Fiancee had K-1 interview recently, and everything went okay and looked good according to the Consular Officer. He gave her a 221g requesting more photos of me with her family.
We gave them at least 2 dozen photos in the petition and with her visa application packet. Apparently not good enough. The next day we dropped as many additional photos we could find with the embassy, as per instructions. (If they want pics of me throwing snowballs at her sister, and indian wrestling with her brother-in law, they got'em!) They had her sign everything and kept her passport, told her they would contact her.

Any advice would be greatly appreciated...


Hi-- I don't have any advice at this moment but I have a question. My fiance is in Russia w her son--I am in the states. As of this date I have not met her parents or her son. (she is somewhat afraid to bring me so much into the picture at this time before of her fear of "backlash" from her ex-husband. Your comment begs the question: What if I don't have ANY photos of me and her and her family?? WILL THAT CAUSE A REJECTION OF k-1? Thank you Mike

Another key question is however: DO you know if the petitioner can attend the interview with the Beneficiary?? Yes I know the Petitioner can enter the building--but can the petitioner actually stand beside the Beneficiary during the actual interview?

We are also wanting to do the same. I explained to Lara today that we need to pester these folks like crazy to have the Visa waiting and to NOT ship it out of the city. We need to know which office of Pony Express the US Embassy uses to ship the Visa's from. Maybe we should put the question to the US Consulate in Moscow? They are the ones that actually have the Authority in the first place! I say this because until just recently I went to the Russian Consulate General to pick up my Russian Visa in person. Now there is a third party process (and an extra $30 fee).
The very helpful folks at the Russian Consulate in February told me they did not like to ship the Passports with Visa in the mail for people that lived within driving distances to Seattle, which I do. It only seems reasonable this would also apply to the US Consulate in Moscow for people willing to pick up the Visa in person in Moscow, also for any applicants that live in the City or nearby. Why mail them when it's always possible they could be lost or whatever?? Crazy!
Here is how I feel it is possible to work this differently than we are being told. I work every day with Russian citizens that obtain temporary work Visa's from the US Embassy and the Passports get to our division of the Company in Moscow somehow (I'll bet not by the tooth fairy or easter bunny either). I won't be shy about this, I am a Lead Engineer at Boeing. I'll ask for sure but I believe Boeing Moscow has a focal person that the Visa's all go to (or that individual goes to the US Embassy and get's them in person). If I am correct the employee's are given the Passport with authorized temp work Visa at the work place along with airline tickets to Seattle and back when they are on rotation schedule. Just so everyone knows..Boeing folks get no discount at all from the airlines! No perks either! I will say the most common carrier's used are either KLM or Delta. We will be flying on a Trans Aero 777-300ER out of Domodedovo to New York and then connect on an American Airlines 757 to Seattle. I'll ask on Thursday if my Boeing Moscow Engineer had to go through the Pony Express process or how this was done for him. I hate to say this but we may be breaking new ground here, Mike. It's possible you two and we are the only ones on the path at this point and looking into this with Pony Express in Moscow.

If I knew there was a definite process in the selection about what/where or what to do with the Visa then for sure I would pick-it-up at the nearby Pony Express office. I believe our course of action will be to have the Visa delivered to an address close by in Moscow, and wait for it. In this way I will not be "upsetting the applecart" by asking to hold on to it as I'll be right over. I feel this will make less risk of Pony Express fouling something up. In the alternative, If I could rely that there was a working policy that someone could pick-up I would do that. So far I have not found any infomation to support this option. Thank you Mike

It will something to remember for a lifetime! Moscow is a crazy place but also fascinating. Recent changes at the US Embassy in Moscow are pretty much for the benefit of the Russian citizen I believe, and I agree it is a good change they have made. This is a pretty stressful process to begin with and to do this without your loved one there has to be pretty difficult. Going into the Embassy itself is a bit weird even for a US citizen.
I'll be going to Moscow in late February or March to meet my Wife there at that time, if we don't get RFE (or worse), and if the timeline holds steady . We are expecting at least 8 months and probably closer to 10 before the CR-1 is processed to her appointment for Embassy Interview. Stay with it..nothing is easy about this process.

My Wife and I have the very same questions as you two. Larisa lives in a small village on the Black Sea and the logistics of the mail service is something less than we are used to dealing with in the West to say the least.
We've joked about how we hope the "Pony" of the Pony Express does not die before it arrives from Moscow! We know that UPS is close enough to her village to be a possible venue. We've used them before. DHL is another story. Possibly they will do the delivery, but the closest I found to Lara is in Krasnodar (about 3 hours away depending on how many of the very slow Russian trucks are on the road that day). We would also like to know if our ladies have to Interview without us present or in fact are we encouraged and welcome to attend. We are just now to the point of sending the I-130 Package for K-3 (which most likely will become a CR-1 before complete, and we are prepared for the longer wait for the CR-1).
Any "old timers" out there currently able to guide us? Thank you Vern & Lara


From Mike & Mila: To use a phrase from President Bill CLinton "we feel your pain"!!!!! (but really he didn't feel too much but it sounds good). Of course it would be best for folks like you or me if one could simply "pick-up" approved VISA from Pony express or DHL or Santa Vladimir--who cares!!! If only we knew from who we could make plans. The info from older "instructions" coming from Moscow Embassy indicates DHL--the info. coming from Moscow Embassy today indicates Pony Express. Does anyone know which is the carrier in use today?? Also is it true that the hoped for "approved" Visa can be "held for pick-up" at DHL office-- what are specifics of this process if you know??

Also, Has anyone had any experience whereby the Petitioner attended the interview w finacee'. Specifically, is it truely the case now where the Petetioner is "encouraged" to attend and if so are the two people interviewed together. seprately, or both. I tried calling the embassy and had no luck. The woman I spoke with said to me in very good English " I don't speak English" and then gave me a phone number to call. I called that number but the message said no one can take your call, good bye.

I had my wife call a company in Chicago that can renew a Russian passport for a fee. They were much more helpful and directed her to a Russian embassy site where she can download a form and submit it along with numerous documents and $65 and, after 2-3 months she will get a document that will verify she is a Russian citizen. Then this company in Chicago will be able to renew her passport.

Told my wife it may just be easier to renounce her citizenship so that she can use her US passport and a visa. Looked into that too but it takes as much effort and time as renewing the internal passport from what I can tell.

Now I need to get busy cancelling flights.

Hi.. I am no expert but if your wife has a US passport she can just geta VISA. She can use a service for that such as Abriggs. Phone #1-800-806-0581 VISA can be turned aroned in about three or four days. good luck

I see. Thank you, it is useful. So the request was not for affidavits but for "proof of meeting" and divorce papers. Did you submit any proof of meeting other than affidavits or did you submit ONLY affidavits as proof of meeting.

The reason to ask is simple. Affidavts are generally considered "trash evidence". About the level of evidence of having a magazine subscription in both names and one or two clicks below joint utility bills (utility bills are not assets) There inclusion in "the list" does not indicate they have equal weight to other forms of evidence. If the ONLY evidence you have is affidavits written by friends and relatives then you are in pretty bad shape. Affidavits in conjunction with other good evidence usually results in approval, but would have without the affidavits anyway.

The affidavits you sent were added to whatever other evidence you sent in response to the RFE PLUS what you had sent with the petition, PLUS the divorce papers and it was determined to be enough to provide a plausible explanation that you had met your fiancee in person and approve a fiancee petition. You did not submit them for "the K-1 process", but for the I-129f petition. The "K-1 process" begins when your fiancee submits her DS 256 and DS 256K, until then there is no "K-1 process"

The OP is filing for a CR-1 and must prove a legitimate marriage exists.

My advice remains. Do not rely on affidavits, get evidence of a legotmate marriage which is available to any married couple.

It is great that her father will write a letter for his daughter AND get his signature notarized!(who would imagine?) but who gets the husband's life insurance if he dies? Who gets the money in the bank account if he dies? In OUR legitimate marriage, my wife receives mine and that was changed immediately after we were married, as in "next business day", she was added tothe bank accounts before we were married.

The OP needs real evidence in addition to nice letters. I hope she gets some.

Yes our RFE for I-129f Petition was to give evidence of meeting within two years. This included: Passport and stamps, Airline tickets, boarding passes, Visa copies, bills from hotels, credit card information, Many photos, Affidavits, so a lot of Primary and Secondary evidence.

Hi Gary and Alla: We recieved an RFE from USCIS for K-1 Visa. They asked for Divorce Decree(s), and evidence of "proof of Meeting" within the prior two years. They said evidence should include, but is not limited to:

A list--then

"afidavits of friends, neighbors, or other knowledgeable associates. All affidavits must conform to the guidelines cited below:
Written statements sworn to or afirmed by two persons, other than yourself and the person you are petitioning for, who were living at the time the event(s) occured, and who have personal knowledge of the event you are trying to prove. The persons making the afidavit may be relatives and need not be citizens of the United States. Each affidavit must contain the following information regarding the person making the afidavit: his or her full name and address, date and place of birth; relationship to you, if any, full information concerning the event; and complete details concerning how he or she acquired knowledge of the event"

We submitted six (6) such affidavits for K-1 process. We recieved NOA2 two weeks later.

2nd)  Yes of course you can wait until she gets to Moscow to do medical but it needs to be coordinated to occur before the interview.

HI   Sure you can call NVC to get the "MOS" number.   And I've heard about others that have "scheduled" once they got the number but there is a risk!!

If you don't have your medical stuff--then you have to get that 1st  (Use IOM)..   So all in all you will have to coordinate some stuff. It's possible your 1st date will need to be re-scheduled.  I think they only allow one (1) re-schedule for free.  If you have to re-schedule more than once they may charge you again.

 

When NVC gets the stuff they assign the MOS# within a couple of days--then they ship it in a couple of days. Then it takes DHL about two days to get to MOSCOW. Very soon after that you get the e-mail.  If you haven't done the medical I would get that going now.

If U have received your NOA2 then your papers get sent to National VISA CENTER---- a week after that,or so, your papers get shipped by DHL to Moscow ( you can track your shipment) (look up DHL shipment on this site)--------after Moscow recieves they will send an e-mail to you and your fiance w intructions for scheduling-----THEN you can schedule.

My experience is that if Moscow received your case then they would have sent an e-mail to you and/or your Russian fiancé to schedule interview. To my knowledge you CANNOT schedule an interview unless they have your case.  I think your attorney is wrong.. From what I can tell after punching in hundreds of CSC numbers they are not always completed in order. As of yesterday:

WAC1290100037 - WAC1290100052 (dated: 05-Dec-11) only one had an RFE, the others were all under initial review. The same for WAC1290110091 - WAC1290110099 (also dated 05-Dec-11) and WAC1290112415 - WAC1290112420 (dated 12-Dec-11). However, the batch WAC1290113395 - WAC1290113417 which is a higher number and so theoretically put on the system after all those other batches listed (but still listed as 12-Dec-11), has mostly approvals with only a few still under initial review.

From what I can tell, a pile of 1-129Fs are batched together onto the system and these are processed in order, but different batches on the same day can be processed days apart, presumably because different batches = different people.

Now those people who were having difficulty locating some December dates to keep an eye on can play with those number above. :thumbs:




HI; A question for you. Do you locate the actual information somehow from the USCIS site or do you get all info from the VJ site. VJ site is dependant upon members updating their information. I was tracking approvals from VSC and I concluded that approx. 3 to 4 get done each calendar day. It is difficult to make projections. CSC center seems to be working a little further out. I suspect the typical time to be about 4 to 5 months. Oddly enough some get approved very quickly, others longer. Just have to wait. Mike

You need both IF you have w-2s. You don't, so you don't need them. In your case the w-2 is replaced with a 1099 and/or a schedule C. Not to worry. If you use a tax transcript you do not need anything else.

1099s if you have them or copies of your most recent tax return with all attachments OR most recent year tax transcript. The will go by gross PERSONAL income...line 22 of the 1040.



Hi Yes-- Thank you. I have 1040 Tax Return--problem is I have no W-2 and the instructions say you need BOTH.. I'm a little confused-- I can furnish them w all documents required by IRS to file a tax return. IRS does not require a W-2. Your input is appreciated. Mike

Does she have any document with her ? The officers might gave to her a document with all her questions answered.
In this document, try to find which penalty she is being charged. iT looks like 212 (A)...( smethng like this /numbers like this) . Tell us more about what she is being charged. ok? Maybe I can help letting you know more about this.ok?

Hi--Thank you. On her passsport there were no notations added. On her Tourist Visa it was written "Cancelled". She was given the write-up of all the questions she was asked etc. The only reference as to a number for a violation is on the last page of these papers which is "TO BE COMPLETED BY ALIEN WHEN APPLICATION FOR ADMISSION WITHDRAWN" It goes on to say: "INSTRUCTIONS" "For withdrawal procedures, see inspection field manual chapters 17.2 and 17.5. Aliens who appear inadmissable pursuant to section 235 (b)(2) of the INA who elect ot withdraw application for admisssion may choose at any time to appear before an immigration judge for a hearing in removal procedures. Aliens who appear inadmisssable pursuant to 8 CFR 217.4 are not entitled to a hearing before an immigration judge"

That was it other than the "Notice to Detain, Remove, or Present Alien" that went to the Air Carrier (Delta) simply said "Notice to remove alien....for the following reasons INADMISSSABLE ALIEN"

My. now, finace was refused entry at JFK (New York) because of alleged working under tourist visa. She elected to "withdraw" her tourist visa and wass returned to Russia. Now, we are in process of processing a K-1 Finace visa. Will the "withdrawal" record impact the current application? Any help would be appreciated. Mike & Mila

So we are spending 10 days together in june and will have plenty of proof of trip, however to be sure i was going to starting printing out our skype conversations every sunday for the week. First 4 weeks combined is well over 500 pages---what proof should be suffient--and please dont tell me 20000 printed pages of skype---thanks in advance!

Does this mean that she was turned away at JFK? "canceled at JFK because of questions" What questions?

If she has visited you twice you can use things like her actual boarding pass, receipts, pictures of you two together, affidavits from persons who witnessed you together in the US, documents of any places you went together, etc. Do you live in New York or did you travel together to another location? If yes, then showing you were on the same flight is another way.

Yes, she was questioned at JFK and she elected to withdraw and "cancel" her Visa for entry. There were no illegal violations and she is free to apply for K-1 along with me, the petitioner. We are past that. Now just getting ready for interview or possible RFE. Was hoping to find a way to get info. from the government to verify here dates of entry into USA. Thank you Mike

What visa was she on? if the visa is still valid she should get the old passport with the valid visa in it. Are you sure you don't get it back or are you just guessing?

Either way, a good thing is receipts/bank statements. How did she pay for stuff while in US?


Her former tourist visa was in former passport, the former visa had been canceled at JFK because of questions. I do have other materials to show her presence in USA,
