We met through a band message board and a friend. I talked to his friend Andy on this message board starting in 2001, he came over for a summer in Chicago and we hung out a lot. I started talking to my husband on this message board once Andy went back and I realized British dudes on message boards aren't total creepers. smile.gif Dale came over for the first time in 2005 as a friend, then two more times after as a friend before we realized how well we get along and how strong our feelings were. Engaged in 2006, he moved here in Feb. 2007 and married in March 2007! His parents are here now. They love Chicago and don't totally hate me for stealing their favorite son.

Yes, I think so. You should contact your Embassy, explain the situation and request a new packet if they'll give you one. The information they provide in that envelope is not to be read by you, so I would assume an open envelope would make that information null and void. Get in touch with your Embassy ASAP.

Can he provide anything other than the hourly wage? Maybe state a disclaimer that you are hourly, but since you work full-time your estimated salary for the year is $XXXX? I am an hourly employee, too, but HR was willing to come up with an estimated annual salary for me. He should be able to provide you with something given how important it is.

When your fiance(e) has their interview, you will need the affadavit of support. You must make 125% above the poverty line for your household size. This can be found by going here: http://aspe.hhs.gov/...07poverty.shtml and multiplying by 1.25.

For a household size of two, you need to earn $17,112. You'll need supporting materials that prove you make this amount, but it's mostly important for the adjustment of status once your fiance(e) moves to America and after you're married.

I did about one per quarter of the last two years, which included two Christmases, some birthdays, us at a wedding, and one of us with our dog - 11 in total.

Approved petitions have been lost and caused major grief for people.

It seems like the longest wait ever, but it will be through before you know it. Once you're approved, you still have to go through NVC, gather all materials for the Embassy, wait for the interview, wait for the visa, and then have him come here. All of that takes about as long as the actual approval unless you have a swifty Embassy.

In the meantime, relax. Read some books. No amount of fretting will make it go faster. It's like watching grass grow.

Write the letter if you want, OP, but realize that there are a heck of a lot of people who have waited longer. Exceptions to the rule cannot be counted as the rule.

90 days is not that long, really. I suppose they should be able to turn them around as fast as VSC (two weeks and, bam, you're approved), but considering the sheer number of applications CSC receives, would you expect them to be as quick?

It's a very heart-wrenching process. Being away from the one you love is difficult and you just want it to be over as soon as possible. But, really, this wait is nothing. Once this part is over, you still have to go through many other steps to get your fiance(e) here. You're just going to have to be patient.

In the end, a few months lost to waiting is nothing compared to the life together you will have. And getting senators involved when your wait time is clearly well within the normal limits is a waste of their time and yours.

Sit back. Your day will come soon enough.

Cases sent to NSC automatically get transferred to the California Service Center (CSC). CSC is extremely backlogged currently which is the cause for your delay. Since they have cashed your checks they have your petition and likely have mailed your NOA1. You will probably receive it in the next week and will be able to check your status at that time.

We did this in Canada before I moved down here ... All our event was basically a large barbeque with all of my family and friends (about 100 people) ... It didn't ressemble anything to do with a wedding and it was more a large party ... I just wanted my family and friends to get to know my wife (fiancee then) and we knew we were having a small wedding down here and we didn't want people to have to fly down here for it ...


Very cool...I think that's what we're going to end up doing, too. Food, drinks, family, friends...that's all you really need!

It wouldn't be a wedding nor would we get an English marriage certificate; it would merely be a celebration so that his friends and family who couldn't make it to the actual ceremony in the States could join in and celebrate.

Hello! You seem to have a similar situation to me (US + UK in Chicago...yay!) so I thought I would respond. This may or may not be accurate still, but even though you submitted your application to the Nebraska Service Center, it will likely be forwarded to California (as mine was). This causes a slight delay in receiving your NOA1, but never fear. If your check has been cashed, you will receive it soon. As soon as you get it, register for your online account and set up e-mail notifications so that any time they send you something in the mail you will know ahead of time.

What they all said + it doesn't take that much longer for them to forward it and then send you a NOA1. That waiting time is nothing compared to what you might have to wait to get approval. It took me maybe 5 extra business days to get my NOA1 from California than I may have gotten from Nebraska.

If you got an RFE fpr more pics, that's a bit odd. Did you send them initially? Is how you met straightforward?


Yep, I sent them with the original package. In the UK, their passport photos are a different size than ours, so I don't know if they didn't accept them because of that or if they just plain lost them. I had to get mine retaken and my fiance e-mailed photos that I had made into wallets that I then cropped to the appropriate 2" x 2" size. I hope that's acceptable.

I think we were as detailed as possible when explaining how we met. I explained that I initially met one of his friends (from the UK) and we became good friends while he was on vacation here. Once he went back, he exchanged our information and my fiance and I started talking extensively for about 4 years through e-mails, phone calls, letters, etc. until he came to visit last summer and that we've seen each other 5 (now 6) times since then.

It had more detailed information, but I won't bore you with that. :P


I do have to thank you guys for keeping me positive. It's definitely a difficult thing to go through and when we started this process we were extremely naive as to how long it would take. I didn't realize just how many people do this. It is definitely worth it...I just miss him very much and would like to start '07 with him!

Ours was 20 pages because we FLOODED them with information. When they asked for proof that we've seen each other in the last 2 years, we included things from every single visit (5 of them) in the last 5 years including flight itineraries, ticket stubs (with dates...I was dumb and didn't realize the one I had sent with my application didn't have the year on it), credit card statements, passport stamps, etc. They also asked us to elaborate how we met, wanted a copy of my fiance's birth certificate, 2 more passport photos (?), and statements from us saying we still intend to marry (which we included the receipt for my engagement ring).

Lots and lots and lots of supporting documentation. I'm hoping it was enough.

Thank you. :) I realize now that there are other people who are going through the same thing with CSC and I feel a little dumb asking the same question. We were just very excited to see that it was updated so regularly, but now that they haven't updated in 2 days we're sitting on the edge of our seats.

I called USCIS CSC and it's still being processed. I hope they decide today...it would be the end to such a great week (he was just offered a job here yesterday!)

Now I just hope the Embassy doesn't take forever... :unsure:

Hello!

First, may I say that I'm very sad that my service center (Nebraska) sent our application to California to be processed. It seems like they're the most swamped!

Anyway, we received the NOA1 in late July and a RFE for more information October 16. We sent 20 pages of very detailed information the very next day. (I wish I would have known about this website before we even applied to save this step.)

They received it on October 19th and have updated our status every day up until the 25th. Is this a good sign? Do you think they are close to approving it? When they received our additional information they said

"However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case."

Less than the maxium stated? They never give a maxium! I feel like I'm taking crazy pills.

I'm sorry if there are threads on this already...I checked back a couple pages, but I'm anxious for an opinion.

I've seen two very different answers to this same question: is it okay to visit the US while your visa application is being processed? In some threads it seems like people are encouraging it stating that you are showing that you are in an ongoing relationship and that USCIS isn't trying to keep a couple apart from each other. In this thread, it sounds like people are warning that it may look bad visiting while you are waiting for your visa.

Now, it may make a difference because you're approved and it's now making its way to the Embassy; however, I don't see why it should matter until you have your visa in your hands, in which case you can only enter the country once and then need to get married within 90 days.

Honestly, being a US citizen I don't know what non-citizens have to go through when entering US customs. I do know that many people have come here to visit their fiance(e)s while their applications were being processed and have not had troubles (my fiance just came to visit last month). As long as it's for a short stay, I don't see why it should be a problem.

I'm not a lawyer, I don't know the laws and am continuously dumbfounded by how all of this works, but based on common sense and my own experience, I think you should be okay.

K-1 Fiance(e) Visa Process & ProceduresHas anyone here used a lawyer for k1 visa?
My fiance's future job is very interested in getting their immigration lawyer (they are an international company) involved in the process. Currently we are waiting for approval (which I feel coming very soon *crosses fingers*).

Do you think an immigration lawyer helps in any way between approval and the interview? They're dying to get him to start work on December 1st (they are getting him a 3-month work visa...will this affect our fiance visa at all?) and want to help in whatever way they can.

Do you have your original documents? Make copies of those and send them to your fiance. The actual application you won't be able to copy, of course, but your supporting documentation is most important, I would think.

Make multiple copies of everything from now on, though!

Call NVC and see if they have received your case yet. If it was like mine, they may have received your case on the same day you got your NOA2 and may have forwarded it to the Embassy already.

Like they said, get your documents together for the I-134 (mostly regarding your finances...letter from your employer, letter from your bank, income tax returns etc.) right away because it could take a while to get all of those.

It's best to be safe and include an additional page explaining every single time you've met with evidence (boarding passes WITH DATES, passport stamps, credit card purchases in the country at that time, etc.). Throw as much evidence at them as you can. Though it may seem it's obvious that you've met and you're clear about how you met, we got an RFE requesting more evidence and a better explanation. This slows the process, so provide it to them ahead of time to avoid this.

Thank you,yeah 10 days aint that bad. When the money is cashed we could still get an RFE right,cos I heard when they cash the money all is good but I could be wrong.


Not true at all. They will cash the checks soon after they receive them, but they may not actually look at your case for days, weeks, even months. When they do look through your paperwork they may find something insufficient or missing and will then issue an RFE. Our checks were cashed about a week after sending paperwork and we got an RFE two months after asking for more information.
