K-1 Fiance(e) Visa Process & ProceduresAssembly of I-129F documentation

I used a couple small binder clips to hold plastic bags with the passport photos onto blank sheets of paper, as well as to section off each G-325A (this probably wasn't really necessary, but as we both had attachments for the form, it made me feel better to sort of clearly define it that way). I had everything two-hole punched at the top and held the entire petition together with an ACCO fastner. I also put tabs along the bottom to help locate specific parts of the petition (I-129F, G-235A Petitioner, G-325A Beneficiary, Supporting Evidence, etc.). And then it was just put in an envelope and shipped to NSC. It was actually very presentable on it's own, so we didn't bother with folders. Besides, a folder would add a whole extra second to the waiting time for approval :P

I did the same as above.

K-1 Fiance(e) Visa Process & ProceduresQuitting job after K-1 Petition sent
My fiance may quit his part-time job after I have already sent the K-1 in. I included the job on the K-1 along with his other part-time job. Well the other part-time job has turned into full-time and he can't do both (well sanely anyways). Since he is the foreign fiance and will have to quit his job anyways to move to USA, does it really matter?

Just looking for some thoughts on this.

Jen

Look at the Guide tab on here. It will go through step by step how to get everything ready to file the petition. Your boyfriend would be the one filing the petition but it requires documentation from you as well. The Guide section is very informative.

Good Luck!

K-1 Fiance(e) Visa Process & Proceduresvisiting girlfriend, problems with customs
I think in alot of cases it just depends on who you get at customs. My fiance tried to come across the border last May via truck and was denied entry. In June, he flew by airplane and was allowed in no problem.

It is however very important to bring with you information that shows ties to your home country. They need to see you have something to go back to. They may not ask for it but its better to be safe than sorry!

Now me on the other hand almost always gets detained entering into Canada. I go to Canada for various reasons such as visiting my fiance, friends and work. I travel there for work a couple times a year so sometimes they think I am coming there too much! :P On a positive note, I was in BC two weeks ago and they didn't ask one question. Phew!

K-1 Fiance(e) Visa Process & ProceduresPacking up your k-1 information to send in the mail...
I used the guidelines here and on USCIS's website on assembly. I used the ACCO Fasteners and punched two holes at the top of each page.

I used a ziploc bag to put the check in and two-holed punched it too and put on top. I then used sheets of paper with our names and description of each section to divide each section. I had tabs at the bottom of those sheets so each section was easily accessible. The pictures I put in order from start to current in our relationship. I also arranged the boarding passes, hotel receipts and ATM receipts in the same fashion. I made sure that the dates on the boarding passes coincided with the dates that were written in my letter of proof of meeting. The photos were in clear plastic with the photo on top and a description of the photo on the bottom.

Make sure to check several times that you signed and dated everything.

I sent mine Express Mail so I had a tracking number and received a copy of the signature via email.

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresEngagement Ring Receipt
Ok I am going to try to make this short and sweet as possible. August 2005 my fiance was told by his attorney that his divorce was done. Well low and behold she made an error on his divorce paperwork and it was just finalized on March 20, 2006. I was up there September 1st and at that time we thought his divorce was overwith. He bought me a ring while I was there and proposed. I was going to send in a copy of the receipt but I thought it might look weird that he bought me a ring before his divorce was actually finalized. Do you think I should just leave it out of the packet and bring with me to the interview in case they ask?

Any thoughts on this would be appreciated.

Thanks!
Jen

K-1 Fiance(e) Visa Process & ProceduresDivorce Judgment
Well I think I am really screwed because of being misinformed by his divorce attorney. As I stated before, she stated the divorce was final March 17th but the Divorce Judgment says March 20th. The new paper that I received today states the following:

'This is to certify that the marriage of blah blah blah that was solemnized on the 15th day September 2001, was dissolved by a judgment that became effective on the 19th day of April, 2006. Dated at Calgary, in the Province of Alberta, this 20th day of April 2006.'

I thought the Divorce Judgment that we received before was the final thing because it had judge's signature and a court stamp. Now it looks like we are totally screwed because we dated everything April 18th and I put the date of termination of the divorce as March 20th.

Why me? :crying: :crying: :crying:

K-1 Fiance(e) Visa Process & ProceduresDivorce Judgment
I am just concerned because I have two different documents. The attorney told us the divorce was final March 17, 2006. The date stamp is March 20, 2006 on the Divorce Judgment. This is the date I used on the petition paperwork. However, in Canada they have a 30-day 'cooling off' period. Now I am wondering if the divorce wasn't actually final until April 20th, and we signed all the papers April 18th. I have so many concerns now running through my head. :crying:

K-1 Fiance(e) Visa Process & ProceduresDivorce Judgment
Well I am expecting we will receive a RFE. I sent in a copy of my fiance's Divorce Judgment with the petition. In today's mail, I receive an original Certificate of Divorce from his fricken attorney. Now I am wondering if this is what I should have sent. Plus, she only sent me a fax of the Divorce Judgment and never sent me the original certified copy.

I am about ready to cry and scream at the same time. :crying:

K-1 Fiance(e) Visa Process & ProceduresTimeline Data?

The information on the timeline is based on other peoples timelines. As more people enter their information, the system adjusts your expected date taking into consideration how quickly cases of the same type are being adjudicated.

Hence this is why it is SO IMPORTANT for people to fill in their timelines.

K-1 Fiance(e) Visa Process & ProceduresCanadian marrying a US Citizen - K1?
Why take the chance? The wait isn't that long. Yes, it sometimes takes up to 6 months but I would rather stick out the 6 months than doing something illegally and always having the fear of getting caught. To each his own.

K-1 Fiance(e) Visa Process & ProceduresCanadian marrying a US Citizen - K1?

*sigh* Gotta love these attorneys.

Crossing the border as a tourist with the intent to marry and settle down is illegal and fraudulent. So is lying to CBP officials if they ask what the purpose of your visit is and you don't tell them you're planning to marry and settle.

If you already know you're planning to get married, you need to apply for the K-1. Folks whose adjustments from tourist status (Canadian, VWP, or B-2) have been successful were successful because their decisions to marry were on the spur of the moment after they entered with bona fide tourist intent. You need a K-1.
