The only issue I see is with the Affidavit of support as he would need to have enough financial support for 7 people if he has to pay child support (kids dependants). Co-sponsor could possibly be needed but in some countries, the embassy won't allow co-sponsors (I think Manilla is one of them).

You are ready to risk his permanent residency and see what happens in the court, relying on hearsay?

Seriously, get all the AOS paperwork all completed before his arrival - all you have to do then is copy his I-94 and visa page and send it off urgent. Mark it URGENT - POSSIBLE AGE OUT and INVOLVE your congressman as well to push it through USCIS - they can do this.

My fiance has filed K1 petition for me. I am guessing my interview will be sometime around Octorber '10 as per timeline. And my passport has expiration date of March '11. I think K1 visas are for 6 months validity. I have not been asked to renew my passport.
But I am worried that should I renew it?
Should I renew it without being asked? because the petition has copies of the current passport and if I renew it will it create any problem?

Renew it - you won't have any problems with visa - it's still the same name, no changes. Besides, if you want to travel later on outside the US, you must have a valid passport.

No, one-entry visa and expires once you enter.

If you want to go home for a visit, enter, get married, file AOS right away and wait 2-3 months to receive Advance Parole - with that you can re-enter the US while AOS is ongoing. Anything other than this process gets your AOS cancelled and you have to start from scratch with CR-1 visa.

The reason I ask is because, I worked as a full time employee at a company for 3 years - six months ago, I left as a full time employee and am currently working for the company on a freelance, independent basis. I didn't note this on my employment history, because technically I am still working for the same company, although I am now freelance as opposed to full time. I just wondered if someone from USCIS is going to call HR at my company and ask for me and be told "she left here six months ago" because I am currently not listed as an employee on their records - I am an independent worker now.

Yes, there are tourist visas issued for 1, 3, 5 and 10 years - sometime even for as little as 3 months or a week only. It does NOT mean someone can stay in the US for that long usually on B1/B2 max time is 6 months - all depends on what is written on I-94 - that is the time given to the visitor to stay in the country. Visa just allows one to get to the US border.

Yes it is your opinion but it doesn't correlate with the facts. In all likelihood, the envelope your petition arrived in is immediately thrown out. It wouldn't make sense for USCIS to care or observe where the file was sent from, considering lots of Americans do travel and probably do the forms with their fiance in the fiance's country. Or even if they're on a working holiday or something.

If you've ever heard of someone being hassled about what country was on the envelope, maybe I will change my mind. But I've been on this site for awhile now and have never heard of that. The process doesn't need to be made more complicated by paranoia.



At my N400 interview, they had all the envelopes we ever sent petitions in (I-751, I-90 x2, N400)... don't know why they keep them, but they're in your file.

No, you can't - your friend is wrong. The only form that can be filed at the embassy is I-130 for CR-1/IR-1 visa provided that the petitioner meets the residency requirements (usually 6 months but on on tourist, student visa) and shows proof of residing in the country - lease, bank acccount...). This is called Direct Consular Filing.

K-1 Fiance(e) Visa Process & ProceduresCBP Officer at POE Lost my Husband's K1 Packet!!

My now husband came in with his K1 on October 6th. His POE was in Chicago, and they processed him in what seemed to be correctly. They wrote K1 in his passport on 3 places (on the face of his visa, on the I-94 (though not on the line of the stamp) and behind the I-94 where they stamped the passport entry again.

When he was entered into the SAVE database, they entered him as a B2 Visitor, not a K1. They also seem to have completely lost his file.

We went to the local USCIS office on an InfoPass appt on Monday to see if they could help us (at the insistance of the SSA office - they're the ones who discovered the error) and they couldn't even find him in the system until we pulled out our NOA2 and used the old EAC case number. No packet logged in after his POE.

We went to our local CBP Deferred Inspection location today and the CBP Officer (Steenburg) fixed the computer mix-up for us, but when I asked him about Peter's hard copy packet, he said he'd check, because the USCIS should have issued him a welcome letter within 2 to 3 weeks of his arrival and if we'd not gotten that, chances are they didn't have his packet. He looked in the system and Peter's packet was nowhere to be found. He said he'd bet that it's lost, 80% chance at this point, with the margin closing rapidly. He told us he called the USCIS office and that they told him they'd have to reconstruct the packet using my copies and hope for the best.

Hope for the best?? I jumped through all of their hoops to get him here. I dotted all my i's and crossed all my t's. We paid our money, we waited, we got his visa and now we're just supposed to hope for the best because one of their gubmint employee slackers misplaced his file???

We need to file for his AOS, but without them having his original file, how are they going to process it? This delays us even further, and he can't work!! I'm supporting 4 people on my own!! This is really irritating. And of course, to contact my local Representative for assistance means calling Mary Fricking Fallin. What a joke.



Welcome letter after POE is only issued to those who activate CR-IR visas.

As your husband is K-1, he wouldn't get a welcome notice until he successfully adjusts status and that is still down the road for you. So I don't believe your packet is lost but probably waiting for AOS submission so it can be joined with it - in the meantime, it's probably gathering dust in some USCIS storage place.

You learn to be patient in this process. And remember, it's not over when she gets the K-1 visa and comes here. There's AOS (read up on it so you know what to fill out ahead of time, get the tax transcripts, I-864, line up co-sponsor(s) if necessary....) so she gets the green card, then removal of conditions and ultimately citizenship.

I just had a question to ask.
I have met my fiance last year around September or so. And I have only seen her in person once back in April, and we have applied for K1 visa of course when I came back to states in April. We have been together for two solid weeks and it was the best two weeks of my life. And we speak to each other on skype every single day. We have received our NOA1 in June 20th and still have not received NOA2. I have called them twice to check on our case and they keep telling me that it will take up to 5 months for the application to get approved.
I have been seeing that lots of people have met their partners two or more times before they applied for K1 visa.
Does anyone have a similar story like mine to only meet their partners once and applied for visa. I am just nervous and kind of worried of what is going on with the approval.
Is it normal for people to apply for visa based on the fact that they only seen each other once?



I don't see a problem as you have fulfilled your requirement of proving you have met once within past two years. Until interview, you have plenty of time for collecting more evidence - either another visit, more chat/skype/call logs, cards, gifts sent to each other...

Shouldn't have your application be approved in the next couple of weeks? You're approaching the 5 months mark soon.

No marriage - no stay - she will need to return after her 90 days on the I-94 are up. She can get another visa from her home country (student, work).

Long story short - things have been rough the past few months as they often are for alot of people in this waiting game - and sadly for my fiancee and I, we've decided to call things off. We had been going back and forth with it for a few weeks and the decision was not something either of us took lightly. There aren't really any hard feelings between either of us after having been so close for 8+ years, for which I'm very thankful. It just didn't work out.

I have 3 questions in particular - a few threads I've read while searching have addressed some partially, but not entirely. I'd appreciate some advice.

1. Our petition arrived at the embassy last week. I know I need to contact them directly to formally withdraw the petition - but can I do so by email? Sending a posted letter to her country is a nightmare and will likely not get there at all. I'm not exactly thrilled about spending $60+ to Fedex it there either.

2. Do I need to also contact the NVC and inform them of the cancellation?

3. Probably most important here - will the petition or the cancellation of the petition in any way affect her existing B-2 tourist visa? She has had a tourist visa for virtually her entire life and her current one still has 9 years validity on it. She travels to the US often - so even though we obviously are no longer together, I don't want this hiccup between us to cause her drama at whatever POE today, tomorrow, or down the road. Will POE even know we had this petition in the works? If I sent her a copy of the withdrawal confirmation to use in case she needed - would it help or harm her in the eyes of an IO? I'd hate to have them think we're trying to mess with the situation, when genuinely, it's the end of the road for us.

Contact USCIS, NVC and the US Embassy - letter signed withdrawing the petition and also include NOA2 copy. You can also fax it to the Embassy. Snail mail is also acceptable.

Ex-girlfriend can reply to any letter she receives (paperwork to fill) by sending them a copy of the withdrawal letter from you.

Should not affect her tourist visa, she still needs to have strong ties to her home country at POE.

hello, i left the US on the 12th of may 2011, when does my HRR start???

My J-1 visa says that : "BEARER IS SUBJECT TO SECTION 212(E). TWO YEAR RULE DOES APPLY."
It says that I'm subject to the HOME RESIDENCE REQUIREMENT because of GOVERNMENT FINANCING, which is a huge mistake since I never received money from my government for studying in the US.

How should I deal with this??


Was it funded by the State Dept? That also carries 2yr HRR.

Hi,

My fiancee and I would like to travel to a US territory outside of the continental united states for our honeymoon and so I would like her to obtain a state ID to avoid any issues with the flight. In Virginia it appears that they will accept a foreign passport with various types of visa's stamped for proof of identity.

My question is what exactly is the k-1 visa. Is it an immigrant visa or non-immigrant visa. I have read that it is kind of a mixed breed and even the forms we fill out seem to conflict between immigrant and non-immigrant. Is there an official answer somewhere?

Has anyone here had any experience obtaining a state id prior to getting married on a k-1 visa?

You won't be able to get State ID or DL until you have proof of residency - usually green card, but sometimes EAD will work as well.

Only if you want to then start the CR-1 process.

Marry, file AOS ASAP and include AP papers - then wait the 90 days or so how long it takes to get the Advance Parole and THEN you can travel.

Im done with my interview at the US embassy here in philippines last june 14, 2011 and the consul officer told me to get a police clearance from japan consulate since i lived in japan for more than a year.. and they gave me my passport back and they told me that i need my passport when i request for police clearance in japan embassy and they give me a 2GO form and they told me to send the police clearance at the US embassy if i already have it and my passport at any branch of 2GO.. and they told me that i don't need to go back there and schedule for another appointment.. but they didn't told me if im approved or not.. they just told me that i need to send my passport back together with my police clearance from japan. does it mean that i got approved? i have no idea :( can anyone help...

And how are you going to show proof of a job and ability to sponsor your fiancee with evasion of taxes? They do require you to submit tax returns for the past three (3) yrs, if you're getting paid under the table there is no W-2.

You really need to open a savings account and don't do anything until you have at least 5-6k in there. From the sound of it, payment 50 bucks a month? she'll be using government aid and not have status adjustment. I hope I'm wrong.

Hi everyone,

I wanted to post a new topic to gather feedback from others and their experiences. The short story...I filed for a K-1 in 2005 it was approved and we married, but the marriage ended within weeks (mutual more my issues). I filed again in 2007 w/waiver and it was approved. After 4 years my second marriage ended in divorce.

I'm on the verge of making plans to move overseas, but in the event that is delayed. What are my chances with a third immigrant visa over a 7-year period? I would appreciate any sound and constructive advice.
