We were approved on the 16th Oct. I've been calling (and sent 2 emails to) the NVC. My emails were acknowledged (automatic response) but no info yet given. I couldn't get an operator and the auto reply kept saying NVC had not recieved our file yet! I called 5 times on the 16th Nov (30 days after our approval) and the auto system STILL said they had nothing from Cal. Patsy called at 9pm last night (16th Nov) and got through to an operator and was told NVC had recieved our file on the 13th and sent it to London on the 15th Nov!!!!!
It seems that Cal USCIS are not sending out files promptly even though they sent out our NOA2.
Timeline for us: 160 days from Reciept at Cal to Approval.
27 days from approval to NVC reciept.
2 days to check and send our file to London Consulate.

I'm going to contact London on Monday 19th to ask for Humanitarian Expedition (speed things up). I've already requested H.E. from London and recieved a reply last week saying they have no files or records for us. Let's hope that they will now have our file and we can make up for the long delays We're praying that London will not take 90 - 100 more days to arrange my interview!

the 4 month was calculated ( before you posted your history) from GC recieved till your wife ( sad to say walked out )

I was just trying to make bobs words simple to read ,
not that the 4 month makes a differance ,
as long as you have enough effidance and divorce cert you can file anytime even before the 90 day ,


Filing jointly would take at least a year, possibly 18 months - 2 years!
Once again, I will say WE WERE MARRIED AND LIVING TOGETHER FOR 13 MONTHS before she left. From 1st March 2008 until the 1st April 2009.
Also, I had been living with her for 2-3 months each time I came to Ga (4 times since 2005). So the "relationship" took 4 years to fail. Even the remaining 9 months of last year - when we were living separately - we went out together and she stayed over at our marital home. The final break came at the end of 2009.
I don't understand why "4 months" is relevant! It's well known that wedding and AOS/GC dates are not considered the same and MY wedding took place 9.5 months BEFORE I got my GC.
As for the taxes: I already covered that - we filed "Married filing separately" from the same address.

So the way i see it is thus:
April 2005: began relationship and visited Patsy 4 times living as man and wife (I know it doesn't count as marriage but it's hardly the way someone would go about fraudulantly "buying his way" into living in the USA!)
Married for two years next Monday 1st. We were not legally separated so, as far as the USCIS are concerned we are still married UNTIL we get a divorce. (NB! Bank accts, mail, insurances etc are still shared and in joint names until then.)
An uncontested divorce can take as little as one month and I can then apply for RoC without her, almost immediately - 4-5 months earlier than a joint application, which would have to be on Sept 10 at the earliest.

My areas of doubt are: Is it beneficial for me to have been married for 2 years? (To disagree with your "4month marriage")
Is there an accepted time limit, or realistic/approved length of time to be married that satisfies the USCIS?

Is there a time scale to be separated for the Ga divorce court to accept "irreconcilable differences" and an uncontested divorce? (I could claim 12 months)

I'm inclined to take the shorter route and file for divorce, leaving less time for anything further to go wrong and to disentagle our lives and pretending just to conform to "rules". We both married in "good faith" and, not only proved it when we finally got married after 3 years of dating, traveling, planning and buying a home, we can still show that to be the case. I certainly would not have wasted 5 years (and more) of my ever decreasing retirement years to come to live in a country I'd never ever been to.

Lona: YOU may be saying in in "simple words" but Bob was not, hence my repeat posted questions, especially about the "4 month" issue that you too have wrongly used.
I repeat... What is this "4 month" time-frame you both mention? Maybe you're trying to say we were only married for 4 months before she walked out?

Anyway, none of these unexplainable comments answers my original questions.

PS. Maybe it would help clarify and correct things if I state the following. (Same info but re-stated)
1) Married 1st March 2008.
2) GC received 10th Dec 2008
3) Walk out 1st April 2009

Therefore we were married and living together 13 months.
Second WEDDING anniversary 1st March 2010.
April 1st 2010 = one year since her desertion/walk out.

I hope this help to identify my status and histiry better?

Given your documentation, I don't see any problems for you to file the ROC successfully, despite the rather short 4-month time frame.


Plan B??? I never mentioned a Plan B!! I take it that you mean the 2nd option?.. IE. Getting a divorce and filing on my own?
Why wait until the I-751 deadline has passed? (90 day window Sept 10th - Dec 10th). Once divorced, I can apply right away (asap) to have conditions removed.
What do you mean by "grey zone"? Are you implying I should prolong the process by taking my time with all this and applying LATE? I would have to give a good, honest reason why when the USCIS ask me to leave the USA!
What do you mean by "the rather short 4-month time frame"? As I stated, we were married on 1st March, TWO years ago (2008). My 2 yr Res card commenced on 10 Dec 2008.

Has anyone had first hand experience of my situation? Does anyone know for sure, the best route I should take? I feel I'm on solid ground to get a divorce (as long as my spouse cooperates - which is not garaunteed) and file for a waiver of joint application for R of C and file myself. I genuinely DID marry in "good faith" and have already proved that over the past five years, since we forst met. So, I feel I would have no problem proving that and that is the only real issue, isn't it?

Initially, I was considering "staying married" and filing jointly in the hope that we wouldn't be asked to attend an interview. THEN get a divorce and move on, assuming I'd get my 10 year Perm Res card.
Am I correct in assuming that having been married for two years is a necessary requirement for USCIS to prove a bona fide marriage?
IRS: Married, filing separately worked best for us (and I'm sure for a lot of couples), so is there any point in getting tax transcripts (evidence of cohabiting) for I-751/ROC?

We will have been married for 2 years on the 1st March 2010. My 2 yr Perm Res expires on Dec 10th 2010. She walked out last April, so we will have been separated for 12 months this April, although we stay in touch and still have shared issues in common. The marriage is strained and all but over and I need to know which way to turn (I am the immigrant, she is the USC). I believe that, if I file for divorce (uncontested) after our 2nd anniversary, I can apply to waiver a joint application for removal of conditions, ONCE I have the divorce papers.

The marriage WAS entered into in "good faith" and we have all the necessary info to substantiate that and my wife has agreed to attend an interview if requested to do so.
So, we can behave as if we're still a married couple going through a bad patch and file jointly in time for Dec 10th deadline. (as long as she doesn't change her mind later). Or, I could try discussing a divorce and getting it done asap and then freely apply to remove conditions on my own.
I bought our home back in May 2007 and put her name on the deeds and she was paying me half the house value as a monthly mortgage agreement - but not any more! I would like to get all this over with asap but I am worried that I may have problems getting my 10 year Res card/conditions removed.
Although I came here to spend the rest of my life with the woman I loved, I now find myself happy to live my new life here. I burned all my bridges back in England as a show of good faith and committment and could not sell my home in a time of my choosing, the way things are.
Can anyone suggest the best way of going about going through removing conditions with the least risk, speedily and quietly?
Do I wait until Sept 10th, or go for the divorce now?

We've called the CSC 5 times but only one touch is showing on the USCIS website. We're still uncertain whether to use 21st May (which the website says they received our I-129F) as our "NOA1" start point, or the day we received the actual NOA1 by mail. That was on the 30th July! We've been touched once (12th July) and we THINK that was when Patsy called about the late NOA1, which then arrived by mail on the 30th July.
I see that some K1-ers got their NOA2 without being touched but we don't understand why. We believe our application is more straight forward than most and everything was sent correctly. So, if they're processed in the order they were received, why are some getting their NOA2s when they applied AFTER us? Patsy's mom is terminally ill and she called on 4th Sept to ask if we could use the "humanitarian clause" to speed up our application and she was told not to bother because we'd be getting our NOA2 and day. We've found that it's down to luck whether we get an intelligent answer, a rude uninformed and unhelpful answer, or someone who doesn't care and makes up an answer to get rid of us, when we call. The worst thing about the USCIS call centre is that no-one seems accountable and you can't get the same person twice.
So we're totally in the dark without any reliable means to check our K1 progress, or plan accordingly. I hope that "touches" are meaningless or, at best, a sign that our application is so uncomplicated that it doesn't require constant checks/touches. But, if that is the case, then why wasn't it dealt with quickly? We believe that we are in the simpler K1 categorie and therefore should be dealt with faster than the "average" time-scale to get NOA2 (110 days). 111 days have passed since the 21st May, surely we don't have to use the 30th July as our start date (NOA1)? That would add on 10 weeks (70 days) to our wait! That would be really bad news but at least KNOWING would be less stressful.
Sorry to have been so vocal (I feel a little better for getting it off my chest...lol) but I do hope that this post helps someone in some way and maybe me too. ~

I'm still worrying about the NOA1 date ( the day Patsy received it [30th July]) being the START day for us as that would explain why we're being ignored.

Thanks for the replies, guys. No surprises but it's good to know I was thinking on the same lines as others with experiences. As for the NOA1/receipt issue. here's what it says on the USCIS website on our page:

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status: Case received and pending.

So I hope this means that our case processing began from the 21sy May, even though Patsy didn't get the NOA1 until 30th July? It's still almost 4 months since the 21st May and my point about the "averages" is this:
Averages take into account the LONGEST and the SHORTEST times to arrive at a MIDDLE time frame. Surely the more simple and straight forward case take the SHORTEST times, which SHOULD mean our case would take less time than the average (MIDDLE)?
I'm beginning to believe that, other than that one touch, our file hasn't even been looked at, inspite of our phone calls and that neither simplicity, nor filing date/order, have any meaning either. I think I'll take my own advice that I give to Patsy...."Whatever will happen WILL happen, no matter what we do, so just be patient". But it IS so easy to feel we're doing nothing whilst feeling we NEED to be doing something. (Like selling my home etc)

I will try to answer some of your questions/doubts.
ie *Start date (NOA1?)
I had the same confusion myself when I started this process but thru my research and readings here on VJ, I am fairly certain that USCIS seems to process applications in the order of their RECEIPT DATE thats printed in your NOA1. Again, I have read, thats how its suppose to work. Now, as we all know USCIS, its not always first come first serve but you can relate your case in regards with the receipt date in your NOA1. The notice date in your NOA1 is when your notice was generated. Someone please chime in if I my understanding is incorrect.

*How many touches are we supposed to look for? What is the usual amount?
* What do the touches signify?
Regarding touches, there doesn't seem to be any usual amount or number. Its totally haphazard but there are certain pattern. I have seen cases on VJ where an application wasn't even "touched" once but they still got their NOA2 and vice versa, meaning there have been so many instances where even after getting a touch or touches, it wasn't adjudicated. A touch means your case is getting updated(not to be confuse with being worked on, which may be the case btw). Update in this context could be that they are filing, shuffling your case between service centers.. or being worked on to get the final approval(NOA2). For me personally, I consider a "touch" as something is happening with my case but its fair to say that if you see a touch on your case after a long time(could be a few months) then its fair to assume that your case has been assigned, which may or may not end in the final NOA2.

In regards with USCIS processing dates, to keep long story short, DONT worry too much about them. Apparently, USCIS uses that date to "convey" to its customer that thats the furtherest(sp?) (as in past) date of application that they are processing but they could be and usually are working on cases that are filed much after that date. For ex., 13th Feb, in my opinion what that means is that they have approved all the cases that were filed on 13th Feb or before.

My K-1 packet was recieved at TSC 05/22/07 and sent to California to be processed. Received NOA-1 via snail mail. I think we are all in the same boat---check out the May filer threads...a few have been approved, but the majority of us are still waiting. I share the same NOA1 date as you--May 24--and it does border on the unbearable to have to wait for such a long time!! I did call my lawyer who is helping us through this process, and they are saying that I should have to wait no longer than 3 more weeks for the NOA2. So that is a little light at the end of the tunnel smile.gif Hang in there...us May filers should all be getting some good news really soon!
