocopies on signature pages!

Hey I know u had rfe. Can u please tell me which service center u filed and how long it took to get ur approval after the rfe. I also had rfe for proof of meeting in the last two years. My lawyer missed that whole part I guess. Well I send my rfe on sep 14 and they acknowledge receiving it in 16. Just wondering to see timeline for approva. Thank you for ur response in advance.



Vermont service center....please take a look at my timeline for exact dates but I think it took two weeks to get an approval :dance: :dance: :dance: for our petition.

I sent in pictures with written explanations on them...Affidavits form his parent, my parents, his sisters and my brother and sister. I attached the calling cards used to communicate with each person.

Cell phone log
itineraries for each time i visited, proof of my dad always accompanying me on each trip....reasons for some of my trips other than visiting my fiance....how he tied into the visits...
cards, poems and pics of gifts.
passport stamp

Then I wrote on everything so the reviewer could see the big picture...

I just got the RFE letter from USCIS, as well, they asked me to submit tickets, copy of passports entry and exist stamps, photos must be handwritten of date and place, and Affidavit statements of two person. I wanted to ask you guys that SHOULD I SEND MORE than what they asked for? or just send in what they just request?




I had the same RFE requesting evidence...I sent in more than they requested to show my story... :yes:
If you have what they are requesting but more would help them understand your relationship then send in more.

Good luck, I am sure once you submit the evidence requested.....you will soon see your approval letter.

I got the same. I didn't copy my passport and include my ticket reciepts. I sent the passport, more pics, and the ticket information.



I did copy my passport and sent in tickets ect.. We will have to wait and see if it was enough. Pretty sure it was.

I got an RFE regarding that they needed proof I met my fiancee within 2 years. Timestamp aside, if they see the picture of you bother together, wouldn't that supply enough warrant that you had met at all?



I got the same RFE. I will be honest I did not send any evidence in with my petition, because I sorta missed that step. I sent in lots of evidence and any additional items they asked for in the RFE. I sent it all in an organized manner so everything was easy to read and follow. I provided lots of pictures, phone cards, phone log, text messages ect...

Did you send in more evidence????

You can let them know as soon as possible but from experience I wouldn't change your mailing address .

I moved before my NOA2 and called to change my address. My service center took 3 months after I had gotten an RFE to change my address. It delayed everything so much but luckily my congressmen got them to do their job and my address was changed

After reading I've become a little concerned now as I've visited my girlfriend now 5 times and have 3 more trips planned this year but have never carried any proof of ties to my country or of my finances. So my question is, what information do I need to carry in case the questions are asked...I generally just show evidence of my return flight.

- Sorry if this is obvious, but since I had had trouble with "short form" Vs "long form" birth certificates on other matters, I was very cautious. In Mass, the short form is just that, it looks like a 5X7 card you can carry around with you with the basic information and a seal. The long form is a 8 1/2 by 11 sheet of paper with all information (sorry I don't have both side by side so I cannot be more specific), again with a seal.

I had run into other situations where the short form was not sufficient. Early in the process I called the USCIS and asked for clarification, but did not get anywhere. I sent the long form to be on the safe side.

Hello :-)

I have been doing some research for awhile now however id like to get some suggestions from you guys!

My fiancé and I are going to start our k-1 journey soon but I'm unsure as to when We should start it as he is currently here in Australia with me and is leaving to go back home to the states in May. Currently he is not employed however as soon as he gets back he is getting straight into job hunting.

I just want to know if it's a good idea to a) start the process when he gets back and lodge it with only a co-sponsor or b) wait until he gets a job, lodge with cosponsor (for more assurance) and send it off?

Like everyone we just want to be together as soon as possible however I don't want to rush it and ruin any chances of us being together....

Any suggestions will be greatly appreciated!

Start the process now! The Affidavit of Support is only needed when you interview. That might be another three - six months down the road, pending on how fast your NOA2 gets through. In any case, you will have a co-sponsor either way right? So it doesn't matter. 

 

I filed in beginning of Nov when my fiance did not have a job yet. He got a job in Jan. We got our NOA2 in Feb, so by the time I had my interview (April), I only had a couple of his work salary receipts and bank statements and letter from employer, and it was totally fine. 

 

PS - say you go with route b - if his job meets and exceeds the poverty limit, you won't need a cosponsor. It's not an assurance thing - they give you a very clear guideline on what the poverty limit is.

It's 12 months. Not 6 months. I too thought it was 6 months and ended up getting a police cert from Australia where I lived for 11 months. The consular officer asked me how long I was in Australia for - and I said under a year, and he said oh okay yeah cause if it was over a year, then I'd need a cert from you. Your fiancee will not need a cert from Philippines.

I put in only evidence between sending in the petition until the interview date.

 

It included: my phone bill for the last three months (highlighting his number)

- a Christmas card from his family, which had me in the picture

- every card or letter he had sent me

- an updated letter of intent to marry me from him.

 

That's it. A scanned copy should be fine. I contemplated printing out our video chats and chat log, but decided against it and it was fine.

Same sex couple filing for the K1.  My partner is in an Arab country and lives with family.  It would be a very serious issue if their family opened up mail with anything about this visa.  So, does anyone know if anything will be sent to their home address?  Anything at all?  I know Im supposed to send them a copy of the packet, but will the embassy send anything?  
Next question, my background check...  What exactly are they checking for?  Is it just a police record or is it a credit check too?  Cause my credit is awful after my divorce. 

 

 

Yes - the embassy will likely send your fiance's home address packet 3. 

 

Your background check? My fiance (the petitioner) did not have to do a background check, only the beneficiary (me). The background check is just a police record check that your fiance will have to go through. Your credit won't have any effect on your petition. So, a bit unsure about what you mean regarding a background check...

Yes - any countries that he has lived in for more than 1 year since turning 16. Except for the US. 

 

I got mixed information. I thought it was more than anywhere for more than 6 months, so I got one for when I lived in Australia for about 10 months. But when I got there, the consular officer (and packet three) states more than 12 months. He didn't request to see my Australia one even though he knew that I lived there for under a year. 

 

edit: just saw the times he was in NZ - I believe he won't need to. It's consecutive stay, and since he was only there for three months at a time, it doesn't count.

OK...I thought that he needs a police record from any country he has spent 6 months or longer in, so I wasn't sure if the US was part of that. he also was in New Zealand for 3 months in 2013, left for Tonga for 3 months and then was back in New Zealand for 3 months this year....does he need a police record from there then?

And yes, we got our NY senator involved last Thursday and approval was here yesterday. Highly recommend it!

 

 

I thought so too. I was in the US on a student visa. So I got one from the state I studied in. BUT, you do NOT need a police cert from the US. I got my US police cert before they sent the packet 3 (because these things take time), and in the packet 3, it clearly states that you do not need a police cert from the US. The consulate officer did not ask me for one either.

Someone with enough assets does not automatically need a co-sponsor anyway. People can meet the financial support requirement with qualifying assets alone.
 

 

Ohh...! I guess I misunderstood when I was speaking to the consulate officer. 

 

I guess it depends on how much asset...do they have a clear line on that (i.e. it's very clear for affidavit of support that you need to meet the poverty line)? The consular agent told me that a steady income (or steady influx of money) had to be proven.

I am just starting to wade into this paperwork.  I live in the US and my girlfriend (fiance now) lives in London, UK.  I have several questions and any advice would be greatly appreciated.

 

1.  My fiance currently resides in the UK and is a British citizen.  However, she was born and raised in New Zealand and is also a citizen there.  She has lived in London for the last 13 years.  The question is...for the purposes of this paperwork should we file under her UK citizenship or her New Zealand citizenship?  Or does it matter?

 

2.  For proof of meeting in the last 2 years.  I have plenty of photos of us together at various times and I have my boarding passes from a trip we took to New Zealand where I met her family.  She has visited the US several times a year for the past 3 years, she has met my family, we have taken small trips together and I have pictures, but she did not save boarding passes from flights.  We have the email confirmations  for when the tickets were booked, but none of her boarding passes.  She can make copies of her passport showing entry to the US and those dates will match with times I have labeled on the photos of us and with the passport stamps, but is that going to be sufficient?  

 

3.  Two years ago I moved back to the town I grew up in.  My parents have a small business here and I have been learning the business and expanding it.  However, I have not been taking a paycheck, so I do not have tax records to show support.  Now that the business is growing I plan to start taking a paycheck soon, but I still have no way to show income of any substantial nature over the past 2 years.  However, we (my family and I) have a substantial amount of real estate and stock that was left in a living trust by my grandmother and when she died that trust was rolled into a corporation.  I have a 25% share in that corporation and the assets are around 1.5 million.  When the corporation was setup the 4 members of my family that had interest were listed as equal owners and I have those papers.  So, my question is...can I use that as proof of support?  Or am I going to need to get someone to help me with support?  My brother and I share a house together that he owns and it is worth about $180k so we could do that if needed?  Any idea on this one?

 

Okay....I think that is all I have at the moment.  I tried searching the forums, but kept getting lost in the sheer volume of information.  Thank you again for any help you can offer.

 

1. Doesn't matter - I applied using a passport of a country that I do not reside in. Her circumstances due to birth and where she lives now will not raise a flag at all. But she will have declare both when she does her DS160. It doesn't affect it though.

2. Should be sufficient. That's what my fiance and I did. We had some e-mail itineraries, photos, and he photocopied our passport showing same date entry/exit stamps. The passport stamps will be most important. 

3. Yes you will still need a proof of support just in case. Even though you have assets, you need to show proof of a steady support. You will be fine as long as you have a cosponsor - you can actually use your parents since they own their own business. Read up on the i-134, they tell you what to do and show when you own your own business.

We did it solo. Our case is super straightforward. Having been approved, the process was straightforward and easy. But of course, the waiting causes a lot of anxiety.

 

We used the forums A LOT. Just read read read all the guides, absorb all the language, and read all the questions on this forum. It's really not that hard, it's just collecting documents here and there. Your case sounds very straightforward as well, you just need to find a cosponsor by the time your fiance has their interview.

Now my problem is i've been disabled since birth (unable to work) i'm scared that I will be automatically denied for that, is there something I can do, what should I expect? Should I even file? What do you guys recommend here? Do I have to find a co-sponsor because of my disabilities? Thanks in advance

 

You disability won't be an issue. It won't show up in your application at all (unless you can see it in the pictures that you might be sending in). But since you don't have an income, you will need a cosponsor to fill in the affidavit of support for your fiance.

Hello - it definitely depends by country embassy. Of course they can enter the embassy, but at my interview, they wouldn't let fiances enter the actual immigration visa interview room.

Yes, that is regarding other Irish people you may be bringing over too, like your kids for example. But your American fiance's birth cert doesn't need to be included in any part of the visa package. Just pop your one in the pot and you're done. :-)

 

Yeah, I'll just go with my official birth cert. Is there anything else that I need to know? I have an expedited interview due to be scheduled in the next couple of weeks and want everything in order. I have my police clearance from ireland (it is a year old) but I'm hoping that will do. How about the domicile thing? What should my wife present. We don't own a property or anything here and will be returning to live with family for the time being.

Hi Dochas, I got my visa months ago and passed the interview no problem. No, you don't need any copy of your fiance's birth cert, all you need is a certified copy of your birth cert throughout the whole process including the interview, :-)

 

Oh, really? I was sure it said you need a birth cert of each person on the application. I guess that is if there is a few beneficiaries.

Unrelated topic but I'm looking at the checklist and it says that you need a certified copy of each person named in the application. Do they require you to have a certified copy of the American fiancée's birth cert also? That seems like a lot of hassle. I hope I'm going to be able to get that in time for the interview because those things can take time. :(

I just got my cehcklist this morning and was wondering the same thing if I need that for my American wife?

We were both separated from our former spouses when we dated. We got divorcedfrom our exes just before we got engaged in april 2009 and we wed in July 2009. We had no problems at all. I would not worry.

You will need to provide a copy of your your divorce decree to prove you are free to marry.
