I would agree to everything in your plan.

Just note she can come to the USA without a visa for 3 months as Swiss national. Maybe you can arrange for marriage within that timeframe and avoid special tourist visa.

K-1 Fiance(e) Visa Process & ProceduresQ11 - Form I-134 Affidavit of Support

You fill it out exactly as the example form states. N/A K-1 PETITION.

Myself and many others have filled it out exactly as the example form states and have had no issue what so ever.

Again, that's your right to put there, no problem.

I have been told by countless immigration officials at 'some' embassies, that leaving a box unchecked and simply putting Not Applicable K1 petition, would warrant further questioning. this is unlikely at most embassies, but, other some have different protocols.

K-1 Fiance(e) Visa Process & ProceduresQ11 - Form I-134 Affidavit of Support
You are not reading the Question Correctly.

For Quetsion 11.

I , refers, to the PETITIONER (US Citizen) who SHOULD INTENT to make specific contributions to the Support of the person named in Q3 THE BENEFICIARY.

If you answer NO, Immigration officials at the consulate will look at this and start asking questions, and ask WHO will support the BENEFICIARY..

K-1 Fiance(e) Visa Process & ProceduresText Notification of NOA2

Correct me if I am wrong, I think the text notification only applies to the NOA1 when submitting that form.

If you want to receive text and email for case updates, you have to create an account on the USCIS with your case number and click yes for email and yes for text notifications.

I am not positive though

I received a txt message at 2:30AM when i got NOA 2 approved. Woke me up but boy was I was happy :)
Winning23MalePakistan2011-10-17 23:29:00
K-1 Fiance(e) Visa Process & ProceduresText Notification of NOA2

If you completed and sent the form with the I-129F that allows USCIS to notify you by TEXT and E-MAIL, do they also notify you of the NOA2 by TEXT MESSAGE? After that? Further notifications by text message??

I sent my initial app for I-129F in on July 23, 2011.
I received the best text message on the 27th! saying they had received my application.
I am not real high tech oriented, so...lying in my honey's arms in Bogota, being awaken by such a text message was quite a nice surprise.

So... I'm wondering, if they are also going to text a notification in regards to the NOA2, which quite frankly, I'm expecting any day now... more likely, in about 9-11 days.

I'm asking because from all I've read here in the past month, and from talking to a rep or 2 at the USCIS, even they admitted that the website, www.uscis.gov, notifications are not always, if ever, up-to-date.

Once NOA2 approved, you will receive another txt from USCIS. then, few days later,
actual paper copy of the I-797 will arrive to petitioner address.

Good luck

K-1 Fiance(e) Visa Process & ProceduresOver 6 months for NOA2 - how to expedite?

You know, in the interest of civility, I've been biting my tongue for months now, but I can't any longer. Most people here are great. But, you and several other high-volume posters on here have this tendency to be especially nasty to other members here. People here are already stressed enough, and you aren't making things any better. You need to rethink your attitude here, or stop posting; either works for me.

To answer your snarky response anyway, the instructions clearly said I could send COPIES of all documents. So, I did. I followed the instructions! And, their response did not indicate what was wrong - if they wanted a certified copy, the RFE should have said so, other than just say they need a divorce certificate, which I had already sent a copy of. That IS moronic! If someone looking at this sees a divorce certificate but has a problem with it being a copy, then a reasonable person would put in the RFE that they need the certified copy, rather than just say they need the same thing again. Obviously, I can't respond to the RFE by sending nothing back, even though they were unclear. So, I sent every document the court has, and all certified; if this does not satisfy their unclear request, then nothing will, since there are no more court documents that can be obtained.

Hang in there, hopefully it will be expedited soon. Each RFE is closely looked at.
Best you can do, is call and speak to a 'live' person at USCIS and calmly discuss your individual case and
see if there's anything else they need. Outside of that, just be patient.

All the best
Winning23MalePakistan2011-10-18 13:09:00
K-1 Fiance(e) Visa Process & ProceduresOver 6 months for NOA2 - how to expedite?

No it was really quite simple. In the I-129F I sent a copy of the divorce decree. The RFE requested the divorce decree (without any clarification about what was wrong with the one I already sent them). Idiots! So, I sent them all the court documents, certified, not just the divorce decree, this time. These morons really piss me off... if they have any question about whether a divorce decree is valid, all they have to do is call the court house in Cambridge and ask for clarification... I called them and talked to them in person too, and they are responsive and helpful. They answer the phone in under 4 rings, really easy to do.

No, there are no criminal records. Both me and the fiancee lead really boring lives... my fiancee has always lived at the same address since birth, and only had the same job. And, I've been at the same job and place for 11 years. Nothing exciting to say about either of us that gov't would care about, other than my previous divorce from a K1 beneficiary.

Possibly the fact your divorce was with a 'K1' beneficiary, would raise concern, and thus, require further followup. Never know, some cases take longer than others. I am sure w/ the correct paper work u provided, it should be a matter of time.. Good luck

K-1 Fiance(e) Visa Process & ProceduresOver 6 months for NOA2 - how to expedite?

Sorry I'm sure this has been asked before, but I'm having trouble searching for the answer. My NOA1 was received by VSC on April 12. I got an RFE after 5 months, and it has been 6 weeks since they received my response to it. Still no NOA2. I'm very unhappy about this.

How do I ask this to be sped up, or do I have to wait for 60 days for RFE response to be processed?

What was the nature of RFE?

Must be something USCIS has to investigate quite throughly if taking long. Just call them and ask for an update.

A pleasant day to all!

I was just wondering if the USCIS will send back the whole I-129f package you submitted for the application, together with the NOA 2 in order for my fiance to send it to me for the embassy interview...

Thank you...

Nope, they don't return it. The application is forwarded to the consulate where your beneficiary will be giving the interview. Once the interview is completed and visa approved, the application is put in a sealed envelope and submitted back to the beneficiary. The envelop will be opened by immigration officials upon arrival in USA. Can't be opened beforehand, otherwise, it's null and void.

K-1 Fiance(e) Visa Process & ProceduresOriginal Documents from the petitioner to bring to the interview

My fiance has his K1 interview scheduled for December 1st, at the consulate in Amsterdam. I am getting ready to send all of the documents that I have to him for the interview. Because they are secure documents I will send them through certified mail. I was hoping that you all could help me to make sure I didn't forget anything important to send to him.

I have included:

  • I-29F with original signatures
  • G-325A with original signatures for both the petitioner and benificiary
  • Petitioner's original birth certificate (is this necessary?)
  • Original NOA1 and NOA2
  • My apartment lease stating my current address and the location where my fiance will live when he comes to the U.S.
  • Two signed affidavits stating my intention to marry my fiance within 90 days of his arrival to the U.S.
  • Paystubs for the last 5 months
  • Letter of Employment from my employer (dated September 22, 2011)
  • I-134 (signed and dated September 22, 2011)
Should I also include bank statements? Do they need a copy of my passport? He will provide all of the evidence showing that we are in an ongoing relationship. Did I miss anything? Thank you in advance for all of your help! This interview is so important; we don't want to mess anything up!

As part of the i-134 form, you will need to have at least two years of IRS tax transcripts or w2 showing earnings You also should have a bank reference letter indicating your name, when account was opened and balance. They don't need a copy of your passport. That proof should have been provided as part of the original i-129f form (COPY OF THE ANY OF THE FOLLOWING certificate of naturalization or birth certificate or passport pages).

Letter of Intent should be updated with new date from you. The text of the letter can be same as the one you submitted for i-129f but the new date is important and shows your intent to marry if the embassy needs to see it.
From my understanding the NOA 2 and NOA1 can be copies, don't sent originals. Just my 2 cents.

DONT SEND YOUR BIRTH CERTIFICATE (ORIGINAL). ALWAYS KEEP THAT WITH YOU.

Also use DHL international to send documents to your fiance. The best in the business.. Expensive but don't take any chances w/ lost mail,etc..

All the best.

K-1 Fiance(e) Visa Process & ProceduresHELP! URGENT SITUATION!

here's what happened:
my friends'brother's visa was approved last week by the US embassy in manila(phils).
now they got a call fromt hem yesterday asking her brother to go back there & submit the affidavit of support papers, paystubs & tax documents which i believe they FORGOT to collect. they kindof revoked the visa & told her brother that his petitioner shouls get a job for at least 3 mos before they can process his visa.
but WHY? that's why they have a CO-SPONSOR right?
anyone pls enlighten us.......let's help them fellow VJ'ers

If the co sponsor don't have steady and stable track record of income.. The US Embassy may want job history more than 3 months for each co sponsor. If it's less than 3 months, may be the issue.. not sure. Such decisions are independent of each embassy and how they view financial support requirements.

thx for helping anyway , but i really did not understand those files lol

If she's an American, and you will be marrying her in Algeria, she is NOT allowed to file K1 visa on your behalf.
She must file K3 visa -- non-immigrant visa is for the foreign-citizen spouse of a United States

Tell her to start reading up on the rules, forms, which can be found on this site or the state department website.

K-1 Fiance(e) Visa Process & ProceduresInsight into USICS Service Center

Not to be picky and have nothing against foreigners (I was/am one once), but your #2 seems to be saying that foreigners applying on a H1-B are given more priority than a USC??
Is the government so blantantly stating (with those priorities) that money trumps their own citizen population?
Since when money is more important than a future spouse and a person?

I guess the protesters at Wall Street are right after all (because the main beneficiary of H1-Bs are the companies sponsoring those persons)

Sadly, I believe the comment about higher revenue generating cases .. It's not right, but, H1-B are money makers for the govt. and possibly get faster processing. The government is losing money and if that means generating income by putting a class of visa ahead of others, this may happen.

However, I happen to think each and every case is unique and we have dozens if not hundreds of cases on this forum where the K1 total time took less than 7 months, which is quite good in my opinion.

I made that mistake also. When i realized the proper consulate was in another city, I called the USCIS number, spoke to a live person, explained to them what happened. I received a letter in the mail -- NOA 1 update to inform me, the correct city was now on the file for the application.

K-1 Fiance(e) Visa Process & ProceduresI-129F Filing and Evidence of Relationship

Thanks all for the feedback.

Yes we are an inter-racial couple and we know that we are going to need to submit a lot more evidence because of that as well as India is more strict about the visas as well.

We actually opted not to have an engagement ceremony when I was in India as we did not want there to be any question or doubt that it was too extravagant and think that we got married. We just did a very small engagement party once we got back to the US.

I'm feeling pretty organized because I've been saving so much stuff but I definitely want to make sure everything is aligned to try to make this as smooth as possible (which will still be bumpy, I'm sure... ;-)

You should be fine. With good amount of evidence, you are all set. Good luck..

K-1 Fiance(e) Visa Process & ProceduresI-129F Filing and Evidence of Relationship
As chigs as mentioned,

In some countries, the burden of proof becomes more of an issue for interracial couples, thus, I would put forth as much evidence as i could to leave no question in the examiner's mind about the relationship.

-Pictures of you too. Include family members if engagement took place. VERY IMPORTANT to show family members in pictures, clearly demonstrates family involved.. good thing for reviewers.
-Plane ticket stubs
-Passport stamps from entry/departure points

-Hotel receipts
-Engagement ring receipts
-Phone records (skype logs, calling card logs, etc..)

If you such information detailed, your chances are much higher for approval. All the best

K-1 Fiance(e) Visa Process & ProceduresNVC. Quick Question

I called the NVC today and they said that they received my case but is not in their system yet, that it may take 3 to 4 weeks to be processed.

Is 4 weeks their realistic time frame in to process or is just their script answer?

( this one is an obvious one but just in case) So I get the visa # when they finally process everything and is sent right?

Thanks

Congrats, good thing is NVC has your NOA #2 in their system. Should not take 4 wks from my personal experience. My case got assigned a case number relatively very fast.

The number is a three letter prefix (City of Embassy- number) i.e. ISL - XXXXXXXXX . they can provide this number to you over the phone, once they have it processed. It takes them 2 to 4 days to send the paperwork to the appropriate embassy via DHL. If are signed for automatic notifications when applied for i-129F, then, NVC will send you an update to inform you, case number assigned, and papers off to Embassy. From that point, the US embassy and beneficiary are in contact to complete the k1 process.

Good Luck

K-1 Fiance(e) Visa Process & ProceduresVisa Denied - Cairo (Age Difference)

My fiancee had an interview today at the US Embassy in Cairo visa denied due to our age difference....Did anybody have the same problems because of age difference they have to deny his visa? They told him to marry a woman in Egypt. Why do they have to question him like this. This is not the interviewer business to ask him just because of our age difference. What is the next step I could do if his visa is denied? He answered everything right, paperwork is all correct but WHY the interviewer do this to him. :( :help:

Sorry, but, the embassy has to side of caution, as there are many many sham marriages which take place. I would also advise getting married in Egypt, as it would legitimize your marriage and provide a better case for spousal visa.
If you don't want to go that path, maybe hire a lawyer in the US, and seek some advice.

None of us are experts here, just trying to provide some reasonable alternatives.

Am I not sure why this is so confusing for you..

Proof of engagement and proof of evidence of support is required by the EMBASSY as part of the DS-156K Form. When a form says, please attach to this form, you should attach supporting documents. If you don't attach what they asking you.. You will delay your interview.

Also, make sure you have the original supporting documents with you for your interview. They may ask for it. May not. But be prepared.

Hello everyone my name is Poonwattie, I am finacee of Mohsin, In his D-156 form they are asking for eveidence of engagement,
now i knw that would be engagement pictures etc, and also they are asking for eveidence of support, now I am the petitioner
and i cant give evidence of support, because from my understanding, they want to knw how he is supporting himself now, not when
he comes to USA, cuz if thats the case then they would ask for affidavit of support, which was provided to usics already, now
they cant expect me to support him in Pakistan at this moment, so how can I give evidence of support??However i will contact
my lawyer tomz. But ur imput will b highly appriciated.Thanx for ur time.

There is a DS-156K Form which must be filled out the BENEFICIARY. The supporting documents requirements are :

- Evidence of Engagement: you should have tons of pictures, emails, chats attached.. This is considering on-going relationship.. after the submission of i-129F application.

- Evidence of Financial Support: This means you the petitioner will need to provide i-134 form and supported documents as attachment to this form..

- Police Certificate:
- Divorce Decree (if any)
- Birth Certificate

You as the USC should have complied a list of supporting documents and signed i-134 form, and mailed them to your beneficiary in PK.

bro i'm the beneficiary myself my fiancee is currently not working i had my sis in law as a co-sponser

so now what she needs to send me i have her bank statement only all documents and tax papers were sent to uscis

when she apply for me from USA i have all the copies of everything which she sent to USCIS tell me what to do

Okay..

got it. The co-sponsor is your sis in law from the USA . Right? She should send you all the documents (same submitted for i-129F), to you for the embassy interview. Since your USC fiancee is not working, the US Embassy in PK needs to establish the fact you won't become a burden to the government once you are here.

So, either your sponsor or co-sponsor must provide legit financial documents for your K1 visa to be approved. As the beneficiary, you should have a copy of the i-129f in your possession, and the i-134 evidence of support forms from your fiancee explaining the fact there is a co sponsor and documents provided, should be good to go.

Email or mail the following to your beneficary:

1. Letter of Employment from your workplace - name, your position, start date, salary
2. Two years of IRS Tax transcripts
3. Bank Reference Letters
4. Any additional earnings i.e. IRA, MMA, or mutual funds.

More info you give, the less hassle it is for the embassy reviewing the case.

Bye the way, all the information above should be have provided via the i-134 form which is a required form by the embassy.

K-1 Fiance(e) Visa Process & ProceduresLawyer VS Visa Journey
I will say this. Yes, there is some pretty unique situations where you will need a lawyer by your side. Having said that, I think people don't have to spend a fortune on lawyers. There are several very good fee based lawyers online where they answer your questions immediately.

Before I started my K1 journey, I contacted a lawyer online used the service, got my answers, and did the rest. Cost was like 100 bucks. But it was assuring to know i was going on the right path. Then, happened to find this site, which, in m opinion is amazingly helpful. Example Forms, Timelines, and fellow VJ'ers, probably more valuable than a lawyer.

If your case is simple, and cleancut, you can file yourself.
If your case involves, an RFE or complications which are delaying your case, definitely seek professional advice.
