The London Embassy is quite accommodating about domicile. A lot of us have been in a similar situation as you are in.

My wife (USC) lived in the UK for ten years. Her proof of domicile was her Oregon driving license with her sons address on it. The Embassy didn't even ask for proof just accepted what we had put on the forms. Somewhere on the Embassy web site they give their definition of what is acceptable for domicile and it is very open.

Make sure you have filed the last three years of tax returns. If you haven't contact the IRS at the London Embassy for assistance.

Our situation is the USC is a UK/US dual national and is living in the Uk at the moment and has been pretty much all his life. We were wanting to file for the K1 now (and use the address of Family in the US) In the new year the USC will be moving back to the US and will be there before interview stage. The USC has US bank accounts and will have a job over there by the time of the interview. But when we file he will be in the UK working here.

Do you think we will have any problems regarding Domicile?

hi, i just have a quick question regarding support.

our situation is...
beneficiary : a UK citizen.
the petitioner : a US/UK dual national, lived in the Uk all his life, moved to the US 2 weeks ago by him self to look for work so he can be the sponsor on the Affidavit of support. he has worked for the past 3 years in the UK and earned over the poverty line and filed tax returns to the US on his foreign earned income so we have transcripts and stuff for previous years.

we have a couple of questions, he is currently looking for work and freelancing at the moment. working freelance would make over the poverty line for the year but how do you prove it and is this a possibility for it?

and lastly, the only other person we could ask to become a joint sponsor has already filed an affidavit of support for another family member. is it possible for this person to support 2 different people at the same time?

sorry. we do have tax history. the usc has tax returns for the past 3 years, i mean the freelancing just started 6 months ago so this is not shown on any tax returns yet & obviously can not provide a letter as he is working for himself.

we got the information about self support through offer of employment for the uk citizen on the london embassy site here...

specifically the second option of proving that the uk citizen will not become a public charge... "2. the applicant has arranged employment in the U.S. that will provide an adequate income for the applicant and dependent family members;"

does anyone have any more info on this. i see this as meaning if the uk citizen has a job offer and have this in writing from the company, this can be used as proof as financial support???

we are going through the k1 visa process. we are just waiting to send our checklist back to the embassy in london for an interview but having a few problems with the affidavit of support. the usc is working freelance for the past 6 months so not really any tax history of income yet. we don't have anyone else to file the form too so i just wanted to ask... do the london embassy allow the UK citizen to self support themselves? (due to a job offer in the US once able to work???) is this a possibility or not as it is our only option at the moment.

it says on the checklist that if 4 months have passed the letter must be notarized. in our case 4 months have passed since we received the checklist.

i understand we both need letters on intent again but we are just wondering if both our letters need to be notarized or just the USC? because the beneficiary will be at the interview so could sign it there and then if needed?

i went to the doctor here in the UK to try and get my vaccinations record and get up to date before my medical and was told some of the vaccinations were not available in the UK.

what does a 27 year old need in the uk?

what is the difference between DTP and Tdap? I have had DTP but not Tdap (the doctor told me you can't get this in the UK, i see nothing on the medical papers that confirm this).

Also I have had MR but states I need MMR, is this the same?

That's the answer you want, 'no trace'. Means there is nothing and never has been anything on file where you're concerned.

No live trace means that although you are not considered to have any recent or unspent convictions, you have at some point in your life, been known to police.

Your ACPO cert is sufficient.

Police Certificate London - my certificate says 'No Trace', what does this mean? is this the same as 'no live trace'? Do we need to order my subject access records. If so what are these are where do you get them from?

i have no convictions or anything like that but read something about the subject access records and wondered if i need these or if my police certificate will be fine???

what is the best way to insure our personal possessions in the US while we apartment hunt, before getting home insurance. also the same goes for temporary medical insurance?

can anyone shed any light on this?

both of us (USC and British citizen) are currently living in the UK but will be moving out the the US when we get the K1 visa in Jan. we will be living in hotels until we find an apartment and are worried about the security of our things.

We have a few questions related to the I134 Affidavit of Support form for our K1 visa interview. Most of these questions relate specifically to our case but I will give the background and how someone can help...

Our situation is like this:
The USC is a dual national (US and UK). He was born in the UK and went to school here and worked here up until Jan 2009. We had previously got engaged and started the K1 visa process (he used a relatives address on the forms who is in the US). His family are in the US and that's where both he and I wanted to be. So in Jan 2009 he quit his job in the UK to go out to the states to find a job, this didnt work too well to start with but finally he got a job offer about a month ago but doesn't start till the end of Jan, in the mean time he has been back in the UK doing some freelance work.

We are worried about issues regarding domicile, how does this work. To my interview I am taking copies of things such as his US passport/ US bank account / US credit cards / US phone bill / US drivers license, is this enough or do we need more, if so like what?

We are also worried if the interviewer asks where we will be living, we don't yet have a specific address. we are wanting to fly out to the states together before he starts work, the new company are providing a relocation allowance and paying for a hotel initially before we find an apartment. Is this acceptable? i also have print outs of the hotel we will probably be staying in and some print outs of the type of apartment we will be looking at which also shows the price of rent.

The job earns well above the poverty line. I am taking copies of the job offer letter which states salary, start date, the position being permanent and a copy of the relocation allowance. I also have copies of previous years tax returns, bank account statements. Is this info enough to prove financial worth? We also have an option of a joint sponsor if this isn't enough.

A couple of questions specific to the form are:

Section1. It asks about place of birth and if outside the US it asks for certificate numbers/A-number etc...
The USC was born in the UK (and has citizen ship through his mother who is a USC, his dad is British). We have stated the city and country as being the Uk but he doesnt have a citizenship certificate number which it asks for in 1.b. All he has is a british birth certificate and a US passport. so for 1.b we have marked: citizenship through mother, please see US passport. is this correct?

Section7. It asks about value of other personal property..
Is this anything the USC owns? such as cars, computer equipment, right down to sporting goods and clothes? how do you prove this figure?

Just because she was living in the UK doesn't mean she didn't need to file taxes...she is exempt from paying taxes up to something like $80k, but she still has to file them. I know because I will have to claim David's income on my 2010 tax return for 2011.



she will have to fill out the form 1040 which is the standard individual tax return form and form 2555-EZ which is for foreign earned income exclusions.

we have our interview on Tuesday, it has been 11 months since we received the NOA2 and only have a notarized letter of intent from the USC. we gathered that since the UK citizen was appearing in person at the embassy for the interview it would be rather strange to have the letter notarized. surely they can understand, if the UK citizen didn't want to get married they wouldn't attend the interview???

after reading other post seems unclear if we need a notarized letter from both the US and UK citizen? we are thinking maybe we will take an unsigned letter of intent too and have the person at the interview witness it being signed, if this is required???!!!?

just to be sure we got the UKC's letter of intent notarized at the last minute today as we started freaking out about it yesterday.

it was at a solicitors office, although he wasn't 100% sure that the US embassy would accept it. because he said usually he would send them away and have a certificate attached to the letter (but this takes a week). what he did do was write on the letter saying he witnessed it being signed and stamped it with the solicitors stamp which says public notary and also a big brown imposed seal. hopefully this will be ok?... if its asked for.

Yes that's what we did. used the invoice number and post code. I checked ours again and now it's not showing any info when it did earlier. It originally said the 11th, then changed to the 12th, now it says it's not in the system. Uhh....not sure what's up with that. We're going to call DX int he morning and see what's up.

Only if it's been more than four months since the date you received your original NOA2.
Our I129F petition, for example, was approved in July and expired at the end of October. It actually can be a bit difficult to find somewhere locally that will notarize a letter for you, and it could cost as much as £75 (mine cost me £30). When I made my appointment, the closest notary place (a solicitars) was about 40 minutes away. I had to wait a few days before they could fit me in, too.



are you sure the UK citizen needs the letter notarized?
