K-1 Fiance(e) Visa Process & ProceduresIs it me or is Vermont now taking FOREVER???
The first thing USCIS does when they receive your petition is give it a number, then cash the check (money is obviously all they care about), then they put it at the bottom of the pile. this drives us crazy because we check the USCIS website every 23 minutes, looking for a change. If only they would wait to cash the check when they are actually working on the case. This would give everyone a much better idea of what's going on. We'd be able to see the progress more clearly just by knowing who's had their checks cashed. And it would keep us away from the USCIS website where we all get frustrated. so, give us a receipt number, give us an NOA1, but dont cash the check until you are actually working on the case. This is just my opinion. I think it would give us a progress report without those little government workers having to say anything to us. Don't you think this would be a good idea? But all they want is the green. Money money money. They raise the fees and what do we get....even more uncertainty and longer waits. If this were a private business it would have ended long long ago.

K-1 Fiance(e) Visa Process & Procedureswhat would you do
Frown upon what? waiting until after you return home to continue your process? I don't understand your question. Are you worried that something will happen with your case between now and the trip? You are due soon to have an answer from USCIS. I think your concern is whether or not you should go to Houston when your NOA2 is due anytime. Personally I wouldn't be worried. Your petition will be sent to NVC, then to your embassy. If they send you a package from the embassy and you wait some days before returning it, they won't frown upon this. I think you may have issues at your POE, but from what I've read there are successful visits. If you know the risk, you should probably buy a ticket that can be changed, just in case. Don't know if this helps, or if I understood your question...

K-1 Fiance(e) Visa Process & ProceduresWhat do I do next?

No offense, but what have you been doing all this time?? You should have been trying to adjust your status. You might want to get a professional to help you.

None taken, but there's been a few personal hassles at home here that I've been trying to care of. Long story short, there's 8 people living in this house and a few of them are violent. I do accept that it's been my fault for not getting things more organised.

Sorry to hear that. Sounds like your spouse and you need a fresh start. There will be good advice on the way, I'm sure. Good luck.

I'm sorry but you people can be really rude. Maybe this person isn't a troll, maybe he/she just didn't read completely. Maybe they have a learning disability, who knows but who are you to judge. We are all going through this and it isn't easy at all. No question is a dumb question and if you don't want to read/answer it then just don't. There is no reason to make someone feel bad for asking a question. God knows I've asked at least one dumb one since being here. Sometimes your fingers rush ahead of your brain. So constructive answers or keep it to yourselves. I know it might be hard.. perfect people who never ask dumb questions or make mistakes...

If one cannot read (and follow) the instructions of a simple form, they have bigger issues than getting flamed on a messageboard.

And if they have a learning disability or some other legitimate issue, do you really think it constitues a wise decision to take responsibility for filling out this type of paperwork? If that were the case, I think it's safe to assume he would have gotten some assistance - free legal clinic, lawyer, friend, family, etc. Come on

I can't believe this is happening. This is OBVIOUSLY a joke. No one with a handicap that prohibits them from comprehending this process is going to be doing this alone. If this is real....immediate denial. No question.
That guy is long gone. My bet says it was even a bogus member.

I immediately thought this was a joke. but it was a little funny to see how everyone pounced on this thread with force. And with the quickness too! If this poor guy was serious, there's no way he's coming back now! but I agree I think it was a phony question to give us something to do. Some of the replies were pretty funny, harsh .....but funny.

I filed shortly after my divorce was finalized. and i even had an active petition filed on behalf of my exwife. I'm praying that they will not bump into each other as one is being canceled and the other is being reviewed for approval. As long as you are legally able to marry, you are eligible.

Good luck to you Cshaw101! You are one of a few August filers that I've seen here on VJ. I think you will be one of a few since everyone tried to beat the price increase. In a way, I think this will work to your benefit in the long run. You know, I dont think I've even seen an official August filer thread. Odd, considering its the end of August. HHHmmmm.

Every time I see threads like this I get sort of jealous. For certain countries like China getting a tourist visa and having my fiancee come here to visit isn't even an option on so many levels, but the main one is she'd never get a tourist visa in the first place.

If she were from a more 'acceptable,' country that the US had friendly relations and issued tourist visa's on a regular basis I'd love for her to come and stay for a few weeks/months and would definitely encourage her to do so.

I know what you mean. Sasha is from Russia and its nearly impossible for her to come here and visit me on a tourist visa. Actually, it is impossible. So, I need to keep going there. It sucks that she doesn't have the same liberty.

Can I ask WHY? What would the aunt gain from this deceit?

I was wondering the same thing. Perhaps her "auntie" lives in the states and was previously seeking a way to keep the neice (the beneficary in this case) in the States. Fraud, basically. That relationship obviously didnt work out. And I'd be willing to bet that there was a previous K3 style visa in the works back then. If the USCIS senses this from her past, there's no way they will approve a new K1 for her. This is a huge mess. i'm so sorry for the OP, but this just doesn't sound legit. Wow!! This is horrible problem! How did I miss this thread for sooo long?

Not sure if I'd just offer up information like this letter from the pastor who will marry you later. I wouldn't even mention anything like marriage. I'm not saying lie, but dont cough up more info than is necessary. No?

Hello to everyone!
Really got confuse on that and dont know what to think! My petition in California center,NOA 1 from 7 may 2007(it,s more than 4 months now),but yesterday boyfriend said to me he received one letter from USCIS...they want some more paper and 450$ to pay.......what is this???? Who have any idea...really need help!!!!!!!!

Is it possible that your fiance forgot to include the $170.00 fee when he filed back in early May? The rates changed. As of July 30th the new fee is $455.00. But if he forgot to pay, they should have rejected your petition or requested the money soon after receiving it. Did you personally see this letter from USCIS? You can check the status online with your case number and actually see this letter from USCIS. If I were you I would ask him to give you the case number and look into this. Sound s alittle odd to me. But maybe not...Good luck to you, though.

K-1 Fiance(e) Visa Process & ProceduresFree to marry??
QUOTE (TexHerts @ Apr 6 2007, 11:12 AM) <{POST_SNAPBACK}>
I have a small question here regarding the 'free to marry' aspect of the visa.

Both of us are in the process of divorces and we have a question.

As she is in Texas she believes that once divorced that she has to wait 90 days from the date of her final decree before she is able to re-marry.

Does this law still exist? (her parents had to do this 20+ years ago)

Does it mean that if it still exists, that she cannot actually apply for my visa until her 90 days is up?

Thanks

If you're in any country and wish to enter an American Embassy or Consulate, you must first show identity in the form of a passport.

Not true. Perhaps it is in their guidelines, I don't know - however I went to the Calgary Consulate at least 4 times and never once showed my passport (and neither did my Mother or my Husband who went with me at different times).

Furthermore - it would be really tough to show your passport at the Consulate/Embassy if you were applying for a Passport.

Hmmm... I thought that you were only permitted inside without a passport if you've lost it or for other emergencies. If you can enter a U.S. consulate in canada casually, without one....that's news to me. And I'm sorry for giving bad info. I'm only speaking from my experience in approx. 5 European US consulates.
