PhilippinesManila Embassy Interview/Visa Status
hey there PW have fun waiting for all the paperwork SSN EAD an AOS lots of fun the screw ups keep coming an coming with them. even our state senator Senator ED Kennedy said he cant believe how incompitant the immigration dept has gotten. his office puts over half of its resources just into dealing with immigration mistakes which are usually immigration DEPT errors. Yove had to wait 3 months to get her social secruity card because the people at the hanover office made the mistake over an over again misspelling her name. it took a call to kennedys office to call there office to get someone to look at what the problem was. yove been here over a year and she still hasnt gotten her AOS card

Removing Conditions on Residency General DiscussionCan I get my ten years card?
I agree. You should go see a lawyer immediately because it seems that your husband was using the marriage to make profit and intentionally hid the status of your immigration procedure. Keep all the joint finance documents. That and your pregnancy should count as an evidence that you entered the marriage in good faith.

Good luck...

I married my husband three years ago, he is an American citizen.
We lived first abroad, for one year, then we moved to the US.
When time came to remove conditions on my premanent residency, and file I715, he filed it and gave the address of the correspondence as his work.
Then he gave me a NOA , which said that my card was extended for one year, employment and travelling authorized.
He did not give me any other papers: the letter which asked me to go to biometric appointment, and others.
I thought that we were waiting to hear from immigration again, as it said on my NOA and did nothing.
I am 6 months pregnant.
All the time since I entered the US he performed fiancial operations, using my name, for there is a larger profit for investotrs who are not US citizen in off shore areas where he invests.
He used my name on alll his transactions.
Then he announced to me that he wanted a divorce and showed me filed for the paper that my case was dropped, and it dated of three months ago.
Can I get my 10 years card on my own, pleading entering into the marriage in good faith?
All the months he was hiding things from me, he was very attentive and loving, especially on public.
And he knew that he stopped my case.
Can it be the proof that he wanted
a marriage which was not valid, and that
I married in good faith?
The papers I signed for his commercial dealings, and the fact that he was nice to me while contemplating to send me back?

Removing Conditions on Residency General DiscussionIt's Always Something - 2 Case Numbers From TSC?
Do you think this happens to those who filed I-751 with two checks?
I have received only a blue letter acknowledging that VSC got the $70 biometrics fee.
Nothing else so far.

-----------
Jan 22 - Send in I-751 via express mail.
Jan 23 - Received at VSC (according to USPS).
Jan 25 - Two Checks ($205 & $70) cashed by USCIS.

Removing Conditions on Residency General DiscussionTwo checks cashed by VSC
So far, I have only got one blue receipt for biometrics fee $70 although two checks are both cashed.

I sent in two checks because I sent in one $275 check before, and my package was returned with the note saying that the fee is $205. (That was the time that this kind of thing happened to many people. The new form says the fee is $275, but service centers were still regarding $205 as the correct fee.) So, I did not want to repeat what I have already done.

I would like to have another receipt saying that they got $205 for I-751 before NOA.
But nothing happened yet. It seems that those sent one check got a receipt for $275 for both I-751 and biometrics though.

I will post here again if I get another receipt.

Good luck to you all!

I thought it would be a good idea to post this.

I sent my I-751 on 22nd. It arrived next day at VSC, and the two checks I sent were cashed promptly two days later on 25nd.

VSC at least cashed checks pretty fast.

Hope they are fast in sending out NOAs too!

Does the receipt no. that I need to input in the USCIS case status alert web page is given on NOA?
I can see some handwritten numbers in the image of my cashed check.
But I think I heard people say that those numbers don't work.

Removing Conditions on Residency General DiscussionNOA received :-)
Hi everyone--

I have received my NOA from VSC. It says on the top right corner, I-797, Notice of Action.
(I thought I would get another blue receipt for $205, but it didn't come. )
So, I guess this is what I should bring my employer before my card expires?

One thing strange is that the NOA is dated Jan. 29.
So, it took about two weeks for it to arrive! I wonder from where it was sent???

I checked the case status online using my application no. and it simply says that they received the case and sent a Notice.
If they send out a a biometrics notice, does the online case status indicate that too?
(I was going to do the automatic e-mail case status alert but I forgot my login ID & password :crying: )
I guess I just have to check every other day...

Anyway, others who filed I-751 a little later than me to VSC should receive their NOAs soon!

Cheers!

Removing Conditions on Residency General DiscussionWhat happens to the 2yr Greencard in Biometrics?
I have my biometrics done today in Boston support office. All I needed to show was my green card and the biometrics appointment letter.

My appointment was at noon. I went in about half an hour early. After waiting for about 40 min., it took about 20 min. for fingerprints and a second for a photo. I spent overall a little more than an hour in the center.

I thought they were going to break my fingers bending and rolloing and pressing left and right!!! All ten, and it was very thorough. I had to do a couple of fingers printed for more than 10 times. The problem wasn't really my fingers or the machine. It seemed that the person who dofinger-printing kept the fingers too wet. Just my guess.

And people are asked to show their hands before fingerprinting. But I saw no one being rejected though.

Hope this helps for those who are going in for biometrics in Boston!!!

Removing Conditions on Residency General DiscussionWhat happens to the 2yr Greencard in Biometrics?
Hello everyone,

I am going to my Biometrics tomorrow. I realize that I should bring my 2yr Greencard with the biometric letter for Biometrics. :)

Anyone knows what happens to the card? Am I supposed to submit it and do they take it away? Or do I keep the card until the I-751 gets approved and then I return the card?

Also, do they take the biometrics letter away? Should I bring my other NOA for the receipt of I-751 as well?

Why haven't these questions come to my mind until one day before the actual Biometrics day? Any help would be greatly appreciated!

Thanks!!!

Removing Conditions on Residency General DiscussionQuestion about the NOA
You will receive another NOA that states that your I-751 was received and your are authorized to stay and work in the States for another year. :)

I have just received my NOA(YES!!!), showing me the date of the biometrics appointment, but I got no paperwork stating that the expiration date of my two year conditional green card(it expires April,25) will be extended for another year.

Does the NOA prove that my greencard is valid for another year, or do I have to get a stamp on my passport when I go to the biometrics?

Removing Conditions on Residency General DiscussionRemoval of condition I-751
I guess threre is a real need for a lawyer in this case. It seems to me that notarized letters from both the husband's and the wife's relatives and friends who can attest a good marriage relationship would help. Photos of the family together. Any documents from either the husband or the wife's workplace that designate each otehr as a spouse/beneficiary for health/life insurances and that shows their US address as permanent address may also help. Any joint estate, home or car ownership... It seems to me that the husband did not move abroad permanently he should get some mails in his US address.

Removing Conditions on Residency General DiscussionWhy did we get a Finger Print Receipt Notiifcation?
Don't worry. It just means that they got your fee and cashed the check.
You will soon get the NOA and the Biometrics appointment letter in 2-3 weeks.
I filed at VSC in January and got the same fingerprint fee receipt notice before receiving the NOA and the Biometrics letter.

Our joint petition to remove my wife's condition on residence was received at the Vermont Service Center last Friday via Express Mail. Since then we got only one thing in the mail, yesterday we got a "Finger Print Receipt Notification" indicating that they have collected the fingerprint fee. There is no explanation about why we got this notice. I would just file it away quietly, but we are bewildered about what purpose this mailing serves. Does anyone know about this?

I filed my I-751 with the Vermont Service Center on February 10th and still haven't received my NOA... They managed to cash the cheque quickly enough though! Does anyone know, typically, how long it's taking at the moment (for the NOA, processing in general etc.)? When should I expect to be called in for biometrics? All advice gratefully received! I really wish someone from the California center would head east and teach them how to efficiently process things!!!

(interestingly, my hubby filed the change-of-address form with the USCIS the same day and received the NOA for that within a week...)

blackdog_harryFemale02007-03-07 14:57:00
Removing Conditions on Residency General DiscussionReciept Number
Yep, this is correct from my own experience. Only the case number in the actual NOA works.
I filed my I-751 to Vermont, and the case number on my NOA begins with EAC.

EAC is Vermont, that much I know. I would assume WAC is Nebraska, since that's where you filed, Mononoke.

Junglee, we have an EAC number written on the front of both of our checks. It doesn't do anything when we try to check it.

Then we got the blue receipt for the biometrics fee, and there is a different EAC number under case number which also doesn't work, then down where they check the box for what the receipt is for (biometrics), the same number from our cashed checks is there. But again, it still doesn't work.

From what I've read, we have to wait for the NOA1 to get the actual case number. :(

Removing Conditions on Residency General DiscussionInterviewed couple...
It _IS_ interesting. I guess the couple was randomly selected for quality control?
But what a waste of time and energy!

I knew a woman from another forum...she filled with VT

she got a RFE and she was scheduled for an interview and was really scared. I posted about this case
before....

The couple went to the interview this month, and the OF ficer said something like " they really didn't need to
be called for the interview since they had a lot of initial evidence already ,
and he only asked a few basic questions and stamped the passport...

just interesting.

Hi~

Since I haven't heard anything at all since biometrics from VSC, I went online to check out my Case Status.
The status is still "Case received and pending" and look the same as when I checked last time after getting NOA.

But I have noticed that they put Feb. 24 as a Last Updated date.
So, what would have been updated regarding the case and why isn't there any change in the case status at all?
Have I missed something???

Does anyone know what "Last Updated" mean in the online Case Status Service?

Thanks!

Removing Conditions on Residency General DiscussionRisk of losing job if I don't get either extension or the 10 yr GC
I filed at VSC and got my NOA in three weeks. So, if you mail the package in soon, you will be able to get the letter before your card expires. My HR wasn't even aware of the expiration date when I brought them a copy of the extension letter. I think I read that it may be problematic to get a new job while you are in the I-751 process since you do not have a current-dated green card. But I think that your old green card and extension letter should be enough for you to keep the job that you already have. So, I am curious about what this part of the HR notice you received means because it stipilates that an I-797 NOA letter is not enough. Perhaps your job is renewed every year and they need new verification of your status?

It is also very important for you to understand the XXX Office of Personnel Management (OPM) will not accept an I-797 Notice of Action. The OPM wants the renewed or new document with the current expiration date.

Good luck!
blackdog_harry

Hello Folks,
My clock is ticking...Its now time to remove conditions. My earliest eligible time was March 25, 2007. Yes, I am aware I have already allowed 3 weeks to past. I am sending the package on Monday or as soon as we receive some expected letter of affidavits on the mail.
My predicament is that I already got a reminder e-mail from my employer's HR warning me about my green card expiring on June 24, 2007. They caught this expiration date because recently I had to undergo my annual renewal of my security and background clearance in order to continue working for my company's client which is a Federal Agency. I was lucky enough to work for the top IT contractor for USA's Federal Agencies like SSA, NSA, etc. I work for the federal agency contract that allows green card holders to be part of the team. And the only reason I am still with the contractor company and not with the Federal agency is due to my green card status. The Federal agency client is expecting me to become their employee as soon as I become a US citizen which is fine by me and I felt lucky to be considered. But first things first.
My questions are: Do you think it is okay to include this e-mail letter in the package that I will be sending for the Removal of Condition and have a letter requesting for a year extension of my GC? How long will it really take to get the 10 year GC? Btw, my husband and I will be filing in Vermont.

fyi - it is not hard to get a job for my skills as I have observed lately but I did not want to lose this particular job. I am intending to work for a long time with this company or Federal agency client. It is not easy at all to get a job in both these places. Before I got in, I had to undergo a lot of hurdles. I felt lucky to work for these places.

The e-mail is worded like this:

'RE: FIRSTNAME LASTNAME
PERMANENT RESIDENT CARD EXPIRES: 6/24/2007

Our records indicates that your Permanent Resident Card expires June 24, 2007. I’m notifying you now because the renewal process can take two weeks to three months and sometimes longer. When you receive your updated documentation, bring the original document to the Security Department office. It is very important that the Security office copy the original document. We track all information pertinent to the XXXXX contract and our office is the one who submits the updated documentation to our client at the XXXX’s office.
It is also very important for you to understand the XXX Office of Personnel Management (OPM) will not accept an I-797 Notice of Action. The OPM wants the renewed or new document with the current expiration date. It is in your best interest to begin filing now to receive your new INS documentation on time. You should also know that you are at risk of being removed from the XXXXX contract if your obligation is not fulfilled on time.

FYI: I will be sending you reminders.

Directions to the Security Office:

blah blah blah and so on....

Removing Conditions on Residency General DiscussionIs This True...?
Yes, have the card updated before it is too late. I tried about 2 weeks before my 2-yr card expires and heard that I should bring a new Green card. So, it is good to have the ss card updated as soon as you receive your green card whether it is a 2-yr one or a 10-yr one.

Removing Conditions on Residency General DiscussionIs it possible to change jobs while green card is expired?
There have been discussion in the past about this matter.
It may help to take a look.
To sum up, updating a SS card to one without a legend is not allowed when the green card is going to expire in 2 wks or less.
Getting a new job with an expired green card + extension letter (NOA) could be tricky but is not impossible with contacting right places--e.g. justice dept.
Continuing a job after the green card expires is fine as long as you submit the NOA to HR because it states that the status is extended for a year.
[I had no problem with this.]

I would like to know if the stamp on the passport will work.
I heard that the stamp is not issued any more but in this case it may be the only way...
That would be good news since it is simpler than calling justice dept.
Good luck and let us know what happens! :star:

Removing Conditions on Residency General DiscussionChanging jobs while the I-751 is pending
I have been meaning to post this for a while.
It seems that there have been cases in which people try to change their jobs while I-751 is pending and have trouble with satisfying I-9 requirement with their expired green card and NOA. (This does not apply to those who have updated their SS card to one without a legend before their conditional green card expires.)
But there are some people like me who failed to do so and happen to want to change jobs while I-751 is pending...

I was just wondering why Driver's license or State ID + NOA should not suffice for I-9 requirement.
An expired green card cannot be used for List A.
But NOA would not fall under the List C?
So, NOA combined with Driver's license or State ID under List B, there should not be a problem in satisfying I-9 in getting a new job...it seems...

Anybody with experience in this?

The following is from The Office of Special Counsel for Immigration Related Unfair Employment Practices (OSC) , US dept. of Justice web page.
http://www.usdoj.gov.../facts.htm#docs

Q. What documents may employees show employers to establish identity and employment eligibility?

A. The documents identified below are acceptable to establish identity and employment eligibility. Please note that the list of acceptable documents is different than the list that appears on the back of the current I-9 Form due to intervening changes in law. However, employers that continue to follow the list that appears on the back of the I-9 Form will not be sanctioned by the Department of Homeland Security (DHS), until such time as DHS issues a new I-9 Form and Handbook for Employers. In addition, please call OSC for special rules that apply in certain situations, including receipts, rehiring former employees, workers with temporary protected status (TPS), documentation for individuals with disabilities, and additional acceptable documents.

List A
Documents that Establish Both Identity and Employment Eligibility.

• U.S. Passport (unexpired or expired)

• Unexpired foreign passport that contains a temporary I-551 stamp

• Unexpired Employment Authorization Card that contains a photograph (Form I-766, Form I-688, Form I-688A, Form I-688B)

• For non-immigrants authorized to work for a specific employer: an unexpired foreign passport with an Arrival-Departure Record, Form I-94, bearing an unexpired endorsement of the individual's nonimmigrant status.

• Unexpired foreign passport with a Readable Immigrant Visa (MRIV) and unexpired temporary I-551 stamp (valid until the expiration date set forth on the temporary I-551 stamp).

• Unexpired foreign passport with a MRIV containing temporary I-551 language and endorsed with an unexpired DHS admission stamp (valid for one year from the date of admission).

See also the receipt rule discussion below for additional documentation.

OR
List B

Driver's license or ID card issued by a state or outlying possession of the United States provided it contains a photograph or information such as name, date of birth, sex, height, eye color, and address

• Original or certified copy of a birth certificate issued by a state, county, municipal authority or outlying possession of the United States bearing an official seal

Unexpired employment authorization document issued by the Department of Homeland Security (other than those listed under List A), including (1) a Form I-94 identifying the holder as an asylee (by stating "asylum", "asylee" or appropriate provision of law), or (2) other documentation issued by DHS (or the former Immigration and Naturalization Service (INS)) that identifies the holder as an asylee, lawful permanent resident, refugee (except for the Form I-94 identifying the holder as a refugee, which is considered a receipt only), or other status authorized to work in the United States incident to status.

Removing Conditions on Residency General DiscussionCard production ordered
I just got an email saying Card Production Ordered.
I sent mine over in the middle of January this year.
It took about 6 months from NOA date to Card production.
I see on the board that some people filed after me were already approved a few weeks ago while some filed before me are still waiting.
So there is certainly some variance.

FYI, Here is my timeline.
CIS Office : Vermont Service Center
NOA Date : 2007-01-29
Bio. Appt. : 2007-02-22

Good luck to everybody!
