Bryant - we do know what your going through and how difficult it is. I would have loved for my finacee (my wife now) to have been able to come to the US on a visitor visa. However it is nearly impossible for a young Vietnamese girl to get a visitor visa to the US. So I made two trips to Vietnam before we applied for the K-1 and then two additional visits before the interview. Its a very tough consulate and everything there is presumed to be fraudulent so the burden is upon us to prove otherwise.

Hang in there man - if your love is true it will be everlasting and you will find your path to be together! Take some time and do plenty of research, your always welcome here to ask questions. Some we can answer, some we can try to advise on, and some will be deciions that you will encounter that must be decided upon by the two of you.

I agree with everyone who says it's not right to go for K-1 if our intent is not to marry. Our preference is to just continue to date, and then figure out when marriage will be suitable for the both of us, but i guess K-1 is not the right thing to do in this instance. She was previously in the US last summer on the J-1 visa. She left on time, and did not break any laws.

Can anyone tell me if sponsoring her tourist visa (is it possible to be a sponsor for a tourist visa?) will help her case?

Visitor sponser ship is misleading. In most cases what the sponsership is actually related to a USC providing proof of income that shows they are able to support the "visitor" during their time in the US.

The biggest burden is to overcome the assumed immigrant intent. All visitors entering the US are assumed to have immigrant intent. That is just the way ot works. So it it the burden of the visa applicant to provide proof of significant ties to their home contry to remove the assumption.

I thought the K-1 gives you the option to marry or decide against it, without consequence. It's definitely a possibility that we could end up marrying after 3 months, because like i said, we are definitely in love. It's also a possibility that we'll need a little more time to decide to marry. Having her stay with me for 90 days and then determine our next course of action seems like a reasonable thing to do.

While you always have the option of not marrying on a K-1 - the INTENT of a K-1 is for the purpose of marriage. After all, one of the requirements is for each to complete a Letter of Intent to Marry! If it were ever disclosed at an interview, or if a CO suspected that there was not INTENT to marry, a visa would surely not be issued.

You should also definately find out what type of visa she was previously in the US on and if there were any overstays and for how long. These are all hurdles that would have to be overcome if there was any past issues.

I have not noticed that one word until you pointed it out. I have never heard of a member mentioning having to send evidence in duplicate and have not read of a 221(g) issued by an Embassy/Consulate for not having the information in duplicate.

I think you could be right about one copy and take an original. You should submit one set of copies of all evidence such as pay stubs, tax forms or tax transcripts, letter of employment etc... Then you should give your fiance(e) the originals for the interview at the Embassy. Then if and only if the CO wants to see the originals she is prepared. She should ask for the originals to be returned to her.

I do not see any reason to submit duplicates of all the evidence. IMO (of course)


I agree - I went at the time of interview and I took all originals and had copies of everything also. The copies were submitted first and if they wanted the originals they were then provided upon request.

Regardless of what route you chose (K-1 finace, CR-1 spousal or Direct Consular Filing - which is a spousal visa process where both parties reside outside the US), you will have to meet the I-864 Affadavit of Support Requirements.

If you want to get married in Mexico and file DCF, you will need to check with the Cuidad Juarez Consulate to determine the criteria that you must meet to do this and also read up on the DCF process.

You could marry in Mexico and then you could come to the US and file CR-1. As a student, you will likely not meet the poverty level guidelines if you are full time. That would be quite a challenge.

If you filed K-1, you would have more time for processing to get something established. You would have to submit an I-134 at time of interview and still meet the poverty guidelines and submit the I-864 at time of AOS.

Your biggest challenge is going to be meeting the Affadavit of Support. Do you know anyone in the US who would possibly be a sponser to meet this.

As mentioned - the USCIS, NVC, etc...are not interested in your degree or ability to find a job, they are concerned with your current income and proving that your spouse will not become a public charge by provided proof of current income that meets the poverty guidlines as defined in I-864P. If you cannot prove current income then it is only a hope to them and is meaningless.

I would recommend that you take your time, do lots of research on your options and understand them all completely before you make any decisions.

Hi Brian!

I would take some time while you are together this summer to prepare the I-129F petition (which your fiancee will submit to the USCIS). No problem with her submitting it while you are here visiting.

The petition approval "averages" around 3 months (can be shorter or longer - no way to know). (I hate averages by the way - can be very misleading!).

After petition approval you are looking at another 3 months (average again ugh) till interview.

After visa approval at interview you have 6 months to enter the US.

If you use the 6 month time frame to enter the US after visa approval, you are looking at (on average ugh) 11-13 months from petition submittal till the time you would have to enter the US. That would out you dead into "next summer" time frame.

If you got you I129f petition approval a bit quick you could always delay sending in the packet 3 info by a month too. Just watch and be cognitive of the dates.

Remember this is all based on averages (ugh again). There are no gaurantees on timing, things can go awry and be very frustrating. If you get RFE's there will be delays. Even without RFE's there can be delays. It is rare that things happen "quickly" but it does happen from time to time.

In our case, we were almost 6 months to the day from the submittal of my petition to the day of her interview. It took another month to get the visa due to a screw up at the consulate.

Do some thinking and discuss with your finacee(soon to be that is). Come back with any further questions. Remember, this is not only your visa journey but a journey you are undertaking to be with your loved one forever. Do lots of reading and understand what to expect.

May have been stated in a previous post but in case I missed it I just wanted to point this out too.

If you hire an immigration attorney to fill out your papers (which is effectively what you are doing), it is still YOUR responsibility to double and triple check ALL of their work. If there is an error, they will not take the responsibility. It is yours.

Some of the forms may seem complicated at times but with most folks can work through it. We all have questions and seek help and advice (even when we know the answers). Its always good to get an opinion or some reassurance when you have a doubt about something.

The folks here at VJ are really great and as you have already seen have lots of opinions. Every case is unique unto the couple who are involved - even two cases that appear to be exactly the same can have varied results. Its a crazy system and a crazy world but you can do it!

It does not say they are required, however most consulates have the expectation that this will be provided.

Just send the past two years - that will be fine. Make sure if you send copies of your actual tax returns that you send w2's and all forms and schedules filed with your return. If you go with transcripts, then the transcript itself is enough.

No problem with having a civil ceremony - its very common. You can plan something formal later if desired.

For comparison sake - I sent two years tax returns, letter of employment, 6 months of pay stubs and bank statements (not a letter from the bank).

We had a civil ceremony.

If you were planning on marrying in Vietnam you would need an Affidavit of Single Status to submit with your marriage application in Vietnam. Since your K-1 that would not apply.

Since you have already got through the I129f petition you must have included the Letters of Intent which include a statement of single status ie..."you are legally free and able to marry.

For the interview, I submitted a reaffirmation of Intent to Marry that reitterated that I continued to be legally free and willing to marry.

Fill in your timeline!

1) Your fiancee did not send your K-1 visa application. What he sent was the I-129F petition which, if approved, allows you the beneficiary to apply for a non-immigrant K-1 finacee visa.

What you can expect next is to wait. Your fiance will receive a NOA1 (form I-767C) from the USCIS. Don't get to excited when this is received, its just a notice that they gave received the petition.

You can then expect to wait around 3 months (more or less nobody can know) for the NOA2 (another I-767C). Once this is received you can get a little excited. The NOA2 is a notce of approval for the petition.

The USCIS will then forward the petition to the NVC (National Visa Center) where a background check will be done. The NVC will then forward the approved petition to the consulate specified in the application. This can take days or weeks (again - nobody knows).

Once the consulte receives the approved petition they will send "Packet 3" to the beneficiary. Packet 3 will include instruction on what you (the beneficiary) need to do. It will consist of completing some forms and returning them to the consulate. (This part varies from consulate to consulate - for us it was just DS-230 Part 1 and DS-2001).

There will also be a list of things to start gathering that are required for the interview.

Packet 4 will be sent after some more waiting. This packet will contain the interview appointment letter and additional instructions on getting your medical exam and what documents to bring to the interview such as police reports, justice record, proof of relationship, form I-134 (that will need to be completed and sent by the petitioner), birth certificates from both, etc.....

This is a typical scenario from our case, it is not exactly the same everywhere.
If you receive any RFE's during the process they will need to be addressed accordingly and will impact the timing of you case.

Read all the guides and complete your timeline so others know what, where, when about your case.

Could go either way on this one Q.T.

I took original and copy to the interview, they never asked for the either. I assume this was beciase there were copies in the original I129f packet.

However this is not a gaurantee, they may ask and may accept a copy, but maybe not. All depends on the CO.

Are you a born in the US USC or naturalized? The reason I ask is that if you were born in the US, you could contact the Clerk of Vital Records in the city you were born and request a certified copy of your original birth certificate.

If you were naturalized, I don't know how difficult it may be to try and obtain a new birth certificate from your city of birth.

I'll have to default to our Vietnam Portal members on this one.

Question to other members - How many USC applicants have been requested by the CO to see your original BC at HCMC?

One thing that stinks, and I disagree with it whole heartedly, is that during my visits to the consulate (when I went in to check on things), I noticed that white male USC's seemed to receive preferential treatment over naturalized VN USC's. Where this comes into play is that they may scrutinize things more closely if you are a naturalized VN USC.

Anyone else catch a glimse of this? Just an observation I made as I visited with others while waiting in the consulate.

Try not to worry too much my friend, but it may be beneficial to do some checking to see what it would take to get a new BC.

Not much point to including it with the I-129f as you will want to complete a new one as close as possible to the interview with updated supporting documents.

Your typically looking at around 6 months from petition submittal to interview so you will definately want them to have the latest and greatest info available.

If you submit this with the I-129f and then submit the same at the interview you may be looking at an RFE for more recent into at interview.

I think you already got this straight but just putting it here again in simple terms.

If you pursue a K-1 visa - you must wait until your finacee enters the US on the K-1 visa to get LEGALLY married and do so within 90 days. If you were to get LEGALLY married at any point prior to her entry to the US then the K-1 visa is null and void and you'd have to start over with the CR-1.

If you pursue a CR-1 visa you must wait until you are legally married before you can start the application process.

Hello everyone!
Well, don't know if my question was asked before and I did try to search and read several posts, but didn't find any of my nature. Basically, my fiancee and I want to get married by this year (December) "hopefully" if we can get the filing back quickly (I hear being an officer in the military expedites the process due to proof being much easier to validate?)..
Well my question is the following:
I would like to have my wedding in Nicaragua though not "Legally" in Nicaragua so that I can apply for the K-1 via the U.S. I understand that if I get a legal marriage in Nicaragua I would have to go through a whole different process of paperwork (confirm/deny please?) and I'd like to deviate from that. However my fiancee is telling me she believes that I need to do it LEGAL, but I doubt that since I know of a friend who also did a wedding/reception there without having to do any legal paperwork of Nicaraguan nature.

The reason I would like to have the real wedding in Nicaragua and the Court-style wedding here is because she has all her family/friends and while myself, I only have my immediate family with me (Mother, sister, grandmother and uncle) my friends have either been deployed or stationed in other countries and the rest are off in their own world (studying, getting married, etc..) so I see it much more fitting to have the reception in Nicaragua and simply fly my family there.

If anyone can comment and/or contribute their information or experience, I would greatly and wholeheartedly appreciate it.

Just wanted to share my experience on this with you. I know many people are against it and there are lots of different opinions but we did what you are talking about in Vietnam.

I visited and we were engaged in Jan 09. I returned in Apr 09 and we had a full blown traditional Vietnamese wedding ceremony (we did not register the marriage). We had over 350 guests and I would not change a thing. It was important to honor her family and it was one of the most wonderful experiences of my life.

When I returned home I sent in our I-129f petition. I disclosed everything about the event and even included photos from the wedding and picture day. In my letter included with the petition I explained everything very thouroughly and that we did not register the marriage and that we were free and legal to marry within 90 days of entry on the K-1 visa.

I dont know if we were just lucky or if it was my disclosure and explantion up front that gave us no problems. We were never questioned about it or given a hard time (and Vietnam is a very difficult consulate).

I returned again in Sept 09 and finally in Dec 09 and stayed intil Jan 2010 during which time her visa was approved and we came to the US.

I am not going to say this is the right way or best way, just sharing my experience to show that it is possible.

Different consulate so this is for the sake of comparison:

For my I-134 I sent two years tax returns, letter of employment, recent pay stubs and bank statements (6 months each). It is the current income that is most relevant.

When you get to AOS and file the I-864 you are required to report the past three years income (and then you have the option of sending tax records for one or three years).

OK - you've got your NOA2. Next your petition will go to the NVC where a background check will be done. The NVC will assign a case number and forward the petition to the consulate.

The consulate will then contact the beneficiary with instructions on how to apply for the visa (referred to as packet 3). The beneficiary then completes some documents and returns them to the consulate and they send the interview appointment and more instructions (packet 4).

This is a typical process. Some consulates send packet 3 and 4 together. Its not exactly yhe same everywhere. However you should have ample time from receipt of packet 3 to send documents and in most cases ample time from packet 4.

We had one month from receipt of packet 4 (interview appointment). I actually updated my I-134 and EOR, bought tickets and flew to Vietnam to hand deliver them :D and be with my darling when she interviewed :thumbs: Ended up taking an extended vacation and staying for a month and a half. She came home with me :dance: I've never been so happy!

Its best to provide the most recent information possible. Consider how long it takes to send documents to your sweety and leave yourself plenty of ample time for the documents to arrive before the interview. Typically you would have plenty of time to send the documents once you receive the interview appointment letter.

It is highly recommended that you make two complete copies of your I-129f package that you submit to the USCIS. The petitioner should keep one copy and one copy should be sent to the beneficiary.

Its not unheard of for things to get lost and you never know when something may be requested that was part of the original petition. Its also a good way for the beneficiary to review and know exactly what was in the petition.

Wow, your the first person I can recollect explaining in such detail the measurement of the photograph! My gut tells me that they are fine. Most people look at the background and that the photo meets the general criteria of the "standard".

Something tells me that you are particularly attentive to fine detail and may loose xcessive sleep over this. You, for your own peace of mind may want to get new photos taken.

However, if in the next set, your head is to small and your eyes are to high, you will be in the same predicament and at risk of a nervous breakdown!

As for me, I think I would send the photos you have and forget about it.

You need to meet the poverty guidelines established in I-864P as posted on the USCIS web site. If your income falls short then you must have qualified and accesable assets to meet the difference in shortfall (there is a multiplier involved when using assets too).

I'm not to well versed in explaining how the assests thing works. I can tell you that I certainly did not have 10,000 USD in my bank account though (maybe 3,000) however my income is approx 3x the required poverty level established.

That is FUBAR.

Yes you will need advanced parole after entering the US on a K-1 and before receiving your green card.

A K-1 is good for 1 entry. The I-94 is good for 90 days (don't leave the country even if they give you a multiple entry I-94).

Get married and file AOS, AP, EAD. Once you get AP you can travel but be careful how long you leave for.

Lets clarify this once and for all!

The I129f - only the USC petitioner is required to submit a birth certificate.

After the petition has been approved and the beneficiary applies for the visa at the consulte - THEN the petitioner will need to provide their birth certificate (and also the petitioners!)

Translation may or may not be required at the consulate - that is a consulate specific requirement. (We did not have to have the BC translated at interview in VN)

However you WILL need to have the BC translated when you file AOS after getting married in the US.

Hello all

Trying to get a small headstart on the paperwork needed after the I-129 is approved..

Reading the Guides I found I still have a few questions..

The first is regarding the Affidavit of Support..

what is the diference between the I-134 and the I-864? What determines which form to use? Is there a requirement for a bond? If so, what kind of bond is required? (Item 5 on the I-134)

According to the instructions, the DS 156K will be furnished by the Embassy if needed. I remember reading that completing this form ahead of time is acceptable,, Any thoughts?

The I-134 is used by the consulates for K-1 visa processing. The I-864 will be used after you get married in the US and file for AOS.
The I-134 is not legally binding - the I-864 is.

I've not heard of anyone securing a bond in a K-1 case (or any other immigration case I have read about here on VJ).

The DS-156 and other forms are typically available through the consulate we sites - they are a redirect link to the DoS website where the forms reside.

Hey Julian - really I was not. Just factually pointing out what is sometimes a misconception. I'm not going to get caught up in all the hoopla in this thread. I did find it a little amusing to a point but my god, I think we all have better things to do.

You know, if a USC made the same comment it would be viewed in a totally different light. Personally - I can find plenty of places here in the US to honeymoon, heck, we went to Niagra Falls for ours. Nothing really special except for the fact that 49 years and a few weeks ago that is where my folks went. Kind if a family tradition :rofl:

A few weeks later we went to Dayton, Ohio (for a bowling tourney) but we used it as another weekend getaway honeymoon :rofl: (really fun for the wife)!

We might go to Florida this summer to visit some friends but I'm really looking forward to going back to VN next year.

While I don't really appreciate people putting down my country, I have some opinions of my own about people and places here and there and everywhere so how am I really any different.

You are incorrect. I am moving here as a permanent resident. You didn't invite me, I'm not your guest. Complain to your USCIS if you have a problem.


You are NOT moving here as a permanent resident. You WILL have to apply for the priveledge of adjusting status to a conditional permanent resident and then a legal permanent resident.

Until you receive such status you are in fact "just visiting".

There was a case awhile back where a kid (don't recall his age but I think he was around 13) was screened because his name matched a name on the watch list. It was quite obvious that this child was not the person but yet they still performed the screening.

If you're talking about the benficiary, then no - this is not correct. No identification documents from the beneficiary are required in the petition package. Those things will be submitted at the consulate.


But you will need a "passport" style photograph to include with each G325A ;)

I *think* this means do you physically live in the county at the time, different from being a federally classed resident. After all, you don't exactly have to register when you move into a county. We had to answer the same question but it was a single question for both of us, rather than asking once for each of us, so it was easier to answer :P


Yeah, I agree with this perspective of the question. The OP is residing in the county although not a resident of the country. You have to "reside" somewhere when filing a marriage application and although you are not yet a permanent resident of the US, for the purpose if the marriage liscense you are residing at some current address in the US.

Since you live in France and are interviewing in France are you not home?

Presuming you mean home to the native land - you will have to wait until the passport is returned to do that. Since the passport is required to affix the visa "sticker" into it, there are not alot of options but to wait until you receive it. Unless you are stuck in AP you should have it within a week to 10 days. If you are placed in AP - you can request your passport to be returned until such time that it is required to affix the visa into it.

Sorry but I am not to familiar with the requirements for traveling between countries in Europe and if there are any other options.

Most can do this without the need for an attorney or agency. You should both read the K-1 guide here very thoroughly and get a good understanding of the process.

One thing to keep in mind, if you use an agency or attorney, it is still your responsibility to review all of their work.

There are multiple steps to the process which starts with the USC filing an I129F petition.

Once the petition is approved it is forwarded to the NVC and then to the consulate in your country. Then you (the beneficiary) are provided with instructions on how to apply for the visa.

Upon visa approval - you then can come to the US and get married and file for permanent residency.

Please read the guides here on VJ and get a good understanding of what to expect. A typical K-1 case without any RFE's may me completed in around 6 months (sometimes shorter - many times longer).

There is no EASY process or fast process - read and understand and you should be fine.
