CanadaHELP on Co Sponsor Info
Please help im panaclking like crazy here. I just realized we may need a joint sponsor as his income last year and the year before was below the poverty line due to losing his job in the layoffs of the economy. He got a new job this feb and earns above the poverty line. We have a letter from his Employer and the stubs showing how much he makes. I am hoping this will be enough with for the interview in MTL on the 27 along with a copy of his savings in a bank account. I know we will need a sponsor to adjust status because they need the last 3 years on the I864 form which s ok we have time for that, but this is cutting it pretty close. Can anyone helpe me out on this. I have read on some posts that Co in MTL didn't even look at the tax return just the recent pay stub and the letter. PLEASE HELP

As far as the Affidavit of Support goes, his current income should be above the poverty line. It will be on your shoulders to prove that his income is above the poverty line as his last years returns will not indicate that.
If you could get a co-sponsor, that would be really good.

We are going to use his moms assets amd she is going to co sign for us, his father passed away 4 years ago and there is an inheritance sitting in the bank which we can use as assets to supplement the $3000 that he was short last year on his tax return, so $3000 x 5 years is $15000 we should be ok. I assume i just get her to complete the I-134 form and put in the amount she has in savings and then a copy from the bank showing how much is on account in the savings.

I know you might know this but I didn't see the following items on your check list:
a) Medical sealed envelope.
b) Copies of NOA-1, letter from NVC, and a copy of the I-129F package sent out initially.
c) Birth certificate.
d) DS-160 form + confirmation page.

Do you think we will need a sponsor. He is above the poverty line now he just started work in February and his annual income is above it, however last year he wasn't because he lost his job and was on unemployement for a while. i am not sure if i should get a sponsor for the interview or not or if the letter from his employer and his paystubs will be enough. I am confused as it says you only need a co sponsor if you don't have adequate income, he does now but when they take a look at his tax return from last year it will below

Well guys and gals, my interview date is 27 days away and of course the fee has to more than triple, however its bitter sweet for me as I kept on hoping and praying that i would not get an interview date before June 10 as i wanted to go to my friends weddind down in boston,so i can't be that upset, plus how many people are still waiting for a date. I am very anxious to get it over with. I think I have all my stuff ready and in order. I have the origianl and copy of everything below

My medical is June 11 and i pick up the evelope the morning of the interview at 7 then run over to the consulate.

I am not taking the tax returns as he hasn't done his yet (i know he's late) and it says in the letter an example of evidence is tax returns, pay stubs etc. I think i wil lbe ok with this and i have everything ready to go.

Hey guys anyone know if there is a storage locker or something were i can put my purse and cell phone while im having my interview. I am staying at by friends place the night before then walkin to the embassy in the morning of the interview but she will be at work when im done and i really don't have a way to get back into her apt. If you need more than one affidavit, fill out the entire form but leave the signature blank, then sign each copy and the original. It states in the directions that you can do this.

This is to 'capture' an 'original signature' on a copy. A Copy of a Signature won't wash, is not accepted on Interview Day - so instead, IMO, this FAQ entry helps with the 'original signature' requirement.

YUP - I can understand how it can be confusing.



Does the Sponsor answer Question 10 on the form "I have submitted a visa petition to USCIS on behalf of"

Just a little confused as I know my fiance would fill this out as he did, but his mother didn't?

When you go into Guides, and click on K1 Visa, then click on the FAQ link for I-134 it is the first paragraph, kinda confusing i think, but you know it could be me with everything that is going on here!!!

Hey have a question. His mother is co signing for us (he didn't make enought last year but this year does) but to be on the safe side we are using her. I was looking thru the guides and it says don't sign the I-134 form??? doesn't make sense. They have both filled out individual I-134 forms and atatched the documents, wouldn't they each sign there own I-134?

CanadaJune 14th Interview Review

We showed up around 6h30 (parked the car on Bleury, below René-Lévesque, 12$ for the day - and a very short walk to the consulate.) We were the only ones there for a while. We were standing on the left side of the doors, and everybody else lined up on the right side, which made me start to doubt myself, but when the security guy came out, he had everybody line up behind us.
We ended up with letter B because our guy doing the security check was slower than the other. No big deal. Went downstairs and waited for someone to come back and escort us up the elevator.
We got called to window 8 after letters A and C. The lady was super nice. She had her checklist and asked for my papers, one at a time.
-Original birth certificate + copy + translation (certified, not notarised)
-Passport + copy of bio page
-Police certificates (originals they keep)
-Medical report - sealed - they dont want the xrays
-2 photos with my name printed on the back
-Letter of intent from Matt (I had one from me but she didnt want it)
-Form 134 + supporting docs (I had copies of the IRS transcripts, letter from employer, his 401K statement, and letter from the bank stating when the accounts were opened, amount in them and last year's total deposits, which they all kept)
-Big ####### enveloppe, with my name and address. She asked if I had written down the tracking number. She folded it a bit better than I had.
She asked if we knew about the new fees and sent Matt to pay the 350$ while we were taking care of the paperwork (you don't have to wait in line with everybody else -- you wait to the side and cut the line). Once he came back with the receipt, she took my fingerprints.
We waited a few more minutes, and after letter A was out, we got called to booth 8. You just walk right in.
The man in there was super nice and friendly right away. I was nervous but had a huge grin stamped on my face (had been waiting 9 months for this day!). He made me sign a form and I noticed my hand was shaking.

He asked a few questions:
- How did you meet? When?
- Who proposed to who?
- What was your technique, sir?
- What do you do (to Matt)?
- What do you do (to me)? .. and a few more detailed questions about my work.
- Ever had issues with the police?
- Ever married? Have kids?
- Ever had problems entering the U.S.? (yes, was denied entry) When? Why?
- Have you been in the U.S. since? No. Matt said we didnt want to take chances and started ranting that it had been way too long and very inconvenient. The man agreed apologetically.

He took a fingerprint of my middle finger and said, "Based on what you have told me today, I can tell you that your visa is approved". He must get a kick out of seeing peoples reactions when he says that because he was staring at me expectantly with a big smile as he said it. Indeed, the permagrin that was already plastered on my face got even bigger.
Matt asked if I could go to the U.S. without activating my K1 for a day or 2 and he said ABSOLUTELY NOT. We'd have to start all over again.
He gave me a piece of paper... not sure where that went. And gave me back my original birth certificate. All the rest they kept. He never asked us for any additional evidence of relationship.
Out by 9am.
I wish I would have believed people when they said not to stress about it!


... Also, I received my visa yesterday, so 3 days after the interview. :)



I am super nervous about my interview for some reason, I just keep on comming up with reason why i will get declined.!!1 stupid i know. We have everything in order and the co sponsor is all in place but i am just a super control freak ha ha!!! Thanks for letting me know what side you stood on, i couldn't remember if it was left or right.

WOW i really hope you guys get your interviews soon. Looks like i just squeezed in. My interview is next week the 23 and I have not seen anyone on here booked after me (K1 anyway). If, (and when) they give me my visa next week i will ask whats going on for you!!! ha ha. don't want to get them mad befor they say the magic words "your approved" to me.

haha yes the "no date set" was very clear. when she said "you wont get a date untill montreal looks at your case" wasnt all that clear to me. I was like hmm didnt they already look at it and say I was able to get a date?? lol she also told me she had to carefully look through my case and thats why i was on hold for 15 mins. I was like you had to look through my case??? and she said yes. i was a bit confused as to why she had to do that when all the other times i called they had no problem telling me right away there was no date. I knew i shouldnt have called today. She just annoyed me and i didnt want to be annoyed on my birthday lol Its ok i got over it.



Off to my medical tomorrow in MTL!!! should be fun. I work at a hospital here so I had to get a lot of vaccines before i started working so I have all them so hopefully the $215 will be it!!! Just heard its Grand Prix in MTL this weekend so hopefully the traffic isn't that bad at 9:15 when I land, then I am off to Boston to see my fiance for the weekend and to pick up all the documents for the interview sooooooooooooooo excited

We often see a batch of CR-1 interview, followed by a couple days (1-2 weeks maybe) later, by some K-1 interviews... That's what happened when i got mine! And the other batch before me as well! So keep hope maybe next week is the one! :thumbs:

GOODLUCK EVERYONE!!! I hope you all get your interviews this week. I can't believe mine is comming up in a month. I have my medical June 11 in MTL. Scheduled at 10:15am then leave for Boston at 4:15. Then back to MTL for the interviw. I ahve to pick up my results the morning on the interview so I will be sprinting from Medisys to the consulate at 7am. Its not far I am very familar with MTL I will be sure to post everything.

This is most excellent news! So EI will pay from whenever my fiance' moves (I think there is some 2 week "waiting period") even if the EAD doesn't come for several weeks/months later, but they only start paying after the EAD is received? That is one of the best things I have read lately.



As long as she has had the required insurable hours she should be approved. There is an EI thread in this forum right at the top. You should read it its really good. I just called as I wanted to ensure info hadn't changed and it hadn't. also go onto service canada website under EI benefits and "who is eligible and it will help you aswell.

That's awesome because I'll be out of work when school stops in June, so I was wondering about EI when I move... Thanks beantown for the info!



Your EAD is your Employement Authorization Document. You need to file for this when your Adjust your status. This will allow you to work in the USA. You can notwork until you have this document. What you do is you send service canada a copy of yourK1 visa, open up a file, keep filing every week, then when you get your EAD send them a copy of the EAD and they will begin payments for you, up to 36 weeks depending on what you were approved for. You do have to have worked for 52 weeks with a minimum of 920 hours to be approved though.

The lady was so nice, she said we can definatly claim, as long as we file within 30 days of leaving our jobs, then continue to fill out the EI report every week even though we are not receiving payments as this will keep the file open. Then when the EAD comes they will start paying benefits from the date we moved to the USA, so you don't lose any weeks if you are entitled to the full 36 weeks they will give you 36 weeks. Also they can deposit it into a USA account.

I almost got super stressed about the 90-days thing, but i'm pretty sure it's valid for a year (or at least 6 months), as Kizza said.

I'm willing to help with the DoS calling thing. My fiancé called yesterday and there was nothing. If someone can call tomorrow or friday it would help :P



The lady at my local police station told me it was valid for 90 days but she was old and didn't understand what I meant when I said VISA so who knows.

Welp, I got everything done yesterday :D with a little bit of a panic attack, but I got it all settled. Thanks again AandB for all the help. Luckily I was saving everything, so I was able to print it all out. :wacko: I'm going to be sending it off tomorrow and i'm going to get my police clearance done Friday.

What is everyone else here doing about the medical? are you guys waiting for the p4 to make a appointment?



I am waiting till I get my interview date to do my medical and get my police certifacte as the police certificate is only good for 90 days and cost $20 so I don't want it to expire and pay yet another fee!!!

Well I just officially became a PR of USA!! I'm sure my experience is similar to others except maybe my wait time was probably longer. I waited for about 50 minutes before I was called and it took about 15 minutes to process my visa.

I'm a little confused though because they did not ask me if I was bringing anything in with me...so once the visa was processed they told me I was finished and I left. However...I brought my car. I thought I would have to fill out some paper work for it...but they never asked and I was just so glad it was over I never said anything!! So can someone tell me if I will need to go back to the border or can I just go to the nearest DMV and register??

Hope they didn't lose it!!! ha ha, We both had the same CO so he better had taken care of my visa too, anyway glad you POE'd ok and can't wait till July 30 to come. So had my interview June 23, 2010 and passed. The CO told me it would take about 5 days to receive my visa. With the holidays in Quebec and yesterday that means today is day #5. No visa yet!!! I interviewed right after Cdnwife and she got her visa on tuesday but she was an IR-1, im a K1. So I called DOS to see what the hold up was and she said it hadn't been printed yet!!! its approved but not printed, good thing i didn't have my POE anytime soon. I am not POE'ing until July 30th,the lady was nice and said probably next week i should have it, lets hope!!! Just in case anyone else is planning their POE's don't assume it will be as fast as they say.

Hey!
Congratulations on being approved! So at the interview, you were told "your visa is approved"? If so, then it's probably a matter of bureaucracy (hope you can say that in English!).
When you think about it, there was a holiday the day after your interview, which means the consulate people were off. Then the 1st of July, which means again they were off. And today they're not working because the 4th of July was yesterday, a Sunday... They'll be off today because of that (mother in law works for the US governement and she's off today)...
So technically, the consulate has had only 5 work days since your interview...Try not to worry too much, give it another week and see what happens.

I emailed the consulate yesterday inquiring about the status of when the visa would be printed. To my surprise they just emailed me back (i was not anticipating a reply back at all) they said "a visa was issued and you should have receive it or receive it shortly" Great no date of issuance and the tracking # not in the canada post system, (Oh i love gov't) So I called DOS and they said it was issued this morning, but she is not sure when it will go out as montreal is so slow with everything!!! So here's hoping it doesn't sit in the mailroom for a week. At least I can relax a little now whew!!!

Ok I am panicking for nothing and just having an OCD moment!!! I had my interview June 23 and was approved, the guy took my passport said 5 days the usual stuff. I wasn't really panicking until 2 people that interviewed on the same day one was an IR1 visa the other a K1 got there visa's already. Should I be panicking?? DOS said that the CO has no notes requesting anything, and that it should be printed shortly. I just find it weired that I was the 2nd person interviwed that day and don't have my visa but other people do, anyone else had this experience?

Had my interview yesterday and was approved, it was so easy why i was nervous i have no idea. Met Canadian wife there she was infront of me in the line, and we ended up having the same CO for the interview so she was giving me a heads up (we got the super nice man and lady) Its like walking into a DMV, but the view is beautiful from up there. They didn't take my fiance's paystubs just the I34 and the letter from his employer and his tax return. I was in and out by 9:10am. I picked up my medical results before i went ot the embassy at medisys. They say they open at 7am but really the doors are open at 6:45 and they gave me my results and i was at the embassy lining up by 7am with only canadian wife and another girl in front of me. Soo happy now, will be POE ing July 30 thru Maine, fiance is comming up July 24 to help me pack and drive the uhaul down, soooooooooooooooo excited and happy this is over woot woot!!!

It's the date of your i94 the 3 month expiry date after your poe. i did my poe april 6 and my expiry date which is 3 months after (the 90 days you have to get married in) is july 5th, which is the same date in my passport and i 94.

Ha ha!!! glad im not the only one that had to question it. Another question. On form 1-485 what date do I use in section 1 where it says USCIS status and then expiration date? is the exp date the 3 months from when i activate my visa or the exp date on my visa

So I finally got my passport with my visa in it yesterday (it looks so pretty) I have a question though. I am filling out my AOS forms and it says on the I485 form (Adjustment of Status) wwhat is your visa #, where is that anyone know. I see a control # and a an A#,and a PETN# its the red 8 digit # on the bottom right? Thanks everyone can't wait till the 30th to activate this!!!

CanadaAnother Problem - Support Form

When I went for my interview we were in the same situation. My husband makes enough yearly income according to his letter from his employer but his previous year income was half that(and not enough to sponsor myself AND 3 kids) because he had just moved back to the US from Canada and wasn't working for almost 6 months. When I got to the interview I told them he made X a year but last year he only made X and we DID have a co-sponsor if needed....she said no thats fine and only took his paperwork. Now for the AOS part...I sent the co-sponsor stuff in JUST IN CASE...



I had the same thing, my fiance was a victim of the economy last year working at the bank!!! of course he got laid off and last year didn't make over the poverty line as he came to visit me for a few months and they wouldn't give him his unemployment. He makes over the poverty line this year and we had a letter from his ER and paystubs and the tax return from 2008 and 2009, plus we had his mom complete an affidavit and I had her W2s etc. When I had my interview the lady that went thru my checklist at the window didn't even take the paystubs she just took the letter and gave me back the stubs. Then the CO who interviewed me said why you have a co sponsor you don't need it, i just said wanted to be safe than sorry. However when i do my AOS we are submitting everything just incase. Also as an FYI give them copies of the tax stuff, w2's tax returns, and paystubs as they keep what you give them so if you give them originals you won't have them for your AOS and you need them for AOS just in case they ask for them. You will be fine

I think that was my my POE too, back in Dec 17 2004,lol. I crossed around 1900ish, wasnt busy at all. I was the only person besides staff in the building. Mind you it was storming outside!! Very painless, and they didnt even look in my u-haul. Customs guys barely looked at my inventory list, was much more interested in his solitaire computer card game!!

just wanted to pipe in and say good luck. We crossed over the Ambassador bridge and if it weren't a Saturday (as the border patrol had stated) we would probably have only been an hour. I had lists of everything and the border patrol did not look at any of it. I am thinking because we had everything so organized and ready for them. I did pay the $6.00 although the border patrol almost forgot to ask for it).
be patient and enjoy the experience.



I am POE'ing on Saturday at Calis ME, so excite. My fiance is flying in tonight and we are driving the U-haul down 10 hour drive how fun!!! can't wait so excited of the fact that i can pick him up tonight and know i don't have to take him back.

I thought you had to wait for your ead aswell but you dont you have to apply within 30 days of moving to the usa. all claims are handled out of the kingston office. i spoke to a guy who actually is the one who determines your approval. A lady i know moved to maine in june and she was the one that told me that you can collect ei as soon as you arrive, she went down on a k1 and was the one who put me in contact with a guy she was speaking to at the kingston office. he said just fax over a copy of my visa and 194 with my confirmation # on it, the only thing is you cant fill out your cards online they mail you your cards each week and then wehen you send them back your money will be deposited. I told him that i thought i had to have my ead as i had to be willing and able to work, he said its complicated but they do process them without and ead if you g show that you are getting married asap and adjusting your status to show that you are taking initiative to apply for an ead.
