She sent it through Western Union? I don't understand. You got a hard copy of it through Western Union? I have an copy of her passport style photo on email. However, I went to Wallgreens and Walmart tonight to print it and they won't print anything passport size. I guess because of security reasons.

What I did was, I told my girlfriend to sent me all the documents I needed from her, like that letter that says your fiance intends to marry you within 90 days and bla blah blah, she needed to sign that letter and sent me passport pictures, she sent me a package through western union, but you will have dhl knocking on your door, it took about 3 to 5 days cause I wasnt home...

I was going to submit a K1-Petition to start the visa process. I noticed that I don't have a passport style photo of? my fiance. Should I fly back to the Dominican Republic to get this from her? Is a passport style photo of her required for the initial K1-submission?

My girlfriend sent me hers through western union, you don't need to go back to get her passport photo!

The CO does not have to allow a co-sponsor. That is another value judgement left up to the person taking the interview and his immediate supervisor. For any chance that a co-sponsor will be accepted, the person offering to cosponsor your fiancee should be a close relative.

All true BUT

Here are the facts of the case:

1. He has no employment
2. He has no written promise of being re-hired to present
3. He has an income from unemployment that is limited in term.

While there is nothing that disqualifies unemployment insurance as income, there is also no requirement for the consulate to accept it. His level of unemployment income easily qualifies for 2 people, probably 3. But they can simply reject the income. I am sure some consulates would accpet it and some would not.

Your last year's income will not matter, UNLESS the consulate wants it to matter. The good (and bad) thing about this is that there ARE NO rules the consulate HAS TO follow. Each one makes their own and the consulate is ONLY required to be satisfied your fiancee will not become a public charge. All the poverty guidelines and sich come from the I-864 used for the Adjustment of Status. There are no guidelines for the I-134. NONE. It is common on VJ to ASSUME that the consulates use the I-864 guidelines as theri guidelines for the I-134. I am sure some do, amybe even many do. But there is no requirement to do so and even if they "do" there is no requirement to do so for every case. Consulates have incredibly wide latitude on this matter.

This could go two ways...

"The guy made $45,000 last year and has good skills and experience and will probably get employment soon. APPROVED"

OR

"the guy has no job and no co-sponsor...DENIED"

Bottom line...if I had ONLY unemployment at the time of the interview, I would bring in a co-sponsor.

That co-sponsor is on the hook ONLY until you submit an I-864 for the Adjustment of Status and for THAT, the unemployment IS counted as income.


Thanks, that was clear enough, I will start looking for a co-sponsor, I had employer write a statement to me before the laid off, stated that I worked from 12/20/10 to PRESENT. Letter says permanet not temporary position, title, and salary, I'll take that with my w-2, a co- sponsor and hope they call me back to work before the interview, only time will tell, thanks a lot!

I submitted form I-129F Semtember 10, 2012, by November 16, 2012 I got laid off from work and I got a letter from my employer saying that it was Reduction-In-Force business was slow, they said they are calling people back to work when business pick up, but gave me no specific date to return, next week It will be 5 months since I sent my I-129 and I am worried because I am not working, I am receiving $870 biweekly from Unemployment Benefits, filed my taxes yerstarday found out I made 45K last year. Not sure if any help, I read other forums people said only actual income counts,any advise on that :bonk: :bonk: Please!!

You are the petitioner (US citizen) and you are bringing your fiancee (Dominican citizen) to the US on a K1 visa. So all the forms you complete at this point are for you fiancee. She should be completing the forms. But most petitioners complete the forms for them or with them. Just make sure all the information is accurate. This is what i know so far....
First: The Consular Section does not mail Packet 3 to applicants, only mail Packet 4 (appointment letter). Instead, fill out one (1) Form DS-230 Part I (Application for Immigrant Visa and Alien Registration - Biographic Data) - (PDF - 175 Kb). Fill out Form DS-156 (Nonimmigrant Visa Application) electronically and print two (2) copies. You must fill out Form DS-156 online, each application will generate a specific barcode for each printed form. Male K3/K4 visa applicants between the ages of 19 to 45, must also fill out one (1) Form DS-157 (Supplemental Nonimmigrant Application) You must answer all questions. If your children are applying for a visa with you, each must completely fill out: one (1) Form DS-230 Part I. Form DS-156 electronically and print two (2) copies of the computer generated form with it's barcode, If they are male and between the ages of 16 to 45 they must also fill out one (1) Form DS-157 - (PDF - 256 Kb). Fill out all of these forms completely, but do not send them before your interview. You must bring the completed forms with you to the Consular Section on the day of your visa interview.

In some embassy/consulate is not a requirement but is highly recommended to asist together. In my case, the date of my k1 visa interview I went with my now hubby. I met other girl applying for a k1 visa also, she went alone and her interview was wayyyy longer and hard compare to mine (in Caracas embassy the interview is performe in a open booth so EVERYBODY around can hear it) her interview last at least 30 min. When it was my turn I went with my then fiance and she asked 3 or 4 question and 2 questions to him and that was it! We were approved :). The other girl was approved too but our interviews were different. Im nit saying that going together will grant her, her visa but I thinks thats an extra plus for both of you

The Expedite is only for USCIS to get it to the Consulate, after that it goes back to normal processing as far as I understand.

 

You'll see in my signature how long it took after my case was received at the Embassy.

I actually called the NVC  and they told me to request an expedite for my case since Im already waiting for the interview I just need them to give me a sooner date so I wont have to fly so close to my due date and I was told that it would take alteast 14 days for a reply so hopefully it will get approved and get my interview date.

How awesome for u!!! Finally some good news that shows good reasoning! Our baby is already 6 months. He's missing everything. So so soooo sad. We got to spend a month together during my maternity leave once I got the baby's birth certificate then passport. And then

I guess it was because my case in NVC was complete and I was just waiting for an interview and I know its mandatory when your petitioning for your spouse to attend and I wouldn't be able to fly to close to my due date

I sent an email to request the expedite for my case on January 29,2014

Then on January 31,2014 they emailed me back requesting to foreign phone numbers, I replied the same day and on February 3,2014 I recieved another email saying I had to resend the numbers with all of our info.(case#,dob,priority date, etc.) and I did so that very same day.

And this morning I recieved the approval. ??

Hello everyone I just recieved an email that my request for an interview expedite was approved.

Now my question is should I call the US Embassy in Santo Domingo or will they send me an interview letter ?

Also I checked the ceac website and saw this message "Your case is in transit to the Consular Section. Your interview date was provided to you by the National Visa Center." This has me a bit comfused becuase now I dont know how I will know about my interview.

They don't process anything really other than filing your submissions away and checking to see when all has been received. Nobody is evaluating your answers. They never RFE like USCIS does.

Administrative processing is what they call shuffling papers, and filing way your things, and waiting on scheduling. It doesnt only mean the dreaded AP where you dont get a visa until a year after the interview.

It's a holiday week and also a busy time for travel and student visas. They might not have opened your DS-2001 letter yet.
