K-1 Fiance(e) Visa Case Filing and Progress ReportsWe asked if possible to reschedule interview, now lost our original date.
Oh what a painful day for us. I don't even know where to begin really.

My fiancee was having problems with her work schedule.
They were being very vague as to whether or not they would give her the day of her interview off of work.
Me, feeling helpless from overhear, leaped into action. Action that today proves fatal to our mood, but not to our process.

I immediately called my Senator. Practically in tears with all the emotions that run rampant through this ridiculous process, I asked if they could contact
the consulate and ask if it was possible to reschedule the interview. Of course they were happy to help and sent an email directly to the consular general.
THE NEXT DAY, my fiancee gets a call from the consulate telling her that the next available date for an interview would be January 14th of next year.
YIKES!! Two months away?? ARE YOU KIDDING ME?!

She asked if she could have a day to try one last time to sort it out with her job, the women on the phone replied, "of course you can."
The day after this happened, my fiancee decided that this was more important than work and regardless of what the job said, she would keep the original interview date of November 12th. This Thursday.
She sent a confirmation email on Friday November 6th confirming she wanted to keep the date.

The consulate called her cell phone multiple times that day, but as it is her work phone it was off because it was a Moroccan hoilday.
Our belief, is that someone at the consulate couldn't reach her, so they just said she agreed to the date change.

Monday morning rolled in (today) and I get a frantic call at 6am.
My fiancee received a call from the consulate stating that her interview had been successfully rescheduled for January 14th 2010 at 8am.
She said, "Wait, I sent an email confirming I wish to keep the date!"

We sent tons of emails in the last four hours. I mean tons.
They finally responded with this.

Dear Sir,



Thank you for your follow up e-mail. Please note that this office has received several e-mails from yourself, from the Senator's office and from your fiancée requesting her appointment (November 12, 2009) to be changed and rescheduled for a later date. This office has replied to the congressman's e-mail informing them about her new interview appointment on January 14, 2010, at 8:00 am. This office has also called your fiancée to inform her about her new appointment and she acknowledged and agreed. Unfortunately her slot for November 12 has been filled and cannot be altered. However, we will keep her in the standby list for any cancellation of any earlier appointment. We apologize for the inconvenience.

Now we are crushed and the rude and mean emails haven't stopped.

Thanks Frosty, and yeah I know it is a HUGE move anyone can agree, however he went through with his interview at the end of March and had his Visa in hand, only to tell me two weeks after he got it that he didn't think he loved me enough to move here and that he didn't have the same feelings for me as he use to. #######!! We have a 23 month old..He was just here to visit in March and never mentioned anything about not having any feelings for me anymore. He even left some things here at my house and advised me that he would have to give his job a months notice and that he would be here the middle of May. It's all so crazy...I was devestated!!

Yea my lady arrived. It took a lot of pushing though.
We were in this situation as well, she told me the same things.
Im just so sorry to hear this.

Well it's a year later, guessing everyone got their approvals and are happily married or soon to be. Just thought i'd check in:)



Well, we got our visa in December. She is still not here! AHHHHHHHH. Driving me mad.
My gal just wanted to enjoy her family and her country without the stress of the visa process.
She wanted to take it all in one last time before she moves for good. We have until June for the visa, but I think she'll come
sooner. Hopefully April. Anyway, she loves her job, her family, and her country, more so than the US.

I completely understand. But I still miss her.
Anyway, we have the visa. That's all i car about.
What keeps me going is remembering how good we were together.
And how good we will be.

Congrats!! My fiance had his medical on November 24th. So now we wait for the interview as well...this is ridiculous....how long does it take for us to get an interview....in March it will be a year since we started....I thought they said the process took 6 months?

last march i was told 3 months by my lawyer. took 9 for the noa2. now i have to wait another 4-6 months for an interview at my consulate. Looks like it will take more than 12 months for me to get to my beloved in chicago.

oh did i mention..patience is most definatly not one of my virtues....

So, its good. Monday came around and they said, COME TOMORROW. So midnight on Monday my gal starts looking over the paperwork.

He says he doesn't doubt the validity of our relationship, but he needs to check with Homeland Security about her.
"I'll call you in a couple days."


The interview itself took twenty minutes.
She was in the waiting room before it for over 2 hours which for CASA is pretty short.
Needless to say fell asleep while waiting. lol. Cutie. Anywho....

Two days go by and im flippin my ######.
He calls her today and says the story checks out, you were under the limit to define an overstay can you come pick up your visa?
To which Hanane replies.....

"No, actually I'm kinda busy right now with work. Can I come tomorrow?"
"Oh...little miss Hanane is busy. Never have I called someone to come pick up a visa, and they told me no! Sure you can come tomorrow." He said.


Thank god. So many ups and downs.
Such a process. Be sure to look for some videos I'm going to make about immigration when reform hits next year.

So she went to the doctor today, her family doctor not the consulates doctor, and was strongly advised not to take the shot.
She is going to another doctor, I think a state doctor, to get a second opinion. The doctor said she would be writing a sworn statement that because of her age and medical history,
that she should not take the shot. Hopefully that's enough. Either way, she is refusing it at the medical exam. *Sigh* But its her body, her choice.

To help, I am contacting my senator and having them on the line the day of the interview to remind the consulate that according to the law, the vaccinations are NOT required for passing the interview.
Well see how it goes. I spent an hour or two just now reading your other posts on Gardasil Danu. We are going to fight this, and I have a senator willing to help. Fingers crossed, the next month is going to be a battle royal!

No idea yet when I'm gong to be ready for the interview. Still waiting for this letter from my doctors. That's being held up because my old doctors haven't even sent my notes over to them (even though they've had three weeks to do so now!) They're supposed to have sent them today, so I'll probably chase that up later in the week and see what's going on.

Once I get my medical letter, I can schedule my medical. Once I have a medical date, I can inform them I'm ready for the interview (assuming papers all come from my fiance by then).

Bah, I hate this waiting.

I'm feeling ill today, so I'm really missing him.



Hang in there FrostyMist, and just remember that all the pain and suffering now is what you are building the foundation of your relationship on. I keep telling my girl that a couple months, who knows, maybe even are year are worth the distance and suffering if in the end we are granted a lifetime. Cheer up girly. You're almost done!!


Side note, I hope to see you guys and gals rally behind immigration reform next year!!

It isnt, but I would check with the embassy in her country, ours will not issue the visa without all the required vaccines done as even though this is a non-immigrant visa, its one with immigrant intent. Its the same reason a lot of consulates check for 125% of the poverty limit when all you need is 100% for the 1st stage..because it is generally accepted you will be doing AOS and they don't want to get you down there and then go..uh...sorry, you don't meet the AOS requirements get out! Not all embassies require the full vaccines prior to the visa issuance but a lot do so I would definately email them to check.

Oh for how it ended up on the list, anything that is recommended to the general population (doesn't have to be required just recommended) ends up on immigration requirement lists. She either needs to age out, take 1 dose or fill out a waiver based on..moral grounds? I think thats what it was...but that has a chance to be denied. Those are the only options really. I would check with them to see if she ages out at 26 or 27 and then take steps from there.

Let me try to find you the law that did that...it was like 1999 or something that they introduced it.




This is exactly our moral problem. She is devastated that she is being forced to take this.
What is recommended for the general population, is forced upon immigrants.
What a crock of sh**. If they are forcing it upon my fiance, she might not do it. She will wait a year.
I really hope we can figure this out. I cannot go any longer. Who knows though, maybe she'll do the first shot, but from the sounds of it she is VERY against it.

Hm, you'd have to look this up to confirm whether I'm right or not, but I seem to recall reading somewhere that you don't *have* to have the vaccines done before the K1 interview. They're needed for adjustment of status, which is why people tend to get them done before the K1 interview. Maybe you can look into it and see if I'm right? Perhaps your fiance doesn't have to have it at all if she's almost 26?



Yeah this is really starting to stress us out. Especially because we both know that this drug was rushed to market for profit, not to help women.
I cannot find the information stating it as a federal mandate, or a vaccination requirement. If anyone has any information on this, I really could use some help.
She turns 26 2 weeks after the interview, so if the mandate says BETWEEN the ages of 11 and 26 or whatever the ages are, we can argue that it is not necessary.
Other people have said they only need the first shot for the interview, but you are the first to question its validity before the interview. When she called the embassies recommended doctors, they all said she would need it, but I am not convinced.

Any help is always appreciated.

Hmmm that's strange...This is the exact same thing I was told when I called 17 days ago...except now it's call back if I don't hear anything for 6 months. Really?! lol What a joke. I wish there was something I could actually do that would impact those that are complete ridiculous with this.

Thats a good point, maybe they are sending it back because USCIS made a mistake and the NVC needs clarification.

You need to contact your higher ups and find out why this happened.
It just doesn't seem right. Have you found any other forums posting about something like this?
You need to narrow it down to K1's being refused at NVC because all the ones I have seen stay no longer than a week.
What did they tell you on the phone at NVC?

I called NVC today and my case was sent out to the consulate. Yours should be the same way kimbear.
I asked them about the necessity of K1 visa's going to the NVC and her response was that they do not handle
any paperwork for I-129f applications. The reason our K1's go to the NVC is just so they can enter the information into the
computer to switch the case number. Thats it. They do this so they can communicate case information to and from the consulate.
They send an electronic copy, and then send it DHL which she said takes no longer than 5 business days.

Hope that helps some. And to the rest of you who have yet to receive your NOA2 yet, hang in there.
Should be a bit of good news knowing that once that is done you only need a week or less at the NVC.


OMFG i'm totally freaking right now...

i called NVC and they sent back my petition to USCIS..####### wtf #######...and they gave me a phone number to call uscis from out of country and THE NUMBER DOES NOT EVEN WORK ITS DISCONNECTED!!!

we have a lawyer..and i just dont get this..nvc wouldn't tell me anything at all...i dont' even know what to think..i feel like i just got hit by a baseball bat..or car or soemething..

i just told david..he just got a letter saying it was forwarded to the consulate too from nvc..

Now is the time to call your senator or congressman. I have never heard of this. Especially because NVC does not do anything with K1's.
From my understanding they just pass it on. I do not understand the last line of your post......

finally got through to nvc today after 2 days of busy busy and they have my case!! woot got my new file number and they said it should be sent to my consulate in a week! yay!

so happy for us marchies!! such a good week so far!

In order to find out if my case got there, I give them the USCIS number right? The WAC number that was on my NOA2?
I know it hasn't been two weeks yet and maybe California to New Hampshire does take two weeks, but Im just SOOOO impatient.

I mean, for all I know, CSC could have just sent it off and now they are throwing it on the people that do the background check saying they are delaying the process.

After my senator inquired into the case, they sent me a follow up email that said exactly the same thing. EXACTLY.

Our case was approved the next day. Hopefully the inquiry will speed things up.

You have done enough waiting. Contact them immediately.
I contacted mine through a letter and then they called me as soon as they got it.
I am from a VERY unpopulated state though so that helped a lot.

Well... I lied. I just checked the website after complaining about no touches. Finally got one. FRICK!!!
After all this, the call to the senator, the emails to the lawyer, and the complaining on VJ, the date FINALLY CHANGED! lol.
I dont even care what it was, I SEE something now.

Funny though, they told my senator that they started on July 31st and the touch came on Wed Aug 5th. The next day, the 6th was when my Senator called back.
Funny thing huh?
