United KingdomVisiting the US on Visa Waiver during K3 Process

Hi everyone.

I'm wondering if anyone has travelled during the K3/K1 visa process. I have read threads where people say it's fine, bring evidence of return/ties to home.

My husband is curious, however about filling out the form for the visawaiver. On it, it asks if you've ever applied for a visa before. I'm assuming he'll check yes, but... he's a bit nervous they'll turn him down at immigration.

Any insight, advice, etc.??

Thanks, as always.

Kristina

Hi Kristina,

I had the same concerns when I went to visit my husband in September. I contacted the Embassy for advice, check out this post for their response: http://www.visajourn...mp;#entry399823

I took all the evidence they suggested and more, but the immigration officer only asked for my return ticket as proof, I even offered to show him all my evidence and he didn't want to see it. He just asked me who I was visiting and why, how long I had known my husband, if I had been to the USA before, and how long I was staying for and that was it!

Good luck with your visit and for the rest of your visa journey!

United KingdomLong birth certificate
I have my interview a week tomorrow, and have been making sure that I have all my documents ready. I applied for my 'long' birth certificate online last year so I would have it in plenty of time for my interview date.

The thing is, yesterday someone at the registrars office told me it wasn't the long version, but my neighbour (who works there too) told me that it is the long version.

I have attached a copy of my birth certificate, can any of you confirm which version I have please?

Thanks ~ Andie

YAY! Congratulations! That's awesome.

We've booked the holiday Inn at Kings cross for our medicals. Not exactly close to the embassy or the bond st medical place, but we'll take the tube and then probably a cab or something to get there. Because the hotel is nice and cheap and seems child friendly and has good reviews at tripadvisor (and NOTHING gets good reviews there! lol) and has a pool! With a 4 year old and a 2 year old a pool is a MUST have to keep them entertained and amused.

Congrats again on the approval! How exciting!

Thanks, and good luck with yours too. Do you have your interview date yet?

I agree with Mags. Go for a Travel Lodge.

Good Luck for tomorrow!!

Thanks for the luck, it paid off, I got approved yay!

I ended up staying at the Marble Arch Thistle. It's a really good location, just off Oxford Street, and only 5-6 minute walk from the embassy. It was a bit pricey for us Northerners, but for London it was pretty reasonable £164 including full English breakfast and VAT.

I know I could have probably got cheaper, but I wanted somewhere close to the embassy, and there wasn't much availability left.

Aaaanyway, if anyone has a bit of extra money to spend, I can definitely recommend it. It was a really nice hotel, and the breakfast was yummy, just what I needed to prepare me for my 2 hour wait in line outside the embassy!!

Cheers ~ Andie :)

Hi everyone,

I have got my interview on Wednesday 15th November at 10am. I can't travel down on the same day in time for the 10am appointment so I'm staying over night on the 14th.

Any recommendations for somewhere decent but not too expenisve to stay near to the embassy?

My boss has suggested St. Giles Hotel near Tottenham Court Road, anyone heard of it?

Thanks ~ Andie

K-3 Spouse Visa Process & ProceduresVisiting US while K3 pending
I know this is a question a lot of you have, and I have been desperately trying to find out the answer for myself. I've had such varied feedback which didn't really answer my question so I decided to email the US Embassy in London, here's what they said....

On 10/08/06, Andie wrote:
I have a question regarding immigration at US airports. I am currently living in Liverpool, UK, and have a K3 visa pending. Will I still be able to visit my husband in Phoenix for a period of 3 weeks whilst the K3 visa is pending? I intend to return to the UK after the visit. I have heard of people being refused entry at the Port of Entry (PoE) because they were married to a US Citizen and had a K3 Visa pending.

On 14/08/06, London, Consular wrote:
If you wish to make a temporary non-working visit to the U.S. while your application for a K-3 visa is being processed you may travel on a B-2 (holiday) visa, or visa free under the Visa Waiver Program if otherwise qualified. You should carry with you evidence that you intend to depart the U.S. at the end of your stay and return to your residence in the U.K. This is generally established by evidence of family, professional, property, employment or other ties and commitments to some country other than the United States sufficient to cause the applicant to return there at the conclusion of his/her stay. If U.S. immigration are not convinced that you are a bona fide visitor for pleasure you can be denied entry.

So my next question is, does anyone out there have any sample letters from their employers? I have my doctors letter, my mortgage statement, marriage cert, return flight itin, bank statement, council tax payments for the next few months. If they don't believe that I'm not intending to stay after all this, I don't know what will convince them! Any other suggestions for evidence?

Thanks ~ Andie :)

US Embassy and Consulate DiscussionLondon 'ere we come...

Just called NVC to see if our paperwork was gathering dust anywhere,
and they informed me that it left there on the 7th November!!

So hopefully, I should hear Postman Pat shortly, dropping a little (big)
packet through my door..

Does anyone know, on average how long London take to send out the packet 3 ?
Im very excited...WOOOOOO

Had the pleasure of DTP in my right arm and MMR in the left, yesterday..
apparently Polio is now in with the Tetanus/Diptheria jab,
My daughter is scheduled in for her Hep B next week, and I think we are then covered.

Good Luck to everyone, and all the best...
Im off now to devour 3 chocolate eclairs....

Also chuffed because of a link on another thread, informing us that a shop in MA
sells Chicken & Mushroom Pot Noodles and Cherry Bakewells (Mr Kipling),

sorry Ill stop now, before my eclairs go soggy

Hi Chloe,

London processed my packet 3 on the day they received it, which happened to be a Friday, but it obviously missed the last post, and they sent it out to me on the Monday. That was only back in the middle of October, so hopefully they are still processing them quickly for you.

Good luck!

I know, I was behind. I didn't realize that we would get his packet 3 so fast. I was in the UK until Oct. 28 and shortly thereafter he got his packet. Now, they told him to only send his forms in but not I-134 with it. So he sent in his forms but I am led to believe he is just taking the I-134 and stuff with him to the interview. I am trying to get them all done and sent off asap just so he has them.
I read this site and all the guides but it always seems to change from embassy to embassy apparently... I am never good with all this stuff unless i have it in my hand and am reading it. With Packet 3 of course I wasn't able to do that....

Oh sorry, I should have been a bit clearer.

You do take the I-134 with you to the interview, but in packet 3 it has a checklist of documents and asks you to tick off all the ones you have so they can go ahead and process your application and send you an interview date (packet 4).

Packet 3 includes a number of forms that you need to complete and send back straight away along with the checklist of documents (but not the actually documents, which you keep hold of until the interview). The checklist includes things like birth certification, police cert, passport photos, affadavit of support (I-134) etc etc.

That's why I wanted everything in advance, so that I could sign off the checklist and send it back with the forms more or less straight away.

I hope I'm making sense, I didn't understand it all myself at first!

Ahhh...good question... I will have to ask my fiance...I know he has his police certificate and then has a certificate from the court in which he was processed, but apparently now you have to get a certificate from the precinct or something rather...of where you were brought in...I am not sure as I know he has his main certificate and has the certificate from the court....

I was prepared in advance by reading this website, it's been such a big help in getting things processed quickly.

I had already applied for my long birth certificate and police certificate months in advance. I also had my husband prepare 2 affadivts of support for both the CR1 and K3 visas and send them to me in advance. I told him to send both, so whichever route we decided to follow I would already have the documents with me in the UK, and could send the packet 3 back straight away without delay.

You should read the guides section if you haven't already done so, I found them to be very helpful.

So anyone who went to the London Embassy, did you ACTUALLY get ALL your papers together before notifying the Embassy to get your interview?

My fiance sent off packet 3 and has pretty much everything together and is having his Medical Dec. 1 but is still waiting on a police certificate that said 40 days. (he just realized he needed a letter from the individual precinct where he was arrested apparently) Now if he has everything but that (which should arrive just before or after Christmas) would it be safe to call in for the interview date in London?

Thanks!

The London Embassy will automatically send you a date for interview with your packet 4, you don't get a choice of dates unfortunately.

When you sent your packet 3 forms back, did you tick the box to say that you already had the police certificate or not?

I did not use an attorney, I used Immigrant's Services out of Memphis TN. They can fill out all the forms for you. This will not speed up the process but they know what they are doing. I think my total bill with them was less than $500. I had them do the papers for the CR1.

If your not already married since your talking about a wedding this year in May. You can just apply for a Fiance visa thats the fastest way to prevent separation any longer then needed.

Yeah we thought about that option, but decided on getting married in the UK instead. He's already got his marriage visa, and we gave notice of marriage in January. Everything is booked for the wedding in May, and friends and family have booked their flights, so we are going ahead with it over here now.

I would apply for everything myself following the guides etc, but Jason would prefer to get a lawyer to sort things out for us.....we both seem to be very unlucky in everything we do, so we are going to leave it to the "professionals" lol

Can anyone recommend a good Immigration Lawyer in the Tempe area of Arizona? My husband to be lives there and he is looking to get in touch with someone fairly soon to try and get me over there as soon as we can after the wedding in May this year.

Brilliant, that's great thanks. I have my passport forms here to send in. I can get a new one in my married name 3 months before the wedding. It's going to be so nice travelling all that way with my husband for a change, usually we both travel alone, so it might make the experience a bit less taxing.

Thanks - Andrea

IR-1 / CR-1 Spouse Visa Process & Proceduresbeginning the application process
I'm getting married in the UK in May this year, and I wanted to travel back to America with my new husband for a 2 week honeymoon. He's American and lives in Arizona. My question is, when we first send in the forms to start the application process off, do I need to be in my home country? will my 2 week vacation in the US make things difficult? Or should I just wait until I get back home?

I realise that when I do travel over there after the wedding, I will have to show immigration that I have definite ties to the UK, and that I WILL be coming back home after the 2 weeks. I was going to take proof of my mortgage and also a letter from my employer. Any other advice on what I might need to show them?

Thanks ~ Andrea :o)
