K-3 Spouse Visa Process & ProceduresFilling Taxes?
QUOTE (immillpind @ Apr 10 2008, 11:51 AM) <{POST_SNAPBACK}>
Just wondering if anyone has experience with this:

Since i usually file my taxes online, I'm not sure how to file for my wife.

We were married on Dec 22 2007. She obviously does not have a SSN, and does not live in the US yet.

Does this mean I'll be filling joint or single? she does not work.

Please help if anyone knows. thanks.

I just talked to someone at the irs yesterday about this. She told me I would need to file for an extension, and need to apply for an itin number for my husband. It would be a good idea to call their 1 800 # and talk to someone, cuz the extension needs to be in by the 15th. The paper that you apply for the number for your spouse, the spouse has to sign. Thats why youll need the extension, the lady at the irs said i would be qualified for a 6 month extension. Good luck, I would call asap and talk to someone.

US Embassy and Consulate Discussiongetting ready to start the process
QUOTE (ZeeNusah @ Dec 28 2007, 10:26 AM) <{POST_SNAPBACK}>
The guides pretty much spell out for you what you need to do.

Since you are filing for a spouse you can do either a K3 or CR1/IR1. The CR1/IR1 is the better visa because your husband will receive the green card and SSN in the mail a few weeeks after entry. For the K3 you will need to adjust status when he gets into the country which means more money.

I don't know what the difference in timelines is between the 2. You can do a timeline search for Morocco and it will give you a better idea of what you want to do.

Good luck!!

Well from what I've been told the k3 is faster,(and of course thats what I want) I just need to make sure all of the exact forms that need to be mailed with the petition for foriegn relative. I dont want a delay because I forgot a form.Thnx again for any help. unsure.gif

Silkafi88, first of all I dont have to do anything, he is still legally my husband. I did not ask for personal advise from you just what the laws are. So kindly keep your opinion to yourself.  Immigration said he had to abide by us passport rules im just double checking on that. Anything beyond that scope dont care to hear.

I flew Luthansa on the way home from morocco in sept. and it was a good flight, they had a little more leg room then British Airways, but they only had a tv screen at the front of the rows, so he might want something else to occupy his time, but tell him dont buy any magazines in Frankfurt airport (cost me 18.00 for 2 magzaines) The airport was good, alot of helpful ppl, when I went through it seemed there was some construction going on but they give you maps if you ask for directions, and I had to spend most of my layover time picking up my bags and transfering them for the second part of the flight. If he feels like he needs to ask directions I just went up to anyone that worked in the airport, even the ones that work at the coffee stands and asked if they spoke english and if they knew where something was. We have been desensitized to divorce in America. This does not apply to abusive relationships but growing apart and not feeling in love is no reason to divorce. Marriage takes work, if you have children that are less than perfect you wouldn't just say I'm tired of this and send them away would you? (sometimes teenagers make you feel this way but we still keep them) Sometimes one person is the problem and there is nothing you can do but try to teach your children better values so they make better choices when they marry. It will only get worse in the US I'm afraid.

Unless something's changed (and it certainly can!) Casa doesn't need Affidavit of Support. You will need that for Adjustment Of Status. Gosh, seems so long ago now, I'm trying to remember what financials we sent. Bank statements w/ letter from bank stating how long I'd had an account there, IRS transcripts....hmmm.... seems like that was it. OH! paystubs if you get them - I'm self employed so I didn't have those.
Don't sweat it too much... there's a list of what you'll need in his packet. Good luck!

good.gif

By the time we reveived the NVC letter in the mail, the file was already at Casa. I would e-mail the consulate directly with the NVC number , names of the petitioner and beneficiary, and birthdates. NVC can;t tell you if its at the consulate, just if it has left.

ok mybackpages do you think we should email the consulate and check it out ?

The consulate had our petition within a week from the letter from NVC (for a K-1 visa). I emailed Casa and asked about the appointment date. I emailed on a Friday morning and on the followign Tuesday they replied with the interview date and that the packet had been mailed to my husband (then fiance).

If they do not reply, wait a few days and email again. My experience is that they will not reply if they do not have an answer fo you.

The e-mail address I used was : IVCasablanca@state.gov

here is what I asked

I am inquiring about my I129F petition filed on behalf of my fiance {his full name] which was forward to Casablanca by the National Visa Center . the case information is as follows:

CSB#########

Beneficiary's name: {full name of the person wanting the visa]

Beneficiary's date of birth: ##/##/19##

I would like to know if an interview date been assigned? If so when?

Thank you for you time.

{signed my full name on the petition}

ALSO be sure to put the petition number and beneficiary's name in the subject heading. Notice that NVC fives you a different number than USCIS did. USE the new NVC number.

I cant get the email to work. help. my file left nvc the 11th of june.

This is just stressing me out. wacko.gif Any ideas what he can do? Im just scared to death about this interview after hearing all of the horror stories comming from morocoo consulate. unsure.gif

When did you express mail the package? It may yet make it.

FWIW, the CO didn't look at our chats at all. She looked at every photo. But I know every interview is different.

You could wire him the money to print off every chat if you feel that is crucial. Or you could pick representative chats from throughout your relationship and just print those.

Here's one thing you could do: Before his interview, make sure you've contacted your representative and you have an authorization on file with them so they can help you quickly if needed. (Do this no matter what.) Have the fax number of the consulate handy (it's around here somewhere if you don't have it). Have your stack of chats handy. Instruct your husband to scan and send you any paper he receives at the interview as soon as he leaves the consulate. If the paper says anything about returning your husband's case to USCIS, get on the phone with your representative so they can start working for you. Then, if you think it will help, fax all your chats to the consulate with a polite cover letter. It would probably be much cheaper to send him the money to print them in advance, but this is worst case. When they receive a fax, they are supposed to put it in your file. Even if he gets the "good" 221(g) -- if the paper says his case requires further administrative processing and they will call him -- it doesn't hurt to contact your representative to make an inquiry for you. Casa almost never grants a visa the same day as the interview.

Go ahead and get that done as quickly as you can, and then try to relax! You've done all you can do at this point. Your husband needs as much sleep as possible the night before and to eat breakfast that morning so he won't be groggy. Tell him to smile and be polite. When he is called, he should put his stack of proof up beside the window and not on the floor at his feet. Put your favorite picture of the two of you on top of the stack if possible (ours was on the outside cover of our little photo album) so the CO can't miss it. If the CO doesn't ask to see anything, he should offer it. He should not be shy about that. And when the interview is over, he should ask the result. He can say something like, "My wife is waiting for me to call her. What should I tell her?"

When you know the result, come here and let us know. There are folks here who have a lot of experience with Casa and can help you if you have to take any quick action -- of course we hope you won't! smile.gif

This is one of the most stressful periods of the whole process, so be extra good to each other, and good luck!

I sent him a copy of the reciept and hopefully he will get to the post office with the tracking number before they close cuz his interview is on monday unsure.gif I just had everything all seperated to each step of the process and all in order so he wouldnt have to worry about all of that stuff and be able to relax at the interview. QUOTE (Maggie724 @ Jul 21 2008, 01:11 AM) <{POST_SNAPBACK}>
I don't think there is one BIGGEST issue. Each case is judged on it's own merits and for that reason it's not a good idea to compare cases with each other. Even the age thing boggles my mind, in the sense that I have seen couples with barely any difference have issues, and personally know two couples from Morocco who have a 25 and 27 yr age gap, and aside from the time it took in AP, they had no issues.

Sometimes the consulate asks the most basic questions; other times they ask what appear to be rather bizarre questions. They asked my husband about my son who died as an infant! I don't even know how they knew about that unless when they asked him about my kids, he mentioned them ALL. They proceeded to ask at what age and by what means he died. Sheesh. What does that have to do with the tea in china? (in retrospect I guess him knowing all that detail showed the depth of our communication).

Reda: Yes Google patty Murray, select the link for immigration and there is a form you can print, sign and fax. Once you have an interview date, call and let mary know. other than that you are pretty much all set.
And something that caught my attention but maybe others or an immigration atty can answer you on it: You mentioned that your husband is trying to establish residence in Spain, while he is awaiting a visa interview in Morocco. Might that look like he is just trying to escape his country by whatever means possible? (thinking like the devil here for a moment) devil.gif

I can not find a link for immigration on the Patty Murray website. Ive emailed her before Said interview and have heard nothing from her. I cant find the form to sign.
