Oh My!
Thank you We Destiny for your post, because I forgot to send the info to you "One Love" and I apologize. I will send them in a pm right now. Please forgive my oversight. I am still praying for you. I am wondering if you know that you are still able to file income taxes each year, and report the foster care income, even though it is not taxable income. I have an accountant do mine each year.

Of course you and I both have actual part time jobs with taxable income as well, but I have had to cover myself regarding my tax-free income (Which is my legitimate business), because of all the areas of life I encounter that require tangible proof of income. If I only reported my part time income, I would not be able to purchase many higher priced items that require financing. So, if you are not currently filing your foster payment income, you may want to think about that.

I will send the web site url now.....Really smile.gif

i talk yo IRS about that they said stupid to put foster care on taxes when its not taxed to pay tax on non taxes

I received 2 RFE during my AOS. I received an RFE for Birth certificate twice, the first time I included documetation on the Biafra war and the chaotic turmoil of Nigeria's infrastructure at the time, the age declaration that K used to get his visa, his passport, drivers license and id card from Nigeria, also, I sent a 2 page cover letter explaining the documents. They then sent me a second RFE for afidavit of support and birth certificate. I sent an updated copy of the affidavit of support with K and my 2007 tax return (he had only worked 2 months), but only my income was used for the affidavit which was well over the limit. I also sent a cover letter stating that I have already sent the information regarding the birth certiicate.

No offense but your lawyer is lazy. He or she should know that alot of things can be expalined away. As Stevi has offered to give you the documents, I would have my lawyer respond giving a detailed explanation of your particular situation and include backup documentation. We need to remember that the people looking over our files are human, and they look for key items sometimes things get misplaced or they just don't see them or need clarification. In my opinion there has to be something they don't understand regarding your income, if you had proof that you made over $40,000 why would you need a co-sponsor?
I would show them Stevi's documents and if they give you another RFE than look into an alternative option. Whts steves documents??

AOS waiting is much easier your SO is here with you biggrin.gif

What ever route you decide to take Good Luck with your approval.

What about bank statements showing regular deposits and a notarized bank letter summarizing all deposits made in the last year ?

Do you have equity in a home ?

Did all that had 45,000 but stated that my income tax did not show enought but I had over 27,000 nonw taxed as well to show.. But my lawyer said things changed you ahve to show enough taxable to support evedence but i think his wrong.. as long as you show all income taxed aree not taxed total should be good..

Dear One Love, I am in a similar situation, but have been advised ahead of time on it. I own 3 adult care homes, which you could say is "Adult Foster Care" because the residents live in the homes. I work part time in psych for a hospital. My income is substantial, yet from the immigration standpoint, there is not enough showing on my income taxes as my gross/net income for the past few years.

Included in my documentation for both the I-129F that I sent initially, and included in my fiance's interview folder, lies a two-inch thick stack of papers. Printed on them is Title 26 of the Interenal Revenue Code, Subtitle A: Income Tax; Chapter 1: Normal taxes and surtaxes; Subchapter B: Computation of Taxable Income; Part III: Items Specifically Excluded From Gross Income; Section 131 Certain Foster Care Payments.

It goes on to explain how this income is non-taxable income, but income nonetheless....

Although I will still use a co-sponsor, I wanted to have corroboratory evidence to substantiate my case (just in case). I also included copies of every rent receipt from each resident, and copies of their checks and money orders that I made before cashing them. This process has made me become a micro-manager in many respects. Bordering on paranoia sad.gif can u paste and copy for me.. so are you getting a sponcer?? Well its not right its income i used it years ago same thing no problem but now why

Take a look at Title 26 of the Internal Revenue Code. Although this does not change the dilemma that you are currently in, it wont hurt to have a copy of it handy.

If you fill in your timeline we could know more about what is going on. If you just want to visit anytime is fine. If you are thinking about him returning with you , then wait to see when your interview is Nigeria is really slow about interviews. Tickets are medium cheap between late September and early November then the prices rise through the holidays. They get cheaper from late Jan until easter when the spike and then go down until summer when they return to being expensive.
Your profile says K1 visa. Have you filed yet ?

wow thats not enough time in NIgeria it takes almost two of your days travel time... I would suggest taken one week with out pay to visit.. Or you marry when u get there?? if so he can be here in 1 year if yu do K3.. get all his info thou like birth certicate with parents name on it.. any info will help you once you back in usa.. Hi Missy,

They never said that to my husband about the 221g paper. They just told him that he would be called back in due time.

He has never received a call from the embassy nor an email about coming back. The only way we knew he had an interview was me calling DOS and being told.

I have called DOS three different times, talking to three different people each time, and they all said that they see that a packet was sent out via DHL on Oct. 30, but to date still has never received it. For your husband to go to the inquiry line is probably going to be a waste of time if they treat him like they did my husband. He came with the 221g paper with the case number on it, and they said the paper was old. Come back on the day your wife told you.

I did, in fact, send another email to the embassy yesterday. When I sent it to lagoscons2@state.gov, I found from their auto response that they are now changing emails and the new one for nonimmigrant visas is LagosNIV@state.gov, and that all correspondence should be sent to that address, so I sent an email to both places. Maybe that was why my others have not been answered, who knows. I sent a short, but sweet email because I know they don't want to see long drawn out questions. God, I hope they answer this time. Oh, also, DOS told me to write a letter explaining the situation and fax it to the embassy, and then call DOS back to verify the fax was received because DOS can see from there whether it was or not, so I will be doing that Sunday night before I go to bed so they will have it early in the morning on Monday.

Thanks so much for all your help and support Missy. I really appreciate it.

QUOTE (MrsJibowu @ Nov 22 2008, 07:57 AM) <{POST_SNAPBACK}>
Hello Kelley,
I know we discussed this privately, but I remember my husband telling me that the interviewer on 7/7/08 said to keep the 221g letter to come back when they call him to come back. Does seem way too simple, but that was my impression.

He received his phone call from the embassy. She did not tell him to bring anything or that they sent him anything just to show up at the same time told your hubby to show .

Is the DOS positive that the Embassy sent your husband a package? Or is she assuming because that is what other embassies might do?
When my husband stated he was going to the embassy I really did not feel he needed to, but extra information didn't hurt.

Just relax we still have plenty of time to figure this out. Did you send an email to the embassy asking them about the appointment.

I did when my husband did not receive his packet 4 or when I heard that the NVC was finished with our case. The took just 24 hours to respond to general inquiries.

Keep the letter real simple to a couple of lines then the will read it. Just state that your husband has a 2nd interview but has not received a letter stating this information what should he do.

i sent email to lagos embassy ask for a copy of letter t get him in for his interview tey went i copied it sent it to husbands email he copied nad got in with it

What experiences have you had sending large packages to Nigeria thru regular USPS? I know its a risk...since they have a reputation of going thru and even stealing stuff. Sometimes the package never gets to the person at all. I am just curious to hear any feedback from anyone who has recently sent something. My hubby says it depends on where its going and how its packed. He said if you wrap all the items with tape several times...it makes it harder for people to go thru it. Plus if u have it delivered to a business address...it stands a better chance. We have a package we're sending for Xmas...and its approx. $700 FEDEX or $200 USPS! ohmy.gif My hubby is disgusted with the cost of shipping!!! LOL He's like."we should have just sent the money..it cost twice as much more to ship it than the cost of whats inside..na wah oo!" wacko.gif hahahaha.. I'm like "welcome to America baby" good.gif

Anyway...just wondering if anyone has recent experiences to share. I always used FEDEX...except twice I sent him a card...and one got there a month later...the other never go there! no0pb.gif

As meticulous as I am, I am sure I am missing someone or something is wrong. All the info I got was what I got off the VJ timelines. If something is wrong please PM me and I will make the changes.

It will be a big red flag and you can expect extra questions at the interview but it isn't an automatic denial

Thye will question you about it and ask him as well.. it will be looked at but you also have the right to change your mind

Africa: Sub-SaharanIs a one-way plane ticket required? Expensive!

Nope. You can buy a round trip ticket and just never use the second ticket. That's what my fiance did to come here on his k1 visa. Much cheaper way to go.

Anyone buying rt and does not use going back you can call airlines and they will credit you like 200.00 worth it better than nothing are all lost

Hello,
If you can i would go with delta because they have a direct flight to the US......With other stops you have to pay for other travel visas just for passing through and at any time that your so goes through a check point with imigration they can send him back to nigeria with out him ever getting here to the states...

Africa: Sub-SaharanIs a one-way plane ticket required? Expensive!

Hi Everyone,

I was wondering if anyone knows if your spouse is required to buy a one-way ticket with their new visa to come to the U.S. for the first time. We have not been given our visa but like from where I live it's about $4000 for a one way ticket, that's double the cost of a round trip.

Do you know if there is anything in the "rules" that says you have to buy a one way ticket for a spouse?

Thanks.

wow i check its like 1600.00 rt to usa april a good month to fly from there

I think you'll get more of a response from the Middle East/North Africa section of this board since all of the embassies tend to handle things a little differently.

K-3 Spouse Visa Process & ProceduresRecipt Numbers for I-129F
QUOTE (kelly1290 @ Jan 28 2008, 10:17 PM) <{POST_SNAPBACK}>
I had a question. When you have your I-129F (K3 Visa) petition approved, is the WAC number that was assigned when you first filed change to a number starting with MSC? My petition has been approved since Jan. 9 and my petition has yet to make it to NVC or if it has, the info has not been uploaded into their system. VJ'r Chimeneze was approved on Jan. 15 and his petition made it to NVC on Jan. 23. He states that on his NOA-2 as well as the USCIS website that his K3 was assigned a MSC number and that was what he used to call the NVC to find out if his petition was there yet. The USCIS website as well as my NOA-2 both have the same WAC# that was assigned when I first filed. I thought perhaps that was maybe why they are not able to locate our petition, but when I called the NVC, he told me they have nothing to do with how USCIS assigns numbers. It is too late to call USCIS right now, but I want to hear from those of you that have had their petitions approved and whether your K3 petition was assigned an MSC# and if it is worth calling and inquiring about that using the "RFE trick".

Thanks for your help,

Deb
