yep you can.  It's even on the EI website.  
 
You can't get the EI until you receive your EAD, but you should apply for it within 4 weeks of leaving your employment.   If you have worked enough hours, you can max out at 55% of what you were making.  (Funny story, when I first started my job with Target, I made only slightly over what EI was paying... So jobs in the USA definitely will pay less than equal jobs in Canada.  I plan on going back to school after I qualify for in state tuition, which takes a year, and save some money up for the schooling.) 


Oh, thank you so much for all of that information. That will definitely help us out as I have student loans etc I will need to continue to pay in Canada and I don't want to have to put that burden on my fiancé. I plan on going back to school as well as I'm one year short of receiving by bachelor degree. I'm trying to research how many credits I am allowed to transfer etc to continue my post secondary education while living there. So much to do!! Lol

You will not be able to work, even remotely, until you get your EAD.  There is no gray area here.  The USA doesn't work like Canada in this area.  You must have a work permit to be able to work no matter who you are working for (unless you were driving back to Canada to work everyday.)   As for EI, file for the EI immediately before leaving Canada and you should get the first payment after they have proof you have your EAD.
 
Technically your debt, and thus your credit history, does not accompany you when you move.  However, if you ever want to move back to Canada I suggest paying it off. Calling your bank is a great idea.  Banks always prefer you continue paying vs not paying obviously.  
 
You should talk to an accountant about your rental property and rrsps etc... There is a likelyhood you'll have to pay Canadian taxes on them so you'd have to continue to file Canadian tax returns?  But I'm not sure about the details, which is why I suggest a good accountant. 




So once I leave my job to move with my fiancé I will be eligible to receive EI even though I will be living in the US? I did not know you could receive EI while you are out of the country.

Is there any way to check how many days you have visited and how many you have remaining? And does the year wipe clean on January 1st? I know I am probably no where close as I only go up for Aprox 2 weekends a month to visit my fiancé in the US but I am thinking of taking a vacation week as we'll to visit him and I know it will add up quickly.

You guys are so lucky! We applied in January and still have yet to receive our NOA2. I only live 2 hours away from Montreal so hopefully once we get that I can call and harass them for a quick interview date and medical. We've called a few times and they keep telling us everything is fine and to keep waiting but it's so discouraging seeing everyone else so far ahead! CanadaPacket 3 questions

The newer one is the current one, everything is done digitally now at Montreal.  In all honesty, everything on the DS-230, DS-156/K is on the DS-160.  We went through the process when we had to do all of them...and it was a lot of redundant questions, each form asking the same things, the DS-160 is the most thorough.
 
The I-864 will get done when you Adjust Status after getting married, or if you are applying for a visa and are already married.  The I-134 is for the K-1 / fiance visa.

CanadaPacket 3 questions
We've been wanting to send in our packet 3 but of course we have questions and they won't answer them over the phone orrr reply to emails!

First question is in regards to the Packet 3 Instructions Materials; on the letter that I received yesterday it sent me to a PDF photo of the required documentation. On the bottom of that PDF it shows that version was revised on July 27, 2012. Buttttttt on the website there is also a Packet 3 instructions Material for K-1 Visa that was revised October 8, 2013. The newer version of this packet 3 request only includes a request for three (3) documents:
1. DS-160 confirmation page
2. Scanned copy of Packet 3 Checklist
3. Colour-scanned copy of the biographic data page of applicants passport
Sooooooo my question is, will these three documents suffice or do I need to include all scanned copies of the seven (7) required documents (including DS-230 Part 1, DS-156, DS 156K) on the 2012 revised edition? Like on the 2012 edition it requests that you also send all items on the checklist with the DS-156K such as police certificate and affidavit of support and supporting documents, do I need to attach these? We have all of the needed forms and supporting documents, I would just like to make sure I'm sending everything I need...... Confused.

The second question we have is in regards to the Affidavit of Support. On the website and in the Packet 3 Checklist only states that he has to fill out the Affidavit of Support (I-134) and supporting documentation. My fiancé has already accumulated all of the required supporting documentation for the I-134. But I thought I saw somewhere he needed the other ones too....would just like to know if there are any other forms he needs to fill out to accompany this Affidavit of support such as the I-864, etc? And I know there are fees for the I-864 etc....

We typed everything out and printed it from the computer in black ink however He signed a few of the pages in blue ink (just his signature). We really don't want to have to refill out these portions of the applications and reprint them. Is it okay that there is blue ink in the signature section????

I thought that I read somewhere that some one was notified that they should expect a I-797E when they received their NOA-1.

Ours just says "I-797 to follow" so does that mean we have been approved ?

Regarding taxes, if he moved back in 2012, he should have a full year of US employment. As long as he meets the financial guidelines you should not need a sponsor.  Submit the employment letter, bank statements, W-2 etc with the P3 packet. Unless he is self employed he will not need to submit a tax transcript with the 134 affidavit of support. He will however need to submit 1 -3 years of transcripts for the 485 AOS later.


Okay, great. Thank you. No, he isn't self employed and does make more than the required amount now so that portion should be okay.

 
I'm not sure about your fiancé's taxes but in regards to your passport stamps, don't worry too much about it. Most Canadian passports don't get stamped when going through a land border. For proof of meeting in the immediate two years, provide official and dated evidence that places both you and your fiancé in the same place at the same time such as, receipts paid by you in the states or by your fiancé in Canada.

I'm starting to worry about the taxes portion because Nicholas (my fiancé) was living in Canada for 4 years and only moved back to the US in October 2012 so he is just starting to get everything together to file his taxes in the US now.... Last year was split between Canada and the US... I'm not sure how this will affect our wait time while they review this. We may need to look into his mother being a co sponsor. But I will definitely keep you updated! Everyone is being such a great help. Still working on why our timeline isn't working at the moment. We have all kinds of photos etc because we have been making sure we see each other at least once/twice a month. However the border crossing never once stamped our passports so I'm going to look into how we get proof of the visits . I only travelled via Amtrack twice so I have those stubs, the rest was via driving our own cars.

Only Montreal and Vancouver do K1 interviews.  Only Montreal does spousal interviews.  The friend would have had her interview in Montreal not Ottawa.  I had to travel there from Alberta.  weeeeeeeeeeeee....  LOL... I spent a week in Montreal because of course the 3 days after the medical does not include weekends and my interview was on a Monday.
 
As you're from Ottawa you may want to travel to Montreal twice, once to get the medical out of the way at Medisys and scout out the consulate, then you'll have to go there for the interview.  There is a bunch of reviews on this website and a Canada forum to help you out.  I suggest reading the Montreal guide in the Canada forum, lots of little tips there. 


Do you possibly know how soon can I schedule my medical examination and my interview? If the waiting times are long in Montreal I want to be on top of this! I have already sent a request for my immunization and will be picking up my criminal record check once the date is closer (I want that to be as up-to-date as possible).

Right now NOA1 - Interview is running 242 days. YMMV.  If you figure 5 - 7 months you should not be far off.

 

Yes all 129 go to the Dallas lock box.

 

I made all the dates the same. It shouldn;t really matter though.

Hi everyone!

 

My fiancé and I are finally beginning our application process for the K-1 Fiancé VISA. He is an American Citizen and I am a Canadian Citizen trying to move to New York in order to be with him! This weekend we have started filling out our I-129F and our G-325a as well as getting together all of our evidence and other needed documentation. However, there have been a few details we weren?t quite sure of and have some questions about and unfortunately the call centre is not open on the weekends. We are hoping some of you could offer some help or pointers please!!

 

Here are some of our questions:

 

Do all applications get sent to the Texas address regardless of the City and State that he lives in?

 

This is our first time applying and we do not yet have an Alien Registration number or File number so is it okay to assume that we leave those spaces blank?

 

And does it make a difference what date we use on all of the forms/cover letter/evidence/continuation sheets etc.
should they all be the same date (such as the date we plan to mail in the application)?

 

Do any of you know how long it has been taking for recent applications to be approved/reviewed? We want an estimate on how long it will take before I can move in with him as I need to give my employer notice so that they can hire a new employee for me to train.

Both of you will need to fill out the biographic information as well as need to attach a passport style photo to each of the forms to be sent in with the initial application. Good luck!

I just double checked on the uscis website because that made me worried:

On the I-129F instructions PDF it says on number 3. Answer all questions fully and accurately. If the answer is "not applicable" or "none" , leave the space blank.

On the biographic page it's self some sections say, "(if none, so state)" so we answered none only where it directed us to.

I read that when filling out the 129f, if the information asked does not apply to you, you would leave it blank. However, now I am seeing people stating they got RFE's for putting "none" instead of "N/A" or simply for leaving the spaces blank. What is the proper way to do it?


We left the spaces blank on the I-129f because it asked to the leave the spaces blank that do not apply. However, the biographic information page asked you to state "none" so we typed "none" on those pages... Hopefully that was right. I'll keep you posted if we get an RFE

jross, what did you write on the cover letter, if I may ask? Did you use your wife's new name or the old name? I'm inclined to use the new one (as I should, since it is now legally my name), but almost all my evidence shows my old name, including my passport and of course my conditional GC. Should I just use my new name, and mention that the evidence shows the old name?

We recently attempted to change Haydee?s surname to XXXXXXXX at the local Social Security office earlier this year with our marriage certificate. We were told that we must first have her Permanent Resident Card updated with the new surname before they could change the Social Security Card surname. I called the USCIS information line to receive instructions on how to do this and was instructed to simply use the new surname XXXXXXXX in the subsequent I-751 filing and to write her original surname ?XXXXXXXX? in the ?Other Names Used (including maiden name)? section. I was told to include a request in writing for the name change (this letter is that request). Haydee?s new full name will be HAYDEE XXXXXX XXXXXXX.

 

On August xxth the full adoption of my son Cesar was completed at XXXXX County Surrogate Court here in XXXXXX, NY. Through the adoption Cesar?s surname has been changed to XXXXXXX and is now being processed by vital records in New York State. A new birth certificate will be arriving soon. We?ve written his current surname in Form I-751 as XXXXXXXX and would like this to be the surname printed on the new Permanent Resident Card. We did the name change via our I-751 as well and it worked out fine. We also did not change her name on the marriage cert so it's ok. It sounds like SS and DMV vary from state to state because we were not permitted to change the name on SS until they had some documentation from USCIS that the name had been changed in their system first. They did finally agree to change both once we brought in the first NOA and biometrics appt forms which showed the new married name.

We did attach a cover letter requesting the name change as well. Not sure if it's necessary, but it's what we did and it all worked out well.

We just recieved another status update saying that the usps picked up a package from uscis on Feb 21st and our cards will arrive within the next 7 days. However, the tracking number provided is the same one as before and it does show that the cards were delivered on the 20th. Weird.

sounds like something got lost in the mail. The extension letter should be the first communication you received from USCIS. It basically confirms that they received your packet and payment and allows you to relax knowing however long it takes them to process, transfer, request info etc.. on your case your residence is still legally extended. They would have sent that within a week of mailing your packet and before transfering your case.

Infopass is the right move.

Nah, don't think so. Your GC will expire ten years from now with same day/month as the initial issue of the conditional GC.

which is why it doesn't really matter for ROC when you get approved, be it 9 days, 9 weeks or 9 months etc, You will still be able to file N-400 90 days before 3rd anniversary of being a PR (i.e initial conditional GC issue date +3 years - 90 days)


The card will read:

Card Expires: 2/20/2024
Resident Since : (date of initial card issue)

That's how ours just arrived. We can still apply for citizenship 90 days before the 3rd anniversary of initial entry to the US. But the actual green card will be valid for 10 years after the date that the new card is ordered for production.

2/18/2014 Received notice that the cards were mailed plus tracking numbers

I was surprised to find that the cards don't expire until Feb 12, 2024 (10 years from the day the new card production was ordered). I thought they would expire 10 years after our initial entry.... nice surprise. So the silver lining at least for those who have had to wait a little longer is that the card will be valid fot that much longer.

Just got a 2nd status update email today! It was the tracking numbers for the cards. I now know they will arrive the day after tomorrow!

Noon today was the notice that the cards were mailed. 9pm this evening was the notice with the tracking numbers. Were on eastern time,
