So frustrated with all this sh!t.
Probably doesnt help that I live in Texas where there is a large number of Mexicans trying to immigrate here.

To be honest I'm not really pissed about him not doing anything. I expected as much.

My case is still at the VSC waiting for approval. I'm really nervous about the next step though.
I thought getting everything ready for the I-130 was a lot of work. The more I read it seems like the NVC part of the process is the most complex..

For Christ is Risen.

I wish and hope all of our petitions get approved soon and we can get on with our lives. Not long ago someone on this board said our Spouses are our favorite persons in this world. How true…

The USCIS is a huge disappointment and in a sorry state of poor planning and utter chaos. They have no justification in continuing to chime in about how busy they are and how inundated they are with petitions. Yes we understood in the beginning that our timing was bad, however we should be seeing more and more approvals at this time. Especially those of us who submitted in August, September and October.

I may not be able to update my profile when my petition does get approved. But I will be try my best, so we can continue to benchmark the timing of our approvals.

This is ridiculous. I am kind of in the same boat as you. My wife is also pregnant. She isnt as far along as yours. She is only 21 weeks now. Still things would be a lot better if she was able to live here with me and we could have the baby in America.

Anyway, I went and spent two months with my wife recently. It was wonderful. I hope you have a great visit with your wife too.

Yes, They asked her how long she is staying and who she is visiting.
She was 100% honest about everything.
They said "why do you live in Japan and your husband here"
She said "because we are waiting on the Visa"

She said the lady just handed her passport back to her and said "enjoy your visit"

I hope my experience can help other people visit their loved ones.

I've never heard of that happening. The main thing I was worried about was how it would look if she got denied entry.
I think though as long as she can show on her passport that she left before her 90 days was up and didnt overstay I dont think there is anything to worry about.
Cause technically there isnt any law against people coming to visit while waiting for a visa. Its all up to the Immigration officer at the POE.
If he thinks she is a risk to immigrate illegally then he wont let her in.

But then again Ive heard this over and over again but Ive never read about an actual IO not letting someone in.
Im sure it happens but I just havent seen it happen.
Im not sure why lawyers and other people scare us like they do.

hey hey, just out of curiosity, how do you communicate with your wife? in English or Japanese? My wife doesn't speak much of English and my Japanese is below-average. I mean I can get my points across but we seldom can have a fluent conversation...she probably married me because of my hotness..j/k smile.gif



We use both. Her english isnt really good and my Japanese is just good enough to get by. So there are still alot of times where I have to repeat things or say something in a different way. Sometimes I sound like Yoda talking.
I need to keep learning more Japanese though! I can communicate great with my wife but with her friend or family I struuuuuuggggglllleeee.


That's awesome. I am probably at exactly the same situation as you are. Sometimes I feel a lack of sentence structure and often just use words or phrases. I am a member of the Yoda club too...I wonder if VSC would be susceptible to Jedi mind trick..

No, Japan is part of the VWP so a visitor visa is not needed.
HOWEVER, she could still get turned away at the POE tomorrow if they thought she was trying to immigrate early. I'm really worried because her belly is getting bigger and I dont know how they will look at that.

On April 4th I sent a fax to your office asking for your assistance with my wife’s pending visa application. In return I got a canned response a few days later. This letter is to let you know that I am VERY unhappy at the service I received from your office and also the fact that I am very sure you did not inquire into my case at all. I mailed my application last year in December and I even paid for tracking so I know the application arrived at the Chicago lockbox three days later. However, the USCIS states that my application wasn’t received until February 6th 2008. Everything I’ve read in your response to me is what I read everyday on USCIS’s website. I know this because I currently frequent immigration websites and forums. I have already heard over and over about how undermanned the USCIS is and the increase in applications. I have done my home work sir. I know you probably get a large number of requests for assistance since we live in Texas and there are probably a large number of Mexican citizens wanting to immigrate to America through Texas.

I need your help. I need to know what is happening with my case. I have signed up on USCIS’s website for updates. I can see when my application has been “touched”. I have read about other people who applied well after me getting approved before me. If the USCIS would process applications in the order they get them then at least it would give people such as my wife and my family a little better idea of when we might be able to be together again.

My wife is now 24 weeks pregnant. Because she lives in Japan and because we are following the rules and not trying to immigrate illegally, I cannot be there to help her. I need my wife here in America with me. I’m sincerely asking for your help and not another pre-typed letter with only your signature.

I apologize for rigorous tone of my letter but I hope you can sympathize with the urgency of this matter and understand my desperation.

I used tracking and saw that my application arrived three days later, 12-24.
I got my NOA1 on 2-13-08

So which is it? Am I a December filer or a freaking Febuary filer?
I think I've read somewhere that USCIS goes by NOA1 thats when they start the 180 days thing.
If that's the case I'm freaking PISSED AGAIN!!!!!!!!!!!!! I want to hit something.



Is there a date on your NOA1 that says something like "Received date" on the actual receipt? Like mine for example says Received date: January 11, 2008 and in the box below it, it says Notice Date: February 8, 2008. That is the date that my online case says, but on the NOA 1 it clearly states is was received in January. I think you are still a December filer, I would call to make sure.


I dont have my NOA1 with me here. Its at my apartment. Ill check tonight and let you know.

Ok, this is probably a stupid question but I dont think Ive ever gotten a clear answer on this or heard what other people are.

I mailed my wife's I-130 application on December 21st 2008.
I used tracking and saw that my application arrived three days later, 12-24.
I got my NOA1 on 2-13-08

I would like to thank everyone who pm'd me with ideas and suggestions, thanks! I have got in to a contact with one of the writters at NYT who handles immigration, my goal is to have this system improve, I dont want to cheat over anyone and jump ahead. After another few conversations with congressman's Office, they took my complain(s) and forwarded me to Zoe Lofgraen Office. There I spoke with a knowledgeable guy, we discussed all the problems that is going on. He said they are aware of the problems, and they have tried to change the system so there would be an easier immigration process, but the republicans always vote against it. He said in the long runs, most of republicans don't care if you wait 5 years or 20 years. He also said that there is only one side of the story with immigration. That there is too much illegal immigration and that there is no one to speak on behalf of immigration party. So it gets ignored, thats why its so simple to get here via work visa without any backlog. Thats why there are Priorities and I-130 isn't one of them. People have yet to speak out. Sub Committee cant do anything directly, but there is lot of information out there. 13-15 months of backlogs will never get cleared no matter how many workers they have to "hire" and "train". A normal approval process of I-130 should take about 90 at most, but due to faulty system and absolutely no chance of fixing it it'll only get worse. The guy was right about one thing, ask any kind of blue color American about immigration, what will he say? He'll prolly point out the illegal immigrants first, and thats all there is. Nobody knows about us, and nobody cares until we let them know. He suggested going through press. I might just do that. Pm me with any suggestion as I will contact NY Times on Monday.

I was very confused about this too.
You are right though, you should stick with the CR-1.
The K-3 is taking about the same time as the CR-1 and costs $1000.00 dollars more.
There is a lot of history about why the K-3 used to be the better option but a lot has changed.
In my opinion you should just stick with sending the I-130

Yes, you're baby will get US citizenship through you and the US embassy should be able to get the baby a US passport and apply for a social security number. I would call the embassy in Japan to find out what you need to bring with you, I'm assuming your US passport and the baby's birth certificate.

Also, Japan does not allow dual citizenship.

Japan doesnt allow dual citizenship? That's odd. My friend told me that her son was a dual citizen and had to choose before he was 21. But she is a lot older than me and a lot of things may have changed since she had her kid.
