Sorry, it gets very confusing when you get mixed and conflicting information from all over...

PhilippinesI-29F approved, MNL# received, what's next?

Thank you for all the info everyone. I did have another question however. I am sending a copy of the packet I sent to the USCIS as well as all the NOA letters I received prior to the approval. It was my understanding that the U.S. Embassy would forward my packet to my fiancee, but information elsewhere says to just forward a copy of my packet to my fiancee instead. Now, are the ORIGINAL signed copies required for the interview? What I am sending my fiancee is the copy of the original I sent to USCIS. Will that be acceptable?

PhilippinesI-29F approved, MNL# received, what's next?

I guess for anyone that needs to know...

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 2. Send copies of the documentary proof that you submitted with the I-129F for your fiance(e) to have on hand for their interview at the embassy. Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate:

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern
(D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well) 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

PhilippinesI-29F approved, MNL# received, what's next?

Hello,

I am getting mixed information on the steps after the MNL# is received from NVC. My fiancee called the US Embassy, and they stated that she can schedule an interview as soon as her medical is cleared. I was under the impression that she had to wait for a packet to be received from the US Embassy. Other forums I've seen on Facebook state that it is unneccessary to wait for the packet as it could prolong the process.

What is the exact process? Can she bring in copies of the documents required? And what exact documents are needed?

Dennis

K-1 Fiance(e) Visa Process & ProceduresRefile or Appeal?

As soon as I received the letter, I went ahead and booked another trip to see my fiancee in the Philippines. I just can't wait another 6 - potentially year long wait just to see her again.

Thanks a lot everyone. I really appreciate all of your help and insight! :) I'll be honest, I didn't know about this website before I submitted my application, and since I've signed up I have had a better understanding on what things to submit. The instructions, guides, and community are really helpful.

K-1 Fiance(e) Visa Process & ProceduresRefile or Appeal?

So refiling it is. Thanks guys.

As far as the missing documents issue goes, this is what the denial letter stated:

"The petitioner failed to submit the intent to marry statement by the beneficiary, therefore, the submitted evidence is sufficient in establishing the petitioner and fiance(e)'s intent to marry within 90 days of the fiance(e)'s admission to the United States.

Based upon the record, the petitioner has not established the petitioner and fiance(e)'s intent to marry under section 214(d) and the Act. As such, the petitioner has not established eligibility for the benefit sought within the meaning of section 101 (a) (15) (K) of the Act. Therefore, the petition is denied."

K-1 Fiance(e) Visa Process & ProceduresRefile or Appeal?

Hello,

My I-29F came back to me denied because I forgot to submit one form. I didn't realize that I needed an intent to marry letter from the beneficiary as well. I feel really stupid that I overlooked that part. The letter says that I can  appeal for $630 dollars and submit that information within 30 days of the letter notice. My question and concern is time and money. I've read a couple of forums on this site recommending that refiling is better because its cheaper and that there is a timeline. Is it true that when you submit an appeal that it can take up to another year just for that?

And if I do refile, how do I make mention that I refiled prior? Am I suppose to send them the denial letter? Do I still use the same alien number given to me the first time I filed? Any suggestions or answers would help. Thank you.

K-1 Fiance(e) Visa Process & ProceduresLetters of consent

Hi DRafael,

I do not think any of those require notarizations but do not hesitate to contact the USCIS California Service Center to get the official information.  I believe what you mean is letter of Intent for K1 visa.  This is a letter with original signature for both you  and separate letter from your fiancée stating you Intend to marry within 90 days of her arrival in  USA.

My fiancée is 21 years old and though not required, I had her parents each prepare letters which were then translated into English and submitted along with the I -129f petition.  So if your fiancée is young then I would recommend the letters just to cover all the bases.

My fiancée just passed her US Embassy Interview yesterday and she will be here in California, just up the road from you in Suisun City in early September and we are very happy.

Best of luck, and yes VIsajourney website has many resources to help you at all steps but do not hesitate to contact USCIS directly or before your medical and interview call the US Embassy in Manila and check their website they are extremely helpful

Thank you! I actually first petitioned last year of October but it got denied because I was missing a document. I decided to visit my fiancee again next month because not be able to see her for another year is too long. I'm hoping the next time I refile will hit the mark. I filed the first time not knowing about this website at all so my packet was missing all sorts of stuff.

Best of luck to you my friend! And congrats! :)

K-1 Fiance(e) Visa Process & ProceduresLetters of consent

Does anyone know if the letters of consent to marry within 90 days need to be notarized? Also does the letter of consent from the parents of the beneficiary need to be notarized as well? I can't remember exactly where I read it, but is it true that if the beneficiary is under 25, that a letter of consent from the parents need to be included into the I-29F packet?
