Our RFE hard copy finally arrived to the lawyer's office today. They need original signed statements of our intent to marry within 90 days of my fiance arriving in the US. It's something we can easily provide but I could KICK myself for not having sent it originally. Our lawyers told me (the petitioner) to write a letter establishing our relationship...not our intent to marry. You'll see it here 1,000 times...use this site and save yourself the $$ of hiring a lawyer. I wish I had found these guides first.

Frustrations aside, we'll provide the letters as soon as we can and I'm also going to have my father provide one as well. Let's hope that's all they need and the approval will come within the next month. My fiance and I haven't seen each other since July...the time is starting to drag!

Good luck to everyone still waiting on some sign of life from the service centers...

Aren't lawyers bascially waste of money in visa procedures? It's probably a glitch. Don't worry too much and wait for the hard copy.


Yep, we hired the lawyer before I found this site. The funny thing is we basically hired him to AVOID an RFE. It's frustrating that USCIS can't even tell us if they are different requests.

So, the mystery continues. I just got another text/email that my case status has changed. It says RFE again. I called USCIS and they refuse to tell me if it is a duplicate notification or if I actually have two separate RFEs to deal with at the same time. Has anyone experienced this?

I'm at my wit's end here.

It may be time to fire the lawyer...

I hope so! I keep going over it in my head and I really don't see how they would need more evidence of our relationship. Let's hope it's something small and administrative. :unsure:

I had a simple RFE and was approved around two weeks after I responded to it. Hopefully it will be a simple RFE.

When responding to a Request for Evidence it is extremely important that you place the blue coversheet on the top of the response you send to them. The VSC/CSC receives thousands of pieces of correspondence each day, if the blue coversheet is not on the top of the response it will be placed in “general” correspondence and NOT sorted as a priority, which may delay your case.

Stay calm and wait for them to give you more information. Remember an RFE can be a boon, in that it can allow you to strengthen your evidence!

Got the text just now...and we've got an RFE. Not what I was hoping for...but at least my case was touched? I'm a little (okay, a lot) concerned about what they could need. We submitted so much evidence, we triple checked everything, and we have a lawyer who did the same. I'm spinning out of control with the negative thoughts now. And how much extra time will this add?

Whew...just had to get that out there! I guess there's no point in worrying until I actually see what they need. Let's hope it's minor.

Congrats to all the approved cases - they are working hard today!

I know it's all about patience. But geesh I can't take it I'm going nuts with the waiting. It's so close now. I just can't stand the anticipation of not know how much longer. I dealt with the process pretty well but now that I know September applications are being touched I can't but help to feel anixous. Sorry about my rambling. I know many are in my scenario, it just helps me to vent off a bit.

Congratulations to those who have received their NOA2 so far. Please update us with how the USCIS to NVC and NVC to consulate experience goes.

It depends on the type of phone you're using. Oh my iPhone, pressing the home button and the button on the top of the phone at the same time will save a picture of that screen to the camera roll. Then email it to yourself to print.

Yep, you can have all of your text records emailed to you in an excel format - then you can edit it and send the messages that you want with dates. I'm in the same situation with using Viber for phone calls so I print screened many, many shots of the call log and emailed them to myself as well.

Yes, it happened to us,too. My friend who also got a rfe explain to me that the first update is the vsc notice us we got a rfe, the second update is the date vsc really send the mail out to us.we got the second update on march 18th, still waiting for the hardcopy,,,

Hello everyone...I've got a question and am hoping that someone else has experienced something similar.

On 3/18, I received a notification of an RFE - the ususal...my case is suspended until I reply. I'm waiting on the hard copy to find out exactly what they need. Today, 3/20, my case status was updated again with an RFE notification. I called USCIS and they refused to tell me if it's a duplicate or if it's a separate RFE that will need a response.

Has this happened to anyone else?

As we start the process, I've become concerned about the whole support issue and whether or not I will need a co-sponsor and how that's handled for the Philippines.

I was living in the Philippines for about a year and half, where I met my wife. At the time I had taken a break from consulting to work on personal writing projects. Unfortunately, for that time frame there was no income, other than minor investments. Now that I'm back in the US, I've picked up with consulting again and am ready to send off the I-130. Starting this year, my salary will be magnitudes above poverty level, but I'm wondering how the income tax form from last year (the time off) is going to look to the officials there. Will they accept my current and projected income, or will I be required to get a co-sponsor? The frustrating thing is that my current income is significantly larger than anything a potential co-sponsor would be able to show.

Does anybody have insights about how this will be handled for the Philippines? Thanks in advance for feedback.

You should call NVC on Friday to see if they've scheduled you an interview. They schedule interviews during the second week of each month for the following month. It's nearly impossible to know how busy the embassy there is but hopefully you'll make the scheduling this week and get a July interview..good luck!!


Thanks for the reply. I couldn't wait, so I called last night. They confirmed what you said. They are currently scheduling the July interviews. The rep said call back Friday or early next week to see if we'd gotten an interview. I'm really hoping for that.

Well, we got our appointment email today. We have a July 9 interview in Manila. On the one hand it's a really good feeling to have gotten here, but on the other hand we're realizing how much there is to do in the next 25 days. It's pretty overwhelming. Ok, so my wife is flying in from the Philippines on PAL and will come into Los Angeles International. I'll be flying into LAX the same day to meet her there at the airport. The problem is that I don't really know that airport and she won't either. Does anybody who's been through LAX have suggestions for how we should be able to find each other there? I think we are going crazy here with all the planning loose ends now, but at least we are almost together again. Thanks for any responses.

You're confusing the requirement to have a CENOMAR (Certificate of No Marriage) with the Legal Capacity to Marry. Depending on where in the Philippines you are getting married you're probably going to need both. A CENOMAR is issued by the NSO (National Statistics Office) in the Philippines regardless or whether you're from the Philippines or not. It simply states that the NSO has no record of a marriage by you in the Philippines. On the other hand the legal capacity to marry is usually issued by your consulate or embassy.

I've just started to fill out the paperwork but wondered what I should do regarding the date of marriage on the I-130 form. We initially had a civil service and then about a month later had a Catholic wedding, which of course for the family was the "real wedding" and the one where we really have all the pictures.

The most obvious thing would just be to put down the first date, the one for the civil service, but just to make sure there wouldn't be problems or questions created for the interview and presenting evidence via pictures, I thought I'd ask the forum what the best course of action would be.

I lived in the Philippines for a year and a half, and then moved back to the US, last June. The last 12 months in the RP, we were married an living together. I've got an apartment in the states and we are also maintaining the apartment in the Philippines where my wife is currently living and where I stay when I visit (now doing so for the holidays.)

We have tons of photos from trips from around the islands and overseas, but not much of the legal stuff on the "bonafides" list as we don't own property or have children. She is on my will and is the named beneficiary on my retirement account, so I guess we can use those. And we did file a joint tax return last year for which we had to get the ITIN for. But the lease was the second thing on the bonafides list, which is why I wondered about a letter from our landlord.

This was a pretty informal place in the Philippines so there wasn't a lease, just a handshake with the owner of the house. For the "evidence of a bonafide marriage" would a letter from the landlord work in place of the lease, something from him just stating that we rented the place and lived there from date to date? What else would it need to say? Would it need to be notarized?

Here's my situation in brief, and I'm looking for any kind of feedback or advice anyone has based on your past experience.

I lived in the Philippines for about a year and a half where I met my wife. During that time I was taking a break from work to write on personal projects. Well, now that I'm back in the US, I've picked back up with my consulting work, having just landed the job finally. I don't want to delay starting the spouse visa any more than we already have, but I'm concerned that because I just started the job and won't have any income on the tax return I'll have to submit, that this will cause problems in the process, like with the whole support issue. I certainly can send a copy of the offer letter showing what my salary will be, along with filing the I-130 and G325 forms. What do you think?

I have read many guides about the different visa methods and as everybody I feel a bit confused. I am from germany and currently visit my american boyfriend of 4,5 years in the United States. I came here on a visitor visa to discuss whether we should get married right away and file for the visa after (K3) or if we should file for all papers first and marry within the 90 days given (K1).

My priorities are to come back as soon as possible to finally work in the US. I finished all my studies in june and I cannot imagine sitting around in germany in order to wait for the K1 three months or longer process. Will the K3 enable me to work over here faster since we are already married? I also wonder if you have to do the medical exam for the K3 as well? I would prefer to get in done in germany!! I really hope you guys can help me based on all your experiences good.gif I appreciate all your helpful answers,
