I am a US citizen and filed I-130 petition for both my husband and my step son in Feb.2013. It is still pending right now. My question is, my husband has been removed while entering the US in 2008. He has been in the US 2x before that happened. On his first visit he overstayed for 3mos. He was banned for 5yrs. The ban was finally over in Feb. of this year so and I filed the petition 2/28/13. He was given the following restrictions on his passport when he was denied entry: 212(a)(7)(A)(I)heart.gif and 212(a)(6)©(I). I am wondering which of the waivers above should we file for him? Since we waited until the ban was over, is it possible that we do not need to file any waivers? Pls. help. Any input will be highly appreciated.

Waivers (I-601 and I-212) and Administrative Processes (221g)Expedited removal/ unauthorized employment

They will not remove your ban just because you married a USC. You can wait out the ban, or your husband can file 2 waivers and try to get the ban removed. The waivers are not something people take on by themselve successfully. You will need a lawyer and the cost will be between 5 and 10 thousand probably.

Hi, me & my husband were married in May 2012. He was on a 5yr ban with the same code as the above here, but was already over in Feb. of 2013. The reason for his ban was unauthorized stay for 2.5mos or overstaying on his previous visit in the US.  We waited until the 5yr ban is over before I filed the petition.  His petition just got approved recently and we are now waiting for an interview in Manila where he is right now. Do you think they will still require us to file a waiver?  Pls. advise.. thanks...

I am asking for my husband. I am a US Citizen but a little worried because we are days from sending our waiver and oir lawyer is telling us that we might get denied because I have no medical record what so ever and we have no kids yet...but come on who wants to risk it, having kids with out their father here? I am really scared we might really get denied. My husband has no criminal record and he has paid his taxes and all that. I have sent pictures of our wedding and several letters from friends and parents. I am not sure what to expect..please if you have been approved on your i601A share your story.=/

I'm wondering who requested your I601 waiver. Looks like your petition for your husband was approved already. Was this requested by the consulate in Mexico? The reason I'm asking is we may have to do a waiver too but no one has asked for it yet. And also, you seem to have all the reasons for a waiver, his living condition in Mexico and yours if you have to live there is not very safe for your family.

I can't even check the status of our waiver. It still says the number does not exist. I know it does exist because we have called. Its been a month. How long does it take to be able the check the status online?

that is really weird... Ours showed up as soon as I got a text from them that they have accepted our I-601. Did you guys ask them why it's not showing on line?  I can only guess that whoever is doing the data entry over there missed your paperworks...

I do a three-way call with the USCIS and my husband in Costa Rica. It works well because my phone plan allows me to call my husband's landline for free. It is frustrating that I can't call. I have seen approvals coming in Around 3.5-4 months. Are you able to track your case on the USCIS website? Our waiver was accepted August 26th but I'm still not able to check the case on their website.

Ok, we will try that. Thank you. Yes, I signed him up on email and text, but not knowing all the update like I used to do before on the petition is just so frustrating .  Waiting for any correspondence in the Philippines will take dble the time waiting here, knowing how slow the mailing system over there. Right now on the website, ours is showing "Intial Review".  Please update us of any news on this issue, if you hear anything. That'll be highly appreciated. Thanks again...

My husband's I-601 waiver was accepted July 29, 2014 @ Nebraska. Since it was for my husband's waiver, USCIS cannot give me an update over the phone. They said that my husband has to call, but he is in the Philippines. Tis is so frustrating and by reading the thread on waivers, it gives us a little hope. Is there anyone here knows what the current processing date is? I'm not sure who to believe, someone posted an approval on a June acceptance and many are waiting longer than that. Any feedback will be highly appreciated. Thank you all.

Just looking to see if anyone has any feedback. My wife is a USC and I am an Israeli citizen. We filed the I-130 back on April 4, 2013, and received our NOA1 263 days ago. On 11/30, the application was transferred to Texas Service Center....no word yet. It's taking forever, and USCIS told her on Friday it could take up to a YEAR just for processing. Seriously?? Please tell me you guys have had more luck with the Texas Center.

 

We had filed an I-129f to speed things up, but they have never even touched the application, and have given us no info despite TWO service requests. It's just sitting there at NBC, and I have no way to come visit my wife.

 

I feel your pain.  If it makes you feel any better, Ours is Feb28 NOA1 and just like yours got transferred to Texas and still waiting for a decision. I called tier 2 last Monday and was told that it is still undergoing security check. They have approved my stepson son tho'.  I just don't understand why they are holding off on my husband when they have approved his son's petition based on our marriage. Can anyone here in VJ relate to me?

Thank you, I really needed that. I am waiting patiently, but when you see cases in June/July being approved before me, just can't help but feel frustrated. And in all honesty, there shouldn't be any problem with ours other than our distance. His son, was approved Nov 27, and his paperwork was now forwarded to NVC on Dec. 24. I was hoping they can both travel together but until now, I am still waiting for his dad's petition to be approved.

This is so frustrating, it has been 10 mos. & 3days of waiting. I have requested to expedite 2 wks ago, they emailed me back saying that my case is undergoing security screening and I just have to wait. Haven't we all waited long enough for that?  I have contacted the ombudsman also, but I have not heard from them either. How long does that security screening being process?  I am a good law abiding, tax payer US citizen and my husband, I would say is of good moral character otherwise I would have not married him, known him for over 30+ years.

Anyone here who can relate to me or undergoing "security screening after waiting for 10mos?"

A few ppl where approved today with Noa1 date of Feb 16th I believe it was

Feb 28 filer and my husband's petition got transferred Oct. 23, still waiting... I don't even know what to say now? so frustrating, miss my husband so much...

I received another email/text update around 9:15 pm last  night that our case has been updated.. when i jumped up to check the status online this is message: The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you.  

 

smh....im already aware and received the hard copy of the the transfer...

 this is the 3rd update within the last week.. hope this means a decision

Goodluck...at least we know where they are right now and if we want to, we can now schedule an info pass to check the status of our case. This is about the 3rd time I've read here on the Forums that at Tier 2 has told someone to file a K3 to speed up the process. I have also read that the boarder officers are seeing alot of people coming in on K3's.

 

My I-129f for the K3 has a NOA1 of 6-24-2013.  The  number for my I-129f starts with MSC the same as my I-130.  I would also like to know when you get the NOA2 for your I-129f if it has a MSC number.  Maybe it will be a CSC number.

 

My question to you is where did you get the Aug 23, 2013 processing date from? Did the Tier 2 tell you that or did you look it up on VJ.

I WAS LUCKY ENOUGH TO TALK TO SOMEONE WHO TALKS THE SAME LANGUAGE AS I DO. I TOLD HER THAT I START TO LOSE FAITH WITH ANYONE AT THE 800 NO COZ' IT'S THE SAME EXCUSES. BUT I KEPT TRYING JUST MAYBE SOMEONE WILL GIVE ME AN HONEST ANSWER. SHE SAID THAT IT WAS TRUE THAT MY FILE WAS TOUCHED BUT THERE WAS AN UPDATE AGAIN LAST WEEK THAT CONFIRMS WHAT IVE BEEN READING HERE LATELY. 4 WKS AGO THEY SAID THAT ALL THE FILE LEFT AT NBC MISSOURI WILL BE PROCESSED BY THE END OF OCT WHICH INCLUDE MINE THAT WAS FEB PD. I called yesterday again, and I asked for tier2 officer. On my first call, the guy told me to call back in 9mins, I didn't argue so I called again in 9 mins. The lady who answered phone said that I'll wait for 3 hrs & I told her it's ok, got plenty of time to wait. I got an answer in less than 10mins. The Officer that talked to me was actually nice. I asked her why my file was sent to California when my husband is still in the Phils. She said, that was wrong and file will not go to CA. After decision, the files will be forwarded to NVC then to US embassy in Manila and that they have no way of knowing how long we still have to wait. She assured me that it is being worked on at this point. And I should feel lucky that there is no RFE. OK? Since I am petitioning for my stepson too, that makes my case slower than normal. I think for us February filers, to keep our sanity, let's go on with our life and live day by day. When the time comes for our turn, and i'm sure it will, that'll be one sweet day!!! but till then, I will stop looking at the status for a while and keep moving forward. I've wasted so much time checking, calling and stressing about all these. Kind of pointless when we get nothing but promises from people who doesn't even works on our case. Info pass will tell you the same thing so why waste time on that too?  I've brought my whole family here in the states(parents and siblings) and with that experiences, I should have known better. I guess now is different coz' I'm waiting for the love of my life that's why I'm so frustrated. To all of us reading this, pls. update your status so VJ can get a better estimates. More power and God bless us all...

well, ours was touched Aug 13 and nothing yet. I called the other day and I was told that our file was transferred to my local office here in California, and I should wait again for another 6 wks. Now I'm confused, coz' I thought that if the petition is outside of the US, the next destination of our file once approved will go to NVC for visa and then go to the US embassy of the person being petitioned. Can anyone help pls?

ok, I just got a call from MSC a minute ago (the call came from this no. 877-376-8929), was told that I will be receiving an update within 14 days. I guess, that was the response I should have received before I called last wk. She also said that getting approved or getting our NOA2 from MSC takes no longer than 8mos. from their end. So I guess I should sit and wait till then. And yes, there was an activity on my case. We'll see...

I was told the same thing. They even gave me a date when it was first touched-Aug.13. Right now, all we can do is wait and see. I may have to call again this week just to see if there's any update.

I know..i wish we don't have to wait this long. It looks like they record all the inquiries we do, so my advice is, at this point, when we have a chance is to keep on calling. I wonder if I didn't call on August 9, maybe my file is still in a big stack somewhere and not on somebody's desk on Aug. 13. So yeah, calling is free and most people I spoke with at the 800no were pretty nice. I will call again next week...good luck to us all...

Tier2 is a person higher than the 1st person you speak with when you call the 800 no. I called a week before and was given an inquiry number so I do not have to wait on the phone for a long time. They said

Tier2 officer will give me a call. But no one did for 5days so I called again and gave them the inquiry no. they gave me the first time. This time, they asked me to wait, so I waited 2-1/2 hrs on hold. Was worth the wait because the person who answered the phone was actually looking at my 2 petitions. Was told the petition for my husband and stepson were both together and very active as of that moment. She said that my files were on somebody's  desk August 13 and so far so good. She gave me a 6wks wait for a decision which is a normal time she said for somebody to work on if the case has no problem. So yeah, I am holding on to her words that by late Sept to 1st wk Oct, there will be some kind of movement from "Intitial review to Decision". If nothing happens, I guess I have to call them again.
