Hello Everyone!

I am the beneficiary and have been living in Finland for 2 years now

Me and My fiance were classmate many years ago  in our home country Cameroon before she traveled to USA.We started dating last year and she visited me in August 2013  which we got engaged. We then filed for Fiance visa in November  and our petition was approved just after 19 days and it is on its way to NVC now before coming to Finland consulate where i will have my Interview.

Her visit in August was just for 2 weeks and now she is in Cameroon and will only return to USA in January which our interview will likely be in February and she can't make it here for another visit due to her job and she is just coming from work holidays.

I was wondering if we may face problems at interview  in Finland since she has visit me just once in Finland.We have no other reg flags because we are from the same region, village, religion etc and more over we were born same year and month with me being just 5 days older than her and in our mid 20's now.

The primary sponsor/ petitioner and the co-sponsor will both need 3 years tax transcripts.  A few payslips and a letter from the employer stating salary and that it is a permanent job is strongly suggested.

Hello Every one. I am the Beneficiary and I want to use this opportunity to thank everyone for your contribution so far including your posts and comments on my previous post.

We got our case number on December 18 and my case status online shows "READY"..My Fiance was studying last year and did not make enough money so her mum will be acting as our Co-sponsor. I have been reading post so far about affidavit but i am not really clear what documents do my fiance and her mum need to support the I-134 form.Apart from letters from their employers and pay stubs ,

Do they need most recent Tax return, tax transcripts, 1040, W2. which of them exactly do they need for embassy in Finland as i have seen that the embassies are different in what they ask.I will be happy to hear your experience so that she can start preparing them when she return to USA after Christmas holidays next month from Cameroon.

Hey guys .. I need some help.. Me and my fiancé did a ( traditional marriage ) in July 2013. But we did not register anything or get a marriage certificate. And I included the the traditional marriage pictures as ongoing relationship (evidence).... Now I am worried that they may deny us a k1 visa .. !!!!Saying that we are married aready !! !!..I've read some posts about traditional marriages and some don't look good!!!. But traditional marriage in Uganda is not legal according to marriage law in Uganda.... I mean we had no any other option rather than the k1 visa.. What should we do? Any one with the same or similar situation??

 

Be courageous and face the interview without fear.Once you can convince the CO the traditional wedding was just a formal party to bring both families together and make you engagement official, he will let you be.If you let the CO knows that even you sees it a real marriage, then you may have some difficulties.In some countries, traditional marriage is considered a legal marriage so if it is not considered legal in your county and you can convince the CO in Uganda that you did it just for formality, you will be fine.I know people from Cameroon my country who have succeeded the interview for K1 even though the CO knows they are married traditionally Good Luck.

After getting divorced in November to a woman I married after a K-1 visa, I am happily engaged again and we are wanting to file a K-1 visa. There isn't any wait time to get remarried after a divorce in my state but how long should we really wait to file with receiving less immigration scrutiny? I spoke with an immigration officer and he seemed to think it didn't matter a whole lot, but mentioned waiting 3 months after the divorce would be best. My fiance thinks maybe we should wait longer to file but I really want to get things in motion.

I make well over 125% of the poverty guideline for 1 or 2 persons, but only because I am a tipped employee. The problem is that my tips are not shown in my pay stubs but rather in a separate sheet that I need to report them myself. In order for the USCIS to consider income, assets - do those tips need to be reported and taxed for them to count them as income?

Don't sweat it - we just got an RFE as well, but I've already mailed it back to them. The reason I think I got an RFE is because I didn't attach a separate page for the question that asks "Describe the circumstances under which you met"...so I typed out a whole page and mailed it to them. That question only has 2 lines on it on the I-129F but I think they want you to write an essay on that question.

My fiancé is confused about the part where it asks for your father's information. Her fathered passed away many years ago but she doesn't know the exactly year he died, and has no way of finding out and none of his relatives seem to know either. Hello everyone!

I'm pretty new here and me and my partner will be sending off our I-129F early next year. However I have a trip planned in the summer to visit my partner.

 

My question is how long does the process usually take? How long does it take to get approved? How long until the medical exam, and then the interview?

 

I want to make sure that I am in the U.K so I am able to send anything else that needs sending, and that I am here ready for my medical exam.

 

I really don't want to have to fly back from the U.S.A so what do you guys think?? If we send it in Februrary, will there be a chance anything would happen in the summer? Should I not visit my partner in the summer? Or should we send the I-129F after the summer?

I'm new to visa journey so any information would be a huge help!

 

Me and my partner are currently gathering all of the documents and proof needed for the I-129F. We plan on sending it to the Dallas Lockbox sometime in March 2014. However, I'm going to visit my partner in America in June until August 2014. My question is, what happens if the I-129F is approved when I am in America? I don't want to be given an interview date at the US embassy in London (I'm British) whilst I am in America.

 

To put it simply, does anyone know usually how long it takes for the I-129F to be approved, and how long it takes to be given an interview date after? I just want to make sure that I am in England ready for my interview rather than being in America with my partner.

Beneficiary, filing evidence of meeting I include only my visa and stamps of entry and exit.

I'm aware that you need to include proof of relationship, and I have read that you need to copy pages of your passport. However, do you only need to copy the pages with the stamps on from visits, or all pages?

I appreciate the advice! The I-134 instruction are definitely vague and we were worried about the expiration date on the form as well, but thankfully older versions are accepted still. 

 

I will bring a copy of the bio-page just to make sure I have it in case they ask for it. The income tax returns are not needed in our case, the lady on the phone basically said they would not even look at them haha. So I guess we can confirm that ITRs are not essential (for the Dutch consulate at least) unless the main or co-sponsor is self-employed. :)

1. Does the co-sponsor have to have a copy of his birth certificate?

Yes or he can provide all pages of passport (This is to proof that he/she is USC/LPR)

3. Since I don't have any recent taxes (besides 2013-started working in October) do I have to write a statement as to WHY I don't have any recent taxes? I've been in college and was unemployed in 2012 to half of 2013. Yes you can write a statement for it. You need to submit pay stub, employment letter, 2013 ITR if you can make it to file before the interview.

4. My uncle whom will be the co-sponsor made more income in 2013 than in 2012. Which tax return will he have to have a copy of, his RECENT as in 2012 or 2013? (since it is 2014). haha. I just want to be absolutely correct before I give him anymore information.

Co/joint sponsors only need to provide a copy of the bio page from their US passport(if using that as proof of being a USC), not all the pages. Also, that would not prove they are an LPR, as an LPR does not have a US passport. An LPR provides a front and back copy of their green card.

 

For the I-864, you are only required to submit the most recent tax transcript. You must list the total income from the last years of returns on the form itself though.

@Janice&Micah: Just out of curiosity, where are you getting this information from? There are loads of different pieces of advice claiming this or that, however some situations may only apply for certain countries. I just want to make sure that information isn't based on assumptions, that's all smile.png

 

@Bristin92: So i'm not sure if this is applicable to you but is your uncle self-employed? I'm only asking this because in the current instructions form of the I-134  it states that if self-employed a tax return is needed. My fiancee and I had the same question because we also have a co-sponsor. To ensure that the interview has what they need I called the Amsterdam consulate to ask their advice on this. The lady told me that they won't deviate from the instructions, so no tax return is needed unless the sponsor is self employed. I just wanted to make sure that this piece of information is coming directly from the consulate which follows USCIS regulations for the I-134.

 

Is the bio-page of the US passport a requirement? I haven't seen it listed anywhere so I would just want to make sure that we won't be overcompensating information!

Hi All!!

 

Five days ago, I sent in my K-1 Visa to petition for my fiance to marry me in the U.S... I am going a bit crazy already, making myself sick thinking I messed something up in the Visa packet!!

 

 

I know it is too early to receive the NOA1, but was wondering at what point in this whole process is it acceptable to contact my state senator to ensure the ball continues to roll on this matter.

 

Any tips/advice/feedback would be wonderful!!

On my NOA2, I read nothing of contacting NVC, and I don't know why some say there is a two week wait for the case number. Where is this information coming from, or is it just common knowledge??

Having your papers dated for September won't be a huge deal. I think they understand it takes time to get everything together and they don't expect you to have your packet completed within a week.

As for the phone number, I can't remember what I put for our petition.

As far as the evidence goes, since you will say that you have only known one another for a very short period of time, I would advise you to give as much evidence as possible to prove you are a bonafide couple. Even getting married to another American within three months seems a bit weird to people, so I can imagine tht would be a huge red flag to the adjudicating officer who handles your case. I sent my photos on whatever paper that the Walmart photo thing uses, and there was no problem there! Just remember that they will not accept discs or flash drives with photos on them. You might want to get a copy of the passport stamps, if possible, showing that she did go through customs.

I have been visiting England since 2011, and on Monday, I  made my 7th entry through Heathrow.. I have never been asked to show documents, even though I always make sure to bring them. My visits are usually quite long. Just last December (2012), I had a return ticket for April 2013, and there were no problems there! And since April, I have visited twice, this trip, included. I think it probably depends on the officer to whom you are called.. It is a judgement call, I guess!

Hello! I am not so sure your July plan will work out.. The NOA2 has a validity date that stands for four months after the date of NOA2. For example, my NOA2 was July 17, and was set to expire on November 17th.

 

So, even if you waited as long as possible to fill out the next set of paperwork, which would be February time, they would, most likely, have an interview for you by April. However, that being said, you'd have some time to enter the US after actually receiving your visa.. So, even though it might be risky to try to stretch it to July, it might not be totally impossible.

Hello!! There is no issue with the two of you sending an I-129f petition while you are in the states! That actually will add evidence of your bonafide relationship, which is always a good thing. If anything happens to be mentioned about the specifics of your visit to the US, it's okay to tell them that you are working on sending in a Fiancé visa petition to USCIS. Saying that allows them to know you're trying to do the process the legal way, and you don't intend to cut corners.

Hi all, alexndillon2125 here. My fiance (the US Citizen) filed our k-1 petition in April at Vermont, therefore we are April filers biggrin.png.. my fiance and I met online in September 2012 and he flew here to the UK in Jan 13. He proposed on Valentines Day and we sent our package I-129F package out in early April. He shipped out to Fort Benning for Infantry Training at Boot Camp for the U.S Army on 30th April and is due to graduate in August (I'll be flying out late July to stay with his family). It is possible he will be deploying a month or so after graduation, so my question is, would we be able to expedite for military reasons around August time incase he gets deployed? Or would they need valid proof of his deployment? Also.. I am due to have an operation on my left shoulder in June/July time where I will have a few screws and ligament and muscle repairs done... would this class as another good reason for medical expedition? I understand its hard for everybody being away from their partners for so long during this gruesome wait for approval, but think, some of you guys can skype/phone/email each other during the process, whereas we can only once a week and have no phone calls during bootcamp! Good luck to everybody waiting approval and lets all hope for a speedy process!!
