Fall 2006, met and fell in love with Dora as she was visiting on sabatical in the USA
Dec 1. 2006 Returned to Hungary
Jan 18, on return, denied at POE. She admitted she worked illegally at the end of her last visit. 10 Yr. tourist visa cancelled. Devestated.
5/5/07 After all papers were translated, married Dora in Hungary

5/18 NOA1, I130 CSC
7/12 NOA1 K3 CSC
12/19 Response to service request. "The processing of you petition has been delayed becuase the results of your background check remains open."
1/6. Still silence

My lawyer, FBI, USCIS can tell me nothing. What the heck is going on?

Everyone here knows how your feel, even though our parents who have known us all our lives, cannot. Please get a lawyer, at least to make sure you file the I-129F(k3) correctly. By the time you get your 130 and K3 processed, if you visit here you will slowly realize how large of a process this really is. But the IMPORTANT thing to do is get the 130 and 129 filled out perfectly.
As for the reciept notice, my lawyer uses here online bank. Listen to this.........
SHE SAW OUR CHECK FOR MY 130 WAS CASHED, SO SHE VIEWED THE CHECK ONLINE AND THEY STAMP THE CASE NUMBER ON THE BACK OF THE CHECK. Sometimes you can't read it, sometimes you can. I went to the uscis page and searched the case number and it was correct. We filed the 129 right away, even though i did not have a physical notice.
Sounds like is saved time? Well, that was 8 months ago and my case is stuck in "background check" for 3 months. I was adopted so i was born with one LEGAL name, but grew up with another. They have to check every possible variation to make sure i am "clean". It was not my fault that my father died, but i am now paying a differnt price for it.
James you will get upset like this more times in the future. READ the stories of people here. You will find great insight, mistakes, sorrow and complete joy. When i get depressed, (and i do), i try to make sure this suffering purifies my love for Dora, not destroys me.
I really hope you invest in a lawyer, at least initially. You can contact me if you want mine, or search your area. The great thing about immigration is that you do NOT need a lawyer next door. After all it is federal law.

Our case is in the hands of the FBI. All my immediate family has applied for "constituent services" with their Senators and Congressman. I imagine their response to be. "It is a congressional mandate that USCIS can NOT process a case (towards NOA2), until the background check is complete.
Our response will be "D'uh!, we know that. Our question is IS THE FBI SANDBAGGING ON OUR CASE?"

Once the check is complete, i imagine the NOA2 w/in 1-2 weeks.

So, since NOA1 of the 130, we are 7 months 3 weeks.

I can afford to fly to visit Dora in february, but i have no one to watch my 3 young children when i am gone.

At the bottom of your online case portfolio is says words similar to this, "you case may show an update, but it may not result in a different case status. This is likely due to standard USCIS INTERNAL processing.

Update,
Both of my Senators and Congressmen have sent inquiries through "constituent services" to inquire what is going on with my delay (stuck in background check.) Furthermore, my family has also contacted their elected reps since Dora is now a relative.
I spoke w/ one of my case workers w/ Senator Nelson on the phone and he was cool. He told me that even though i KNOW my case is stuck in FBI, his first contact is with USCIS. I imagine that USCIS will respond "FBI has it, not us". Then he sends the whole inquiry to the FBI and they in turn must reply.
I do know that these numerous inquiries will at least get some attention to my case. My case worker told me that his experience is that a case like mine, (background checks) sometimes get put in the "difficult pile". Since production is most important, they crank out the "easy/normal" checks as fast as possible. Cases like mine sometimes get stuck in a different pile since it takes longer to clear a case like mine. Perhaps this is my situation and it may motivate the FBI to get mine processed. I'll keep you all posted.
Otherwise, i wish you all peace, strength and blessing from God.

I am no different than you in devotion. My day begins with thinking of Dora and going bed as i fall to sleep, her name is the last thing that passes from my lips. Timelines mean nothing to how we feel of our soul mates.
I am almost 40, the father of 3 children and my 16 year marriage failed of my faults and the demons of my ex's chemical problems. To find a woman as Dora is unthinkable. She is a wonderful model of strong, intelligent and honorable femeninity. I would pass through the gates of hell for her. I know how fortunate i am to be granted a second chance to have an intact family.
I am curious, what is the status of your 130? Your timeline drops off in Oct. Otherwise, i pray that God strengthen and bless your love. One day your journey will end, and we all know, that darkness cannot exist in the light.

Well, with my priority date of 5/5/07 (I-130) and no touches, no RFE's, i now have case workers from both my Senators and my Congressman. I also email the President and First Lady (email is free, why not). No one can yet tell me why my case is so far behind in background check, Dora and I already know in the end it will be clean.
But great news this morning, on webcam i asked Dora:
"Baby, what are you doing on Feb xx in the morning?"
"I am working baby."
"Shoot. Do you know of anyone else who can pick me up at the airport in Budapest?"
Dora completely fell out. My crazy ex-wife will watch my 3 kids while I visit Dora for a week. I don't see the end of my case w/ USCIS, but at least i know i will see Dora. AND SOON!

I feel with you. I am finishing day 251 since my 130 reciept date,stuck in background check. Go to your Senators and congressman's pages and look for "constituent services". You should find a "privacy act statement" that you must print and sign. This will empower your reps to get your info from another agency.
Enclose a DETAILED letter with the KEY points of your case. After about 10 days you will get a letter from the rep, "I have contacted the appropriate official as to your case......"............ Then call the reps office and find out the NAME of your case worker and listen to them.
I em in this stage. They are all "pushing" as to what the hell is going on." But in the end, I know our love is so much stronger than this broken process. I for one pray that God grant you the strength to endue this terrible moment and come out stronger.

Thank you for your kind words. I called everyone today thanking them for their prayers. Also, my 3 children are excited that Dora may soon be with us. Only WE can understand the pain and joy of this process. I pray that all of you have speedy processing and that those who are reunited may have their love pruified by this painful process. As Pope Benedict said "If man only understood the value of suffering, he woule pray for nothing else." All of us, in our suffering have seen our love go through the fires of hell. But in the end, darkness cannot exist once you shine the light on it. Please continue to pray that i continue to purify myself to be a great husband for Dora. Hmmm. 2 weeks ago my case worker with me Senator said "my contact with NVC's congressional unit say we have the case", still when i call NVC they cannot find my case. But 2 weeks may be a bit much to ask.
All i know is that 2/14 i fly to visit Dora for 1 week. I booked the flight long before the NOA2 but was scared i would see her cry in the airport upon my departure again. That fear has been greatly diminished since the NOA2. So now, when i depart it will be more of a "see you soon", than "goodbye????".
My children have all made Valentine's cards for Dora and I am so touched because they did it on their own. Dora already calls them "my babies". We are so excited to see eachother again and just do NOTHING for 1 week.

Hi Everyone,
Day 4 in Hungary with Dora. We spent 2 wonderful nights at a spa hotel on Lake Balaton, i had never done the spa-sauna-steam room-walk on rocks deal. Now we are back in the country at her fathers farm, just laying around.
The great news is that the Embassy is still wonderful. The IV unit knows us well, so when i checked in she alredy had a file on us (even though NVC has not sent them our case.) They collected Doras medical, police check, my 2006 tax return and other documents. She gave us the visa application for the K3 (only 131 dollars). She also gave Dora a blank interview letter, so as soon as the Embassy gets our case, she will find the earliest interview date, call Dora on her cell and have her write it on the form.

If your wife got the Erkolcsi Bizonyitvany (Police Record) that costs 2200 forints and was requested by paying for it at the Post Office, it is not the correct one. She must go personally to the Varkapu u. 30/A address and make the request personally. Not sure exactly what the difference is but it is this that is required for US visas.

K-3 Spouse Visa Process & ProceduresNVC doesn't have case, but Hungary here i come.
Well after 9 months since I last saw Dora, i depart tomorrow to spend 8 days with her. We finally got our NOA2 with congressional help 2 weeks ago and even though NVC still does not "see" the case, i know we are in the end game.
Again, when i arrive i will check in at the Embassy and meet our "friends" there again. Two weeks ago she got her police report and today Dora finished her medical so we are just waiting for them. I will arrive with all my phone bills, my debit card with her name on it and numerous documents that will make it sure she will need a shopping cart to get everything to the interview when it happens.
But i have to tell you, all i look forward to is doing NOTHING with my princess bride. After this week of medicals, she is exhausted, i am exhausted with work preparing to leave for 6 work days. So we plan to just relax for the first 2 days, then go to her fathers house in the country and i will help him with the pigs and chickens. Her father is a beautiful man. When i was taking pictures of when i remodeled the master bedroom and bathroom for Dora, in the pictures her father was amazed at the tools i was using. SO, he will get a killer tool when i arrive!!
Even though we have no common language, my relationship with her father is so wonderful. He is such a beautiful man. Last year, i asked Dora to translate in Hungarian my intentions to marry his daughter. I went to him with a piece of paper and read these foreign words to him. I tried to read them clearly, but he rushed to me and kissed me on the cheek. I will never forget that moment, but soon i will see my father-in-law again.

Did i read you correct, interivew APPROVED! Hell yeah bro, that is BEAUTIFUL NEWS!!!! I am just behind you at about 290 days. Do you have any travel plans yet, or are you still in shock? For us, our buddy at the Embassy call see our case on their computers and they expect to get the K3 from them by the end of next week. Since packet 3 and 4 are basically finished, they will call Dora simply with an interview date. They said that the begining of the month they are usually busy processing Visa Lottery cases but would try to sqeeze her in.

Just before my lovely father in law left to let Dora and i have a night together, we checked my emails. My Mom and Dad have been calling NVC everyday checking for reciept since I left. And 3 weeks to the day after USCIS approval, BOOM, NVC has it. Now our buddy in the Embassy will start calling NVC tomorrow asking for the case. I return home this Saturday night, but at least I know that my blessed Dora shall be coming soon after.

K-3 Spouse Visa Process & ProceduresNVC HAS SENT CASE TO BUDAPEST!! YEE-HAW AGAIN!
Im back from Hungary only 7 hours, but my Dad (who had been calling NVC every evening when i was in Hungary), discovered that they passed it on Friday 2/22.

So after 3weeks and 2 days after NOA2, our case is bound for the Embassy in Budapest via DHL. They may recieve it by Wednesday, then call Dora and set up the interview. Some of you may have known that the Bp Embassy has been wonderful. All Dora has to do is wait for the Embassy to call her next week and schedule the interview, and pay the $131 for the K3 visa. She could be here as soon as 2 weeks as long as their interview schedule is not to backed up.
This made for a wonderful departure in the airport yesterday. No tears. We just said, "see you soon!". As for those of you who were delayed like i was, trust me; After NOA2, all the bitter feelings of the process go away. Check out our buddy GOGO's post on how hard it was for him, 310 days to NOA2. But now he and his wife are in bliss, like Dora and I. Yes, the process sucks, but we are stronger.

Thank you all so much. Even though the news is good, it is hard to feel totally positive. Numerous VJ'ers have gotten to the interview only to have something happen negative. At least we have a devoted lawyer who has been talking to Dora about the interview for some weeks. I do feel that this process can give you no true peace until you great your loved one at the airport.
So, i have continued to push. My parents and sisters have all written emails to the Ambassador for their approval of our marriage and forwarded them to Dora to bring to the interview. Who knows, maybe she will have one of those 2 minute interviews like some have had, but how can we possibly count on that happening???
Dora is very confident, I on the other hand just don't want to have to "restart" the 130 that is sitting at the National Records Center. Sure she has a cancelled tourist visa, but we have countless letters to Senators and Reps admitting it from the begining. She even admitted she worked the last 2 weeks upon trying to reenter last January to visit me. Of course she was sent back and visa cancelled. But from the begining we have been honest.
How sad. Dora became interested in my nascar hobby and wanted to buy some Daytona gifts for her family (she has 28 cousins). So she hustled some extra cash working at a hotel to earn $500 for 2 weeks work as a housekeeper.
Stupid mistake, but we have paid the heavy price. I can only hope that the Embassy see that this was a silly choice rather than a serious crime. But all my hopes rest on this question.
Otherwise, we have to restart the 130 and try to survive another 3-4 months. Please pray for an honest and professional interview for us.

Well after 302 days we will finally interview for the K3. The Embassy has been too wonderful to us. Dora has a shopping cart full of documents as well as letters from my family addressed to the Ambassador in support of our marriage. The only thing i worry about is something stupid. All i can pray for is an open and honest interview with no game playing. Still though, i can't relax until i see her at the airport.

Dora had a CANCELLED 10 year tourist visa. She was coming last Jan (after our relationship had begun), and we were anting to explore the possibility of our relationship. (I was divocred with 3 children). She was denied entry 14 months ago. Of course came the long road to be able to legally marry her in her country.
Our lawyer told us 14 months ago that at the interview, the fact of her cancelled visa would be the hot topic. Even after all this time we did NOT know how pivotal this would be even after countless chats with our lawyer. In the end, Dora arrived with a truck load of documentation supporting our marriage, he asked to see nothing.
All he did was pound her for (i came to know 2 hours) as to her original tourist visa application. It appears afterwards that his sole purpose was to ensure that my wife was not
a visa violator from the very instance that she desired to VISIT the USA. The interview was so brutal that at one point the interviewer feared Dora might pass out and she was escorted out for water and candy, then to resume the interview. Now, my fellow members, Dora is college educated and this process almost broke her. Even after he told her she was approved she was not certain as to her fate. SHE WAS BROKEN BY THE INTERVIEW.
The only reason she was approved was that our marriage was VALID. How i mean that is that the consul could NOT find any break in her story as to her intent to visit the USA.
So, for my fellow VJ'ers if your spouse has a prior visa problem, expect a very difficult interview at the least. But if your journey is true, they will never be able to break it. But if you are hiding, they will find it.
So, for those that may be hiding something, don't ever expect a happy ending. But for those that have nothing to hide, stand in the light for darkness can not overshadow it.

APPROVED.
I just got an email from them embassy, "the visa was approved by the consul and she can pick it up on Monday." But when i spoke with Dora she was completely drained. We have always been open that she had a cancelled tourist visa. The consul did not care at all any documents about our relationship. He beat her up for 1 hour about her cancelled tourist visa. She almost passed out. They brought her water and candy.
The consul wants to run her fingerprints one more time against a US data base, then she can pick up the visa on Monday. Yes, i am greatly relieved but this is tempered by the brutal treatment she got from the consul. I NEED A DRINK!

I'm a nervous wreck. I have been up since 3am (when Dora's interview was to start.) I just called them Embassy and she JUST started her interview. The guy told me to call back in 1 hour. I am burning through rosary beads.

My lawyer is completely confident. I too am positive, but a phone call would keep me from running to the toilet!!

Well, in 36 hours I will pick up my beloved wife and bring her home, and Saturday we meet with our lawyer to file the AOS. Only us VJ'ers know how difficult this journey is. I can't wait until tomorrow.
See, over the past summer i thought she would be here bye Christmas so i demolished the entire master bedroom and bathroom. I installed a huge jetted tub, bamboo floors in the bedroom and topped it off with all new furniture. On Dora's new dresser is a huge pile of gifts from my family. It has been sitting like this for 6 months, waiting for her to complete it. My 3 children (ages 10,8 and 5) are so excited and have been cleaning the house all weekend. They want it to be perfect for her.
My neighbor will watch the kids as i go to pick her up and we will wake them when we get back with hugs and kisses. Then we will all sleep together in the new bed. I am taking Wednesday off work so we can walk the kids to the bus stop in the morning. Then do NOTHING until school is finished.
I do have one strange feeling. After 14 months (Last Jan we decided to marry) i have been at this stupid computer for hours a day, like some of you. I am trying to imagine what it will be like not NEEDING to be online all the time. Of course Dora will webcam with family a lot, but I will not have to worry about the 6 hour time difference in Hungary ANY MORE. Wow, what a ride.

Hmm,
As to your question "can k3 be tracked at nvc?", well by the internet the answer is NO. If USCIS says "we have approved your petition" on you NOA2, then that document will tell you what you need to know. Example:
Both my k3 and 130 were approved on 1/30. As i read the NOA2's the K3 was "forwarded to the NVC", the 130 said "forwarded to the national records center" (they assume we would do AOS). So once you get your NOA2's, you have no reason to call UCSIS again. All you can do w/ NVC is call them every day and be ready w/ your USCIS case number, name and birth date of your spouse. Until they OFFICIALLY recieve the case (which includes data entry), you will hear "we have no record of that case number."
But once they do, they will give you an NVC case number. Most K3's fly out of the NVC for the Embassy w/in 4 working days since there is nothing for them to process. After all it is a temporary visa so they just push it to the Embassy to finalize. The 130 however takes much longer.
So in the end, READ your NOA2's. That will tell you where your petitions are going. Then start making buddies w/ the Embassy and let them know you are real people. This was my case. My wife just arrived on 3/11 on the k3 and we are in heaven.

I am jealous of many of you. My 130 just went over 246 days. Due to my SR in December i got a letter, "background check remains open", which means im sitting in FBI. By common timelines of NOA1 5/18, i have been sitting in background check for 3 months now. No touches, no RFE's. As a matter of fact, i have had no touches on the 130 or K3 since NOA1 was generated.
On 1/4 I contacted both Senators and my Congressman for constituent services, and all are investigating. It seems my case is in the unfortunate 1-5% of cases that just seem to float around for no reason.
Of course i go mad sometimes. I am alone with my 3 kids from my prior marriage, so i have to stay strong. Dora too is suffering for she rented her flat on a long term lease and moved back with her widower father for what we thought would be a short time. Sadly, we are greatly mistaken.
But for those of you around 180 days with no approval, be strong. Our marriages are stronger than this process. As a matter of fact, i believe that this suffering is purifying my love for Dora. Let us all endure, and prevail over this. May the peace of the Lord be with all of you.

So I figured out what part of the problem is with the Kyiv Embassy. Maybe this isn't indicative of everyones experience, but it makes sense to me. This is a letter I sent over there, it speaks for itself, but the locals working at the Embassy need a reality check:

I too wrote a letter to the Embassy in Budapest, but it was to praise 2 employees. Both Hungarian. One was wonderful in helping me get my documents correct to marry in Hungary, and the other for her help in understanding what consular processing would look like when our case got to that point. Both employees were recognized. But sadly, my case is at CSC and my 130 is now 249 days old, no touches.

Yeah, i agree with "B". Order it. IF you find out something different later just order a new one. The cost of a fee, even if $100, is worth the world to save "40 days." Hell, I'd pay $1,000 just to get my case moving!

I think you are in great shape since you have the NOA1. What is the reciept date? Like the other post, I don't think you have anything to worry about. If the do ask for an RFI, no problem. But i am WONDERING if maybe you can send it now with a copy of your NOA1 and a letter saying, "I might have forgotten to add this with the original". I can't imagine that hurting at all.
