I was interviewed by a new CO who only asked me 2 questions, while she asked my fiancé about 5. My fiancé went to the window with me this time as advised by Kari18.

One issue that came up was the fact that, the person who invited me for my B2 lived in the same city with my fiancé at the time. But he insisted to the CO that he didn't know her. They went back and forth about the MD, DC, VA area and proximity of some cities, blah, blah, blah.

 

She finally said our information was sufficient and that my Visa will be ready next week. My blue slip in hand, the moment was surreal.

I became a US citizen thru my ex-wife in 2009. Divorce two(2)years later( very heartbreaking) and had remarried and applied for my spouse. I-130 had been approved with NO incidents, No Rfes or anything like that and the case now in NVC. My question is, is it a good idea to take to the interview at the consulate in Ghana a notarized letter from my ex detailing how our marriage ended and is not just because i met my new wife.

I think the Judge decision is automatic approval of your first AOS so no need to re-apply. With your case, I suggest you involve an attorney. Did you apply for another I-130 when the case was moved to court?

Germans don't need a visa if they can use the VWP with a valid ESTA. Have you considered passing ESTA?

Furthermore, it's illegal to enter the US on the VWP with the intent to immigrate.



 

Where is the fraud here? The "intent" is too subjective. A lot of people come with B-2 visa and later adjust their status to permanent residents. As long as she enters the States legally I don't see any fraud. Unless this guy doesn't want to speed things up to live with her future wife, I don't see anything illegal with his girl using this easy avenue.

Your fiance should be paying his taxes directly to the IRS at least every month even though he is self employed. This will help him get a document to prove how much he is making on his tatoo business. All the counselor wants to know is that his income from the tatoo business is sufficient enough to take care of you. I think he can also estimate his monthly income and have it notorized plus his last three years tax return transcrips. Good luck

Ok...I'm freaking out pretty badly right now so I hope someone can help me. First of all, I know this is my fault and accept my responsibility so please, I don't need anyone to make me feel worse by stating the obvious.

I've been trying to be proactive and gather as much information in advance as I can for when our NOA2 comes through (was hoping it would be soon but now not so much!). I've seen in most of the posts here that it's a good idea to at least provide the previous years tax return--sometimes three previous years. This whole time I was thinking I'd be able to provide returns from 2012 but now I've just realized...if we get our NOA2 before April filing, I'll have to provide returns for 2011...and I don't have one! I was living in Argentina for 18 months and honestly did not think I would have to file taxes while out of the country.

I feel horrible now because not only could this jeopardize our petition, but I'm genuinely scared about what the IRS will have to say. I have no documentation of my earnings for that year. I came to Argentina first to study. I decided to extend my stay a few months and after meeting my fiance I ended up staying for a whole year and a few months. I was teaching freelance English classes and earning pesos--I do not think I earned enough to be considered "taxable"--at least not in dollars, so I didn't even think of filing (not to mention the fact that I truly did not think I would be responsible while I was away..not sure what I was thinking now :bonk: ).

Now of course I regret it and know I have to take care of this but my question is...has anyone else been in this situation? Does anyone know if I can file as self-employed and if so, what documentation I would be expected to provide (note: I don't really have any "official" documentation of anything :unsure:). Also, if we receive our NOA2 before I can file my 2012 taxes...how essential is it to provide tax returns? Will they not approve us even if I provide my bank statements, letter from employer and W2s? I'm so depressed right now... :crying:

It is a requirement of the K-1 that you have seen each other within 2 years of filing, you met that requirement, and being at the interview with her will be another visit. Just make sure you do go for the interview or before, if not it may be a problem. Good luck

I have filed for my fiancee and waiting on decision, hopefully a positive one. I have kwown her since high school but we went our seperate ways and each got married and divorce. We met again when I was in Ghana in June of 2010 and decided to get back together again. I went back again in 2011 to spend the valantine day with her. I was a green card holder so I couldn't file for her. But I became I citizen in November of last year and filed k-1 for her a month after. I am wondering if not visiting her in 2012 will be a problem during the interview? I have all the evidence to prove that we have been talking and providing for her. I plan to to be with her during the interview

Well being there is the best option because you seem to have presented enough evidence the first time. You should have gotten married and file 1-30 the second time or contested their decision. anyway, there isn't any straight forward way for parkaging the evidence. Just have all the evidence with you to the interview. the possibility that you will stoke interview is high. Good luck


He was denied his visa at the interview for lack of evidence. We presented about 100 emails, phone records and about 30 pics of my first trip including the engagement ceremony. Now, we have pics from my second trip, 500 emails, phone records, im's, letters of support from our family, plus me in the flesh. I'm hoping this is enough, but I was wondering how to package it to present to them at the window.

what evidence did you present the first time? What was denied the first time? the k-1 application or the visa? In the meantime, being there at the interview is a smart move

Our interview is on 3/13/13. I know my fiance' in Ghana has to complete his paperwork, medical exams, and police report. But how do I put together this packet of evidence? I have our NVC petition package, tax transcripts, w2's, paystubs, emails, im's, phone records, photos from my 2009 and 2011 trips, and cards. Is there any special way to put these together or just label them neatly. I'm so nervous because they denied us for lack of evidence so I may be over thinking things.

Ps. I will be attending the interview with my fiance' this time.

Hello my fellow VJ memebers today i received a text message indicating me that my case has been updated. I anxiouslly enter my receipt number and when i check it says that they are requesting evidence.can anyone who has had a similar situation or knows about please tell me what evidence they might be requesting, just so i have a heads up before i receive the notice through the mail. thanks in advanced any help is appreciated.

Thanks very Carol and your suggestion is well taken. I have been sending her answers to possible questions and I hope to continue to do that. I think I have to be patient with her because sometimes I get angry with her because there are some asnwers I expect her to know and when she doesn't, I just go crazy. It may have to do with differences with our educational background and my exposure to immigration officers. Anyway, thanks very much for your suggestion because you made me realized that I may have been hard on her and it is about time I calm down and help her.

You can be moral support, and in some embassies it helps that the USC is there.

If you don't like the answers of your fiancée, try to talk with her so she understands why you don't like it... You can practice together so she feels comfortable with possible questions. In this sense, it probably help to be together so you can talk it through for real and not by skype or phone Posted Image

Visited twice since we met, communications,money transfers, pictures, bank statements showing that she was using my american bank card for over year in my native country until I stopped it. But I want to fly to home to attend the interview with her because I am not happy with some of her answers to possible questions and that scares me sometimes. She thinks since I have filed for her, AO will just call her to come for the visa. Also she is been there once for student visa but was refused. Do you think my presence with her will improve her chances of getting the visa?

I had my interview for my k1 visa today at the US embassy in accra. Although my fiance accompanied me to the embassy the security did not allow him to enter. Now after presenting tons of emails, skype log, whatsapp chats and all other cards and tickets and boarding passes and answering all questions i was asked about him i was still given a white sheet to present more evidence of proof of an ongoing relationship with him. I pointed out to the consular that he was there with me but the security didn't allow him to enter but she said so long as Im not in front of her with him or not carrying his passport(which i didn't know i could use) i need to bring more proof.
What more can i send after all that i took already?

I called Texas Senator Ted Cruz's office and spoke to Melissa Miller today regarding the backlog at Vermont. She was very short and rude. On top of saying "Looks like you'll just have to wait" she told me that she "wouldn't be reaching out to them (Vermont) again" because she already called for another gentleman. When I pointed out that many people were being approved from months all out of whack she brushed it off and basically called VJ contributors liars. When I told her that the recent timelines showed approvals from July - February she scoffed and told me that she wouldn't look at anything unless my case was filed before October 15, 2012. 

 

Really frustrated with the conversation I just had. 

 

Senator Cruz and other southern Senators want to end immigration as we know it so what do you expect from them.?

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 2. Send copies of the documentary proof that you submitted with the I-129F for your fiance(e) to have on hand for their interview at the embassy. Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate: 

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance 
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available) 
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern 
(D) List containing serial numbers and denominations of bonds and name of record owner(s). 

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well) 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)


NOTE: Tip Regarding Vaccination Records

The K-1/2 beneficiary will be required by the embassy to have a "medical" done prior to the visa interview. Part of this interview will require that previous vaccinations are documented and potentially additional required vaccinations performed. Once this is complete the doctor will note this on a DS-3025 form that will be sent to the embassy. During the medical appointment request an official copy of the vaccination records from the physician (or a copy of the completed DS-3025 if they will give it to you) as this will be helpful to have on hand in the future (specifically it can be helpful when filing for Adjustment of Status if your DS-3025 form is not available).

Ghana does for K-1s. I was a senior in college when I petitioned and recent graduate (grad student) when interview came. so I didnt have the income. Make sure both you and your co-sponsor provide documents- Tax Transcripts for sure, letter of employment(s), paycheck. w-2s and tax returns can be used but I would not advise for Ghana, as they usually request the Tax transcripts which are easy to obtain and cover all basis.

We had no issue with a co-sponsor. It was my dad.

So I still have at least until August to hear back about my NOA2 but I'd like to be prepared. I would require a co-sponsor for my visa IF I am still working part-time when the NOA2 arrives. Can someone tell me what the process is like when you have a co-sponsor, what stigma it puts on your case? I'm young and broke due to college loans and education debt. How badly does this reflect ? What advice would you give? What steps can I take to prepare?

List your current annual income: how much you make an hour times how many hours you a work a week, then multiply that weekly amount by 52 weeks to get your annualized current income. The letter from your employer and recent pay stubs will be the proof of that current income amount.

"Can you co-sponsor if you've done so before?" - Yes, but the co-sponsor must show on the form that they have co-sponsored before. To my understanding, the people still under that co-sponsorship may be counted towards the "number in family" of the co-sponsor. Therefore, the income would have to be greater to cover not only your fiance, but the others still covered by the co-sponsorship. So, a co-sponsor's income/asset profile must be able to support the members in his family + the persons still co-sponsored, the income/assets above that can be used to co-sponsor your fiance.
 

"Do we (me and co-sponsor) both have to file the i-134 and the i-864?" - Yes, sort of... The I-134 is for the visa only. The I-864 is for the adjustment of status later. It is my understanding that an I-864 can also be submitted at the visa stage as well. But I would personally get both signed by a co-sponsor. More important is the income level. At the visa stage, you only need to show income above 100% of the poverty level. At adjustment of status, you need to show above 125% of poverty level. Hopefully, you and your co-sponsor can show the higher level, even at the visa stage.

 

Current income would be based on your current work (calculation). Then show whichever previous 3 years you can, by the most official documents available.

 

Get a good co-sponsor.

I truly appreciate it.  I make enough and the sponsor does as well...I just have a co sponsor because I'm nervous that my w2 won't reflect that.  What should I put on my annual income line...what was on my 2012 w-2 (which is only for about 4 months of work?) OR what I can estimate from the letters from my employers?

Hello all...I desperately need the answers to these questions:

 

My fiance is in Ghana.  I have a co-sponsor.

  • Can you co-sponsor if you've done so before?
  • Do we (me and co-sponsor) both have to file the i-134 and the i-864?  
  • Annual income: 

How do I prove annual income for my given situation: I was abroad for the majority of 2012.  From November til the end of the tax deadline I was employed part time and received my w-2 for those few months.  I recently got a 2nd part -time job. No w-2 though. So would my "annual income" be what it says on my tax return for 2012 (for just one of my part-time job)? OR could I estimate my annual income by calculating my hours and wages worked a week and multiplying by 52 (w/ my letters from as evidence)

I know that the form asks for the most recent years tax transcript, but people recommend having the past 3 years. Is it a problem if I didn't file in 2011 (I wouldn't owe because I was a student at the time). I have 2012, 2010, and 2009.  OR should I file for 2011?
