Can I abandon my K3 case??? I filed an I-130 petition and a I-129F K3, if my I-130 is approved before the I-129F K3 can I abandon my K3?? How would I do that???

Yes, you dont have to nothing but you can notified during the CR1/IR1 interviews that you no longer seek the K3.
The K3 will be cancelled automatically if you let it pass the time frames. I would use my K3 interviews for I-130 if the I-130 is completed before your k-3 interview. Because most of the time you will have the K3 interviews before your CR1...goodluck!

On Monday and Tuesday my wife went to St. Lukes Extended Med Clinic and a couple of hours ago she told me that she passed her Medical Exam with flying colors. Now we are only one step away, her interview is on 21st APR, pray for us and wish her goodluck. It will be close to a year when the last time we seen each other. All of those stressed that she worried about medical was now in her back, she felt 10 lbs lighter. They took her passport, pictures, and fee of about PHp 10,500, and today gave her vaccinations paper and everything will be forwarded to the USEM. I will post a follow up on these one after her interview on 21st, April. Between now and Tues she will review and organize her documents again. Thanks to those who guided us... to many list to thanks.. will UPDATE!
congrats to you but can i ask you did she have to do a sputum test and did she have to pay for this test alone or if she did take that test is it included in the fee of $213.35. and the visa fee can you pay it like a week before the interview hope you can help thanks.

@@@ As far as I know that med exam included with everything as my wife said. Since your doing a K1, yes that can be paid through BDO before you go to your interview otherwise it will be delay for your visa cause they wanted to see the receipts that you paid the appropriate amount. Thank you, few more days before the interview as my wife getting nervous just like she did with her medical exam.

Is there something I am missing.

IR-1 / CR-1 Spouse Visa Process & Procedureswhen to send ds3032 email?
QUOTE (KeralianNY @ Apr 15 2009, 05:44 PM) <{POST_SNAPBACK}>
Great news!!!

I called and NVC finally gave me the case number for our I-130. I am planning on waiting a day or two to send DS3032 email- or should i just make my spouse send the email today itself? The young lady from NVC who I spoke to over the phone said they just received this today and she doesn't think everything is manually entered or not.

I was asked the following: petitioners name, spouse's name, and both of our DOB's

Also she took both of our email address and mentioned we should be receiving email updates regarding the case.

How would i find out when is the right time my spouse can send DS3032 email? or what's the key question that i should be asking NVC if i need to call them?

Somebody please advice!!

Thanks

As soon as you case is generated and received noticed from the NVC. NVC will not acept anything unless you have your case in the system. Wait till they give you a case number, from them, a hard copy then you can e mail the DS3032 follow up with a hardcopy to be safe. Goodluck!

Hello all,

My husband is the US citizen. We are done with NVC. He got via email my interview date 10 days ago. But I still haven't received anything by regular mail. Is it normal? Am I supposed to receive something via regular mail?

Thanks to all and good luck.

My wife and I both received the interview letters from USEM via e-mail. NVC is trying to minimize the use of snail mail if e-mail is faster. NVC soon to be changing to e-mail correspondence. REMEMBER NVC use to send us the bills for AOS and IV bill and then you have to send it back via snail mail? Now you can pay those online which saves you 10 days in processing time. ONCE NVC converts everything to electronically, it will be alot faster and some of those NVC staffers can get lay off...hehe!

QUOTE (robbyrob @ Mar 13 2009, 05:38 PM) <{POST_SNAPBACK}>
I think the petitioner(US) will only get the interview letter via email. Within the interview letter there is a link to the embassy with the packet 4 instructions on what to do next like medical, courier fee, documents, etc. Possibly once the the embassy receives the packet from nvc the beneficiary may get the instructions via regular mail also.

My wife and I both received the e mail for the interview instructions. They e-mail to my wife and CC to me... the PRINT of that email is good enough to go to the medical and interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo i have to stay in the US while applying for my wife?

Hi guys, I wanted to know if i have an address in the US, and a US bank account and a State ID, do i have to stay in the US, the whole time that I'm applying for the CR-1 visa for my wife. I was thinking, that I would apply for her then I could leave the US and go back to the country she's in and stay there a while, for example a period of 5 months or so. Then come back to the US a few months before she's expected to come. I'm using a co-sponsor, and after the i-130 form would be approved, I could have my sister send all the paper work required at that time to NVC by mail, since she would remain in the US. Does anyone know if this is fine? That the sponsor leaves the US for a couple of months while waiting on the Visa to come out?? I mean i think it should be no problem, that the US citizen leaves the country right?? Just that the Inteding immigrant is not allowed to enter the country while their visa is being processed, if anyone has any answers let me know thank you very much for your help.

You can do everything away from the US if you have someone doing your paperwork for you and have someone mailing you all the correspondences from the uscis and the nvc, dont forget the timeframe in each country.

BUT she said something which has me worried: that I need to send in the ORIGINAL birth and marriage certificates with my DS230 I+II. Really? The originals? That doesn't seem right. What has been your experience?

It says "original documents or certified copies of the documents listed in this section from an appropriate authority (the issuing entity)."

So if I have official translations of the documents, can I just send those?

We made a certified copy, send the real one to the NVC, when we have our interview we received the original back. Goodluck!

Hi all,

For the DS-230, question 20 asks for places lived for at least six months since reaching 16. The first column heading says City or Town. Is it necessary to list the complete address or just the city/town for the first column? If we specify city only, what do you do if the beneficiary has lived in multiple address in the same city?

Thank you.

We put all the proper address and got 2 PCC for the same city but different address;eventhough its like 20 mins drive diifferent.

Last week I've paid the IV bill and today when I called the NVC center, the AVR said that on april 16 they've sent the instruction package to the beneficiary. So my question is can my wife send the DS-230 with all supporting documents before she receives the Instruction package? Also I haven't mailed the AOS (I-864)package yet, because I'm not sure if I can do it as soon as I paid the Choice of agent bill or do I have to wait a notice from NVC when to do it?
Does it matter if i send just the employment letter, copy of last 3 years tax returns, copy of W-2's just for 2008, but no pay stubs? Are they going to ask for RFE?

Many Thanks .

@@@ Send your PACKAGE only if your case have been GENERATED, if you send it to soon, it will take longer because they have to put it manually and find the right desk. Having a barcodes make it easier for them to place your case in the right person!

Why are their sending packkage to your benificiary, she didnt choose the agent? If the benificiaru chose the petitioner as the AGENT, it saves alot of time. You can e mail the Choice of Agent to the NVC...

I hope someone will be able to clear out my confusion. I have read the guides but still...

okay..first of all, my sister (who is US citizen) applied for my other sister (married, husband and a kid) who is in India.
So far they have sent choice of agent, I-864 to NVC. Now they are ready to send out ds-230 to NVC (from India)

below are the questions that I had..

1. on the ds-230 instruction it says dont send any documents along with yr ds-230 while some of the posts here ask about what to send with ds-230?

2. there are two parts to this form. Do they just need to fill out part-1 and leave te part 2 empty and sign it when they go to their interview..??
or they need to fill out both parts and not sign it.(section 35)

Any clarification in this matter will do great...!!!!!
Thanks for your help in advance...

Before I can help you I need to know how far along you are. Have they generated your case yet.
Yes page 2 dont sign cause you sign those in front of your interviewer.. stated under oatht that was the person. You send the DS230 along with the forms that is needed with it, here is my example... because if you send one at a time, it will take longer and u will be ask for RFE, Req for Evidence.... goodluck! Why sending eveything from India, choose the AGENT from the USA, make it faster and easy to do paperworks and save time.

question number 21 on the I-130 form ask: If filing for your husband/wife, give last address at which you lived together.

I was going to write this in: RECENTLY MARRIED; ONLY HOTEL STAY, DURING MY TIME IN THE PHILIPPINES

We were just married there on 3-30-09, so we never really lived together, only the weeks at the hotel together.

So, should i list the anser above or would it be better to just put N/A, or something else?

Thanks much

I filed an I-130 for my wife, I thought that i didn't need to file one for my step-daughter ( yes I mis-read and understood the instructions, I though she would have deriviative status on the i-130 but that is only on the i-129)..
Now do not know if i should file an i-130 for my step-daughter now, 90 days after filing the I-130 or file an I-129F assuming it will be faster than waiting for my Step-Daughters i-130 to be approved.

So what do you think.. should I go ahead and file the i-130 for my step-daughter and just wait ..
or file the i-129f hoping it will be approved faster than the Step-daughters i-130

If I file the i-129f what documents do I need. The instructions are a little confusing... """You must submit the documents required in Items 1, 2 and 4 of the instructions, but may omit the documents required in Item 3.""""" but I am not quite sure what those items are.. I called the help uscis help line and they didn't know either..LOL

Hope all that makes sense and hope someone can offer advice...

You must as well file her paperworks or wait till you get your NOA1 and use that case number. For every person you want to come to the US, you have to file seperate for them. Goodluck!

On Monday 13 Apr and Tuesday, 14th, my wife went to St. Thanks to those who guided us... to many list to thanks.. will UPDATE...

Today my wife got up about 345 in the morning to get ready for her Visa Interview. She got there about 6 am, got in the line, inside, given number, filled up the form, waited to be call and when she was called by her name, it took the CO about 5 minutes to do her interview. She was told that he (CO) thanks the armed forces for doing what they do, told she was APPROVED, given the pink slip and she then paid Php 220 for Air21 and jumping and yelling to get in the taxi. She called me right away after she got home to her friend's house where she decided to stayed instead of the hotel. The money I gave her to pay for hotel used to MAG GALA or visit the Manila which I told her to do. Glad she did now waiting for May 8 and we will be together again. I bought the 1 way ticket in March for $ 910 but she told me she could have got it for $ 775 but HEY as long as she gets here, $ 200 more is worth it for the fare just to be with her.

I thank GOD for everything, thank everyone here that supported me and gave me guidance. Thanks all, you know who you are.... MMW,que, merle, happy, and the rest of the VJs. For those whos waiting, there is a light in the end of the tunnel... it will be good to know that our 1st Anniversarry we can spend it together.

congrats!!

btw, did you pay for the vaccine or is it included in the Php10k?
and any idea what questions were asked??

Thats one of the reason the fee webnt up because of the MANDATORY vaccines. What question to ask, medical or interview? If its medical they pretty much like ROBOT, they do everything for almost everyone... nothing you should worry about unless you tetsted positve on TB or other stuff or x rasy need to be redo.

Hi all,

For the I-864 submission, do we need to submit the tax return for 2008 with original signature, or can it be a photocopy of what I submitted?
Can I also mix and match, I plan to send tax transcripts for 2006, and 2007 and my tax returns for 2008 (since it's too early to get a transcript.)

Thanks!

Yes you can send 2 transcript for the 2 previous year and the tax return for this year as long that you have supporting documents for your financial income. Photocopy is fine , thats what I sent them and have no issue. goodluck!

Give them a chance to put your case in the system, once your case is GENERATED then you need to get everything ready as it will go fast from here on. If you have anyhting need to be signed, sign them and do not dated it till its ready to be send. Get DS 230 ready, PCC, MC....etc whatever applies to your case. IR-1 / CR-1 Spouse Visa Process & ProceduresWhere an I look to see touches on our case. . . .
QUOTE (Kittykisses73 @ Apr 29 2009, 07:55 AM) <{POST_SNAPBACK}>
I have a question!?!?!? Everyone talks about seeing "touches" on their cases and I am wondering if I am looking in the right place.

I login at the USCIS web site where you have to put in "Customer" from a drop down menu, and then our login name and password.

Is this right? I mean is this where you all see touches on your cases. We only show that they received the case on March 4 2009, they do not show that we received a biometrics appt notice, and they do not show the RFE we received. I have called several times as well and that doesn't make touches show either blink.gif

I just would like to know if I am actually looking in the right spot. I know everyone states that they don't keep the system up to date very well, so I was hoping that maybe I could look some where else. . .

Any help you can offer would be appreciated.

When you see "TOUCHES" means that someone have the time to be place the updates info in your case. Some people will get APPROVAL with no "TOUCHES" n\and some get " TOUCHES" after the APPROVAL. It's not reliable information but if you get "touches" means hey you got case reviewed. Goodluck.... NO other message will be place in "touches" except the date that someobne works in your case and they wiull not be on a specific details. All "TOUCHES" means someone look at your case, what they did, who look at it, what do you need will not be place under the "TOUCHES" updates, just the DATES only. I hope this help!

By the time of his interview, it'll be 425 days from the day we filed the I-130. Whew, what a long journey! But it's well worth it! smile.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresCousin denied visa
QUOTE (crazysamurai @ Apr 27 2009, 04:17 PM) <{POST_SNAPBACK}>
My cousin recently stood in for immigrant visa in Mumbai Consulate in India and they DENIED him the visa......Here is the timeline of what and how it happened. Can anyone from VJ community help me understand why this happened and most importantly....HOW TO FIX THIS.....

1. My uncle was a green card holder and he applied for his son to come here on Immigrant visa. At that time his son was over 21 but NOT married. So his visa category was "Adult Unmarried Sons/Daughters of Permanent Resident".
2. My uncle became citizen in 2004. So, he "upgraded" petition for his son so he can come here faster because of him being US citizen now.
3. My cousin (my uncle's son) got married.
4. My uncle submitted his son's marriage cert. and later (upon birth of his grand child), grand child's birth certificate to add them (wife and son) on his son's petition as dependents.
5. In 2008, NVC approved the case. DSL forms were sent to my cousin in India. My cousin paid necessary fees (choice of agent, IV fees, etc.) and filled out DSL forms and sent them to NVC.
6. Mumbai consulate scheduled a visa for him (my cousin) few days ago.
7. My cousin went to get visa with his wife and son.
8. Consulate denied him the visa because they said: He got married before my uncle became citizen, so he can't come under this category now.

After all these waiting for 6-7 years, they (NVC, USCIS and Consulate) NEVER found any issue with this application and now they are finding problems when he stood in for his visa interview....THIS IS SO INSANE....PLEASE HELP....

CS

The big mistake I see on this CASE is that your cousin got married and now belongs to another column of visa request. I think he is now priority 5 because he got married and now an adult. That will take from 6-10 years. Your cousin PRIORITY is the least on his case... son/daughter under the age of 18, wife/husband, is sample of the priorities... to bad!

I was reading through here and I was curious as to how some of the people for the ITIN did their Power of Attorney. Did you get it notarized in the US or in the foreign country and then translate it into English?

I don't know if it was mentioned before but on page 2, right hand side, very last bullet states if your country is classified under the Hague Convention you can send a COPY of your passport

Here's a link to the Hague Convention to see if your country applies.

Also do you have to show SO income?

I FILED MINE SINGLE BECAUSE OF THE TIMING AND THE W7 TO GET MY WIFE TO MAIL IT TO THE IRS AND I WANT TO MAKE SURE THAT IT WILL MAKE IT ON TIME. I WAS ADVICED TO AMMEND MY IRS RETURN ONCE MY WIFE GET HER OWN SSN. SO IF I GET STIMULUS CHECK THIS YEAR AS A SINGLE, THEN WHEN AMMENDED MY STATUS TO MARRIED THEN I WILL GET THE OTHER HALF IN A LATER TIME.

hello everyone, please, someone who can explain well.

My wife and I knows each other from 2003, she was intruduced to me by my auntie who is her co-worker and I am working in Saudi Arabia since January 2001. We spent almost 5 years of our relationship without seeing each other. We had the plan to meet each other by 2007 but we didn't because it's hard for her to get a replacement in the Hospital but we made it on June 2008 when I resigned to my previous job in Saudi and that was the first time we saw each other. Due to the time limit for she has only 31 days to stay in the Philippines, we made everything rushed just to get married and also I got my new job in Saudi once again and anytime soon I will be leaving to Saudi. We got married on July 11,2008. July 27 was her return to the States and the date that I will be leaving to Saudi Arabia.

We didn't spend much time with each other during our stay in the Philippines, do you think it will be a problem during the application of my petition? unsure.gif

No, you shouldn't, we have almost have similar case. I went to PHIL for 30 days because thats the only days I can get off from the army, we did rushed everything and nicely talked to some people to take their seats for small fee for the required class/seminars. WE made on time, got married, 3 days honeymoons, she stayed in PHILS and I went back to US, filed her paperwork and 10 months later she is here with me.... the 10 months later was kinda s@#! but she is here now for good.

Your petitioner can fill up the forms but the benificiary still need to make the petitioner, if choose to, as the AGENT... the DS230 will be sign by benificiary and forward to petitioner if he/she the agent of choice.

if ds 3032, is what your asking, you can emial the NVC indicating there whose your agent and the address of your agent the beneficiary must be the one to inform the NVC about the choice of agent.
