United KingdomPacket 3 preparation
I wondered what kind of stuff can I do in preparation for whenever my packet 3 arrives. We still haven't gotten our NOA2 yet after 5 months tomorrow so I want to reduce the wait after we get it to a bare minimum. What can I do to prepare myself and send the packet back literally a few days after I recieve it.

Any help would be greatly appriciated.

Thanks and safe journey to everyone still waiting

United KingdomWould it effect my visa case if I quit my job?
Basically, I'm running into a few problems at work and feel like I'm being harshly treated and really don't want to work for this company anymore. I listed this job on the forms I sent back to get an interview but really want to quit. Will it effect anything if I decide to do that? I have a second job if that effects anything.

Ask yourself "how can I present the best financial picture?" Do you think showing the low paycheck that's not reflective of her normal working hours paints a good picture? Take things that are positive and in your favor. She's already written a yearly income. Now show things that support that much in a year.

Thanks for your reply, I feel a lot better about it all now good.gif

It doesn't matter what we think, but rather what the consular examiner thinks. Worst case scenario, they'll send you away and tell you to send in paperwork showing a cosponsor, at which time your visa will be issued. (Assuming you pass on all other criteria, which I'm sure you will.)

I know this, I was just hoping that someone could share there advice if they were in a similar position to mine. But thanks for reminding me that the worst case scenario is only having to wait for a few weeks further.

Quick question to anyone.
How many paystubs do you think I should submit and how recent would they like to see? I have the 3 most recent paystubs at my disposal but my finacee has had some family problems about a week ago which led to her taking pretty much a week off which has led to a low pay stub which sends the average down to below the minimum. But the other 2 are fine and well above the required standard. Should I submit only those 3 and explain what I've said or should I get together a recentish group of paystubs that indicate she meets above the requirements?

I know none of you out there are consulates or interviewers but I really do apprieciate any advice you guys can give.

Thanks ahead of time, you guys are awesome good.gif

You did say you had paystubs as well didn't you? I think those are also incredibly important as they're interested in seeing that the income is currently ongoing... so don't forget the paystubs!

Yeah I have 17 paystubs to bring and the average weekly wage of these times by the 53 weeks in this year, she makes literally just over the 125% mark. I also have bank stuff with over a $1k in savings in it from her. Does this sound good enough to you?

Ok thanks, everyone for your replies. Since my interview is on monday I don't think we will have enough time to submit a co-sponser paperwork in time. So I'm just going in with my fingers crossed that they do actually follow the guidelines they require. She makes enough and I have tax transcript and W2 that confirms she does - so that should be enough right? If it doesn't work then so be it, we will have to submit a co-sponser after the interview. unsure.gif

Sorry for the double post but I've got a question to ask. If they were to have doubts and bring it up, will I have the chance to present a case or arguement at the interview and change there mind?, or as soon as they decide, will that be it and I will have to go away and get a co-sponser?

Ok, so I've done an average wage over the 17 payslips I have and it works out pretty much smack on the 125% line. She also sent me a letter from 2 of her banks which come to a total of just over 1k extra. do you think this will be enough?

You're panicking just a bit...

I'm not surprised her work won't give her much in the way of an employment letter - most don't give one at all (so the Embassy/Consulate won't expect much in this area). They will take her weekly pay-stubs (I hope you are providing as many as you can) to calculate her yearly earnings potential - so as long as you're at/over the minimum you should be fine (that is what the minimums are for). There are plenty of folks who qualify by earning the minimum.

Now - should you still feel uncomfortable - you could go ahead and secure a co-sponsor, get that ball rolling in the event you end up needing it (at the request of the Embassy/Consulate) - not saying they'll ask, nor am I saying you'll have it in time for the interview - but if they ask, it won't take that long to have one ready.

Hope this helps. good.gif

Thanks for the reply, it did a little bit

United KingdomPanicing over Visa Interview
I'm really stressing over the visa interview. Not so much proving evidance over our relationship and I have all the documents in place and have everything I could ever want but its the proof of support thats making me very scared at the moment. My finacee doesn't have the sort of job that earns you a lot of money but she does earn 125% and this is evidant on 2 different documents (Her W2 and tax transcript from the previous year) and her employment will only show her current year to date earnings due to company policy and its obviously below that line as the year hasn't finished yet but if they divide it down to the weekly average paycheck then it does top the 125% mark for the year. She goes over that 125% mark by only 1-2k and I'm just worried they will turn me down because of this. Does anyone have any advice or went through the same thing? Its to late to get a co-sponser as my interview is on Monday. I just hope they stick to there guidelines and I should be ok. Am I just panicing for no reason?

Removing Conditions on Residency General DiscussionDivorce Waiver
Hello fellow VJ's

My relationship with my wife has reached the point where weve deemed our relationship unfixable. She's been cheating on me behind my back and divorce is the likely outcome. We are still on very good terms which is going to be useful but I wanted to know what should I include in my divorce waiver packet when I come to try and remove my conditions, once the divorce will become final. And what are my chances of getting them approved. We married out of love, of that I have no doubt, and there is support and backing from her and her family that this was the case.

Im not sure what to do but I would like to continue developing and building my life in the usa. What evidence should I get to prove my case that we married in good faith?

Thanks ahead of time

Todd

? Letters from my 401k and life insurance provider stating I put my spouse as beneficiary.
? Letter from my former wife’s life insurance provider stating that I was her beneficiary.
? Car insurance card stating that we shared a joint insurance policy.
? Copy of our car title showing that we owned a car together.
? Joint bank account details from our Bank of America checking account set up in 2010 and Joint bank account details from our SunTrust checking account set up in 2008 that show that our financial assets where intermingled.
? Photos from our wedding.
? Photos of the two of us together at various points during our marriage.
? Photos of trips taken together along with airline reservation tickets of trips we took together.
? Copy of BJ club cards on our joint account set up just before termination of marriage.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary Filers who haven't heard yet thread
Hey all

Just interested in seeing how many of us haven't heard from January. As it seems like we are the ones being left behind at the moment. We filed on the 13th January and have even asked for help from our congressman but we haven't heard anything from them yet. I'm guessing it might be to do with the all in one box thing but someone on the 14th Heard so it almost blows that one out of the water. Any theorys?

Keeping my fingers crossed it won't go on for much longer for any of us

Peace out

Todd And Christina

Well I'm guessing, by guessing I mean working out on the average number of H-1's being processed so far compared to how many weeks they've been going so far, its going to be at least 2-3 weeks before they fully return to K-1 mode as we know it. I really really hope I'm wrong though sad.gif

I find it quite unusual that nothing has happened there regarding K-1's for about a week now. I know we only have a small portion of the applications that come in but my fiancee is actually having a nervous breakdown about the uncertainty about it all. We submitted our's on the 13th and haven't heard yet and its becoming increasingly frustrating that couples (I Know its not there fault and I'm happy they've heard something) almost a month after ours have heard. Has anyone any information and idea on why it has suddenly seemed to of stopped after a lot being done at the end of last and start of this month? wacko.gif

Good luck to anyone facing the same problems as ours....

USCIS usually sends a confirmation of the change of address to the new address - hopefully she received this (mine took about 2 weeks to get).

Since the USCIS site doesn't show an RFE nor an Approval then apparently nothing has been missed in the mail and things are simply taking this long - you're due/overdue to be adjudicated so I suspect you'll be hearing something sooner rather than later... good.gif

(Your fiancé could call USCIS to ensure they did in fact update the new address.) good.gif

What kind of confirmation are you refering to? She got a number from then when she called to change it and it followed pretty quickly with a update on the website about our case but I'm very sure that she didn't get anything in the mail

Actually technically 13th July will be our 6 months up and weve already been in touch with our congressman who hasn't even bothered to get back to me after 3 weeks and quite a few phone calls and emails. I can't really do a lot because I'm only the beneificary and my fiancee (who is the petitioner) is often to busy with work and moving to do anything so in fact were both really struggling atm, by july things would of calmed down and she will be able to do more but until then all this waiting and watching feb people get approved is a hard thing to take. Unless, is there actually anything beneificarys can do over the phone?

Is this unusual behaviour and does it usually take this long for a representative of a congressman this long to get a response to USCIS?

I'm considering contacting our senator instead to see if they will be a bit more helpful. Will this cause any problems?
