My fiance was denied on a K-1 visa 212(A)(9)(B )(II) but where given the opportunity to apply for the waiver.

Couple of questions:
  • When my fiance submits his I-601 at his appointment, does he go through another interview, or is he just going to go in and submit the necessary paperwork and play the waiting game?
  • What is the current waiting time for a response on a I-601 for K-1 applicants?

There's a Holiday Inn Express as well, less than 1 blk from the Consulate. One of the clinics moved near the consluate (we did our K-1 medical there), the other stayed near the old consulate. We had a great experience with the folks at Holiday Inn Express.

If it's her name on line three then I don't really understand why they ask for spouse. Please help me!!! Someone with experience dealing with Mexican process.

Hi Emily,

I don't want to bring your spirits down, but it is best to leave the return date open. I just went to juarez about a week and a half. there was different turn around times in getting the visa.

Yes, there was some people who got their visa's the next day, but I will say that there was also people who waited about 4-5 days, which required them to stay over the weekend.

Most of the delay is not the Consulate fault but DHL, who is the responsible party. Once the consulate process the visa it is then send to DHL where the recipient is to personally go and pick it up. But DHL sometimes takes a long time to do what they need to do in order to get it ready for pick up.

The consulate in Ciudad Juarez received our petition from the NVC on Jan 1 and on Jan 31 our lawyer received the letter inviting us to being consular processing. Everything that's in the packet is also on the consulate's website. I hate that you're waiting!

As Cici stated, we went ahead and got "Certificado de Antecendentes no Penales". Again, re-stating Cici, it is up to the official who asks for your paperwork who will decide. My boyfriend has no criminal records, so we had no problems with that. Our thought is it is better to have a lot of information (paperwork) on the day of your visit at the consulate other than showing at the consulate and being told that we forgot to bring additional information.

He got his from Toluca, as that was the closes place to where he lives. He was able to get his very fast from what I understand. We were going to translate it when we were at Juarez, but the translator said that it was not needed any more becuase they don't ask for it. When he went to the consulate they took the original copy.

If you are missing something they will reschedule your appointment and you don't know when that could be. The more information you provide the better changes you have to proof your fiance will not be a financial burden to the US

You don't want the official to deny your fiancee's visa just because you decided not to provide your taxes because as you said you are not self-employed. blush.gif

Ok, so you need to have your invitation letter printed out! Not a problem.

When go to the consulate, and there is a big line, first try going to the front of the line, and ask one of the guards which line is it to get your invitation letter printed out as you never got it. If they are cool(nice) about the situation, they might just let you in and direct you to the information line. If, no then just get in line with everyone else and then they will tell you which line is the information line.

If you arrive before the consulate closes on Friday, then just get the letter on Friday, that way you have less stress on Monday. But if you get it on Monday, make sure you go early so you are not late for the medical exam.

After all that stress before and during the interview and finally being approved I got back to the hotel to take a nap. When I woke up it was around 2 and I checked the DHL website and to my surprise the VISA was ready and waiting for me. I just got back from going and picking it up. I'm just so surprised about how lightning fast the interview and getting the visa was. The medical was another story but whatever it's done.

To answer some of the recent questions.
They are still not using the DS-160.
They did ask me for the DS-157.
At the clinic you can pay with pesos or dollars for the medical exam.
For the visa fee at the bank you have to use pesos.

Regarding the questions about the interview. It's pretty much what everyone have posted. In my case it was very fast. I think it was that fast because we sent a huge I-129F that the interviewer was reviewing. The only thing extra he asked were pictures. That was my case, either way come prepared with lots of things.

To some degree you can give thanks to the "Swine Flu". Since the Consulate Offices were closed for over a week, DHL really didn't have a backlog of visas to issue. So for now, we can say the turn around time is fast. yes.gif

My signature has a link to a google map i created that shows where everything is at. Including the hotel. Make sure it is in Satelite mode. Don't the map is old pictures but it is current in information. You will see that everything is close to each other.

NVC will send you a letter saying that an approved fiance visa on you your behalf is being sent to ciudad juarez to be further processed or something like that. That is when you know that it eventually will be there (and wait a bit before you call so you give it time to get there). They will send you guys a fiance packet, which has the directins of what to do next and what papers you will need for the ciudad juarez interview. DO NOT RELY JUST ON THE PAPERWORK THEY SEND YOU FOR COMPLETE INSTRUCTIONS!!!!!!!!!!!!!!!!!!!!!!!!!!! Alot of the info is missing, so look at the guides or double check with somebody on visajourney before you go to make sure you have everything that you need.


AND alot of people mention a packet, we never got a packet...just a letter!

I would recommend waiting a month, but because of the medical situation the embassy's are closed until May 6. Since nobody is working, applications/petitions are not being processed.

Wait about a month and a half. Call and ask if the invitation letter has been send out. If it has, start making travel arrangements. If not then wait a little more just in case it comes in the mail or call again.

Note: You don't have to wait for the letter to arrive to start organizing all the paperwork your fiance needs for the interview. You will not get a package in the mail only a letter with a website address:

Me and my fiance went on March 10, 2009. We used the new DS-160 as indicated on the consulate website, but the people reviewing the paperwork right before security check also requested the other 2. Luckily Holiday Inn Express (Paseo Victoria) has computers in the lobby with internet services that we did it in a few minutes.

I would recommend you do all the forms to be safe and not sorry.

I recommend you wait 4 weeks to receive notice from Juarez. If nothing then call them as that is the only way to get information.

I am not familiar with CR-1 interviews. So don't know about that.

adjustment of status cases. It allows the Attorney General to grant a waiver
to any alien who subsequently has been vaccinated after having been found
ineligible at the time of adjustment of status. Since medical exams for
immigrants are conducted prior to the visa interview, most applicants will
not need an INA 212(g)(2)(A) waiver. However, during the initial phases,
some applicants will appear for their interview without the completed Form
DS-2053, Medical Examination for Immigrant or Refugee Applicant. Consular
officers must refuse these applicants under INA 212(a)(1)(A)(ii) and the
applicant must return to the panel physician to complete their medical exam.
Once they have done so, they will obtain a Form DS-2053. This form is
submitted to the consular office and the consular officer would approve a
blanket waiver under INA 212(g)(2)(A).


If everyone remembers K-1 visa applicants were not required to get vaccinated during the medical exam. We can assume to say the were "Waived". Once the K-1 visa holders crosses the border gets married and then starts the process of "Adjustment of Status" (I-130) or something, you will be asked to take the necessary vaccines.

Just an FYI on this subject. If you happen to use JFK airport in NYC as your first point of entry into the US, they will issue you a temporary work authorization stamp in your passport that is good for 90 days. This is typically enough time to receive your permanent EAD. Unfortunately, this is the only POE into the US that does this and it's not very convenient for immigrants from Mexico to use that point of entry. Because Aldo was coming out of Cancun, he flew to Salt Lake City on JetBlue Airlines. They use JFK airport as a layover city, so he was able to get the temporary work stamp. good.gif Something to think about...it may not be possible for everyone to do this, but it was a big plus for us. Thanks CGOlivas, I'll see if I can research that independent contractor stuff if not well we will just have to wait. My fiance was kind of hoping that he could work right away, he doesn't like just being around doing nothing. I know it probably takes like 3-6 months for the work authorization to be approved. He is just going to have to deal with.

To get the SSN do we need to take another form or just taking our passport and showing them the k-1 visa stamped on it would work?

We don't need to use an airplane, which totally sucks because he is going to have to wait to be able to work. But on the other hand its good because we can see each other more often now. If the kid is part of the application, yes they need to go inside to the consular officer. It is very important that they show up.

Yes, K-1 applicants need to get in the big line. When we went in march, my fiance had to get in the big line also. Correct, there is no specific date, but their is a specific timeline. The day before the appointment we went to the consulate around 3pm to educate ourselves on what my fiance needed to do to get in. He asked us what the purpose of the visit. We told him we had an open invitation, and if we could just go to the front of the line (we were trying to be friendly with the guard so he can be nice to my fiance the next day). He tested us a little on the appointment, and he pointed out that there was still a time frame to follow. He was polite and nice about the situation. We told him we wanted to come early in the morning, but the early we could be there is 7:30 because that is when they were allowing the 8:00am appointment people in.

True not everyone is a K-1 visa applicant, but everyone that is in line has an appointment for some reason. that line is not as important as once you are inside. Don't know how much you were able to observe, but from what I remember, is that you get in that big line first. Then they direct you to another line according to your appointment time. Then you go through security check (where they pass you through metal detectors). Then you get in another line, where they tell you where you need to go according to the reason of your visit. That big line is just to get inside the consulate.

Overall, hand in there, as you have already observed, you are not alone right now. Hope you have made friends in order to have somebody to share your thoughts on waiting for your loved ones. That is one thing that helped me out, making friends with people that are just their for support for their loved ones. It helps to settle the nerves.

Yes, the new consulate has been in business since about November 2008. I would also recommend the Holiday Inn Express.

I recently heard, that ever since they moved to the new location, they have been at least closed once a week. It seems as though they are not 100% completely moved or in place. It happened to us also. They were closed on Wednesday the week we were there. But they also had plans to close on Monday of the following week. Even the locals don't know why they close so much. Especially when they are non-holidays!

You will not be disappointed in choosing Holiday Inn Express, Make sure you take advantage of the Continental Breakfast between 6-10am. It is not just toast and cereal. They also provide eggs, refried beans, and another hot dish which changes dailyl (Please pick up your plates after eating, as their is no actual "bus boy". Their is a gentleman who is their, and after speaking with him, he clarified the situation, so thought I would pass the word)

Medical Exam: I would recommend to arrive before 5:30am. How early that is up to you! I send my boyfriend at 5:30am which he thought I was nuts but then he said there was a lot, but a lot of people there already.

There was a couple in which we became friends with and they said they would hear people getting ready as early as 3am. we were sound asleep and did not hear anything until the alarm sounded off. Again this are my suggestions. If you arrive over the weekend, I would recommend to make friends with people who have been there a couple of days already and get the latest inside scoop! Or just let the "Dumbo" ears do the work laughing.gif

Well my fiance did not get approved or denied, but that is another story.

In regards to timeline, Paul_Light, I would add another night to your schedule.

The fastest I heard someone get their passport was the next afternoon. But at the same time, another person, went to her interview on Wednesday, but did not get her passport until Wednesday of the following week.

There is no exact turn around time after getting your visa approved. I provided both examples just to show that it can go either way!. When I made my plans, I just purchased a one-way ticket and estimated how long we would be at the hotel. We did not purchase our return flights until we knew we were done with business matters. It was not surprising to hear hotel guests adding additional nights to their stay as they did not know when DHL will have their packet ready for pick-up. It was on a day by day cases!
