VISA INSTRUCTIONS FOR FIANCE (E) NONIMMIGRANT VISA APPLICANTS
 
 
 
Our office has received a petition entitling you to a K-1 nonimmigrant visa classification as an alien proceeding to the United States to marry an American citizen.  In order to be prepared for your visa appointment with a Consular Officer, please read the following instructions carefully:
 
All K-1 non-immigrant visa applicants must complete the application form DS-160.  You may access and fill out the DS-160 form at this link: https://ceac.state.gov/genniv/
 
Important Note: The DS-160 will require time and accuracy to complete, and must be completed in English.
Before using the DS-160, please note the following:
·   You must provide accurate and complete information in English, to answer the questions (a translation into Greek will be available at a later date). You will be given an opportunity to review the information before submitting the form.
·   As you complete the visa application, save a copy on your hard drive, CD or USB and ?save? often.
·   You should review the Department of State photo specifications before uploading the photograph. If your photo does not comply, it will not be accepted. Whether a photo is successfully uploaded or not, applicants are required to bring a photo to the interview.
After completing the DS-160 online application, be sure to print the confirmation page (pdf 267kb) generated by the online system and bring that page to the visa interview.   We suggest that you save the confirmation page and email it to your email address in case you need to access it away from your house.
 
1)    All the questions must be answered properly; if they don?t apply to you please put N/A for ?not applicable?. Our office cannot process your case unless the above mentioned form is properly and completely filled out.
 
2)    If you have underage & unmarried children who apply   with you, you will have to fill out the same forms for each child.
 
 
3)    As soon as you have obtained all the documents that apply to your case, carefully read the statement at the last page, sign and date it, and return the form to this office.  Keep the documents you have obtained until your appointment.
 
NOTE:  Only one copy of each document, except photographs, is required.  However, you are advised to obtain and keep a duplicate copy of each document for your records.
    
1. PASSPORT:  A passport must be valid for travel to the United States and must have at least eight months validity beyond the expiration date of the visa.
 
2. BIRTH CERTIFICATE:   One birth certificate for each person named in the application is required.  Birth records must be presented for all unmarried children under age 21, even if they do not wish to join you at this time.  On the birth certificate the exact place & date of birth as well as both parents? full names must be mentioned.
 
3. UNOBTAINABLE BIRTH CERTIFICATE:  In rare cases, it may be impossible to obtain a birth certificate because records have been destroyed or the government will not issue one.  In such cases, you should obtain a statement to that effect from the civil registrar's office and proceed to obtain secondary evidence of birth.  A baptismal certificate may be submitted for consideration provided it contains the date and place of the applicant?s birth and information concerning parentage, provided the baptism took place shortly after birth.  Should a baptismal certificate be unobtainable, a close relative, preferably the applicant?s mother, should prepare a notarized statement giving the place and date of the applicant?s birth, the names of both parents, and the maiden name of the mother.  The statement must be executed before an official authorized to administer oaths or affirmations.  In such cases, please bring any secondary evidence you might have concerning your birth. 
 
4.  POLICE CERTIFICATES FOR COUNTRIES EXCEPT GREECE:  Each visa applicant aged 16 years or over is required to submit a police certificate from the police authorities of each locality of the country of the applicant?s nationality or current residence where the applicant has resided for at least six months since attaining the age of sixteen.  Police certificates are also required from all other countries where the applicant has resided for at least one year.  A police certificate must also be obtained from the police authorities of any place where the applicant has been arrested for any reason, regardless of how long he or she lived there.  Police certificates must cover the entire period of the applicant?s residence in any area. A certificate issued by the police authorities where you now reside must be of recent date when presented to the consular officer.  The term ?police certificate? as used in this
paragraph means a certification by appropriate police authorities stating what their records show concerning each applicant, including all arrests, the reasons for the arrests, and the disposition of each case of which there is a record.  Police certificates from certain countries are considered unobtainable.  The Consular Officer will advise you about any
particular country.  If specific questions arise regarding police certificates, please consult this office.
  For residence in Greece, A PENAL RECORD FOR JUDICIAL USE is requested
 
PENAL RECORD:   A penal record for judicial purpose can be obtained by presenting Form DS-2002 at the Public Prosecutor?s office in the district of the applicant?s birth, or from the Bureau of Penal Records ? Ministry of Justice, for persons born in Athens/Piraeus district.  For persons born outside Greece, this certificate is obtainable from the ?Penal Service for foreigners? (Mesogion 96, Athens, Greece).  If applying from outside of Greece, both Greek and foreign nationals must apply to the Greek Embassies at their place of residence and include in their written application full details of their identity & residence in Greece.  Penal Records will be sent directly to the Greek Embassies from where the request was filed.
NOTE: Penal records for JUDICIAL USE will be sent directly to the U.S. Embassy in Athens-they will not be sent or given to the applicant.  Please do not obtain penal record for General Use as it is NOT acceptable by the U.S. Embassy.
 
For applicants who previously resided in Albania (now residents in Greece), police certificate from the following authority, is requested:

5.  COURT AND PRISON RECORDS:   Persons who have been convicted of a crime must obtain a certified copy of each court record and of any prison record, regardless of the fact that they may have benefited subsequently from an amnesty, pardon, or other act of clemency.
 
6. MILITARY RECORD:   A certified copy of any military record, if applicable and obtainable, is required.  Persons who have served in the Greek Armed Forces must obtain the Type ?A? military record.  Persons who have served in the Police Force should present the standard official discharge certificates.
 
7. PHOTOGRAPHS:  Two full face photograph ? a close up of the face ? must be submitted with the application.  The dimensions of the photograph should be 50mm x 50mm.   Photographs must be taken against white or off-white backgrounds.  Photos that do not meet these standards will not be accepted.
 
8. MARRIAGE CERTIFICATE:  If you were married previously, obtain one certified copy of your marriage certificate(s) from the place where the marriage took place.
 
Proof of the termination of any previous marriage must also be submitted (e.g. death certificate of spouse; final decree of
divorce or annulment).
 
9. EVIDENCE OF RELATIONSHIP:  You may be asked to submit proof of a valid fiancé/fiancée relationship with your petitioner.  It is, therefore, useful to bring with you letters, photographs, or other evidence of your engagement.
 
10. EVIDENCE OF SUPPORT:  Any evidence which shows, that you, and members of your family who will accompany you are not likely to become public charge while in the United States. The Form I-134 lists evidence which may be presented to meet this requirement of the law.
 
11. MEDICAL EXAMINATION:   You are requested to contact one of the Embassy?s physicians when you receive the instructions from our office for your medical examination.
 
12. TRANSLATIONS:  Greek documents or documents in English DO NOT need translations.  All documents not in Greek or English must be accompanied by official English translations.  Translations must be done only by the Ministry for Foreign Affairs, Arionos 10, Psiri, 105 54 Athens, tel. no.

To get the penal records for judicial use?? No, it doesn't cost a dime. Maybe you have to put an "ensimo" on the application or something, but that would be less than 5 Euros max.

My lawyer went to Evelpidon and requested them, because I was in the US back then.

As for the liksiarchiki praxi gennisis, I think you can get it from KEP, but I had to go to the municipality's office (Athens in my case), because there was a mistake in my name, which I had to have corrected

Police certificate (piniko mitroo) is completely separate to court records. Court records are required if your husband has had any run ins with the law arrests, convictions etc. You need to provide court records for those.

A police certificate is ordered through the Department of Justice, and it is sent through to the US embassy in Athens, and that is after the US embassy has received your case file from NVC. This means you will not be able to include it in your IV package when you send it to NVC.

Just make a note your IV cover letter that, greek police certificate cannot be included as it is forwarded straight through to the US embassy.

 

 

I second that!
You don't need court records if the Greek person did not have any law problems in the past.

 

The penal records have to be for judicial use and the police send them directly to the Embassy within max. a week after you apply for them. It is a record that the Embassy will ask for, when they receive your file from NVC.

Another thing that I found out on my inteview date (30th of January): when they ask for birth certificate, they actually mean the "lixiarchiki praxi gennisis" (birth registry). Luckily, I had both available.

I called the NVC on October 21, and they gave me the number over the phone. Our case had already been mailed to the embassy by then. It arrived at the embassy on October 24. I was on hold for about 45 minutes before I was able to speak to someone, but it was much faster than waiting for an email response. I sent an email on October 18, and received a reply over a week later.

Also, they gave my fiance her chest xrays back and told her she will have to present them to immigration officials when she lands in the States?!? This seems strange and as far as I know x-rays can't go through the x-ray machine at the airport, so how should we carry them?

The Greek embassy wants the marriage certificate even though she is divorced. You must provide what your embassy asks for, they may require different information than other embassies. The instructions specifically said:

 

If you were married previously, obtain one certified copy of your marriage certificate(s) from the place where the marriage took place.

 

 

 

 

 

what you have is a copy.
not a certified copy.

you might have a copy of a certified copy, but that's not what the IV Unit needs to see.

They need the certified copy issued from the issuing authority. Scanned/emailed/printed out? You just broke the evidence chain and 'that thing' is easily reproducible and as such, not what they asked for.




 

Yeah what she has is just a copy, not even a copy of a certified one. Certified copy is now on the way.

The embassy's letter is quite clear on this one. It specifically says: If you were married previously, obtain one certified copy of your marriage certificate(s) from the place where the marriage took place. Proof of the termination of any previous marriage must also be submitted (e.g. death certificate of spouse; final decree of divorce or annulment).

 

And these are the instructions for the fiance visa and not for the already married couples. I guess it is a Greek thing. There must be a reason why they also need the marriage certificate for the Greek citizens...

 

Anyway, I had (luckily) kept them :)

I'm curious about that too. She has a copy with the I-129F package, but I'm going to send off a certified copy to be on the safe side. The Greek embassy is also requesting the marriage certificate too. She emailed them to see if they need mine as well.
