K-1 Fiance(e) Visa Case Filing and Progress Reportsour visa got approved
hello all,

Initially, I started my journey posting questions about my K1 visa petition being too complicated as it is. The first post I had was about filing a K1 visa petition as soon as getting divorced. With it, after I stated my case, I got all the haters, without even thinking whats the real deal. Let me give you guys an idea on what was our situation before today.

My fiance was married to a Filipina for 8 long years. They have a 6 yr old kid. He petitioned the first wife 2002 with an IR1 visa category. In the middle of the petition, my fiance met me me, around 2004. We started chatting online, since we were only introduced thru MySpace and finally met July 27, 2005 when he visited philippines that time. I knew about the marriage but he said they are longer together so I continued with the relationship with him. When he went back to US after that 1 month visit, I learned that they are still together and the petition is still running. That moment that I knew that they are still together, I broke up with him and the next day I knew i was pregnant with him. I continued with the baby, gave birth April 25, 2006. When my baby turned 3 months, I filed for a CRBA for him and it was granted and now he is a US Citizen already.

IR1 for the wife got approved March 2008 and left for Hawaii on April 2008. My 'fiance' continued with the petition because he thought the relationship with the first wife will be fixed once she get to the US. My fiance went to Guam and not flew to hawaii with her because he got an offer for a new job and a business around end of March. As you notice the petition took alot of years and the first wife already had the plans all set and dont want to go with him to Guam. THe whole plan was for the wife to go to Hawaii and my 'fiance' try to go to Guam and check out the life there. My 'fiance's ' business went well the same time as the wife got a stable job in Hawaii. He wanted her to come over to Guam with him and unfortunately, they started fighting over it and resulted to divorce. My fiance filed for a divorce on July 2008, that was 3 months after the wife got to the US.

My fiance decided that after the divorce, he will petition with with a fiance visa petition. Divorce was granted Oct 3, 2008. My fiance filed for my K1 visa on Oct 10, 2008. He went to Manila for 5 days and proposed to me on October 15, 2008. I am all worried about our case bec he just got divorced and the ex wife just got to the US. I know that it will be a red flag for them. But we still pushed thru with it as we really have a bonafide relationship with trials and mistakes along the way.

We were also worried about his income when we'll have my affidavit of support since he got there in the middle of the year meaning it will be hard for him to earn income good for 6 household. THat will include the ex wife, their kid, me, our baby my first kid and him. But his business suffice the income and made 35k for 6 months plus savings. so were ok with that.

People here thought that we are having a VISA Fraud with my case and will cause the first with to be deported and me being denied on my interview. Let me tell you guys that I JUST GOT MY VISA APPROVED, for one because we really love each other and our relationship is genuine. Mistakes happen, we are just people not perfect as it is.

His mother and stepfather are willing to sponsor for us. I sent an e-mail to one of the consulates in Brazil, they won't take phone calls. I hope I get an answer, cause I could not find anything on the website.

Yes Just file I-130 and if she becomes a Citizen she can have it upgraded, wait time is many years so dont expect any results for a long time They are just issuing visa's to people who had an approved I-130 from Dec 1997.

what happens if he becomes a US citizen while he filed an I-130 petition when he is with a 2yr greencard that will be a 10 yr greencard after he adjust his status?

i see that people with greencard that petitions sons/daughters are faster than a US citizen filing it now. Since they are now giving F2B (Unmarried Sons and Daughters (21 years of age or older) Children, and Unmarried Sons and Daughters of Permanent Residents for those who filed 01 DEC 97 and for F1 (Unmarried Sons and Daughters of Citizens), they are now giving visas for those who filed 15 JUL 93.

Hi,

Would like to know advice for my friend. She got here as a spouse of a USC with a 10 yr green card and got divorced last year. She still haven't changed her SSN card, alien card, state ID card nor passport yet. She doesn't know where to start. On her work, she claims married yet she is single now with 1 dependent (her kid with the USC). She will get married next year with another man. She wants to know what's the best thing to do as far as changing her status. When you change your name and file it at USCIS, you filing fee is $370. then you pay for the passport that will show the maiden name thats $50. then change the state ID, dont know how much and for the SSN card, don't know how much too.

We want to know, can she file it next year when she gets married so that when she files it, it will show her new last name? How about her SSN? she is supposed to be single on her return with 1 dependent, can she just go to SSA ofc and change her status there? How much is it? And she just file for her New Alien card and passport under her new last name later on? Please advice.

Hi,

I applied for the child care payments here in Hawaii for our youngest son but still not signed the packet they sent me. I am still in doubt to push thru with it because I am under CR1 and Im thinking if that is like a violation against the affidavit of support that my husband filed for me. Considering that is a funded by federal government. Am I being a public liability and just dont apply for child care payments? Hope you guys can help. My deadline of submiting the packet back is before june 1st thanks

Quite likely, but you should still check with a lawyer to know all the legal options.
You can always move to her country to be with her if nothing else seems possible and if you both want to be together.

I would suggest that you have your Guam divorce decree confirmed in the Philippines so that it will be validated there. That is the recent rule now when one of the parties to the divorce is a Filipino citizen. Unless you do that, your ex-wife will remain married to you and if the USEM would conduct its own verification, such fact would appear.

My second question is, about her point of entry. i filed in the guam sent it to CSC but i was wondering if can her point of entry be in new york or in hawaii, not guam?

It could be true love for you this time but you still have to prove it to the USCIS. You do have a uphill battle, if you have any, with your situation. USCIS will not just go by 'but its for real this time', they will check your past and your petition history and a lot will depend on that to say the least.
You might want to research a lot more, take legal advice and check for eligibility etc and not just look for 'you'll be alright' here on VJ coz frankly its a very messed up situation.

I think this statement and the timing of your actions is going to place you in the position of having to prove you did not commit visa fraud with respect to your first wifes IR-1 and that by filing for the K-1 for your gf you are not attempting to do it again....

More bad news... since there is no divorce in the Philippines you and your wife agreeing to file in guam could be also considered fraud to get around the fact that she cant initiate a divorce, so its possible you divorce mmay not be recognized in the phils and it may be that you are not free to marry which is a condition for filing the K-1.


i am a US citizen before i married my ex wife. so as an american, and since i was the one who filed for the divorce, it should be honored here in the philippines. I just have to go to the US embassy and bring them the copy of my court orders and send it to the NSO office here.



You should check with your home state regarding your divorce in Guam, as it is probably voidable, as it was done to circumvent the laws where you are a resident. If it is voidable, then the USCIS may not recognize it. In California, it is family law 101 that any foreign divorce is worthless if you never intended to leave California.

By sponsoring your new gf for the K1 you could lose both of them. The first one because it is a visa-fraud and the new one cuz' you will be denied cuz' of the visa fraud with the first one. If you explain like you said, the case to the immigration, it will be another proof of visa fraud, bc it is exactly what you did


look, i honestly mean that this is real. i didnt commit any visa fraud. bec everythin was all for real! i didnt planned to do this to my first wife. in fact i filed her IR1 visa even before 2004. I filed it 2002 and I have to reactivate and write a letter why was i wasnt doing anything with all the notices that they have sent. i always go to the philippines and i didnt realy know how my petition would go. it was again active on 2004. so this means i cant be with my girl forever?even if everythin is set for reals? i know it is hard but i need advice as far as making it it easier for us like would it be advicable to be on the day of the interview? things like that. i really feel bad because im trying to fix my life now since it was really a mess to start with. now that everythin is running smoothly, i feel that i dont have any other choice but just to suffer not bringing my 'love of my life' in the US. sad.gif sad.gif

the hardest thing because its not. its real! i guess it'll be a hard interview for her but i guess we just need to tell the whole story from one point to the other. any advice? should i make a flowchart or something and bring it on her interview or something? would it be advicable to be with her during her interview?

me and my mom. i had a joint sponsor as i was not making enough money that time. for my fiance visa petition , understand that i cannot have a joint sponsor only my income is allowed right? so i opened a business in guam that makes enough money.

thanks for the reply.

when i filed for the affidavit of support for my ex-wife, i had my mom as my joint sponsor on that. the poverty guidelines that i am considering includes her (ex-wife), my son with her, my new girl and my son with my new girl me and my new girl's derivative as a k2 visa holder. that makes it 6. and my income tax return shows that i am making enough money. i didnt mention that i filed for my son with my ex wife's citizenship here in US embassy manila and it was approved. Tho it was a bit hard bec the consul questioned if that was really my son and had some DNA test but passed. technically, i had 2 sons, one with the first one who is now a US citizen, second would be for the second woman who is now a US citizen as well.

During first son's application for citizenship, my ex wife was asked if she knew all about my new relationship and that started the consul's requirement for DNA test before approving my son's citizenship. I admit, i made a mistake but is now trying to fix them all up.

I am a US citizen and was married to a filipina last 2000.i filed for her IR1 visa on 2004 and she got her visa and left for the US last april 2008. i met another filipina last 2005 and got a baby with her (who is now a US citizen btw). it was all because i fell in love with the new filipina but still continued for my first wive's IR1 petition. my first wife has forgiven me after everythin that happend and things are going well among the 3 of us. we hav agreed to get divorced the moment she gets her SSN. now that she has her SSN and now working, i went to guam last may 2008 and filed for a divorce after a month of staying in guam. i got the court order that we are finally divorced last august 2008 and immediately filed for the k1 visa for my new girl. we got the NOA1 last oct 29,2008 and went back to the philippines to stay with her for a while again. got in the philippines last nov 4, 2008 up to the present. my question is, would there be some complications as far as being with my new girl in the middle of my first wive's petition? i got divorced before filing the K1 visa petition but our relationship is active since 2005 before my first wife got her IR1 visa.

My second question is, about her point of entry. i filed in the guam sent it to CSC but i was wondering if can her point of entry be in new york or in hawaii, not guam?

I hope i can get answers from you guys. i know our relationship is really interesting and kinda messed up but were going thru it.

Hi, I am currently waiting for my case to be sent here in manila since it is stucked in NVC since january 20, 2009. My fiance might have the same case as you do. He was married to his ex-wife for well over 8 or 9 yrs already. They got married here in Manila, he petitioned his ex wife last 2004 and got to the US as legal permanent resident, 10yr green card. (IR1 Visa). Me and my fiance met in the middle of his petition to his ex wife and had a kid with him. He tried to work their marriage out by continuing his petition with her thinking things will change when his ex wife gets to US. When the ex wife got her visa, she decided to fly to hawaii after a month of getting it. Before she got her visa, my fiance had a great offer from his uncle from a different state to try and open a business there. He took advantage of this business opportunity and went to Guam after acquiring his stuffs in manila that he will use with his new business. While his ex-wife was in hawaii, things never changed. My fiance said she's still the same as what she was before, keep on nagging,yapping on him that he couldnt stand it anymore. He is starting the business that he knows will be an opportunity for them but unfortunately, the ex-wife didnt understand and all she thinks is just herself just how she was before. things never changed and that is why my fiance decided to just get a divorce which they both agreed and fixed the custody of their 6 yr old kid. After he got the divorce decree, he filed for my petition and was approved. Now case is in NVC and hoping to be here in the next couple of weeks since we are on administrative processing ( which I know sucks ) because its another wait.

Anyway, good luck. as soon as I 'm done with the interview, I'll message you. There was one case also that is like this. it was from 'Billy' here in VJ. For as long as you are free to marry and can provide proofs of bonafide marriage, you should be all set. But then again, you might be asked, what happened to your old relationship, where is she now and will ask a lot of questions about your current relationshiop.

my case is still at NVC stucked in administrative processing. However, the NOA2 i received will expire this may 2009. Would it be okay if I complete my medical next week while waiting for my case to be sent here in Manila from the NVC? I'm really thinking that just in case we would have to do the sputum test that takes 2 months, I have ample time before my approved petition expires. Also, I wanted to do this medical next week March 2 and 3 since medical here in the Philippines takes 2 days, and that is the only best time for my 6 yr old kid to be absent from her school compared to the next coming weeks as it will be her examinations week already. we have the same case as yours. My fiance right now filed for a K1 visa for me last Sept 2008. He was married with his ex wife last 2000 and we met in the middle of his petition to her ex wife (IR-1) visa petition that was july 2005. His petition to his ex-wife was approved last March 2008 and is now in the US. The reason why he still continued with the IR1 visa for his ex-wife because he thought that when her ex-wife gets to the US, they can fix their relationship just for the sake of their 6 year old son. However, things got worst when she got there in the US and they finally agreed to get divorced.

My fiance filed for the divorce last June 2008 and he got the final decree on august 2008. He had a baby with me who is now 2 yrs old and who is a US citizen already. We were technically together when he was still married with his ex-wife. We have proofs of emails, remittances, packages sent to me and packages that i send him, pictures plus we have a baby! Mistakes happen and when his wive's visa got approved, he tried to work it out with her and check if things will change when she get to the US. He was originally based in Hawaii so when he filed for the ex-wife's IR1 visa, it was in Hawaii, so the ex-wife is now in Hawaii. The ex-wife flew to Hawaii last April 2008 and my fiance was left here in the Philippines to take care of some stuffs before he flies back to Hawaii with her.

His uncle in Guam offered him a job in Guam that is until the end of the year. (it is an advertising company that takes care of the ads for businesses that will publish ads for 2009) and a business that he could start there and it looks promising to him so instead of flying to Hawaii, he flew to Guam to save more money to settle in Hawaii with the ex-wife. The whole time that he was in Guam, busy with the new job and the business, it made their relationship worst! He thought the ex-wife will understand the situation since he will just work with the uncle for just a year and try to have a business on the side.

So they both agreed to get a divorce so my fiance filed for a divorce in Guam since he is a resident there already and got the decree as I've said last August 2008. He flew back here in the Philippines last week of August and proposed to me. I love him so much that I didn't have no doubts of saying YES. He filed for the K1 petition for me last Sept 2008 and now is with the NVC. I'm hoping also that we could start a new life away from all the mistakes he had in his life.

when your I-129F petition is approved, then you apply for the K-1 visa at the US Embassy in Manila. The fee for applying for a K-1 visa is $350.

They are two separate fees.

And yes, a separate $350 is paid for the boy's K-2 visa. Is the boy listed as an accompanying dependent or as follow-to-join?
