I believe that the wife would have to leave to go to the Country of her origin even if the couple stays married. she would have to apply with Immigration for her visa to make herself have a legal status in the U.S. Deportation would more then likely take effect due to her illegal status in the States.

So, I received notice that my NOA2 was approved and "sent out" on April 30th. As of Thursday, May 07 no NOA2. How long does the average NOA2 actually take to get delivered (Texas Resident). I would think it would only take 3-4 days. Its now been 8 days. Hmmm.

So, she will either have to say that she ommitted this fact (lied! whistling.gif ) in her B-2 interviews, or that we did not actuall know eachother back then.

My sense is that it would be best to be honest if the subject comes up in the interview.... but of course to not mention it if they don't ask! Does anyone have thoughts on the best way for us to approach this? Should she say that she did not mention me because she knew it would mean automatic denial? We were not planning on getting married, just having her visit my folks and hometown... which we will have to do now with a fiancee visa

I think the USCIS are mainly concerned if you have an actual on going relationship with your fiance. As long as your divorce papers are in order then there shouldn't be a problem I would think. Good Luck...

Hang in there. My process took so long but in the end my finacee finally received her visa approval (8 months later). It will get resolved. Just don't let your frustration get you down... Good Luck...

If it is denied, do we have to send another $455 to the USCIS? Can we resend the petition once I'm 18 if it is denied? Do they void the first check if the first petition is denied?

I was just going over my I-129 that I recently sent in and preparing to deliver the originals and a copy to my fiancee. I had several binder clips of evidence detailing each of our meetings, each containing a cover sheet. The last one was additional "assorted" evidence" which included cards and letters. When I made the cover sheet for this, I had not yet decided on how many cards or letters I was going to include, so I just put "XXX" in the place of where the number will be (At work, I always use a couple X's in place of dates and other things that I don't have available but will plug in later.)

Well, in my visa packet, I never went back and put that number in. So the very last line in the table of contents for that coversheet reads: "XXX cards and letters." No, I'm not kidding, I wish I were.

I am absolutely beside myself. I'm imagining the reviewer seeing this and thinking I was trying to be funny and burying my petition. My only hope is if they don't read it too closely.

What in the world can I do to rectify this??

Ah, just go with your gut feeling. It sounds like she is the one who will be in charge of all of the paper work anyway. Just make sure she is over 18, otherwise she will have to have daddy and mommy's consent. Good Luck...
