Africa: Sub-SaharanInput front loading for high risk countries needed.

A lot of confusion is how much is a lot, too much, not enough and just right. That is no general answer and one size does not

fit all. If someone has a one year relationship before filing then it is obviously less than someone who has been in the relationship

for 4 years. A couple pages of varies means to communicate a week or month depends also on the length of the relationship, weekly if a 

short relationship and monthly if a long relationship or if the case was returned due to 'lack of bona fide', then you start over and 

in the end have to proof you are still communicating and have an ongoing relationship and have not bailed out.
Of course one has more if several different means are used as well.
A consistent flow and quality is more important than "too much".
Visits are more important and evidence of such as we all know by now.


My purpose is for others to join in and list countries that they know need this little extra front loading so we have a picture of

which countries besides Nigeria.

 

We have Nigeria and China so far. Again I suggest the whole of West and East Africa, would also add Vietnam but prefer 
someone from those regional forums to make that call.

I hear ya Ebunoluwa.good.gif  I grow so tired of "I submitted the required Marriage certificate. They asked for nothing else why did I get denied" or "I thought all we had to do was meet within the 2 years". People need to stop.  And you are rght quality frontloading really you can't fake the funk cuz a CO will and has interviewed and seen through all that wahala.

 

Just in the last year I have seen time and time again denials not from evidence submitted but from how the interviewee responded to questions they should have known and a CO will come out of left field with that stuff and rightly so.

 

So I am all for the frontloading (sniff I want to petition somebody now....hehe)

 

Okay seriously though. As I have told so many people who have asked me what to submit and how to submit. I say your petition should be your love story a page turner each page giving a snapshot of your  lives together and apart but building that future that you will someday have together.

Everyone needs to step away and look at your stack of evidence with a CO's eyes and say if you didn't know these people (and a CO don't know you) what does this stack of evdience tell me about them. And you sure can show feelings, emotions and attitudes in those chats, skype's, IM's emails and letters.

  The problem with "high fraud" consulates is they got that tag for a reason.  It almost always has to do with the average behavior of the people that walk through the door.  People that fail to get a visa with one passport and show up later with a different one,  people who present all sorts of forgeries they buy from "visa agents"   The consulate knows how many spousal/fiance visas survive the first few years based on how many of those people file for ROC with a waiver and how many are just deported for outright fraud.  Each one of these people makes the metrics of "good" visas drop and raise the bar for the next person.   Anyone can photo shop or manufacture evidence ,  I can get 100 affidavits about the truthfulness of the relationship for less than a decent dinner,   What matters most is the ability of the interviewee to convince the CO they have a reasonable relationship despite what the metrics and red flags may point to.  To many enter the embassy thinking the visa is a done deal and get caught ill prepared and some get tripped up by the impossible to answer question like what happened in our first interview.  .  The paper work just prepares the CO for the questions  it is up to the person on the other side to be able to answer those question in the proper manner

Sadly we didn't submit much with the I-130, only copy of marriage certificate, change of name notification, 3 wedding pictures with both set of parents and that's all. We did not put chat logs, phone logs or email logs, even though we have 3 years Phone, Facebook and Skype logs. Just did not think it fit to put them. Now the petition is at NVC and we are about to send in the AOS package, do you think it won't be awkward to send relationship evidence at this stage? 

I do not think we have any red flag as the age difference is 5yrs, beneficiary is Nigerian, petitioner is a Nigerian with US LPR and has visited Nigeria 3 times in 3yrs. The only think that may raise flags is lack of relationship evidence in my own opinion. What do you make of it? Do we go ahead and put this evidence at NVC stage?

Hi all, I have read all your comments and i quite agree with all of you. Basically we all have different vantage points. It is important to mention that most fraudulent Green card seeking guys come out here to fashion themselves with ideas on how to go about it. It is equally important to point out that there are a lot of innocent guys who through this forum have received help to get together with their loved ones. One thing is, you cannot close your eyes completely because you detest the sight of bad guys, if you do so, you risk not seeing good guys too.

I think NVC is another opportunity to add more documents you feel can strengthen your case most especially when it is going to high risk countries (West Africa, East Africa, India and maybe China...list not exhaustive), and also if you have found lots of Red Flags in your application ( Age difference, Nationality, Meeting the Parents/Previous visit...list not also exhaustive).

It is a lot better to RISK adding more COGENT documents and maybe a relationship timeline (as someone suggested) to give an overview of your case and a ready made impression on the CO. I used the word RISK because, of course, some CO's may find a lorry load of documents offensive and somewhat suspicious. You don't want to submit a rim of paper to a CO who happens to be a member of "SAVE THE TREES" society!

 

So i will go ahead and add the relevant documents. In my own case, Petitioner and Beneficiary are both Nigerian born, been friends/dating for 9 yrs before petitioner became LPR, been married for 4 months.

"Front loading" is a phrase i have come across a lot of times on VJ. It basically means submitting so many relationship documents at the petition submission stage. (I-130) as opposed to taking them with you on the interview day.  For example, email logs, chat logs, phone call logs , wedding pictures, etc 

 

"High Risk Countries" are supposed to be countries with high risk of fraud. Countries like Nigeria and other west and east African countries. Someone mentioned China, India and Vietnam too.

 

"Red Flag"  is another phrase i have seen which means suspicion of spurious relationship between the petitioner and beneficiary. High indicators can be Age difference, racial difference, number of visit times and the list goes on and on.

We 3 are in the same boat...I do not expect any activity on my case for 30 days..If it gets approved before that, it is a bonus. This process has been the worst nightmare of our marriage lives so far. 


 

Now I really wish that I filed in the first week of September with 09/03 as my PD. That would made my file to go to CSC..oh well who knew the future?

Yes, but I realized when I went through all of my paperwork the other day....I obviously sent in the other set of passport photos.  You see, we had taken two sets.  I still had one set and thought I'd forgotten my photos.  But, I didn't actually!  dancin5hr.gif

 

Mine said Initial Review the same day I called the USCIS and they told me to keep waiting.  Three hours later, it said Post-Decision activity!  Strange...so keep checking!  Another approval came from California, I read in another thread.  

 

I'm a USC.

I'm updating here, too.... Tonight I got a text and email saying the following:

 

"On September 24, 2013, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN."

 

My case status has been moved from Initial Review to Post Decision Activity on the web.  I can hardly believe it!  I believe this is the NOA2...but one of you who knows better can tell me if I'm right.  dancin5hr.gif

Wow! Wow!! Wow!!! I have been quietly following your posts for a while now, mainly because my priority date is Sep-09-2013 and i believe yours is Sep-10-2013. My petition was forwarded to the California Service Center and i got the WAC number just like you did. I decided to use your case as a forerunner idea9dv.gif  for mine. I red all about the missing passport sized pictures in your petition and i thanked God i didn't leave those out in mine and i kept hoping for the best. The fact that people claimed petitions are no longer being forwarded to California Service Center because of heavy backlog got me worried. Moreover the estimated waiting time on the usgov site is not enticing at all.

 

I have just checked my case online and it still says "initial review"mad.gif

 

Now i don't know if i should worry or rejoice, judging by the expedited action on your petition. By the way what happened to the missing passport photographs in your case? Did they ever request for those?

 

Also are you a US Citizen or an LPR?

Vietnamcosponsor in vietnam?

Vietnam is one of the countries that dos not normally accept co-sponsors for the K1.  The fact that you have god employment prospects may help, and as same sex couples (presumably?) cannot marry in Vietnam that may make them see things differently too, but in general, if there is a way you can get married and petition for a CR-1 spousal visa you would have a much easier time with a co-sponsor.

 

Where did you read that about Vietnam? I only read that Manila don't accept cosponsor. I have read mixed review regarding cosponsor acceptance in Vietnam. Some say they accept and some say they don't.

Hello, I hope someone can answer my questions. I have been with my fiancee for 4 years now, long distance relationship, we talk everyday and I have 2 years of phone record (i use phone cards the couple years before and then switch to Rebtel calling services). I am in a same sex relationship and DOMA has been struck down recently (June 26th). So I have the right to file petition for my fiancee. Ok a little background about DOMA is that it define a marriage between a man and a woman but it has been voted by supreme court as unconstitutional.

 

I am master student in the research field (researching diabetes) and my fiancee is a national Sivananda yoga certified teacher (Sivananda located in California). She has been teaching yoga and owning small business for over 7 years now. I have very little income (not enough to meet the requirement), but I do have over 60K in saving (I work before and saved my money). I have a cosponsor (he is a friend) and he makes very good income. He makes over the requirement.

 

Ok finally my question, would Vietnam view my cosponsor negatively? Would they accept cosponsor? Would they take inconsideration my degree and her degree? We won't have trouble finding jobs and I do intend to go for pHD degree. Also we have a lot of evidence, so they can be sure that it is not fraud!

Hi I was wondering how long do you have to provide additional information when you have the blue slip?


At the first interview that we got a Blue Slip. Nhung thought it was her fault and I told her no way. The information they requested just said how good she did in the interview.
These are some of the questions they asked her in the first interview:

Explain how we met
Who introduced us?
Why do you choose fiancé paper work?
When did we meet?
What does fiancé do for a job?
How do we talk?
What do we talk about?
How many times does your fiancé come to VN?
What does your fiancé do for a job?
Explain his job
How many children do we have?
What do you think about your fiancé?
Why do you choose to marry your fiancé?

When she got the Blue Slip they ask for more documentation.
They want me to provide were I have lived for the past 10 years (already did that) and who lives with me now and who has lived in the same house during the 10 year period. It has to be notarized
They ask Nhung to provide the same information. (and it has to be notarized)
They ask whom did we meet through and did that person get paid. They ask for notarized statement from that person also.
They ask for notarized timeline that was provided in original documentation submitted at the first interview.

The second interview Nhung gave them the documentation they requested and waited until about 1 1/2 hours for them to call her and tell her visa was approved. They do not ask her any questions this time.
She did say today she saw a lot of people getting blue slips. http://static-forums...O_DIR#/ohmy.gif

I did not attend either interview as I am still in the US. I will fly to HCM on the 8th of next month.
My friend's wife interview is the 1st of February for the second time as they received a Blue Slip the first time also.

It actually only took my fiancee a few days to get her PCC in Tra Vinh. She just paid the usual fare, i dont think it was too much. The lady that helped us was very nice. also helped my fiancee renew her birth certificate (she lost her birth certificate) and her single status.

Took us exactly 10 business days. Make sure you get PCC #2. #1 is good for six months. #2 is good for one year and is now the only one the consulate accepts.

Hello I am very happy to tell you that our visa has been approved!!!! Originally we had a blue sheet due to my fiancee forgot her police report and 2 5x5 pictures. We came back in the same afternoon to give the two require materials. And we were issued our visa. I will submit my detail review in a few days. We are very busy to prepare everything for the departure.

Another positive note is that the immigrant visa chief came out to congrats us. We are the first same sex visa approval in Vietnam. She was asking if we are willing to share our story. Good luck to everyone that have interview! It is very positive to same sex couples.

So the list that I started collecting for interview at consulate is this;

1) I just ordered 3 years tax transcript from IRS
2) File tax for 2013 and will include that with our interview next year
3) Bank statement but we should get this until at least the end of the year right? so that our bank statement is more recent. Which I am currently have about 55K in assets and trying to grow it to 60K assets in my saving.
4) I go to graduate school to get my master degree. Should I submit some kind of information about that? Would that be relevant?
5) I also are admitted to graduate school next year, which will pay around 20K per year. Should I include my future income? Is that relevant to proof my case that my fiancee and I wont need federal or state assistant.
6) Letter from current employers
7) Fill out form I-134 and I-184. I heard it is good to fill out I-184 as well. Is that correct?

If the airline confirms that you actually boarded the plane then it should count. I've never seen a case of this being used so I can't be positive. Do you have the stamp from the visit in your passport? If you can show the stamp in addition to the letter that would be best. In my case I had lost most of the boarding passes so I provided the flight receipt along with the exit/entry stamps corresponding to the dates on the itinerary.

 

 

Vietnam doesn't stamp my passport. They stamp my visa but I never kept my visa for those trips. Only Korea stamped my passport because Korea is my layover. In combination with my flight information, that should prove I did board the plane right? Yes the arline wrote me a letter confirming that. I might have boarding pass laying around back in Seattle. Hopefully I can find it. I should have kept all the information but I never think that proving is so difficult. Thanks!

Primary evidence is something concrete which is not easily fabricated. For example if we are talking about primary evidence that you have met in person, boarding passes, passport stamps, and bank statements showing ATM/Credit card transactions in your fiance's country. Secondary evidence would be flight itineraries (They don't actually prove you were on the plane, just that you purchased the ticket) and photos (due to photoshop they can't be considered primary evidence of meeting). 

 

 

 

What about letter from the Airline certifying that I flew with them? Does that count as primary evidence?

There may also be more scrutiny depending on which country your fiancee comes from. Some countries have been flagged as high fraud and they might be stricter when it comes to same sex couples. It may not be discrimination per se, it's just the fact that even with non same sex applications, there have been times when people "help their friend get into the US", even if they're relationship is no more than platonic. I think it wouldn't hurt to include more proof of a bona fide relationship evidence in your 129F while keeping this in mind. Maybe affidavits from your boss/family/friends acknowledging your relationship, more pictures, emails/chat logs, call logs, receipts with both your names on them, wedding invitations, etc. 

 

I know that adjudicators shouldn't discriminate, but it might pay to front load your evidence so you can prevent any additional delays.

Oh about the emails and IM messages. We have plenty but it is in Vietnamese. Do I have to get official translation or can I do the translation myself? I would think it would cost a lot to get translator for thousands of page chat and message.

Technically, you should now be able to file the I-129f for K1.  The hurdle may be that you'll have to be arriving into a state that'll allow your same-sex marriage. Does your fiance live in a state that's sane?  When you complete your forms and do the intent to marry letters, I'd be inclined to indicate in those that you intend to marry in a state that allows same sex marriage, just to be 100% clear with whoever is adjudicating your file.  The State department can't discriminate against you anymore because of the overturned DOMA. That's why it's great!

 

I'd be interested to see, over time, if there are problems on the local embassy side of things. We already know that the embassies vary wildly in terms of approving visas based on other factors.

 

In terms of your evidence - that sounds good. Make sure your boarding passes are dated within 2 years of your i-129f application, since that's the bit they care about most (having fact-to-face met in the last 2 years).

 

My actual residence is in Washington. I just come to Illinois for school. Washington allowed same sex marriage now. I stated in my letter of intent to marry that I will move back to Washington to marry and live there with my fiancee. My friends and parent are there in Seattle. I was wondering if passport is enough or do I need to include my birth certificate and naturalization certificate (I am a US citizen through my parent)? I have the passport here with me in Illinois but the Birth certificate and naturalization certificate is back in Washington. I will come back to Seattle to get teh document in mid - Aug. My question is that should I wait that long to file for I-129f or is the passport enough? Thanks for your reply. I hope to get everything in order and organize so we don't run into problem.

Hi I am new on this website. I am currently preparing my K-1 package for my fiancee. I am engaged to my fiancee (we have been in relationship for 4 years now). As you may or may not know, DOMA (federal law that defined marriage is between a man and a woman) has been struck down by Supreme court on June 26th. So I can file petition for my fiancee now. My question is that anybody on this forum are preparing for their same sex partner as well? Would my applicatin face any discrimination from the US immigration department? Although I did read that they will treat same sex applicant the same was opposite sex applicant. I have 4 years worth of pictures of us, 5 boarding passes to see my fiancee, 2 years worth of phone records, and other letters that we have send to each other. Do you think this is enough or shoud we get more evidence? Thank you for your reply!

Yes I am getting my fiancee to re-take it and send the digital copies to me. If she mail it again, it would takes 2 weeks. I don't understand why it is so specific that i is needed to be 2X2? But again I don't want to have any problems with my application. So I will follow the requirement.
