Well, thankfully, the Laos government has nothing to do with the interview. The U.S. government, on the other hand, does. Rather the COs do. However, the interview is in the distant future. You will first need to get past the petition stage. Have your fiancee apply for a tourist visa, it will most likely be denied. She will need to show several attempts/denials not only for the U.S. but for Canada/Mexico as well.

These hardship waivers are notoriously difficult to obtain as the one K-1 pre requirement is having met face-to-face at least once in the last two years. I do wish you luck in your endeavors. Do realize it is an uphill battle. You will need to exhaust each and every avenue.

FYI: The K-1 visa is so that you can enter the U.S. to marry your USC petitioner. The 90 days is given so that you can plan the wedding, it is not meant to be a "test drive" -- no matter how many claim that it can be used for that too. That is why you sign the intent to marry form.
All these "issues" should be sorted out before applying for the visa, IMO.

Now of course I understand things happen and if you don't think getting married is the right thing for you to do now, you should certainly wait and weigh your options. I wish you all the luck in resolving this situation.

If you don't get married within the 90 days, your fiance needs to leave the U.S.

He can use his VWP privileges to re-enter the U.S. but be advised that admission to the U.S. is at the sole discretion of the CBP at POE. He will need to demonstrate overwhelming ties to Sweden that would compel him to return at the end of his stay.

VERY IMPORTANT:

Under Indian laws, a religious ceremony/wedding is deemed to be a valid LEGAL marriage in India. Unlike other places like Thailand or Vietnam. Doesn't matter whether you register it or not. I distinctly remember reading about two cases which were denied for precisely THIS reason. Please remember local customs and rules differ from one country to another and the consulates go by those rules.

Do NOT attempt to go via this path. If you have to get married in June/July, withdraw this K-1 petition and file for a CR-1 once you have the marriage certificate. The K-1 is for fiancees. Not wives.

Your father is an illegal alien if he is still waiting for his PD. How did he get into the State without a visa if his PD never came up? You can't be a LPR/GC holder without your PD ever having become current and you having been issued your family-based immigrant visa in order to enter the U.S.

Like Jim said though, his status no bearing on your status.

You have accrued a 10 year ban.

You can either wait it out. Or you can apply for a waiver in which your USC fiance is going to have prove hardship. She will have to prove WHY she can't come and live with you in Mexico, which seems a little illogical considering she already spent a few years there.

She will not get the full 90 days this time, only the remaining time on the I-94. She will need to return and get married ASAP.

Failing that, you will probably have to file for another K-1.

There's nothing you, your Congressman or anyone can do. Only the applicants can qualify for it by demonstrating significant economic and social ties that will compel them to return at the end of their stay in order to convince the CO.

Daughter's in the U.S.--mother, father, little brother are most likely NOT going going to be issued B2s together. Not from Peru.

I'm sorry about your situation and I understand your fiancee's heartbreak but unfortunately, this is a situation most K-1 entrants have to keep in mind/expect on some level.

You can always go back after procuring the AP and have a big celebrationg in Peru.

"Traditional" meaning "religious" marriage in India is de facto legal marriage, EVEN if you don't register it. So yes, your lawyer was absolutely correct.

Remember, consulates go by the rules/customs/laws of the country in which the marriage is taking place.

Don't even think about this route. I remember reading about 2 denials specifically for this purpose.

You can get married and apply for a CR-1 for her. K-3s are dead.

Or you can file for a K-1, and then get married in the U.S.

The choice is yours.

If she didn't finish her application and left before her AOS was approved (based on her first K-1 marriage) -- then it could be that they considered her application to be abandoned. Maybe somehow that got translated as deported in the systems? So now they won't let her in?

You've got more problems if this is her second K-1. You really need an immigration attorney, buddy. Good luck!

If you have no intent of marrying and just want to try out life in the U.S.A., you'd be committing visa fraud--using a specific visa for a totally different purpose.

It's that simple. The K-1 visa is NOT meant to be a test drive, no matter what anyone says so. Encouraging such an act is against the VJ TOS as it is illegal.

You already state that it would be "impossible for you to get married within the 90 days" of U.S. entry. THAT is the ONE requirement of the K-1 visa--that the K-1 entree marry her original USC petitioner within 90 days.

While I do understand your situation and realize the bind you are in -- you should not begin the process--a long, exhausting, tiresome, frustrating expensive one--if you can't fulfil the basic requirement of the visa that you're attempting to secure. You're setting yourself up for failure right at the start.

Also, do NOT, under ANY circumstances lie to immigration. Bad, bad idea.

If you get married, that will void the K-1 and you will have to go through the entire process of getting a CR-1.

The only stipulation of the K-1 is that the marriage must take place in the U.S. within the 90 days. Marriage outside the U.S. voids the visa.

You've applied for a fiancee visa. If you get married, she's no longer your fiancee, but is, instead, your wife. Thereby, she is no longer eligible for the K-1.
