hey - how's it coming with the tax forms?

Hi first i want to thank everyone on here for the great help, about the tax forms nothing yet but we work on that i will keep inform you about that ,by the way i just today update my time line ,my interview day on 1/23/2012.

Many people do not get jobs or work in USA before AOS and they pass just fine.
But what other proof of co-mingling of assets do you have?
Joint banking?
Joint credit cards?
Are you her life insurance beneficiary?
Are you on her healthcare plan for health insurance?
Do you have a drivers license with the same address on it?
Do you have the light or gas bill in your name?
Has family sent you cards or mail in Both your names

There is alot of proof you can submit without having a job.
But she still needs to have filed taxes. and for 2011 she needs to file married filing jointly.
When is your interview?

My interview on 1/23/2012 ,about the other proofs yes we do have Joint Banking and all the bills have same address and our name on it , so she sent the USCIS from w7 for her Tax when we sent them all the papers work including the medical exam and all then they asked me to do my finger print then they send me the letter for the interview date with what papers they need me to bring , so please let me know what we need to get now because my problem now that we do not have much money and i need to know if that right to tell them that i do not have any jop for two years without mention that i was working with her on her company because if i did i guess they will ask me why then there is no tax joint with both your name on it . so i just want to know what the right to do.

I just looked at your timeline. You have been in te usa since Dec 2009.
Did you file taxes together for the last 2 years? Married filing jointly?

If she did not then she needs to fix them quickly. She should not have filed married filing separately. and she should not file head of household unless she has children in the home.

If that is what the government is questioning then she needs to speak to a tax man or amend her taxes quickly.

Yer adjusting status FROM a K-3
so YOU will not have any SSN
so it's sorta weird to have any tax return info
as you aren't allowed to work, as a K-3 visa holder.

I'm thinking the adjudicator on yer casefile is confused, much.

At best, you could have applied for an ITIN after you arrive in USA via the W-7 form and your wife filing the entire tax return, via paper filing process, to the special ITIN/W-7 address in Austin Texas.

re: AID for work? Sorry, you mean EAD? With an EAD card you can get a SSN, within about 2 to 3 days at yer local SSA office (two trips - one to apply, second trip to get the number - card mailed out 2 weeks later)

You and your wife refile tax returns, the 1040X, one for each year that you've been here. IMO, that'll satisfy the requirement. Can get it done without HR block, and you'll probably have a nice surprise, a retro-active tax refund.

If you start on Monday with the trip into yer local SSA office, you SHOULD be finished up by Friday, to submit the 1040X via paper submittal. Keep an entire copy of everything you've submitted, as the adjudicator wants to see this before you are issued a greencard .

Thanks so much for your reply , let me tell you and make it more clear , yes i do have a SSN and EAD sorry for my misspell but i didn't work because i kept looking but no luck other wise all this time i work with my wife from home with her company , so i am so confused now because when we sent the papers work to USCIS she sent them form W 7 for her Tax but just have her name on it so i really don't know if i should tell them the truth that i working with her but then are they will ask for any form of tax have my name on it or i just say to them i didn't work and didn't maintain that i help her ? i do have other proof like joint bank account,rent, billies and letters have our address on it with our name .

Hi and Happy New Year all MENA Friends wish all of you doing good , sorry i know it had been long time for me to post anything on here but i was really busy , i need your help because i am so so so confused i will start my question ,, well i got a letter from the USCIS for the interview for my AOS and they ask me for the papers work they need for me and for my wife ,one of them is the Tax Return or any recently tax for me so the problem here my wife working from home and i help here with this business so when we sent them the paper when first start the process for the AOS she send them her Federal Tax under her name only because she did not add me to any tax also i did not work anywhere so i do not have any kind of tax and i am here for two years now so what i should do in my interview ? is that simple to say i don't work so i do not have any kind of tax and also i can't say that i help her with her business because in this case i need a tax Report and we do not have money now to go to H@R to ask for sharing tax because it will cost us $350 .. sorry for talking a lot but time is short and i really need to understand it clearly . so please advice me what to do and what the right to say in the interview to make everything going good without any delay , ah i forget to tell you that i do have my AID for work but i don't work any place .

Thanks so much . no i did not re do my taxes because we realize that when my wife sent to USCIS her tax she added my name and we did not know that lol ,, and no the officer didn't aks me about the tax all he asked was about if i work or not and i told him the truth that i help with my wife company . thanks so much for your great wishes , wish the best for you .

Hi everyone , first i wish to everyone on here the best luck and the best ever on your Journey and your life all , last Monday 1/23/2012 was my interview for AOS so i want to share with you all how's it going and my experience on there and let me tell that i got Approved and the officer told me that they will send me my Green Card within two to three weeks , thanks so much to all Visa Journey members and to this great web site who help me and help lots of people on here, so i will start now how the interview went and really was so smooth and nice .
my Interview was super easy , i and my wife went to CIS office at 10am which was late for our interview because it was at 9:45am but we get lost while going there but it no cause any problem they accept us so we set and wait till 1pm then the officer called my name so we went inside his office .. he was so nice guy , we did the oath for tell all the truth , then he asked about our ID and then asked me for how long we get married and my first and last name and some easy questions about if i get arrest before or fail to vote or belong to any releagues group and i answered no to all this questions then he asked me to show him my social security card and my EAD card then he asked me to show him the English version for our married certificate and the divorced certificate for my wife ( she was married before ) and my birth certificate the English version too , then he asked for any documents have our name together so i show him our joint bank account and the lease for our home also some of out bills , then he asked my wife if she have any kids and if she married before then he asked me same question about if i married before or ever have any kids , then he kept my EAD on my file and print out a paper then he told me congratulation Mounir your application approved and we wil send you an official letter telling you that and your Green Card will be mail to you within two to three weeks then he gave me the paper he print out was said the same as he told me , that's it was so easy no hassle no any person questions nothing just as easy and i ever will expect .
Again i wish the best to all of you guys and forgive me for not coming here often but some times i got busy and just can not find much time to come here but for sure i will do my best to be here time by time .

Hello everyone,
I have a question regarding the CRBA issued by the American embassy in Egypt. I had a baby 4 months ago here in Egypt and have an embassy appointment next month to give her my American citizenship through a CRBA. On the embassy's website it says I have to bring "the child's foreign birth certificate" in order to issue her a CRBA. I went to the egyptian medical government office yesterday to try and pick up my daughter's computer printed birth certificate, because I was told back in december that it would be ready in April. Well, the medical government office manager told me that all egyptians with foreign spouses have to wait 6 months to 1 year before they will get the computer birth certificate, unlike egyptian husband and wife which only wait 4-6 months. I would really like to visit my family in America this summer and bring my daughter. Will the US embassy accept the handwritten birth certificate that i was issued by this same medical government back in december (a few days after her birth)? The handwritten one allows her to get immunizations from the government, and this birth certificate was issued to me from the egyptian medical government. Please if anyone has any experience doing this same process in Egypt, please help!!


Yeah , they accept the handwritten one you took after her birth ... just translate it in any official translator , a copy of your passport and her father passport , your marriage certificate and if its in arabic translate it too , a picture as far as i remember of the baby , 205 dollars for both CRBA and passport .both parents must be available and the baby as well ... just no need to have a certified english copy .. translate the handwritten one by any translator ..

You will be eligible to IR1 Visa as u have been married for 3 years .... IR1 Gives you 10 years green card while CR1 gives you 2 years green card and then one must remove conditions before their 2nd anniversary ( which don't apply on you )

I130 is the form you fill and send to USCIS to be approved and get the IR1 visa

the USCIS processing time doesn't tell you 5.5 or 7.5 month specifically for NOA2, it would mean the whole process.

people arnt going to refer her if she is lying.... only time will tell, if she gets the approval like she said, then she isnt lying.

and we all belive we are getting the run around with this whole july 18 #######...



The 5.5 or 7.5 months are the average time for the USCIS step only ...it may take less and may take a bit longer to get approved then some more time in the NVC process and embassy as well

You say the RFE requests passport photos and copies of your divorce. Not sure why you mention "joint documents". Did the RFE also ask for "joint documents"?


RFE did not ask for joint documents, and within few weeks of sending the documents, i received the email that we were approved

but now, my wife called since the approval letter never came or even reached the NVC - and after getting transferred to an officer, he said
the decision was reversed a week later

we were blessed with an addition to our family of a baby girl, but that was after we filed, can i send her birth certificate now

I mean it keeping me up at night, they wont send the approval or the denial for that matter

INS is No longer USCIS is in action now name has changed for years. The period who adjudicated your case seemed to not have paid attention to what he/she was doing and that your petition was not submitted with the initial evidence. Passport photos of the applicant/spouse has long been requested and was in effect in August 2010. The copy of the divorce certificate should have been included when the petition was being submitted.
It's certainly not a first because there are instances where cases will make it to the NVC and they will send it back to USCIS for review. It's fixable it seems and all that you need to do is respond to their request for evidence.

to sum it all - this is what the INS websites states on our case, my wife is a US citizen and I am an Egyptian Citizen
She filed I-130 August of 2010 - Vermont service center

they sent us an RFE wanting passport photographs and copies of my divorce,
what is odd is that they never requested evidence of the joint documents, and we actually made the mistake of not sending it in the first place -

Post Decision Activity
On December 15, 2010, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283


I dont know if this happened to anyway, but I have been pushing my lawyer to follow up, and my wife actually called the 1800 number asking to speak to an officer, because NVC has yet receive our case

I think this is a FIRST, correct me if I am wrong, but the INS officer said and I qoute " THIS IS VERY STRANGE, your I-130 was approved on Decembe 15th, but the decision was reversed on December 22nd) we received nothing, not an approval or a denial

Hello All

I had posted a week a go or my case and I just want to list my case history and inquire about similar experiences

- granted a temporary green card Oct 2004 through marriage
- Marriage was later terminated March 2006
- Interview August 2007 and nothing
- Moved in NY - another interview 2008 and nothing again - just another 1 year stamp renewal on the passport
- got married again April 2008
- Moved to Egypt August 2009 (basically, we got a great career opportunity so figured why not give it a chance) mind you that my stamp was still getting renewed
- January 2010 - Notice of deportation, WHAT the**** - apparently I had a third interview set and I never showed up (even though that interview notice arrived in the mail)
- One lawyer told me we can fight to revive your old i-751 since you have been in temporary status for close to 5 years but we move back to the US ( not an option, wife was pregnant and I just started a job here in Cairo, another said your wife can show up to court and just ask them to close the case - I had to prove that I am not physically in the US hiding and that I had voluntarily left the US. The judge closed the case with no issues.
- August we filed that infamous I-130 from NY.
- October - INS requested copies of the divorce and passport style photographs (what a joke, it was included in the original packet) but of course, we complied as usual
- December 15th, an email that we approved the case and mailed you a notice, then nothing, month after month we call and they tell us, you can filed i-824 app for an action on an approved notice, but that is it. NVC got nothing.....
- YESTERDAY - my wife calls them, and apparently she went off on the ISO, that she wants her husband here and that time is being delayed and no one is telling us anything

According to the ISO screen, the case was approved December 15th, re-opened December 15th, denied December 22nd but no notice was ever sent
they she told my wife that she will email the Vermont center on our behalf, so we can at least understand if we need to submit anything or file an appeal - just get an answer
I do not know what the ISO email can mean, but I have lost faith by now

they wanted my wife's - and thats what the RFE asked for

If your wife moves to Cairo I believe the DCF requirements are 6 months legal permanent resident in that country. If she stays there for taht 6 months and then files it could be a shorter process than if she stays in the US and decided to re-file. If she moves to Cairo, and decided to file normally through the US she can do that too as long as she has an American address (maybe her parents or a sibling) to have the mail correspond too. I'm sorry this happened with your lawyer. Thanks to VJ there are many many people that do this whole process sans lawyer. Don't let it intimidate you. If you think you can follow the guides by yourself I'd recommend that. It's always hard to put your future into someone else's hands. Good luck! :)

The irony is that it is not a terrible reason like " you lack evidence to prove it is a good marriage)

yet, it is devstating to lose out on those 7 months having to resort to watching my little girl grow on the webcam

my wife was living with me for over 6 months before she went back to the US ( Family tax business, so they are in seaon) and she is Egyptian as well, so the 6 months resideny is not a problem

My wife is now planning to bring our child and come live with me here in Cairo. She is an Egyptian as well, ( US born)

Since the appeal is not an option, shall I just wait and file directly with the consulate when they are up and running

I just do not know if he will assume the charge and pay for the second filing or not

I have not approached him yet, because I need to figure out everything and avoid going off on him

No, you don't have grounds for an appeal. You're better off filing again. However, your description is confusing. USCIS is pretty lax on the size of the photos as long as they get them with the petition or they arrive within the time allowed. If they arrived late, and you got them to your lawyer in time, take it up with your lawyer. If it's his fault, have him pay the new filing fee and do the second filing at no additional charge. If it was your fault, then take your medicine.


Gentlemen -

When they requested the RFE - apparently he sent them the wrong picture ( he sent mine as the beneficiary) my wife's pictures as the beneficiary

it does smell fishy, because he did not even know it was denied, according to him for the last three months, we are waiting for everything to go to the NVC. My wife called asked for the Tier II support and went off on them which got the denial mailed the very next day

The denial letter acknowledges that we sent the response to their RFE in time, but we sent the wrong picture

We lost 7 months, and now the filing is up from $355 -

I had posted a couple of weeks ago regarding our case
My wife had applied the I-130 for us back in August 2010 from NY.
in Octomber - We received the RFE for the missing passport style photpograph, strange it was sent already

We send it again to the lawyer, and he sent the packet back to immigration within the allowed time frame

December case was approved, repoened the same day then denied - Then for three months we got nothing,

Sadly, The denial states that we did not submit the required photograph for my wife -

Sometimes we get so consumed with immigration errors and shortcomings that we see nothing else.

They denied us on reasonable grounds, they requested the pictures and we sent the wrong set.

Did I do the wrong thing to trust our lawyer blindly to submit all the required evidence..? I dont even think we have grounds for an appeal -

Dont misunderstand my meaning or intent here. It is critical that you do this exactly the right way. No need to apologise just take a deep breath & relax.
A motion to reconsider is simply a letter saying that is what you are asking them to do. It is free & different that a motion to reopen.
Just write a simple statement of facts. Tell them a mistake was made when the photos were sent in. Explain that you have enclosed the correct photos along with the copy of the docs you got from USCIS. Ask that the case be reconsidered in light of the new & correct info they can review & therefore approve the case. Ask them to notify you of any action they take.
One problem with this is you will probably not know what is going on for a long time. You will begin to think it didnt work ect. Offset that by waiting at least a month & then make INFO PASS appointment to see USCIS. They will be able to tell you the status.


it is definitely worth a try. I am an Egyptian citizen, and from the looks of it, US embassy here may not open for a while, so I have time to invest into this options

It may not seem important to you but you do not have room for another mistake. If you want to reopen the case you will have to file for that.
My post clearly says " motion to reconsider ". The goal is to be helpful. Read what I said please & follow the example. If you dont send these items back to the correct department they will likely be lost in the black hole.
What you do next has everything to do with your chance of success. The RFE tells you where to send the info back to.

we actually lost three months waiting for the denial to come in the mail. case was originally approved december 15th, notice came march 13th

All is not lost. We made exactly the same mistake & got the same letter. There is a way out of this. Ignore the denial letter. This is a standard procedure when they dont get the correct responce.
My husband sent in a copy of the RFE & denial letter along with a " motion to reconsider" asking for them to accept the correct info. It was accepted. We lost 2 months because of our stupid mistake but they did approve the case.
You have time to do this but you need to get it done asap.


the Denial notice has a date of March 8th, I actually do have few days, but how do I go about the motion to reopen?

and I am assuming I would send everything back to the same address listed for the RFE?

what about the portion of have you filed before? i think this is where we mention the previous case that was denied i believe

and no more Vermont, everything is now chicago lockbox?

C. Yes, you do mention your daughter.

Were you denied (sent a NOID) or did the lawyer you used not respond to an RFE for the proper passport photo? Ignoring an RFE deadline would result in your petition simply being closed (I think). Based on your post, I think the lawyer you used did not respond to an RFE for a proper passport photo.

Anyway, before you say you were "denied" when you submit this form, find out exactly what the disposition was on the last petition.


It was denied, we received a letter late around March 13th with the details. the denial letter states that you were given ample time through the RFE to provide the correct photo picture of the pettitioner but failed to do this to this date ( date of the notice)

the lawyer claims her sent the right photo, and it was a big mess, because he also received a notice when the case was reopened and never told us


it is truly frustrating, to lose out on months and money on such simple reason, so here we are again

Hello everyone

I have posted a while back regarding our case. We were basically denied I-130 after initial approval. the letter stated that we did not submit the correct passport photo style
so 8 months and $355 later, we are trying to do it on our own, fired the lawyer that pretty much ignored us and said that he did nothing wrong

C. information about your alien relative/list all children: we have a daughter that was born right after we filed the first time, and we have obtained a US passport for her through my wife the petitioner, do we mention her name in those few lines, since we are submitting the counselor birth record as well.

D. Other information:
Have you ever filed a petition for this or any other alien? well, we do have to say YES now, but how much info do we provide, just my name the filing location and it was denied, since i am pretty sure they have record of what has transpired

Bob - We are definitely sending the marriage certificate & our daughter's birth certificate

we just figured the photos wont hurt

we do have copies of everything, just need to print some of the wedding pics again, and thats it

i would rather elect this option than wait for few weeks for a rejected packet in the mail
