K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List
Try not to stress over it too much yet. The RFE could be for one of the smallest of things, like forgetting to sign something or a gap in employment history on the G-325A. I know it's hard to wait but hopefully you'll receive the notice soon and it won't be as bad as you suspect. :)

K-1 Fiance(e) Visa Process & ProceduresWhy is medical examination so expensive in London??
So the exam is not very in-depth but if other health/wellness checks with private health companies like Bupa charge at least £200 for most basic one then that price seem reasonable. Especially that they do not have to worry about competition and lack of customers ;-)

Thank you!

Packet 3 that London will send to you upon recevieing paperwork from NVC will include this link:

The requirement for 125% of the poverty level applies to the USC. You can not (As far as I know) count your non-US income towards that goal.

They are a K1 Visa the thread is of no use. That thread is of no use to them. Nor an IIN.

OP that notice was to let you know finally your petition has been shipped off. Department of State DOS),  NVC is under so I would start calling NVC after about a week get your case# then you can start doing whatever they do for your embassy to get things  moving.

Oops. Didn't see their k1 staus on mobile. My bad :)

K-1 Fiance(e) Visa Process & ProceduresConfused about DOS/NVC

It takes up to 30 business days for the NVC to give you a case number, best to come to the NVC thread and read Saylin's wiki which has all the steps in place for you

http://www.visajourn...lers-july-2014/

You need to call the NVC to see if they have given you a case number and the invoice identification number.

Cheers.

K-1 Fiance(e) Visa Process & ProceduresUrgent: Might have sent a bad cheque with I-129F/K-1 Application. What can we do?

Hello all,

So there it is. We had it SO perfect.

We crossed all our i's, dotted all our t's, turned this K-1 Application into a bureaucrat's wet dream and sent it off to Texas.

Then, this morning an email from my fiance:

While doing his tax returns, he noticed that his back account number no longer matches the one on his cheques. His bank got taken over by another one, so maybe that had something to do with it. He's sorting it out on his end, but, long story short, the cheque we sent out with the application was most likely a bad one.

Now, question is: What do we do? Can we contact USCIS in some way? Do we have to wait for them to send it back to us?

The application only arrived in Texas a few days ago. Is there anything we can do so we don't have to wait forever to correct our mistake?

I'm honestly panicking.

In your guys' experience: What would be the best course of action?

Thanks a million!

K-1 Fiance(e) Visa Process & ProceduresReceived I-797, Notice of Action. What comes next?

Hey all,

I haven't posted in a while as we were waiting for an approval of our K-1 Visa Application.

Just a few days ago, it has finally arrived. That is, the I-797 Notice of Action has arrived in the mail at my fiance's (the petitioner's) place.

The receipt date is April 15th, 2014

The notice date is September 8th, 2014

I know that they now have to contact the NVC and they will take it from there and notify us.

As the beneficiary, I have a few questions at this stage:

1) Do I need to bring the original form I-797 to my interview at the Frankfurt Embassy?

2) Is there an average time on how long it usually takes until I have to do the interview? I'm in Germany, so not sure how that would affect things, if at all.

3) This would be the stage where I can bring letters from friends and family that have witnessed our relationship, right? I know this isn't necessary, but we have them, so I figured why not.

4) Is there such a thing as bringing too much proof to the interview? We have years of photos, emails, postcards, Skype conversations, etc. Also, from which time frame do they need proof? I have plenty of stuff ranging from 2007 until 2011 and beyond. Do they specifically need proof of relationship from the time span between the receipt date of the petition and now?

That's pretty much it for the moment.

I'm sorry if some of these are stupid questions. We just want to be sure that we have everything covered and no unpleasant surprises.

Thank you all in advance,

<3

K-1 Fiance(e) Visa Process & ProceduresDS-160 Questions (Germany)

Hey there, guys!

Just a few small questions. I would like to fill out the DS-160 now (it's been a little over a week since I've received notification to do so) and I have a few questions regarding it. One pertains to my location (Germany). Sorry, I hope these are not too stupid but I'd rather be safe than sorry.

So I've looked over the example form here on VJ to get an idea of what it will look like.

1) First of all, I was wondering if any fellow Germans could answer what to put under my National Identification Number as it has to be different from my passport number, right? I have a 'Personalausweis' with a 9-digit number in the top right corner and a 6-digit number towards the bottom right. Which one do they want?

2) Passport stuff: My passport is very new with a chip. What kind of passport type would it be? Also, what is a passport book number?

3) Person paying for your trip: What if I don't now yet?

4) Have you ever been in the US? Yes. But does 'date arrived' refer to the last date you've been in the US or the first date ever?

5) I will have to put 'unemployed' as my current occupation as I have been for just a few weeks. But will there be space for me to put previous occupations? I don't want them to get the wrong idea.

6) Countries visited within the past 5 years: Which order do I list them in? Latest one first?

7) Have you belonged to, contributed to, or worked for any social or charitable organization? I've donated to Greenpeace, Unicef and a couple of other charity organizations a few times and made small monthly contributions to a deaf children's organization when I lived in the UK. I cannot remember all of it and haven't kept the documents to prove it. Do they want any details? Is that really relevant?

8) Probably the most confusing question: Do you have documentation that you've received vaccinations in accordance with US law? I'm not sure if I have all of the vaccinations needed, yet. I thought that's what happens after I send this form in. I don't know which ones I still might need but the letter I received also tells me that I should NOT schedule a medical examination until instructed to do so by the Immigrant Visa Unit in Frankfurt. I don't want to get unnecessary vaccinations if I don't need them.

Other than that, everything is pretty much self-explanatory.

Thank you in advance for your answers! :)

K-1 Fiance(e) Visa Process & ProceduresDS-160 - About work history, education, and timing

Thank you, chiggins82! I really hope so too. I'm not even sure how work history is relevant in the first place when it comes to fiancee visas. At least for the beneficiary, but I'd love to hear some more opinions from a few Germans who have been through this.

So, to be clear, they will not be asking me for any further documents to prove previous jobs, such as signed job contracts, etc. ?

If I end up having to list previous jobs, can I list the ones that aren't physically documented too, or do they need to see additional papers to prove that I've worked somewhere?

K-1 Fiance(e) Visa Process & ProceduresDS-160 - About work history, education, and timing

Hello all,

So it's here already. Late last week, my letter arrived from the US Consulate in Frankfurt telling me to fill out my DS-160 online.

I have to admit the reason I haven't filled it out yet is because I'm a bit scared and intimidated. It's all happening so quickly, now.

I'm sure most of you felt the same way after waiting for months and months for something to happen.

I hope I haven't waited too long now. Does anyone here know how long one can or should wait with filling out that form after receiving the letter from the local consulate? The date on the letter is September 30th.

Now, my concern about the content of the online form. For those applying for a K-1 visa, how important is the whole work history part?

The reason I'm asking is this (and I apologize if this is a bit of a long story):

I was at the end of my first semester of my BA studies in London when, in December 2011/January 2012 I suffered from what I guess is known as a severe burnout syndrome. My body was suddenly unable to handle the stress and my immune system completely collapsed. I have for the most part recovered, since, but back then, I felt so sick both mentally and physically that I had to quit University. I still have my degree from the US college I went to earlier, but I guess I'd just have to list what I did at the University in England as random University courses, if at all?

My bigger concern, however, is my problematic, difficult-to-list work history: When I last lived in the US, I was a full-time F-1 visa student, therefore constantly busy and there were barely any jobs available to me that I could have legally accepted. For my optional work year, I had a relatively high post in my college's film department, but it was more like intern work as they were unable to actually pay me. When I moved to the UK, I did a few translations for a London-based online company while studying. But I was only paid per project and the projects were so few and far in between, that they were still below tax level. I then did the same work for a large US company using the online outsourcing portal Elance, which to the best of my knowledge is perfectly legal, but the work itself was also so few and far in between that I didn't have to list it on any tax forms.

I never received any hiring or firing papers from any of the two companies, so I have no proof for having worked there. I only have a former co-worker in London who can vouch for me. In 2013, I officially moved back to Germany to be with my family and try to get my health back. For over a year, I only did freelance English tutoring work, which also didn't give me enough money to declare taxes. It was more on the income level of weekly babysitting.

This past Summer was the first time I've had a consistent, paying job since 2006. I did newspaper delivery, which was still below minimum wage.
Then, a few months ago, I was offered my first paying above-minimum-wage, tax-and-health-insurance mandatory job when I worked as a receptionist at a local hotel and even ran the place for two weeks while my boss was on vacation. After he returned, I wanted to quit as I had been subjected to sexual harassment, but was fired within the same conversation.

I am currently in the middle of filing for unemployment but I have no idea if this is useful or even relevant given the fact that I plan on emigrating so soon.

Does anyone here know if any of the above information can be held against me and maybe give me some advice about how to fill out this form?

Thanks a million in advance!

K-1 Fiance(e) Visa Process & ProceduresUrgent: DS-160 and misplaced social security card/number

It has changed, actually. Just this year. I looked up the info.

From the FAQ's:

5.  I have lost or misplaced my (or my child?s) Social Security Number.   I am (or my child is) NOT a U.S. citizen or legal Permanent Resident Alien.   How can I find out my Social Security number?

Effective August 1, 2014 the Social Security Administration stopped providing Social Security Number printouts or verifications.   The Federal Benefits Unit is unable to provide you with a printout or verification of an SSN.

If you are not a U.S. citizen or legal Permanent Resident Alien (?Green Card? holder) and you need to verify the details shown on your Social Security Number record, you must apply directly to the Social Security Administration for a printout of your Social Security Number record (known as a Numident).    These applications can take up to 60 days or more to process and are processed on a first come basis regardless of the mailing method used.

This means that applying for a verification of my SSN would cause a major delay in the process right now if I were to wait for it before I go ahead with submitting any other forms.

I had an F-1 visa and it was on a different passport, which expired years ago. My current passport was issued to me just three months ago.

Thank you for your help! But do you think I can just check "does not apply" on my DS-160 form now and in the meantime ask for a replacement card or verification of my details? I don't want to delay the process any further but I also don't want to get in trouble for making wrong statements on the online form.

K-1 Fiance(e) Visa Process & ProceduresUrgent: DS-160 and misplaced social security card/number

Hey everyone,

Yeah, I still haven't filled out my DS-160. The last thing holding me back is an issue that I've never really gotten resolved and I'm confused as to how I should handle it or whether I should handle it at all.

I first came to the US in late 2006 on an F-1 student visa. After my studies, I applied for a SSN and card. I received my card in the mail, but never really had to use it or the SSN number. Before I moved back to Germany, I must have misplaced my card. I don't know where it is to this day and I've never had to retrieve it or look for it until now. I believe ages ago, someone on this forum told me that it wasn't a big deal and that I should just put DOES NOT APPLY into form DS-160, but I'm worried. I mean, they can certainly see that I have a SSN. It must be somewhere in their system. I just cannot remember it and never wrote it down. I know this was a mistake, but it's honestly been so long, now. I have waited over two weeks to fill out my form DS-160 and I should really get to it. I would just like to get a few more opinions on what I can or should do now.

Thank you SO much in advance!

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

The itinerary definitely won't be enough. Anyone can produce an itinerary without having done any travel at all. Boarding passes are very good proof given they are difficult to fake and actually proves that you traveled.

Primary evidence:
Exit/entry visa stamps, airline ticket boarding passes, hotel receipts, ATM withdrawals in the subject country/city, apartment leases in both names, utility bills, etc. (for those that have lived together) are irrefutable as primary evidence.

Secondary evidence:
Photos, bus tickets, engagement ring receipts, affidavits from family/friends may be used to supplement weak primary evidence if the primary evidence can not stand alone on its own merits.

This is very good evidence but remember that if you traveled to someplace other than where your fiance(e) lives, say someplace in between e.g. a different city, a third country whereby it is clear you were there but it's not clear that your S.O. was also there at the same time, then all the passport entry /exit stamps and airline boarding passes in the world won't make your case.

I'm not sure if this situation applies to you but if it does be sure to prove somehow that both of you were there, wherever "there" might have been, at the same time.

It is probably best to explain your evidence piece by piece on a separate piece of paper, particularly if your travels were difficult to understand.

P.S. The affidavits from family/friends can't hurt as well as an explanation from you that you stayed with him/her and did not use hotels, etc.

Quick question.  I received an RFE to send a letter of intent to marry my Fiance and it states that "I may also submit copies of any evidence you have establish your mutual intent to marry one another.  I send the letter of intent however I did not have any other proof".   My letter did not mention anything about primary or seconday evidence.

In reading your answer "The itinerary definitely won't be enough. Anyone can produce an itinerary without having done any travel at all. Boarding passes are very good proof given they are difficult to fake and actually proves that you traveled."  I did not keep my boarding pass because I did not know we was going to fall in love and had no idea about the K1 visa process.  I send in my purchased itinerary because I had them in my email with copy of my stamped passport.  My fiance lives with his cousin, they do not have a lease there with his name.  Therefore, hotel was not necessary.  Is that going to be problem in our process.

K-1 Fiance(e) Visa Process & ProceduresMissed vaccinations before I fly to the US on k1 visa, will this be a problem??
Have them done in UK then call civil surgeons in the area (and dont stop) and get one that will transcribe those for you without trying to rip you off or convince you that a full medical is needed for aos.
I just didn't believe it's such a pain so instead of having td and mmr done at knightsbridge I waited till I arrived in US.
About 20 phone calls and a lot of nerves later I found one that got convinced that I do not need full medical and had MMR and TD and pages 1 plus 5 of I-693 done for $175 which was ok considering that Walgreens charges $100 for MMR and $55 for TD.

You can find some here http://www.visajourn...you-off/page-23

And read more about I-693 and civil surgeon problems here http://www.visajourn...93-and-ds-3025/

Good luck :-)

K-1 Fiance(e) Visa Process & ProceduresBasic Questions

Hello all. New here... Please go easy on me, as I'm very new to all of this! biggrin.png

I just have a some general (perhaps vague) questions regarding the K-1 Visa process. I looked through the FAQ, but couldn't find the direct answers, but maybe I'm blind..

Anyways!

1. My fiancee is Lithuanian, and she moved to the UK in 2011. Does she have to return to Lithuania to do all the embassy stuff, or can that be done in London, where she lives? (Again, sorry for being so vague.)

2. Do I have to visit her home country (Lithuania) before we can start the K-1 process? She has come to the United States twice now to visit me.

Thank you, guys! smile.png

No and no, she lives in Uk now and as part of EU she's legally there regardless of what shes doing there so she can apply through London and you don't have to visit Lithuania.

Hi. I can only say that tourist visa denials should not affect the petition. I have been denied tourist visa 2 months before applying for fiancee visa for that sam reason. K-1 Fiance(e) Visa Process & ProceduresFingerprints needed for getting Police Reports?

Do any of you know if you need to send fingerprints in when asking for a police report from another country? My fiancee is a Japanese Citizen and I am a US citizen. She needs a Police Report from Australia. I have not seen anywhere where the US Embassy ask for fingerprints for a K-1 Visa, but it was mentioned on the Australia Police Website that it may be required in some cases. She is definitely not a criminal. Any experience with this? Any help or advice would be appreciated. Thanks.

If applying for US visa in Australia police check needs to include fingerprints as per http://canberra.usem...ov/iv_faqs.html thus the info on police website. Check with your local Us embassy what they ask for but I have found on US embassy in Tokyo this info: " If you need to obtain a police certificate from a foreign country and fingerprints are required by the police authority of that country, the Visa Branch of the U.S. Embassy may take fingerprints without a fee. Fingerprint service is available at the Visa Branch of U.S. Embassy Tokyo on Fridays (excluding U.S. and Japanese holidays) from 14:00-15:30. Appointments are not required." http://japan.usembas...a-ivpolice.html - just in case if you need it!

Your lawyer can ask you for whatever documents he or she wants and it's up to you to trust or fire them, or just challenge them. Most on this forum will not recommend using lawyers to get K1 visa as the process is quite simple if you follow the guide above and read the forum. Unless your case is very unusual or had problems with law or us immigration.

When filling petition i have sent exactly whats on the list in the guide mentioned above.
